Congrats!

You can try to file for AOS. It's not allowed for people under visa waiver to file for AOS (you can read it on form I-94), except an immediate relative to a USC. The problem is that your husband can't travel outside the US during the whole process. Another problem is that your husband can't get a working permit during AOS.

However, you have to prove that you didn't plan the wedding.

I think your wife has to apply for a reentry permit.

"Lawful permanent residents and conditional residents require reentry permits to re-enter the U.S. after travel of one year or more."

I hope you realize that you're just as much to blame as he is for your current problems.

Let's look at the problems:

1. He didn't learn a single word of English in 1 year. Okay, lazy on his part but what about you? Did you encourage communications in English? Before I found my wife I had a couple of Chinese girlfriends who spoke varying amounts of English (one in the US one in Canada, the Canadian spoke more English FWIW). I spent a lot of time helping them improve their English skills and it was a great relationship builder. Even with my wife who speaks good English I spend some time helpign her improve it.

2. Regarding his job, of course you can find him work that doesn't require English. Look within your local Ukrainian/Russian community and you will find many resources that will get him cleaning offices after hours or loading trucks on a dock with other non-english speaking immigrants.

3. You can't afford your current lifestyle AND you want your old life back. This is the reality of Marriage. If you Love him and he Loves then together you guys should be able to work through the tough times and in the end your relationship will make you stronger as a couple.

4. He's handling the problems like a crybaby. Well remember that he is in a foriegn land and doesn't speak the language. His life has been turned upside down and he is completely lost in the translation. Have some patience with THE MAN YOU LOVE. You are 90% of his life right now and the fact that you're ready to throw him out with the trash isn't going to fix anything.

Finally, don't forget you signed an Affidavit of Support promising to be financially responsible for him for the next 10 years, divorce doesn't erase that promise to the US Government.


This was a real good statement even though we don't know the whole story of them.

I'm wondering if I send all my original documents along with the DS230 to the NVC, is it still necessary to bring original documents to the interview?

The IR-1/CR-1 guide said that you have to send originals to the NVC and you have to bring originals for your interview. It doesn't make any sense to me.

Can anybody give me an advice?

Hello, The form I-864W is only an "exemption" from the affidavit of support. Since your daughter will get the US citizenship automatically she'll meet the requirements for an exemption.

Intending immigrant is a child who will become a U.S. citizen immediately upon entry under the Child Citizenship Act of 2000 (CCA). Under the CCA, some children become U.S. citizens immediately upon admission to the United States or adjustment of status to that of a lawful permanent resident. For this classification to apply:

At least one parent of the child is a U.S. citizen;

I am back again. Just got home from my trip yesterday. It was sooo great. I will post some pics later. Las Vegas and Grand Canyon was soooooooo crazy...... everyone needs to see those places.
Santa Fe was not too great but is a good place for art-loving people.

He my friends,

we got touched as well on the 22 Jan. So I hope we are all done with the it soon.

I really can understand all the others that have been waiting longer than us and hear nothing from the service center.

Oh well. I just think all you can do is waiting for right now and I really feel happy for others who gets an approval before me. Sure I want to be with my husband as well, but I know my time will come too.

What are a few month, maybe a year, if you already know that you will spend the rest of your live with your love???

I have not been with my husband for 9 month longest and still live. Sure it is hard, but this is just how it is and the world (thank god) is not going to end because of this.

I am just happy for everyone who moves a step closer to this great day!!!

Just my opinion about the whole approval thing.

A Request For Evidence (RFE) is a form USCIS sends to to you.

You should check with your Fiance if unsure of the specific I-129F version you filled out or if an RFE was received.

From your last comment, I am surmising that you are not the U.S. Citizen?

Clarify these points with your Fiance and reply back.

Oh man, Im even more confused now. I know we sent a seperate sheet together with the I-129 F and explained where and how we met- is this the RFE?!? I have to ask dave if they asked him about this IMBRA and Criminal background-I dont rembember being asked. I know they sent the whole package back one time cause there was a mistake and then we just sent it back and got the Noa 1 in June....

IMBRA is the International Marriage Brokers Act. The act became effective on 06 March 2006.

On the I-129F you filled out, did it ask questions about Marriage Brokers and Criminal background?

You may get a separate Request for Evidence (RFE), which is a form that asks those questions, despite the fact that your I-129F already asked.

That is the wonder of the USCIS, always doing things right!!! :lol:


Be sure to go to the USCIS website and establish an account. You will need the A# from your NOA-1 document, an e-mail address and some other information. This will allow you to track progress and get automatic e-mail notification of changes to your account status.

Even if you use the "new and improved" I-129F with the IMBRA issue included, you may still receive a Request for Information (RFE) with the IMBRA questions.

If you are the USC, can someone forward that mail to you in South America? You will want to fill that out and return it ASAP, or your process will halt. They also impose a time limit to respond to the RFE.

With that said, be sure to establish a way to get that mail forwarded to you.

What William said is right - since you filed with the "old" I-129F (the new one wasn't available when you filed so I'm making this assumption) they will send you a supplement request for evidence (RFE) so that you can answer 3 questions in order to comply with the law. Other than making sure this form is filed out and returned, it doesn't matter where you are physically located while they take their time to process. Make sure you have set up an online account and have access to your email as well as having someone get your mail at home. You may also want to start gathering the items for packet 3, post approval, so it's not a mad dash when you get home. But it's fine to travel - go and be free!
