Expeditious naturalization for PR/CPR spouses applies when your husband receives his official orders to move to a foreign base. You have to be included on his orders. The application is usually lodged after the orders are received and before departure overseas, but NO EARLIER THAN 90 days before the intended departure date. For example, if your scheduled to depart on Dec. 1 to your husband's foreign base, you would have to have filed the N-400 application on or after Sept. 1 while you are still in the US.

However, your Active Duty Spouse's foreign assignment should be at least 12 months on his current overseas base. The N-400 for military spouses cannot be adjudicated overseas, so be prepared to fly back to the US for the interview and oath.

Thats basically what I said and have said everytime that question is asked in this forum. It has been asked on more than one occasion. Except I said you must go back stateside to lodge it,..But the point is, it must be lodged with the relevant stateside service centre associated with your resident state,whether you mail it there or you mail it while your stateside and you do indeed need to go back stateside for interview and oath.

I think the people just dont like the answer they are hearing , and dont want to do the research themselves, and would rather have other people do it, hoping that the answer that they want is going to pop up.

I even went so far to find the ruling in the INA laws and guidelines once, but that was taken with a grain of salt.


Sorry that you might get the impression that I or some others are not taking your information for right. I am really thankful for that but since I know that rules changes quite often and in my situation there is another application (to keep my current citizenship) necessary I need to double check to make sure not for wasting the money on that if I cannot apply for the US Citizenship.

@natty: thank you for your reply. That was what I thought. Therefore I contacted USCIS to get the confirmation (due to the fact I want to apply for keeping my german citizenship with the german embassy which takes a while for approval and the approval is only valid for 2 years). The operator on the phone told me that there are no exception for military spouses, unless we met the required circumstances (what the circumstances are, she could not tell me). So that was why I even
did not bother about that any longer because I do not want to spend a few hundred dollars on the german embassy and waste it in case I do not meet the requirement for naturalization.
It is sad that nobody from USCIS can give you the answer according to their guide.

@yhanie: thanks for your input. This whole issue is really confusing. To be more clear in my case...the reason why I ask is because there is a 90% chance (which is not sure yet) that my husband will get orders to go to Korea for 2 years coming up summertime. And as you may know you will not get the orders until a couple of months before you are going to leave. So you mentioned that I could actually file the application before we are leaving. Does it mean that the application will be processed while I am overseas?
There is another twist in this case because I would like to keep my german citizenship therefore I need to apply for that which in case it gets approved is valid for only 2 years. To make sure that I really can apply for the citizenship without the 2/5years condition I called USCIS and I received the answer that there is no exception for military personel. So know I am really really confused!!! wacko.gif

my GC is only valid for 2 years.
According to the pdf file from USCIS the requirement for Naturalization for spouses married to an US military member I have to be permanent resident at the time of the Interview. So now comes my confusing point...my GC says permanent resident card. So does it mean I can apply for citizenship eventhough I got that since march only?

You can apply 2 years and 9 months after your PR date (when you get your green card). As for living over seas, it's usually a no that will not count and will cause problems during the interview. However, being your USC is in the military that may not be the case for you. I believe if you are living on the US base (US Soil) then that may count for your continuous residency.

You will want to check that out though with the INS and make sure you get all the proper re-entry visas etc to preserve your green card...

Does anyone knows about the rules of natualization of military spouses?
I came to the US on a K1 Visa, got married and got my AOS approved back in march.
Now my husband and I we are wondering if I have to wait for 5 years until I can apply for US-Citizenship.
Also how does it works when we are stationed overseas (outside US) for 2 years. Are these 2 years included in the 5 years?

I definitely won't be able to do the interview and ceremony before we are leaving. We won't get the orders until approximately may and probably have to leave for Korea in June/July already (usually he get the orders about 2 months prior before departing). And as far as I can tell from the way USCIS is working it should be NO WAY I will have an interview appointment, not to mention the ceremony. Or will there be a expedite processing time due to the orders?

Sorry for asking so much, but I just want to make sure, that things won't be mess up.

Just a general question about naturalization.
Since my husband is in the military and he get orders for overseas (over 1 yr) I have the opportunity to apply for naturalization without meeting the 3 yrs of being married requirement.
So my question would be...
1. Do I apply before leaving the US (as soon as we got his military orders)?
2. How about fingerprinting/Interview and Oath? Will I be able to do that at the US Embassy oversea or do I have to come back here to the US?

Sorry to hear about your situation.
I think you might have misunderstood the circumstances that you are eligible for the US Citizenship.
You (your wife) is eligible at your 3rd year anniversary since she became a greencard holder
OR
if you are outside the US on military orders she does not have to meet this 3 years requirement BUT at the time of the naturalization she has to be in possession of a valid greencard as well as she has to stay AT LEAST ONE MORE YEAR overseas after the naturalization.

You probably misunderstood this and your lawyer was not as good informed as he should be.
But I really doubt that you can get the refund on your money back because people can tell you anything they want (sad but true) but fact is that you have to
gather the information to make sure that the informations are correct!

I do not know how it exactly works for the Philipines, but in for example germans are allowed to have a dual citizenship as well.
For that we do have to apply for a permission to keep our german citizenship with the german embassy first BEFORE applying for the US Citizenship. If they approve they provide us a certificate that proofs that we can keep the german citizenship. If we apply for the US Citizenship without this approval certificate, we will automatically loose our german citizenship.

As I said not sure if this works the same way for you.

My interview took 45 minutes because the interviewer had to run some name checks while interviewing me (the person that supposed to did not run all name options) then I had to wait another 45 minutes to get the oath letter (this was because I had the chance to take the oath the same week).

It was very nice. The interviewer was very nice. No additional documents were needed except for current lease and utility bill (for proof of residency)

319(cool.gif only applies to expidited citizenship, not to AOS. I am not aware of anything in the INA Act that will expedite AOS process. If you do get your AOS and greencard prior to your husband's deployment then you can go ahead and apply for Citizenship as long as his deployment orders are for 12 months or longer. That will allow you to skip the whole I-751 process to lift conditions on your permanent residence.



The requirement would be that the applicant will move overseas with her husband and that she has to be overseas at least 12 more months at the time of the interview!
