I've been through LAX twice, once on the ESTA visa waiver and once with my K-1. There is usually a bit of a wait to get through customs (they're a really busy airport) but apart from that i've never had any problems, all of the staff that i've ever dealt with have been really friendly and easy to deal with.

No, you don't need any proof that your returning to your home country because it's generally expected that you will be staying in the USA. Even though it's a 'non immigrant' visa, the purpose of it is so that you can marry and then file adjustment of status and stay in the USA.

How long are you there for? just a few hours? I had a three hour layover in New Zealand and didn't need a visa or anything because i went straight to the transit lounge, i didn't leave the airport. i think if you were staying for a few days it would be a bit different.

It's really funny to see how some people use the internet to feel important. For your imformation my fiance was denied based on he wasnt able to prove a bonafide relationship. As far as his charge it was dropped due to no evidence and was wrongfully arrested. He was released from prison and case dropped. That is why I went ahead with the interview. Since you guys are such immigration attorneys then you shouldnt be on visajourney.com. I dont care how many stars are on your names. OK? this is why I would rather take advice from people who ARE familiar with the Jamaican embassy and how it works.


If you only wanted hear from people who are familiar with the US embassy in Jamaica then you probably should have posted this in your country specific forum instead. You asked for help and advice and these people told you what they know.

Once you have the visa it will be valid for entry into the US for six months. And then once you arrive in to the US the visa is cancelled and replaced with an I-94 giving you 90 days to get married which will fulfill the conditions of your visa

I'm not sure whether or not they will discriminate against age when it comes to co sponsors for the I-134 and I-864. you can't get ahead by sending them all at once. the I-134's need to be submitted to the US embassy before/at visa interview and the I-864's will need to be submitted when the beneficiary does AOS. Don't forget that even though you don't earn enough you still need to fill out the I-134 and I-864 when it comes time because you are the petitioner.

we didn't hear anything from NVC but we did get the NOA2 from USCIS which said that it was being forwarded to NVC in the mail and email/text message. some people don't get the email and text message though so. We had to call NVC to get our case number and find out when they forwarded it onto the Australian embassy. Took nearly a month to get our case number by calling them.

My husband and i got our hard copy a couple weeks after our NOA2. I have heard a lot of stories though of people who have waited a month or so to receive there's. I wouldn't worry too much right now and just do what the lady on the phone said, call back if you don't have it in thirty days. It's a busy time of year for post so that could be a reason you haven't gotten it yet.

How fast the service centers work changes all of the time. My husband and i sent in the I-129F last March and back then VSC was slow as all hell and CSC was processing things a lot quicker. So even if CSC is slow right now, it could speed up at anytime :)

i'm currently in canada and he's in arizona.
also, another thing that makes me nervous is the income thing.
he's in school full time (graduating in the summer for microbiology) but he has never worked.
looking online it says he has to make $30,000 a year, but again, he doesn't work.
his father passed away years ago and left him a little over $10,000 (which he still has), his mother pays a lot of his bills, and he has a trust fund for over $100,000 he has access to.
could him not having a job pose a problem? D;

I don't have an answer for your financial question sorry. the poverty line for two people is actually just under $20,000. With the amount of money he has saved that could very well be enough to satisfy immigration but i would try and find a co sponsor to be on the safe side. You will have to check form instructions but people can qualify as over the poverty line if they have enough in savings.

Yes, they should send you a letter 'NOA1' to state that they have received the petition and that will also have a number on it so that you can track your case on line. It could take less than five months but it could also take longer than five months to get your NOA2 it depends a lot on which service centre the petition goes too. When we filed ours it went to CSC and they were working really quick at the time and we got approval in three months. However, i think they are taking quite a lot longer at the moment.
you're 19 and he's 21 yeah? that shouldn't be a problem at all, there are people with much larger age gaps than that. btw, which country are you from?

So you are saying that the approval goes to Bogota the US embassy where my fiance goes for the interview and at the same time to NVC? So in theory i can just call Bogota for the case number and schedule the appointment and do not need an action from the NVC?


The petition will go through NVC before it goes to the US embassy. From what i remember it seems to take about a month, give or take, to get through NVC.

The number above the beneficiary's name is their Alien number, you will be asked for this number when completing forms in the future. Also,The approved petition will go to the embassy in your country that processes K-1's. On the way to the Embassy it will go through NVC.

haha, yeah don't worry! I sent my DS 230 ahead of my packet three and when i got my packet four it said that i needed to bring it to my interview with me because they hadn't received it yet. I took another copy to my interview but by the time i had it they had already found it. If you have any other Aussie specific questions i suggest posting them int he Aussie forum, there are a lot of really helpful people there who know a lot about immigration process in Australia/for Australians :)

I wouldn't worry so much about it if it said it's been delivered, both levels belong to the US Consulate in Sydney. You'll notice when you go for your interview that first you will go to level 10 for security check before they send you up to 59 for your interview. They are also probably a bit slower at checking through mail at this time of year too as it's just been Christmas and New Year, i'm sure a lot of people have had time off.
Also, is it only the DS 230 that was sent? I sent my DS 230 ahead of my packet three and they didn't manage to match them up before my interview so i just took another copy to my interview with me, no biggie.

It is my understanding, perhaps I am wrong, that it depends on the drug use. If it was long ago history, under age, proof of treatment, etc. Those things make a huge difference. It used to be automatic fail but I thought I had read if it was over 3 years ago you should be ok or if it was an underage use-as long as no conviction of something, you should be ok. You will be asked about it but you would not necessarily fail.


Sometimes people who admit to past drug use will be drug tested and then made to come back in six months or more for another drug test before the medical is approved

Psychiatric issues (cutting etc) can also be cause for extra scrutiny.


Yes, i got scrutinized for this at my medical but luckily i passed without a problem as i bought with me a letter from my doctor explaining the situation etc and made sure i told the absolute truth to every question i was asked and it was fine. Some countries and doctors could be a lot stricter though. Some people have had to psych evaluations before their medical could be passed.

Double check with your consulate (just email them) but you should be fine if you have a co sponsor that earns enough. My husband had only just started working when i had my interview and hadn't really worked before so had never filed taxes. We emailed the consulate in Sydney and asked what we could do about the situation. In the end they told my husband to write a letter explaining why he didn't fill out the I-134 and why he has never filed taxes, also took some of his pay stubs and work schedules. We had a co sponsor also which is his mother and she filled out an I-134 and and got a letter from her work, some pay stubs and most recent tax return. We also printed out the email correspondence we had with the embassy incase they questioned it at the interview.

So, email the consulate and ask them about it. Every consulate differs a bit with what they want for proof of income etc so check with them.

My husband and i live at home with his parents and he has been living here all through the K-1 process also. We live here because we can't afford to move out yet, especially with me not working. We will continue living here for most of the year too so that we can save money before moving interstate. I really don't think that it affected our application in any way. If he had earned enough to sponsor me then he would have sponsored me on his own and that would have been fine. As it is though, he doesn't earn enough so we used his Mum for the co sponsor for the K-1 and again for AOS.

Good toi know....when I looked it said the California office was at 5 months processing time so I was a bit concerned.


If there is something missing from the package then they will send you an RFE so you can send them what they are missing.

No I didn't...My fiance doesn't have checks and is insisting that money order from Walmart would do. I am not sure how it works and why would we need to track the money order as long as we know that the petition is received and signed for?


My husband i alwasy use money orders, for K-1 and again for AOS and we've never had a problem. We just make sure that we get tracking on the package when we send it so that we know when they receive it :)

yes, both need to be signed when they are sent in with the I-129F. There is a form that is to be signed at the interview but it is not that one. I think the one to be signed at interview is DS156 or Ds 156k one of the two. I'm not sure about the roman numeral question though. For country, sometimes my husband and i wrote USA, sometimes United States or United states of america. depends which form and how much room there was to write it. For us, all of those three have been accepted.

At the initial filing stage they are more concerned about proof of having met in person in the last two years. The relationship evidence will come in later at interview stage. So basically, you need to send things that show you in the same place. What you already have sounds pretty good. When we filed we sent about five or six photos of us together (names, date, location written on the back), proof of our joint bank account (because we both had to be there to open it), hotel receipts, ticket stubs and passport stamps also a bank statment from my Oz account showing that i had used my card in his town.

You can look at my timeline in my signature. My EAD took about 54 days i think but i'm still waiting for it in the mail. I have an interview time too for my Green card interview, it's just under three months from when we applied. There are peopl who applied before me though who have been waiting longer so, yeah, it varies quite a bit sometimes.

It's always good to make a copy of everything that you send to USCIS and the consulate etc. In case something goes wrong or they lose something and just for your own personal records.
My husband sent me a renewed letter of intent to take to my interview too. It wasn't required by the consulate but we figure better to be safe than sorry :)
