Let's remember that for some people it is a big rush for very very good reasons. It's not that they are just making it out to be a rush for fun. You and your fiancee (it seems) have been together for most of your relationship in the same place (I may be wrong) and it sounds like you'll be back in Germany and with her soon after you leave. But for some people here, they haven't seen their fiancee's in years! I was lucky in that when I applied for the K-1 me and my fiance were living together in London and now I live in Brazil with my fiance, so I've been with my SO throughout the process...but most people are not so lucky.

They aren't crazy for making it a rush, they simply want to be with the one that they love.


Rushing in our situation would be unnecessary and stressful. She was in the States for a year under her au pair program while I was still here in Germany. (She had it all planned out before i even met her). I did have some chances to visit her, but I know how it is being apart. And this isn't the 1st time I've been away from the States and Germany for work purposes for extended periods. I think sitting down and knowing what you are getting yourself into is just as important as completing the process without wasting time. That's why I'm asking all my questions before I leave on this deployment. If your expectations are 6 months and the process takes a year or longer, problems certainly arise.

I've seen a guy get mad (wanna hurt somebody mad!) in Iraq because he expected to return home on a certain date. I asked him how much longer he would be there and he told me 2 days. He just didn't prepare himself for that ahead of time.

So it's up to you, do you want to wait until July/October 2010 for her to be in the US with you, or about 6 months from now?


Part of the problem is that I leave for a deployment in a few weeks. I will not be back in Germany until around October. And this isn't the biggest rush in the world that some people make it out to be. She's still in college and would finish up around July 2010 anyways. Let's just say the DCF is an option that neither us want right now. October through the first week in December (when I head back to the US from Germany) is likely not enough time to get married here, and do the DCF. She doesn't want to come over right away because she wants to finish up school. I don't blame her for that either.

We've discussed all the options together. The K-1 is still the way we want to go. Right now we are just working on the Advisory Opinion for the 2 Year Residency requirement. Not that much to it and I'm ready to send it off on Monday. It will take approx. 2 months to hear back for the answer. If she does need a waiver and if we are lucky and it gets approved, that would take about another 2-3 months. It's possible that the HRR could be sorted out before I even return to Germany. I can't do much while I am away but submit the required packages and wait for answers. I have plenty of time to do that in the desert!

I looked at her DS-2019 and it is a replacement copy. It doesn't have anything checked at all. Her J-1 visa says she is not subject. I found another forum concerning this. The lady there had a problem saying that the check in that box didn't exactly matter. I'm not sure if my fiancee received money from her company. She was sponsored by Au Pair in America. She says she paid for all of the fees though.

Anyways, there is an Advisory Opinion we are going to apply for. Basically, Department of State will review her DS2019, and make a decision whether or not she applies to the HHR. We'll see what happens from there.

Thanks for all the replies so far. I've looked at the DCF. I'm not sure if I can meet all the criteria. As of right now, I have no idea where I will be stationed at next in the States. I won't find that out until July/August. So I don't have a home in the States, and I won't until December.

Another problem, I'm deploying in the near future, and I expect to be home around October. Getting married fast enough to apply for this DCF before December would be difficult.

"Important Note: A US Citizen living overseas that wishes to complete the I-864 Affidavit of Support for their spouse (as part of the DCF process to get an Immigrant Visa) will be required to have a US home/domicile to qualify as a Sponsor for the I-864. In addition to having a US domicile the US Citizen must have continued employement when they move/return to the US. Per the instructions on the I-864, the US Citizen and their spouse's assets may be used to qualify if the income requiment is not met. In many cases however a couple may need to get a joint sponsor to successfully fulfill the requirements on the I-864."


I will look at what her J-1 Visa says on it in regards to the HHR. We still would rather pursue the K-1 visa. I've found the contact info for the Embassy in Frankfurt, and will find a way to ask them about the HRR. Their website mentions the possible need for a waiver for those who are former exchange visitors.

Hello everyone,

I've been reading posts here for a while now, but this is my first post! Let me start with some background info to make this easier. I'm in the military and have been stationed in Germany for the last 3 years. My fiancee is a German citizen and is still in Germany. She spent last year in America on a J-1 Visa as an Au Pair. I believe that part of her trip was funded by a 3rd party company (Au Pair in America). She returned to Germany in July of 2008. I'm set to return to the States in December. We want to apply for the K-1 Visa as soon as I return.

My question is: Will the J-1 visa interfere with getting a K-1 visa? I've read another post where others were having problems and had to wait for a 2 year period. I think it was called 2 Year Home Residency Requirement.

If you can answer that question, I have a few more... Can I start the K-1 process when I get back in December, and just have to wait for a final approval after July 2010?

And yet another question.... She plans to visit some friends in the States this summer for a 2 month period on a regular tourist visa. Will this add to the potential 2 year waiting period?

Last question, I swear! After hearing our situation, would getting married in Germany before my return to the States, and applying for a K-3 Marriage visa once a return be a better alternative? I do not know if this 2 Year wait would also apply for a K3 visa.

So we're beginning the K-1 process. Currently, I'm in the Air Force stationed in Germany. I have a basic question on the I-129F. I will be filing the Petition while Overseas.

I am the petitioner and wondering about what address I should use on the form. On the 1st page, Part A it asks for my address. Should I use where I physically live in Germany? This would be a regular German address, I live off the base, nothing special. Or should I use my mailing address that I use on the base. It is a seperate U.S. mailing address that is an APO, AE. It is not a physical address, just an address where the US Postal Service can send mail as if I were in the US.

Page 3, Part C asks if I'm in the Armed Forces and where I am stationed at. Also, a seperate block for my current mailing address.

My best guess is that use my German home address for Part A, and for Part C, I use the name of my base and my APO, AE mailing address.

I'm sure someone out there with ties to the military can answer this. Thanks!!!

Thanks for the info! I was searching online and I did see where it said any countries for over a year. The sources I saw never came out and said exactly the US was exempt. I've been searching around VJ and most people have been saying the same thing as you.

I emailed the Embassy before I posted just to double check. So I should hear back from them eventually.

Here's a question though... On any of the forms where it asked for where you lived/worked/studied.... Did you put wherever that was in America? I ask because my fiancee was in 1 state for only 2 months, and another state for 10 months. I plan on writing that info down, but she has a lot of things to put down for the last 5 years. School, internship, Au Pair at 2 locations, and a new job. Looks like I'll have to add an atachment.

We're just starting the K1 process and I will be mailing in the I-129F packet in soon. Ny question is concerning when the packet gets to the Embassy. My fiancee is German and will go through the Frankfurt embassy. I know she will have to get copies of her police records.

She was in the US for 1 year as an AuPair. Would she need to get copies of that police record too? There should be no problems getting the German police records, but I don't know how to obtain the US ones if she does need them.

Anyone out there been in a situation like this?

Hey everybody,

I have a question about Supplements to the I-129F and G-325A forms. I will be adding a supplement to 2 of the questions on the I-129F. For the supplement I have what form and question it is for at the top of the paper. Followed by my answer. Do I need to do anything else, like sign and date this paper? Notary?, anything crazy like that?

2nd questions is almost like the 1st. My fiancee will need extra space for her last 5 years of work. (Addresses don't fit)This will be another supplement. Does she need to sign/date it herself?

I will also be providing a basic timeline of our relationship from the start until the present. Anything special need to happen for this? Basically, it is just a timeline of when we met, trips we took, and a list of proof provided (receipts, tickets, stamps, photos). Followed by the actual proof after this letter.

This is about the 5 years of employment history for my fiancee. She's German and we will be writing down one of her schools to cover the 5 year requirement. The name of the school is totally German, and someone who doesn't know any German would have not a clue what it says.

So... Do I need a certified translation for this? It's just the name of the school, I will list her occupation as "student".

I will be filing a I-129F K-1 Petition shortly. I'm in the military stationed in Germany. I read the I-129F instructions about how to pay the filing fee...

"Use the following guidelines when you prepare your check or money order for the Form I-129F fee:
1. The check or money order must be drawn on a bank or other financial institution located in the United States and must be payable in U.S. currency; and

2. Make the check or money order payable to U.S. Department of Homeland Security, unless:

A. If you live in Guam and are filing your petition there, make it payable to Treasurer, Guam.
B. If you live in the U.S. Virgin Islands and are filing your petition there, make it payable to Commissioner of Finance of the Virgin Islands.
C. If you live outside the United States, Guam, or the U.S. Virgin Islands, contact the nearest U.S. consulate or embassy for instructions on the method of payment."

So, I'll be contacting the embassy on this one, but is there anyone out there who's in my situation. I have a regular US bank account with regular, American style checks as well. I'm thinking those would be OK. The city/state on my checks are APO, AE which is a US mailing address for those stationed overseas.

I was ready to mail the whole thing in tomorrow until I read that part.

Hey there everyone!

I was looking for an answer to my question on the forum but couldnt find anything I was looking for.
I am currently waiting for my visa appointment to be issued. Yesterday I received the information that our Co-Sponsor's (my fiance's sister) paperwork finally arrived with my fiance.
The problem now is that she did not fill everything out completely cause she was not sure with two questions. Could any of you that had experience with a Co-Sponsor help please?

She has to state my information and not my fiance's information right? Cause the affidavit is executed on my behalf and not on my fiance's?


# 11 The check boxes: I intend or I do not intend to make specific contributions to the support of the person named in item 3.

She now checked I do not intend. Was that right? My fiance of course checked I intend and we assumed that she would have to check the same one.

I really would appreciate your help as I dont want this to be the reason my K-1 Visa wont be approved!

I will arrive by train (I currently live in Munich) so it is about a 3 hour ride and I would rather be there early and not miss my appointment. I think trains depart every two hours so it is great to know already that I should be there at least 1 1/2 hours early!


Okay great. So I got my appointment at 8 am now. I thought they only open at 7! I am so afraid now that I will miss it. I am thinking about calling them and asking when I should be there at the latest. I am super afraid now that I will mess things up :(

Well, an hour earlier sounds good. Maybe even 1 1/2 hours earlier. You have to go through security and there will be probably a lot of people waiting in line. Not to mention traffic, depends on where you live. I can't really tell though, because I haven't been to an interview at the Frankfurt consulate. Anyways, you don't wanna miss your appointment. So better be safe than sorry.

I am not sure about your first question; my fiance and I have the same problem and a friend who did the K1 process a couple of years ago recommended to find a Co-Sponsor, so I recommend you to do just the same but maybe someone else has a different experience with that?

About your second question, as far as I am concerned, I think you have to include both girls, as she is still dependend on you.

I would recommend the same thing. We received NOA1 on December 3. What I have been told from friends who went through K1 is that they look at each case and that a lot of it just depends on the evidence you handed in. I had friends that waited longer then 5 month and were able to take actions but before the regular processing period of 3 to 5 month there is nothing you can't do, I am afraid.

You can sign all documents except DS 156 k, since this one is required to be signed in front of a consular officer. All the other forms you can hand in signed after the receipt of Pack 3.
As far as I remember, you must sign DS 230 and DS 156, saying that you agree and understood the terms and that everything you provided above was correct and the truth. Therefore you can sign all documents. On DS 156 k it also says DO NOT WRITE BELOW THIS LINE. Just follow the instructions on each form and you should be fine.

I’m not going to bring my new bride to the states just to dump her there – in a foreign culture – and go back off to Germany. And I have no one she can stay with until the process runs its course.

The K3 route seems to be the same except we’re getting married outside the U.S. Doesn’t she still have to wait in the states until she receives her green card?

Can anyone give me any advice as to how to proceed? I want my fiancee, once we’re married, to be able to travel to Germany with me on my assignment. I’m going to call the USCIS Monday to ask some direct questions, but I was hoping some of you folks may be able to assist


I would suggest getting married and filing just an I-130 petition (with supporting documentation) for a CR1 visa. Once the visa is in hand and used, she enters the US with LPR status. The actual green card will arrive at the US address you have on file within a few weeks but the I-551 stamp in her passport will allow her to accompany you to Germany immediately.

You would want to check on whether DOD civilians on assignment are treated the same as actual military as to their overseas assignments. If military, your wife being in Germany with you on assignment would be considered the same as if she were in the States, with respect to maintaining permanent resident status. I'm not sure DOD civilian employees' spouses get the same treatment.


From what I've read regarding INA 319.B, DoD Civilians are treated the same as military members.


Good. Somebody else suggested getting her a visa to Germany and marrying there, then filing the I-130 directly with the Consulate in Frankfort a few months before you wish to return to the States. In theory, this is equally viable as an option but in practice, getting the visa from the DR to Germany may not be viable. Further, the timing is uncertain. You could end up needing to leave her behind in Germany or stay past the end of your job with no income to wait for her visa. I think you'd probably be more comfortable getting on with life as it is now in whichever country you each need to be for the next few months, then reunite one time with all issues dealt with. Your call.


I've been doing a lot of reading, and it seems the best option for me is to get married in the Dominican Republic and then file my I-130 and go the CR-1 route. That way when the approval comes through I won't have to worry about adjustment of status, and then bring her on over to Germany. Once I get married and file the I-130 I'll talk to the USCIS about expediting the case. However, I really don't won't my case expedited to be honest. My fiancee is taking indepth english classes on the island and I would like her to finish the curriculum.

I’m not going to bring my new bride to the states just to dump her there – in a foreign culture – and go back off to Germany. And I have no one she can stay with until the process runs its course.

The K3 route seems to be the same except we’re getting married outside the U.S. Doesn’t she still have to wait in the states until she receives her green card?

Can anyone give me any advice as to how to proceed? I want my fiancee, once we’re married, to be able to travel to Germany with me on my assignment. I’m going to call the USCIS Monday to ask some direct questions, but I was hoping some of you folks may be able to assist


I would suggest getting married and filing just an I-130 petition (with supporting documentation) for a CR1 visa. Once the visa is in hand and used, she enters the US with LPR status. The actual green card will arrive at the US address you have on file within a few weeks but the I-551 stamp in her passport will allow her to accompany you to Germany immediately.

You would want to check on whether DOD civilians on assignment are treated the same as actual military as to their overseas assignments. If military, your wife being in Germany with you on assignment would be considered the same as if she were in the States, with respect to maintaining permanent resident status. I'm not sure DOD civilian employees' spouses get the same treatment.


From what I've read regarding INA 319.B, DoD Civilians are treated the same as military members.

They will use the address noted on the I-129f.

You may be able to get more assistance regarding military related immigration issues here.

thing is that students jobs in germany arent taxed, even though theyre official, its a special thing to make our lives as students easier-so shall i list them or not?its a lot then wink.gif

I have a question concerning the G325A form too. I'm a student, so I only worked summer jobs and part-time jobs, do those have to be listed also or can I just write none?If I write them down, there are huge gaps in between, do I have to explain why there are time gaps?

my fiance, who is filing it, is in the US army. which address does he need to provide there?

and a general question, which address is the USCIS using to send him stuff?the one that he provides on the first page of I-129f?

I just got my NOA2 and loosing my mind out of happiness! :rofl:

What do I have to do now? Call the NVC for what? I have all my documents for the interview ready, medical is done, what can I do now to safe time? Do I have to wait until the embassy sends me package 3 to send the forms I downloaded online?
And what are package 3 and 4? forms?

Any ideas how fast we get the interview dates in Frankfurt?
Plus, is the fee they are talking about the petition fee or is there an other fee for the visa?

He ca go the the courthouse where the divorce was granted and request another certified copy by the court.


He is not living in this state anymore. What are we doing now? Does he have to go there or can he order it by calling them or sending a letter?

If he doesn't he can easily get it from the county in which the divorce occurred.


Of course he doesn't have it. The problem is. His divorce was in New York. He is now living in Florida. Can he get it without traveling there? Just call the court or send them a letter?
