Of course he doesn't have it. The problem is. His divorce was in New York. He is now living in Florida. Can he get it without traveling there? Just call the court or send them a letter?

my fiance and me we want to file the petition real soon. I have a question about the divorce decree. He has been married twice. The first one is long time ago. Do we still need two divorce decrees? Or is it enough to just give the last one? Because he couldn't marry his Ex wife if he hadn't been divorced right?

Germany is a Visa Waiver country for USA. You do not need a Visa to visit him. So as long as you meet the requirements for travel you can come visit for up to 90 days with no visa.


I know that I dont need a visa for visiting him usually. But I read a lot of people that had been in trouble at the airport when they wanted to visit their fiance during the k1 process.

hi,we filed in may i visited in september. we just go a RFE at the time. i flew to chicago. no issues at all. it went as usual. the only question that came up was: do u have a returnticket. i was never asked that before - but of course i did so no problems. he didnt even wanna see it. i brought some ties (letter from my employer stating when i need to be back at work letter from my parents). if i were u i´d go ! i think since beeing from a VWP country there shouldnt be an issue. just be honest at all time since i dont know if they know about the pending petition/visa or not. just dont offer information but be honest if asked

Sounds good. So far we haven't filed but it's good to know that a lot of people didn't get in trouble when they visited their fiance. So you told the officer that you are visiting your fiance, showed your NOA and than he asked for the ticket? That was very easy I would say.

My fiance had a lot of trouble the last days with the IRS. He had a court appointment and they convicted him to pay his tax returns back. Its a lot of money that he should pay the next 3 years. Now we are so afraid that they will deny our petition for K1 because of the money problems he has...
What chances do we have right now? Trying to find a Co Sponsor? Wait the next 3 years is no option for the both of us.... For explanation we haven't filled the petition so far but we want to file it soon.

hm. i have that site with the Info for the Frankfurt embassey but where do you see that its required to bring part I and II to the Interview? I just dont see it but maybe im too blind lol. Hi Guys,

my Fiance in the States just received NOA2 a couple days ago and I am getting ready to gather documents and Info for the embassy in Frankfurt. I came across something confusing, it states to complete form DS-230 and somwhere else it says DS-230 part 1. If I look at the DS230, the part 1 is the Biographic Data and Part 2 is "Sworn Statement". What do i sent to them? Will I only need to fill out and sent Part 1 which are the first 2 Pages?

Also on DS-156, question 26 "how long do you intend to stay in the US", question 32 "do you intend to work in the US (list full adress of employer ect)" what do i check there? of course I intend to stay forever and also intend to work after we are married and I do the AOS... and as they ask for duplicate version of this form, do i glue my Picture in the Original and copy the whole thing or do i make 2 complete forms?

The Information about what to send and what to bring with me to the Interview vary a lot, do I just sent EVERYTHING? or do i really just sent the required forms and take the rest with me to the Interview (birth certificate, Police record, proof of relationship)?

Getting a little overwhelming here right now because i want to do everything super correct :(

I disagree - there is a vision test in Germany. OP, I have just been to the medical in Frankfurt this week, and I was in a similar situation as you. I have very weak vision and wear strong glasses. I had however decided to get new glasses a couple of months ago already, so I had those with me at the medical. The physician asked me to stand a couple of meters from a chart with numbers on it and asked me to read off the numbers in the last line (smallest numbers). I did so with glasses on (that was fine), and was then asked to take off my glasses and re-do the whole procedure. I told him my vision is bad, and he asked me which line I am still able to read. I told him that I can barely read the first line. While he was writing down the results, I asked him if I can fail the medical exam for weak vision, and he told me no, and that it is just important to balance the weakness out with glasses or lenses.


Thank you very much. So i think I'll be fine. And yeah without glasses? I wont be able to read anything haha. So its ok if you just say "oh i cant read that last Line, i have to get new glasses"

Hi,

I have a question about the Medical Examination in Frankfurt for the K1 visa. During the Medical, I have to do a vision test and thats what my question is all about!

I wear Glasses but am in the need for new ones soon because my Vision has slightly decreased over the last 2 Years, now my concern is, is the vision test a "pass or fail" or is it just to determine your vision strenght?
I obviously cant get new Glasses within the next 14 Days, so does anyone know if its okay to just say that I will get new ones once im in the States or so? or am im overthinking it and ill just be fine if i cant read all the Letters or whatever it is on the visiontest?

I really need help on this worry.
I am the named "Alien" in this situation. My fiance and I are now applying for a K1 Visa, my Fathers name is missing on my Birth Certificate and I know nothing about him, my Mothers name and place of residence at that time is listed on the Certificate but that is all I know about her.
I was fostered at a very early age (my legal Guardians being Banardos Foster Care) but both my Foster Parents are now deceased. I am worried about putting anything misleading or confusing (unintentionaly) on any forms concerning my Parents in any way.

I photocopied postcards and letters and also envelopes that had both our adresses as sender/recipient on them and where the stamped postage was visible. On the photocopies I highlighted the date that was stamped on the envelopes to show the timeframe and since I was approved in August I guess that worked for them.

When filling out the 129F petition he will have to answer a few questions in regards to his criminal record. I know you know he's in prison now, but are you aware of his whole criminal record? That's what they're going to want to know about him, his criminal record, and if you know about it. It would appear that if he has a criminal conviction of a sexual nature,then he will have a long road ahead of him, and his petition could be in limbo or denied. Otherwise, it may not impact at all.
You might want to look at his parole conditions if they're available, or speak to his parole officer. I don't know about the US, but in Canada, depending on the offence, an offender can be restricted in who he can associate with, and even if he can marry, where he can live, etc.

If he doesn't have any income and hasn't for 3 years, he's going to have to have a co-sponsor. His family appears willing to help him out as far as giving him a job, so they may be willing to co-sponsor.

Yes, I am aware of his whole criminal record. The state he was incarcarated in has open records. We started out as pen-pals and before love became a topic between us, he told me everything. I checked it online and it is all true. Plus I have met his whole family on all of the visits and every little thing he has told me about himself was proven to be true by them as well.

Checking with his parole officer on restrictions is a good advice, though I will not be able to do so myself. He will be assigned one closer to his release date and will then file for interstate compact to move to another state (where his mom lives). But I think he can check with his social worker in prison, I'm sure she will be able to find out for him as well. So thanks for that!

Yes, his mom is willing and it seems there is no way around it....

I have a couple of questions and I have not been able to find any answers by searching this forum, maybe there is someone out there who can help me.

Here's the backround:

I am a German citizen living in Germany. My boyfriend (US citizen) is currently in prison. He might be released early this year (sentence reduction hearing is in September) or definitely March 30th 2009. He will have served a 3-year sentence with another 3 years parole to go.
We met as pen-pals, I have visited him three times within the last 6 months, the next visit will take place once he is released. We have tons of letters, phone bills, pictures, emails to and from his family, airplane tickets etc. to prove that we have a real relationship. We plan on filing for the K1-visa as soon as he gets out and will have a permanent address (with his family). He will be a student, but will be working also (his mom helped in setting this all up).

So here are the questions:

1)
Is his criminal record a problem when filing for the K1? Myself, I don't have a criminal record at all, I am just worried that the visa will be denied because he is considered a criminal.

2)
As he has not had any income within the last 3 years (before filing for K1), and we are not sure if we want to ask his family to act as sponsors: is it necessarily the US citizen that has to prove he will be able to support me financially until I am allowed to start working myself? Or can I prove that I own enough myself to cover for myself until I earn money in the US?

I am grateful for ANY advice/help I can get!!

It's actually quite simple.

- When the times comes, he can use his current residence and he can add the PO box for mailing purposes or use the current address (whichever is more reliable).

- On the question about where the fiance intends to live, he can use his current residence, and later on when he moves, he can update the address again.

- in RE to the household, while I'm pretty sure of the answer, I rather someone else with more tax knowledge replies this for you

No, not yet. We filled out the application, but when we were about to send it, a few things changed, like him quitting his old job and getting a new one, staying in PA instead of TX etc. and we don't know if it is better to wait and fix things first, like getting a place first for an address or if we can apply now, since some of the information we had given are not the same anymore. Obviously he would add the new job, but I wasn't sure about this whole address issue. I just don't want to create any confusion or complications to the people working on our file and want to clear things up before I actually send it.

Hello there,

my fiancé and I have been wanting to file our application for the I-129F for quite a while now, but due to his old job as a Trucker, we managed it greatly to procrastinate. Anyhow, the first time we filled out all the documents, we listed his fathers' land in Texas as address, since he didn't have his own place, driving around the US the whole time. We also added a Cover Letter, stating that all his mail gets send to his P.O. Box in Pennsylvania. He had this one already, because his mother lives there and she usually gets all his mail. The reason we did that was, because we were worried of sending our application in and not having an actual address at this time where we are going to live.
Things changed now though. He quit his job as truck driver and got a local job in Pennsylvania. He stays at a friends house right now, till he can get his own place. He said, he applies for me around Christmas, if everything goes smoothly with buying a car and renting our own place. I am a patient person, but if I could cut out a month or two, wouldn't say no to that. So my question basically is, can we put in the normal address spaces his P.O. Box for him and on question 14., where they ask "Where your fiancé/e intends to live", can we write "to be determined" for now? Are we supposed to state that later on somewhere when he has the new, physical address of our place somewhere, will they ask for it or does it even matter? I mean, he will have a place for sure till the application is processed and send to germany, but do we really need to stay on the safe side and wait another two months or can we just apply now and get around all this terrible waiting time? Waiting is long enough anyhow hehe.




Also another subject that has been picking on me for some time. He has three children with two different mothers (oldest just turned 16 a few weeks ago). I asked quite some people if they count as his "dependants". On another website they told me "Yes, they count to his household size", hence the I-134 and later on the I-864 ask for it, because I was not sure at that time if he would meet the required income for 5 people, if they count at all. I asked an immigration attorney from Tennessee about it as well and he said as long as they don't live with him, which they don't, and they are not listed as dependants on his tax returns, which they aren't either, then they do not count to the household size. He does that professional and it should be right, but I am still worried to trust that. He makes enough money now, no matter what, but it would be still nice to know if he needs to list them or not? Does anybody know anything about that issue?

EDIT: Oh, and if that works with the address, do I still need to send the application to Texas or somewhere else close to Pennsylvania?

There is lots of "gray area" with this. I truly don't think its so cut and dried that he has to include them, this may be a lawyer question.


Mhh interesting questions. I know that he told me about such "gray areas", but you are right, without lawyer it might be difficult to figure such things out, since it is so complicated. I know that his oldest, the daughter (15-16) carries his last name. I don't know if his sons have his name though. I will ask about those things tomorrow when we are on the phone again. All those things are stressing him right now, lots of work etc. but I can't figure it out. I don't even know if he still has parental rights. I read about it and you can lose it, if you are always away and don't really have a relationship to your children. Well, that applies to his situation perfectly. I don't know much about his children, since they are no part in his life, unfortunately, but I'll see what I can find out. Someone knows a good lawyer to ask for this situation?

If he is self-employed, his current income will be found on line 22 of his 2011 tax return. If employed, he would do a calculation of his year to date income at some point in 2011, divide by the number of pay periods up to that point in the year and then multiply by the total number of pay periods.

Is he employed or self employed. That's the first question you need to have the answer to.


He is employed with a company from Texas. His salary is per miles though and therefore never the same. He gets payed after every "Job", so some take just a few days, some maybe a whole week. That's why it is quite difficult to figure out if his yearly income would be enough by now, calculating since the changes in Octobre. The rest of 2011 wasn't really good for him, but just because he wasn't really working that much.

Thank you for both answers. Well, he is a truck driver, so his salary is not always the same amount and it makes calculating a bit difficult. He should be over it anyhow, with or without the children counting, but we need to be certain now. But since we have still have at least 6 months till my interview, it should be enough time to make sure it is enough. It is possible to work more in this time and use it as proof for the income, am I right with that? Because he has been a lazy #### last year and he became a senior driver, which allows him to take students with him and make more money, at the end of last year. So, there have been significant changes to his income. Guess I need to kick him and make him calculate everything. He knows best about his payment D: But at least I know what is going on now and that helps a lot already. Time for preparing :) Thanks!

Hello, I am new to this place and it is the first time I found a similar question to mine. I have been searching for an answer for such a long time, because the two Affidavit of Support made me confused and worry a lot.

My US fiancé has 3 children from two previous relationships too, but was never married with them though. He is a truck driver and never sees his children and it is not wanted by the mothers anyways. He has no custody of any of his 3 children and doesn't claim any of them in his tax returns. So, do they still count as his dependents and do we need to include them when counting our household size? And do we also need to list them in both Affidavit of Support (I-134 and I-864), or not at all? I am so confused by it for quite some time now. Are we a 2 people household or 5?! Most of the foreign Consulates/Embassy request all the documents not in english to be translated by a certified translator. You may want to do that, it is better safe than sorry.
