IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsJuly 2013 filer update
I received an approval from USCIS on April 7th via email. I still have not received my NOA 2 in the mail. I called the NVC and they said it takes four to five weeks for them to receive anything. Do I update my timeline now or wait until I get the notification in the mail. If I am suppose to update the spreadsheet also how do I do that? I know it's crazy but I can't even find it! Where the heck is it?

IR-1 / CR-1 Spouse Visa Process & ProceduresI got excited for no reason!

Hi - I am fairly new here and from what I have learned since I signed up is I will have plenty of time to make some good friends here!

So, I got all excited because I received an email from USCIS that I thought was my NOA 1. Now I realize it is just a notice that:

"Your case has been accepted and routed to the USCIS National Benefits Center for processing"

I suppose that I received this only because I filed two G-325A forms. One for my spouse and one for her son (my stepson now). And just now I realized that is why I got two emails from them with different receipt numbers! Duh! Anyway I thought I was going to be able to update my timeline but I guess that isn't an event the gets entered into the timeline. Right?

So, what to do next? - Correct me if I am wrong. I wait for the first actual snail mail letter and that will most likely be my NOA 1 (I do put that into the timeline). After that I prepare myself for a very long, agonizing, miserable wait. If I have no RFE's after months and months and months of waiting ........other stuff will start happening but there is nothing to do in the meantime except try to become familiar with this site and the governmental requirements? As I understand it, what I can do that will help me the most is learn to be patient (not my strong suit). Another helpful thing would be to not make mistakes. Would you say that is correct?

A couple of questions:

?Is there a section or thread talking about minor children of a beneficiary of an I-130?

Receive IV Bill - What is this? I haven't been able to figure this out. What is an IV Bill?

This website has already helped me more than anything else I have done to try and be prepared for this process! Thanks.

IR-1 / CR-1 Spouse Visa Process & ProceduresI have my I-797. I have some "Now What" Questions

Wow thanks. Great answers!

Something I don't understand. I keep hearing five months or six months until I even hear from NVC. But then I look at timeslines and quite of they tell a different story. For example Ryan who answered my question has at the bottom of his post his timeline. Three months between his NOA 1 and NOA 2. What is a NOA 2. Is it something that I do not have to respond to in anyway? Anyway from his NOA 2 (what is that?) to the NVC case number being assigned is less than a month. Is that something that doesn't need to be responded to in anyway? I guess I am easily confused. My question is not when but what is the next step where I will have to do something?

IR-1 / CR-1 Spouse Visa Process & ProceduresI have my I-797. I have some "Now What" Questions

Is this where I should be posting this?

Hello. I have received my I-797C Notice of Action in the mail. Now I am preparing for the next steps. I have read James?s Shortcuts and LingChe NVC Shortcut on the VjWiki. I have some questions. I am in California and my spouse and her three year old son are in Havana, Cuba. I have filed two I-130 petitions, one for each of them. Throughout this whole process I will have to do everything twice right? Once for her and once for him.

1. Can I file the DS-2032 via email now using only the receipt number from the USCIS or do I have to wait until the NVC asks for it?

2. Do I get a separate case number at some point from the NVC and if so when?

3. In Cuba sometimes the translations from the approved government office can take months. Is it too early to get the police records now? I shouldn?t need police records for the three year old boy right?

4. I was under the impression that no originals of any documents would be required until the interview so all of the originals are in Cuba with my spouse. Now I think I might be wrong about that? Do I need to get the originals and the translations here in California so they will be available if I am asked to send them in? Will I be asked to send them in?

5. I need to go to Cuba to visit. Am I correct in assuming that with a June 26, 2013 priority date it will be several months before I receive anything from the NVC? I don?t want to risk delaying the Visa process because I wasn?t here to take care of something in a timely fashion.

6. When I checked on the USCIS website for an estimate of processing time they said 6.3 months at the Vermont Service Center. There was no option of selecting any other office but I thought I would be processed in California. What happened? Why is it the Vermont Service Center?

I have six million more questions but this is enough for now. This website has so much information I am sure there are answers for all of my questions somewhere close by. I have been doing a lot of reading and if there is some reading you think I should do please give me a link or directions how to get there! Thanks thanks thanks! Thanks.

IR-1 / CR-1 Spouse Visa Process & ProceduresJuly 2013 IR-1 / CR-1 Filer Questions

01/29/2013 1:39 p.m.

Hello All,

Even though I find Visa Journey incredibly helpful and I have spent quite a bit of time trying to familiarizing myself with the site I find I have a very difficult time navigating the site. Because of this I am going to ask several questions.

1. I would like to be added to the July filers spreadsheet but have no idea how to do that. My NOA 1 is July 3, 2013. I was informed via e-mail on December 27, 2013 that my petition was transferred to the Texas Service Center (TSC). I also received a Form I-797C in the mail on December 30, 2013 also saying my petitions (one for my spouse and one for my stepson) had been transferred to the TSC. I can't even figure out how to post a question in that forum or any other forum for that matter. What is the procedure for doing that?

2. Looking around the website I know I found a guide that was titled something like "Easy Spouse Guide". I found it more than once but now after multiple searches cannot find it. It is so frustrating. How can I find that again or am I dreaming?

3. I have a timeline but I notice that many people have a detailed timeline at the end of their posts that has more information than the timeline. How do they do that?

4. I hope I am getting close to receiving my NOA 2. Because I am newly retired I have no employer to put on my Affidavit of Support. Is there a guide on the most effective way to proceed on an Affidavit of Support as a retired person?

5. By the time my petition gets to the NVC my wife's police record document from Cuba (no issues!) may be easily be eight months old. Will she have to get another one because it is that old?

6. There is a mention on that I-797 of a Premium Processing Application. What is that?

I will have many more questions when the time comes to deal with the National Visa Center (NVC). I wish I wasn't so confused about navigating this website but I just am. I have to apologize.

I really appreciate any help.

Joe

IR-1 / CR-1 Spouse Visa Process & ProceduresRFE advice needed - Cuba

Thank you all for the suggestions. I did have to get a special marriage certificate and also take it to the US Interest Section to have it legalized. Many many people have told me that they don't do that for birth certificates but the language in the RFE seems to contradict that. It is very specific language. My relatives in Havana are going to ask again. When we got the birth certificates we did ask and were told that other types of birth certificates were not available.

As a side note all of my Spanish translations were rejected because they were not certified in the United States. We used the official translation office in Havana that I was referred to by the employees in the US Interest Section. I guess they were wrong. ESTI is the office I used. This is the link: http://www.ecn.org/a...ba/esti_ing.htm

So, please don't use them.

IR-1 / CR-1 Spouse Visa Process & ProceduresRFE advice needed - Cuba

I received RFE's for my spouse and my stepson. I have spoken with USCIS and know eveything to do ..... almost. I made mistakes on the I-130's. I was told to write a letter stating the were my mistakes. Okay.

All of my Spanish translations were rejected because they were not certified. I was told that to be certified someone fluent in English and Spanish had to "certify" that the translations were accurate and that document would require their signature. Okay.

Here is what I didn't get a satisfactory answer to. One of the paragraphs of the RFE states:

Additionally, the birth certificates submitted for the beneficiary and his mother does not indicate whether the documents are valid (to be used) In Cuba, Abroad or both. Please submit a birth certificate for the beneficiary and his mother that is valid for use in the United States.

I have no idea what to do about this and I received no other advice for a level 2 USCIS support person other than get a certified translation. Has anyone had any experience with something like this?

IR-1 / CR-1 Spouse Visa Process & ProceduresI-130 Procedural Question

Thank you for the information. Will NVC only ask for one fee or do I just pay one fee but send two I-864's?

snowjoeMaleCuba2014-03-18 08:10:00
IR-1 / CR-1 Spouse Visa Process & ProceduresI-130 Procedural Question

I filed and paid the fee for two I-130's. One for my wife and one for my step-son. Recently I was told by a professional immigration facilitator that I just need to file one I-103 and put the child on that application. A phone call to the USCIS yielded a different answer. They said that I did need to file two I-130's. Who is correct?

I ask because I am preparing to file my Affidavit of Support. The is language on the form that says "I am sponsoring the following family members immigrating at the same time or within six months of the principal immigrant named in Part 2 Do not include any relative listed on a separate visa petition.

My question:

Do I file and pay for two separate I-864 Affidavit of Support forms?

IR-1 / CR-1 Spouse Visa Process & Proceduresbirth certificate translation question

Well this is interesting pushbrk! I submitted birth certificates for my wife and my stepson for several reasons. First reason is that I had them and the translations. Second reason was that I felt that proving parental relationship and custody would be helpful. I guess the third reason would be that I felt more would always be better than less.  If I read your post correctly I did not need to provide birth certificates, possibly should not have provided them, and therefore I created my own problems. Now I feel worse than I did before. Yikes! Wow.

IR-1 / CR-1 Spouse Visa Process & Proceduresbirth certificate translation question

I recently had a RFE because my translations were not certified properly. It delayed my visa application at least 60 days and counting. From the USCIS website:

http://www.uscis.gov...cations-mailing

  • Please submit certified translations for all foreign language documents. The translator must certify that s/he is competent to translate and that the translation is accurate.

The certification format should include the certifier's name, signature, address, and date of certification. A suggested format is:

    Certification by Translator

[typed name], certify that I am fluent (conversant) in the English and ________ languages, and that the above/attached document is an accurate translation of the document attached entitled ______________________________.

    Signature_________________________________
    Date                                             Typed Name
                                                         Address

Halfway down the page. I wish I had know this before. :(

IR-1 / CR-1 Spouse Visa Process & ProceduresI-864 EZ OR i-864

I am back. To answer the question B & G asked, yes I have IRS Tax Transcripts from 2010,2011,2012, and 2013. This is starting to make a little sense I think. I used to have lot's of W2 income but now that I am retired I have none so based on that alone I cannot use 1040 EZ. Correct? Even though the year end tax forms from Social Security and my Pension plan "feel" like W2's they aren't. I therefore have to use I-864 which has 13 pages of instructions on how to fill it out. Unbelievable.

snowjoeMaleCuba2014-05-26 10:56:00
IR-1 / CR-1 Spouse Visa Process & ProceduresI-864 EZ OR i-864

I am so gun shy about this. On both the I-864 EZ and the I-864 they have a box to check that says a IRS Form 1040 EZ will be provided by me. I don't file using form 1040 EZ. My accountant uses form 1040, not 1040 EZ. Also I only need them to consider my retirement benefit but of course there are lots of other itemized items and other income that I have. I have my last three years transcripts and all of the years have sufficient income to meet the requirements Also going forward I have letters from Social Security and my pension plan which show plenty of income to meet the 125% of poverty line requirement. So which for do I use?

Oh one last thing. I have filed two I-130's. One for my spouse and one for my step son but I can see how this would make any difference. I just dorn want to file one form and be told iI need to file the other form.

Tell me what to do please!

Joe

IR-1 / CR-1 Spouse Visa Process & ProceduresAffidavit Of Support I-864EZ ?

Affidavit Of Support I-864EZ ? - I have a question about this. I am retired and easily meet the 125% poverty level requirement for support. I intend to use only my social security and my pension to support this. The I-864 EZ requirements say that I need W2's but the year end statements I get are 1099-R for the pension and SSA-1099-SM for social security. It seems like those should suffice but I don't want to make any mistakes at this point.

I also have printed the Social Security Letter that is available online and shows my income from them as backup. I also have an income verification letter from my pension plan. I think sending those is a good idea. I also ordered my tax transcripts but it doesn't seem like I should send those but I have no idea how picky they are. What should I do?
