319(cool.gif only applies to expidited citizenship, not to AOS. I am not aware of anything in the INA Act that will expedite AOS process. If you do get your AOS and greencard prior to your husband's deployment then you can go ahead and apply for Citizenship as long as his deployment orders are for 12 months or longer. That will allow you to skip the whole I-751 process to lift conditions on your permanent residence.



The requirement would be that the applicant will move overseas with her husband and that she has to be overseas at least 12 more months at the time of the interview!

Do you mean that you want to expidite your AOS or to apply for Citizenship?
Because you won't be able to apply for citizenship since you are not GC-Holder yet and also to be eligible for the Citizenship you need to be stationed overseas with your husband which is not the case here.

Meriem setif is right. Even though you are outside the US but on military orders you will be still considered on US soil. You have to use your APO Adress for your application. As military spouse if your husband get orders overseas OVER 1 year, you do not have to meet the 3 years being married requirement. If you do not want to naturalize but just keep your GC then you also can just file for lifting of conditions from overseas again using your APO Adress.
Hope I could help you with that information. I just learned about it myself because we probably are going to move overseas too (my husband is in the AF)

Hi,

I think you should go to the consulate in Frankfurt and just ask about all this. Or call. They are usually very helpful.

From what I know the amount of time you're married to a USC doesn't have any effect on the visa/citizenship process.
I know a couple who has lived in Germany for 15 years and they had to do the exact same procedure: apply for greencard, then citizenship.

But I think you might want to look into the DCF process, which still seems to be possible in Frankfurt. This would be the fastest way of getting the greencard, and because you've been married for more than 2 years, it would be the 10 year unconditional card.

The folks in Frankfurt should know...

Don't you think there might be a US bank that has a kind of cooperation with a Canadian bank so that taking money out of the ATM woulnd't cost fees.

I know that with Bank of America and a big German bank it doesn't cost fees to get cash...


If you live in a city with lots of students, subletting your place with all your furnitures should not be a problem, I think. Usually there's always someone there who needs stuff.

Hi guys!
I have some questions regarding the I-134 form filling out by the co-sponsor. My fiancee, who is the my sponsor is a student and didn’t work last year and doesn't has any income. Her dad will be the co-sponsor and he fulfills easily the 125% of poverty line.
I still have some questions regarding the I-134 form.

Question 1 on the I-134 form:

My fiancees dad got his U.S. citizenship through naturalization. On his certificate of naturalization there are two numbers. On on the top left side writen in red and it consists of 8 numbers and one below that writen in black consisting of one letter and 8 numbers (it says JNS Registration No.smile.gif. I think it is the second one (writen in black), just wanted to double check.

[b]Question 2 on the I-134 form:“I am XX years of age and have resided in the United States since….”

Should I write down the date of his naturalization, the date when he got his green card or the date he entered the United States for the first time (he can’t remember the exact date of his first arrival in the Staates just the year and month)?

Question 7 on the I-134 form:!!!
My fiancees dad is self employed (one-man business – truck driver). He did his income tax return together with his wife (but his wife is not working any more since August 2008) . Therefore the income on form 1040 is as follow:
“Line 7: Wages, salaries, tips, etc.:” $ 12,724 --- this is the amount his wife made
“Line 8a: taxable interest:” $277
“Line 9a: Ordinary dividends:” $110
“Line 12: Business income:” $83,726 --- this is the amount he made with his one man business
“Line 17: Rentel real estate, royalties etc.:” $-11,707
“Line 22: total income:” $85,130
They have two dependend children mentioned in the form 1040 (my fiancee and her sister).
Should I just write the amount mentioned in line 12 $83,726 and add his wife to the children as dependent on him?
I also have some attachement to form 1040 (Schedule C , Schedule E, Schedule SE and some others). On Schedule SE under line 2 you can find the net profit of $83,726 (business income). Line 4 states the “net earnings from self-employment”: $77,321. Is this maybe the right number?
Should I have two co-sponsors him and his wife? Should each of them fill out an I-134 form? They have two dependent children therefore his salary ($83,726) would be enough to fulfill the 125% of proverty line. Hers wouldn’t be enough ($12,724). Or is their both income mentioned in line 22 of $85,130 enough and should they just fill out one I-134 form with both names on it?
Any recommendations how to fill out question 7 with the correct amount of income? What would be the easiest way?

Question 8 on the I-134 form:

On the income tax return statement it is mentioned that both of his children are dependent on him and his wife for support. How do I know if they are wholly or partially dependent? My fiancee is still going to school, her sister just graduaded, but doesn’t has a job yet.

Question 9 on the I-134 form “I have previously submitted affidavit of support for the following person:”

My fiancees dad had to submit affidavit of support 25 years ago when some of his family members wanted to visit him from his home country Poland. He did that a couples of times back than. I guess it was nececarry due to the Cold War and Poland was under Russian control at this time. It was always just for a visiting visa for a couple of weeks. So it was not the same affidavit of support like the I-134 now. Should I write all his family members down? Also he doesn’t remember the exact date any more cause it is so long ago. Or is this question just regarding to I-134, affidavit of support? Should I just write down “none” cause it is the first time he is filling out the first time an I-134 form for a K1 visa? Just want it to do it the right way, therefore I am asking.

Question 10 on the I-134 form: “I have submitted a visa petition to U.S. Citizenship and Immigration Services on behalf of the following person.”

I would write down “none”. Just when my fiancee fills out the I-134 form as the sponsor, she would have to write down my name.

Specially Question 7 and to figure out the right income is confusing me.

Yes or No (You'll notice there is no mention of a K-1, tourist, or other visa in the question.). You are making more out of this than there needs to be made. I'd put the information down - date it as best you can and move on - it's not that big a deal - especially since it was 25 years ago.

Very doubtful submitting an affidavit of support for family 25 years ago would have any affect on your case now - especially if there were never any issues with these family members.

Scared or not the answer is what it is. If the previous person sponsored now has citizenship, that will be on record. It's ok to note that when you file the affidavit.



So if he has citizenship now it will be not a problem any more? I am just scared, cause my fiancee's dad cousin got denied, but she also applied for a tourist visa and they were probably assuming that she wants to stay in the country like his brother. In my case they know that I want to get married and obviously want to live in the country, so I hope they will not care about that.
do you guys think it will matter or should I just find another co-sponsor, cause I will be probably denied due to that whole story?
if I write all the names down from his family, should I also write down the name of his cousin who's visa got denied?
should I write down that his brother stayed first as a illigal immigrant and got his green card later?

my fiancee's dad will be my co-sponsor. He is self-employed and makes $80.000 (line 22 form 1040).
I will provide his income tax return (2008) to the I-134 form.
I can not include monthly pay stubs from this year cause he is a truck driver and gets paid by checks from different clients after he gets a job done.
What kind of document do I have to provide in order to prove his income from the year 2009?
Do I even need any additional documents to provide? Or is his income tax return from 2008 enough?

Hey guys!
My fiancees dad will be my co-sponsor.
His household size including me is 5 people. Regarding the 125% of Poverty Line his income should be $32,237

His income (income tax return form) was in
2006: $38,515
2007: $29,655
2008: $42,215

He is self-employed. On the guidelines for the I-134 form it says I have to provide his last income tax return papers including papers which show his income from the last 12 months. I already have these papers. Is this enough or should I also provide the income tax statements from 2007 and 2006? I was reading in some forums here on the website that this is necessary. Is this true and why is it not mentioned on the quidelines on the I-134 form? In 2007 his income was a little bit lower than the requested income (125% Poverty Line). I am afraid that I get refused because of that.

Does anyone has experience with the embassy in Frankfurt?
What papers should I provide, just the 2008 income tax return from or also the papers from 2007 and 2006?

I have two short questions.

1)
I already received my K1 visa. My fiancee is living in San Diego. I want to fly out from Frankfurt to Las Vegas (I found a cheap flight). Can I cross the boarder in Las Vegas or has it to be San Diego. I quess I know already the answer and it should not be a problem. Just wanted to double check.

2)
I want to take a flight with an other airline from Las Vegas to San Diego.
The flight leaves 3,5 hours after landing in Las Vegas. How long does it take for me at the boarder until they process my visa papers?
Just want to make sure that I can get the flight.

I have some short questions regarding filling out DS-230. I heard that the Consulate is sometimes very picky with this stuff, therefore I want to be sure.

Question 12: Your Present Occupation
- I am a student and not working. Do I put “Student” or “Not employed”

Question 14: Name of Spouse
- I was never married should I put: “None” or “N/A”. In the introduction on DS-230 in the top it is just “N/A” mentioned. On the example form at this site, it says to put “None”. What is right?

Question 32: List below all employment for the last ten years.
- I am a student and I just have occasionally a job. For example: I was employed from 02-2005 until 06-2006. I was employed from 07-2007 until 09-2007. Between 06-2006 until 07-2007 I wasn’t employed. Do I mentioned this period as “not employed”? I did this while filling out I-129 form and it was fine. Or do I just mention all periods where I had a job?

Question 33: List below all educational institutions attended
- I am still in school and I will finish my MBA in 03-2010. Do I put in the field From/To “03-2010” since it is not possible to put “present”?

- there are just three empty lines. But I was in the United States five times. Do I fill out my three last visits on the DS-230 form and mention the other two on an additional sheet or do I write “see additional sheet” and write all five on a separate sheet

Thanks for the replies. Since you asked here is my situation. I am basically confused about the amount of days outside the US questions and trips taken. Here is why.

I am applying for my citizenship based on receiving my green card based on marriage to my US citizen wife. We were living in Germany during the time we received my green card and then moved to the US. However, prior to moving to Germany we were living in the US. I was living there on an L1 visa (inter company transfer visa). So I have lived in the US in the past five years twice with a year and a half in between in Germany. Further, we got married while I was in Germany and my wife was still in the US so while initially living in Germany I traveled back to the US a few times on business trips and also to get married.

so even though I am applying using the three year rule the question asks for five years of travel and days outside the US information and I have no idea what to answer since I lived there for some of it and should I include those times or what. To be a bit more clear here is my time line.

1998 to May 2004. Lived in the US on an L1 visa
May 2004. Moved to Germany
Traveled to US in October 2004 and got married to my now wife. She traveled back to Germany with me.
October 2005: Moved back to USA on my approved CR-1 visa.
Now applying for my citizenship.

I have seen different opinions on this site about how to answer questions on the 3 year versus 5 year travel information so that is why I do not know how to answer based on the above time lines.

Note, I have done the entire process so far without a lawyer and would be happy to continue but am not sure how.

I do not impress easily, but very impressed with both the service and the quality of this flag, got the cotton 5 by 8 foot version for my wife, all stitched with the stars stitched on, and made in the USA. That is really hard to find.

The certificate that came with it testified it was flown over the US Capitol building and is a gift from her husband to Gloria Consuelo D in honor of her receiving her U.S. Citizenship.

Now what to do with it, half thinking about using an expandable ten foot pole, if security let's me bring it in to the oath ceremony, if that ever happens and waving it in the background. But only if this flag is larger than theirs.

But will have to buy a yard flag pole, a couple of bags of ready mix concrete and pull out my man killing post hole digger, that should really impress the neighbors.

Straining my brain as to how we folded the US flag in the military, but can't recall how we rolled our underwear, socks, and towels either, but in such a manner when thrown against a hard wall, it would stay intact. Wonder if I could get a refresher course in basic training?

Was a bargain at 28 bucks for such high quality, and thanks to Lucy, a wonderful gift.

You can contact your senators office and order one and you should receive it much quicker than your oath letter.


Was it LucyRich who told you about that or me? Also, although it can be flown in your yard, I would highly suggest that you buy a flag case for it to remain as a treasure in your home. You can find them at Michael's or some other craft store for about $30 on sale. I would get a second one to fly outside...but keep this one special. good.gif



If you ordered the 3 by 5 foot flag, Staashi, and posted it some time ago, it was you, then my thanks to you for posting this. I tried to find that post, was under a different topic heading as I remember, but that was thousands of posts before.

Do remember the only proper way to dispose of the flag was to burn it, but recently, I gather that your intentions can make a big difference, either respect or disrespect.

If you wish to dispose of an American Flag then you are correct, the approved method is by burning. See the link for rules governing the flag.

However, if you are concerned about people's viewing of you burning the flag you can also check with your local vetern's office. A lot of times they will take flags and ensure it is disposed of correctly.

I will have the option of taking the old or the new test. While I know the answer to my question is subjective I am interested in people's opinion as to which one is easier? I will study both to make my decision but I would like to hear some thoughts.

Hello all,

I am scheduled for my interview in November. My citizenship application is based on marriage to my wife who is a US citizen. I got a request in the mail from the USCIS stating after a complete review of my case they want me to bring more information to the interview. They have asked for all travel documents issued to me (passports). I do have all of my passports.

I assume this is due to the fact I have lived in the US in the past on a work visa, then left and came back on a green card which also included some business trips back to the US during my absence so my application is a little bit confusing on number of trips abroad, addresses etc. I have attached the link to that discussion.

Do I need to be worried here or should I assume it is just confusion on their part and they want to check stamps in my passports?

Hello,

When I married my wife (US citizen) I was living in Germany, she in the US. We got married in Vegas. I entered the US on the visa wavier program (Due to being Irish) got married and left within the 90 day period. I had confirmed with the embassy and the state department website and they all confirmed that was legal and I did not need a finance visa since I wasn't planning on staying in the US. My wife soon followed me to Germany.

I later applied to get my green card based on my marriage to my wife while we were living in Germany. The fact of how we got married never was raised as a problem or an issue by the embassy. Neither was it raised when I removed conditions last year.

Now that I am applying for citizenship and got a note stating after a review of my paperwork they want me to bring all of my passports to the interview I am becoming paranoid. Does anyone have experience with marriage this way and if so was it an issue at the interview?

I passed my interview on November 20th and was told I should get one within 6 weeks for the January ceremony. Still nothing. THis Thursday will be six weeks. I assume due to holidays etc it may not come until early January.

My wife was born in Japan. Her father was a US citizen living in japan at the time but not part of the armed services. My wife was registered as an American born abroad and received a US passport. Her father had satisfied the timing requirements for how long he had spent in the US etc so she was eligible to be considered. she is regarded as a US citizen at birth, not a naturalized citizen.
