IR-1 / CR-1 Spouse Visa Process & ProceduresPetitioner has no W2 as he has not worked since 2006
well, i'm just gonna think like how they would: i would wonder how he got the funds to see you in Oz and how he was able to...put $$$ in for keeping in touch with you and all that...basically how can you guys maintain your relationship on that level if he is not holding down anything...then i guess that's where his dad would step in and say i'm supporting him, etc...

but then, that might mean that his dad would have to show him being claimed on his taxes?

it might be a bit of an issue, maybe might be a good idea to find a co-sponsor who did work and who could provide w-2's for the past 3 years (even though it's optional) just to be on the safe side?

i'm sorry, i'm probably not making it easier for you to understand, i'm basically just throwing out questions and concerns that might pop up in their heads when they take a look at your case. hopefully someone more competent than me will answer. smile.gif

IR-1 / CR-1 Spouse Visa Process & Procedures2year Gc to 10 year GC
QUOTE (ROMANTiC COUPLEz @ Sep 3 2009, 04:31 PM) <{POST_SNAPBACK}>
Hello everybody, i just wanna share my experience with regards to green card,..
i thought this might be helpful to others..

btw, last may 29, 2009, i arrive here in USA, and on July 1st (my birthday) i got my 2years GC,.. i could have been happy, but i noticed that my GC is good for two years, i know and i believe i am illigible for a 10years GC since my hubby and i were two years married upon my POE,.. so what i did was, i applied for my SSN first and wrote a letter to USCIS, i included my 2yrs GC, and all evidence that i am illigible for 10 years GC.. and by God grace finally i received my 10 years GC..

Am so happy, kicking.gif kicking.gif kicking.gif

and if u have the same situation all i can say is make a phone call to USCIS, so they can give u a correct information on what you have to do, and to make sure that what you are doing is right,,

and to those who will be coming, if upon your POE the two of you were two years married, inform the people on your POE that u are two years married and able to received an 10years GC, all you have to do is to present evidence example marriage license..
or make a phone call to USCIS after you received your welcome letter for them to change your GC expiration. I am saying this things because this are the things i forgot to do, i should have received a ten yrs GC if only i informed them earlier..

thankz for those people who helped me here, thank you for giving me the courage, and also for the idea that i can do something to correct my GC..
thanks for posting! this is going to be our situation as our wedding anniversary is november 1, and hubby's interview is october 27th. most likely he will be going through AP so hopefully by the time he gets his GC (fingers crossed), we can try to do this...thanks a million. good.gif

IR-1 / CR-1 Spouse Visa Process & ProceduresUnusual love story, how to present it during interview?
don't worry....

similar story for me. we got married in a municipal building in ankara, turkey. we just had a few friends and my cousins and aunt joined us later for nargile and dinner in the city. my mom and siblings couldn't make it out because of work and what not, but they sent me their blessings. it is what it is. not everyone has $$$ to splurge on big fancy showy weddings and what not. what matters are your intentions and feelings towards one another. and especially in these times, when the economy sucks everywhere, hopefully the consulate will get that.

good luck to you rose.gif

I apologize for not giving all the info.
She lives in UAE but is a british. We have applied for CRI. Usually how long does it take for us to get an interview date?and should i be bugging NVC and calling them?

hi there,

yes call NVC and give them your info and ask them if they have gotten an interview date yet. that will be the easiest way, you will also be getting an email from NVC about this as well if you have given them your email.

good luck!!!

i dunno....when i filed the i-130 i followed its instructions to the tee, and only submitted the translated copy of our marriage certificate (which was notarized, of course), an affidavit from sis in law and i think that was it...and i wrote a letter (cover letter of sorts), and i got approved. guess it varies, i wouldnt send pics and stuff though, i was told by USCIS they dont want pics....

but maybe send it the other stuff, and have you considered calling them directly as well to ask?

if you pay online, you can download a lot of the forms online that you need from http://www.uscis.gov.

i would suggest that you get acquainted with the forms that you guys will need to fill out by checking them out on the same site too. that way, you will be more than prepared when the real stuff comes in.

maybe you can have your spouse fill in the ds-230 now and send it to you and when it is required you can just put in the date and send it in (is that wrong?)

good luck!

thanks that's what i wanted to know - if I actually send the forms. I plan to try to get every thing prepared so when I get the notice I can just send the forms. I hope it's ok that I put in the date... Is the DS230 the only form that he needs to complete or are there others?

yes this is very helpful. thank you so much for this information. Yes we originally filed for K1 but go married before it was finished...

so does that mean you're filing for a k-3 or cr-1 now?

1) Nothing will be sent, you can call NVC and speak to an operator to get your case number

2) Again, nothing will be sent, you can get all the forms by reading the guides

3) The choice of agent is (unless you have a lawyer) chosen by the beneficiary to be the contact person for the case. Generally this is the petitioner

4) You have $400 fee and a $70 fee during NVC

5) I-864, DS230 will need to be sent in after the fees are paid. Again, read the guides

6) You can call again and speak to an operator. After your case is complete, you'll be contacted with the interview date

Good luck

1 & 2) thanks...i thought she meant getting a letter from uscis about her case, but guess she meant the forms.

4) wouldn't this depend on whether she was also doing the i-129f route too? aka more money...

QUOTE (chris@beth @ Sep 11 2009, 06:55 PM) <{POST_SNAPBACK}>
Our I-130 has just been approved so we're ready for the NVC stage now. I just have some questions regarding the NVC process:

1. Will NVC notify the petitioner that they received a package from USCIS? If yes, email or post? And how soon do they send the notice?
2. Will they also send something to the beneficiary?
3. What does "Choice of Agent" means?
4. How much is the payment on NVC?
5. Aside from DS-3032, are there any forms/documents that we need to send? Will it be sent to beneficiary's consulate once the case is complete?
6. Will they again send notice if the case was already forwarded to US consulate of the beneficiary?

I really hope someone can answer these questions because I'm confuse now. My husband is so busy with work and online studies so he doesn't have time to research and call NVC just to be put on hold for so long that's why I want to help him on this process. Thanks a lot in advance. God bless.

Beth

1) yeah i guess, but you should probably call them and ask as well, i suggest you give them your email as it'd be quicker to receive updates and what not, their number is (603) 334-0700. how soon depends on anything, just call and ask...have your EAC number ready, as well as your and your beneficiary's info.

2) well, you'd need to give NVC the beneficiary's contact info. again i'd give them your emails.

3) choice of agent basically means who your beneficiary designates to receive paperwork and notices. i'd go with yourself. most people do that. your beneficiary can email NVC and provide the following information and inform them that they are designating you or whomever as the choice of agent:

<h2 xmlns:o="urn:www.microsoft.com/office" xmlns:st1="urn:www.microsoft.com/smarttags" xmlns:w="urn:www.microsoft.com/word" xmlns:x="urn:www.microsoft.com/excel" style="border-bottom: 1px solid rgb(204, 204, 204); font-size: 14px;">By E-mail</h2> The NVC’s e-mail address is NVCINQUIRY@state.gov.

In order to ensure a prompt response:

  • The Subject Line of the e-mail should be the relevant NVC Case Number.
  • Provide the applicant’s name and date of birth and the petitioner’s name and date of birth.
  • If you are an attorney, include the name of the law office requesting the information.
  • If the petition is employment-based, include the company/organizational name.
  • Reference only one case per e-mail.
4) well, it depends on the type of visa you're applying for? your info says N/A which isnt clear...is it a K3 or a CR-1/IR-1?

5) you need to send the following in:
for IV: http://travel.state..../info_3195.html

for the I-864: http://travel.state..../info_3730.html

general information can be found here: http://travel.state..../info_1335.html
i'd also check the above poster's link because those shortcuts are awesome.

i had some threads here myself about stuff that i was sending in. please see: http://www.visajourn...h...=208150&hl=

http://www.visajourn...h...=212504&hl=

http://www.visajourn...h...=210013&hl=

6) yeah, you'll get a letter from NVC via email or post (if you don't provide your email) about them completing your case and sending it off.

but first and foremost you need to get your NVC number and your IIN number (Invoice Identification Number). This will be provided via email, you will then log in here and pay what you need to pay:

https://ceac.state.g...ice/signon.aspx

DO NOT send anything in until you've paid what you need to pay, because when you pay, the system will generate a cover page with a barcode that you need to print out and send with your packets. but for now, you can start working on assembling your packets.

good luck!!!

FYI - she is not illegal. She is out of status. She entered the US legally and has overstayed. She is elligible to adjust status if married to a USC and the overstay will generally be forgiven.

To the OP - I'd send in your expired visa to indicate that you are not illegal and that your entry was properly documented. The USC must petition for you - I hope this is the case for you.

Good luck.

just for me to know...but when does a person become illegal and not "out of status"? is there a time frame? she stated it's been 4 years since she entered....so i would assume that means that she's illegally here at this point.

IR-1 / CR-1 Spouse Visa Process & ProceduresMilitary records
i think you will need it whether at NVC or the interview stage. when i got my letter from NVC after my case was completed, there was a list of stuff that supposedly was required at the interview if it was not given to NVC earlier. one of those things was a military record (thank God i got that earlier).

you will most likely need to explain why your hubby/fiancee didn't go to the military and show some kind of documentation in regards to what he did to delay it.
