We are going through an K1-Process right now. My fiance had divorcement papers in german that we got translated by a friend who speaks English and German fluent. Now im scared: Does it haave to be an offical and certified translator or is it enough if my friend signed this paper along with the translation?????

USCIS Document Translation Policy

Per the USCIS, documents not in English must be translated. The policy states as follows:
"All documents that are in a language other than English must be submitted with a translation. The person translating the document must certify that the translation is complete and accurate and that he/she is competent to translate from the foreign language into English."

All translations must include a statement similar to the following:

I typed name , certify that I am fluent (conversant) in the English and
languages, and that the above/attached document is an accurate translation of the

The petitioner would have to withdraw and cancel the petition if they decided to split. This would not affect her entry upon the US whatsoever.

Our petition got approved kicking.gif kicking.gif Im getting ready for the interview now and gather documents. Now i read something about the interview that better not be true. It says that i need originals of EVERY document that is in the package. Does that mean i need my fiance`s paperwork in original too or only mine?!?!?!?

A...You need everything from the checklist, of course, but you also need originals of everything that was originally submitted as a copy, even with the I-129F petition (except the US Citizens passport and the original I-797 approval notice). Original birth certificates, divorce or death decrees, and originals of any documents to support the I-134 fall into this category. The Consulate has the right to ask for the original of any document, so best be prepared.

Hy everybody,

I`m new here and i already have my first question..my USC Fiance and i sent the I-129F off in the end of July this year.
We received are NOA 1 in August, and since then case status hasn´t changed,what is normal because of the current processing times, i know..
Now my question is, since he finally found a house where we gonna live in, actually everything what we planned is done...Now we are just waiting for this whole process to be over as fast as possible.
So yesterday when we talked on the phone, we had the idea of maybe getting married spontanious. The idea was that i will visit him (i have a b2 visa) for a week or two and then we just decide "spontanious" that we don´t want to wait anymore and get married during this time.Would that work?or would we get problems? or should we just wait until i get the visa??
I already have been there for 180 days this year, so the full six months,which are allowed. So another question would be, if they let me in when i go there, let`s say maybe january??Cause i`m only allowed six months each year..

Thank you for all ur answers, maybe it´s a silly question but i just wanted to know if this could work...

Ideally I would like to come straight out in May and look to work straight away but I understand this is impossible. I just need to budget as I obviously want to take a good amount of money out with me.

Since July 07 the fee for the petition increased to 455 $ thats the biggest part of all the costs..Then there is only the costs of the visa fee at the embassy, but i dont know right now how much it is (not more than a hundred i think),then the police certificate ....

5. My fiance is in Med School and does not have a full time job, will this hinder my chances of obtaining a K-1 as she technically cannot support me?

If you find somebody as a CO- sponsor u won´t have any problems

youre def right that we cant please anyone, i always thought i was a kinda nice girl and i brought them bierkrüge and jägermeister- guess that wasnt convincing enough.

giuly, unfortunately you got me wrong-were only 4 months into this deployment and its supposedly to be a 14 or 15 month tour, so we still have a long way to go.

does anyone have more information on the expedite?

yes, my fiance is army. i was told that he could get service from jag, but that is only partly true because we would have to be married then, like DCF or K3. so thats not an option then. waiting until after iraq would mean about 6 months more separation and we wanna avoid that by any means.

thanks, germany is a beautiful country indeed wink.gif and im really proud to be german, but not all ppl are open towards germany because of its past (wwII). well, theres nothing i can do about it anyways.

yeah thats the point, that its easier to have someone there to help me with the birth certificate and all kinds of paperworks. i have a certified pocket sized birth certificate but i read here that we need a long version. i tried to order it online but they wont ship to APO (his address in iraq) and of course neither to germany.
we need additional info like his parents birth dates and cities but he doesnt know them and he cant reach them via phone right now (how sad is that, i know).
yeah, i spent christmas at his dads house and on the outside, hes smiling at me and stuff but hes talking trash behind my back about me being german. believe me, i gave my very best to show all my respect but guess it wasnt good enough.
his mom has 5 kiddos and is like the sweetest person ever but a total messie. i dont wanna trust her with important stuff because im sure it would get lost.

the main problem is that his parents arent supportive at all, so we cant count on their help.

Well - it depends.

I am a July 2007 filer - and we got approved in January 2008. Fortunately everything went fast after that and I already received my Visa.

So it IS quite possible that you have to wait 6 months before your get your NOA 2.
but the way it seems right now processing times are getting shorter again and hopefully you won't have to wait so long.

1 and 2. I have just looked at some old posts, still recent, and there have been many people who are on CR1 and left the US without a re entry permit. I hope this link works - http://www.visajourn...php/t28122.html

Also, I think she will only need a re entry permit if she is out of the country for more than year. There is a possibilty she may not need one because she will be out of the US because of her husband, who is out of the US because of the military. I do think that being in the military changes some things, especially residency requirements.

3. You're welcome, we chose the IR1 route because of less paperwork, I HATE paperwork!! :)

For a spouse can be 5 years until she can apply for citizenship if when she enters US she gets the conditional residence (less than 2 years marriage)...after 2 years she will become permanent resident and she has to wait another 3 years for citizenship.

Wow, that was too big for my eyes :lol:
1. she can go outside US when she is on a conditional status but I am not sure for how long. I am in Germany connected to a military base and a friend of mine went to US just to get the GC and SSN and she came back to Germany cause her husband is still here working like a civilian for the Army. But every 6 month she travels back to US just not to loose her residency there.
2. us military bases in the world should count like US soil and you should be able to get your wife with you. you should go and ask at the JAG office.
3. about citizenship, I think the rules are the same: you said you two are married 1 year only it means she will have a conditional status the first 2 years entering in US, after that she will become a permanent resident and in 3 year can apply for citizenship. If you where married more than 2 years your wife would get the permanent residency from the start so faster to get the citizenship.

I summited my tax return when I got the RFE, it was a good proof that our marriage is bona fide because we have joint tax returns. At the interview, the Officer said they do not need a tax return because they have it already. ;)

You filed I-130 to the Embassy that means you did DCF. Once your petition is approved you will receive instructions from the Embassy. If you started the process in person at the Embassy you will receive packet 4. If you started the process using the mail you will receive packet 3 followed by packet 4.
