Hold on Oct filers... hope is near!! :) :)

Removing Conditions on Residency General DiscussionI-751 October 2011 Filers

Hi Simbafuzz,

FYI, my wife just returned from overseas (with her expired GC and extension letter, no I-551 stamp). Upon returning at LAX, she gave the immigration officer her passport and GC. He scanned the GC, took her fingerprints, ask her how long she was gone and welcomed her home. Didn't ask to see the extension letter. I'm assuming that when they scan the GC, it must show on their system that it is under a one year extension. Still good to have the extension letter as backup, but she didn't need it this time.

Enjoy your travels and see you back here when you return!

Thanks Greg for the affirmation! Actually, the immigration officer was/is my last concern - I am more worried about the airlines in my departing airport, they may just not understand the concept of an extension letter! And just in the worse case, to avoid that last minute stress, I wanted to do this! But you know, never say never - so for all I know, they will still harass me and I will end up trying to convince them, lol! I will let you all know once I return!

Dismissed. No fine, no points, nada.

Yoohoo!!! Glad you are out of the woods... See, USCIS is still there to protect our rights!!

Alrighty people, here is a post by a paranoid obsessive person! :innocent: I am traveling overseas this weekend, and this whole extension letter, and expired GC has been playing havoc with my thoughts! And finally, I gave in yesterday, decided I really didn't have much to lose - made an infopass appointment for today. The USCIS lady was extremely helpful, and when I stated my case, and said, I was worried about the departure airports - she herself offered to stamp my passport with the i-551 stamp! Phew, it was worth the long drive, and some additional peace of mind.

So, if you have excessive time on hand, and are obsessive as I am  - it might be worth a try! HOWEVER, I have heard only a few offices are this nice and provide these stamps - I was at the Raleigh-Durham field office which had just one free infopass appointment for today! But I do intend to keep my expired GC, and extension letter close to me while traveling! :D

Hope this helps anyone out here ... Thanks!

I actually have the same question! My guess was, from how it was worded in the NOA1, that it's extended from the conditional GC expiration date. Either way I'm hoping we're not still waiting in either October or January!

I think you are right, sounds like the GC date is moved by a year! ... I know...hoping none of us have to worry about this, and we all hear approvals before that!!

Phil never got a touch after the biometrics and still hasn't since our NOA was issued in October...

Yup neither did I! I am tired of seeing the only update on my case status, as Initial Process since the NOA :hehe: :) I do have a silly question (but someone wise once said, there's nothing like a silly question, so I will go ahead.. ;) ) ....

Our 1 year extension is that as per our GC expiry date, or NOA date?

I believe you only get the stamp if your case is still processing even after your NOA1 letter expires...or if you have to travel after your GC approval but before receiving it in hand. I could be wrong but that's what I've gathered from the forums thus far!

Thank you! That's the best sounding explanation I have heard so far! Though knowing USCIS ... you can never be sure  Yes, I do remember you too, I think we are riding together as far as our paperwork is concerned! :)

An example of what happens without the letter:

Here

Thank you Corinthians... but this is even more perplexing - of course I would be traveling with the original letter, and expired GC. But can anyone confirm - don't you receive the i-551 stamp only after your ROC application has approved???? I think that's my main question. And, how can I get an i-551 when my case is till under processing??... as they say only emergency situations get this stamp.. :help:

Edit - just happened to read this post about travel which calms me! I am worried more about the airline refusing to allow me to board than the immigration officer, is that crazy?!

Thank you SunshineFL. I have a quick question, and have been researching for a while about traveling with a expired GC and NOA1 letter. But I just read this post in the July filers, and got a little worried - July filers #737

Do I need I-551 stamp for travel now? Or is it after approval before new GC arrives? Any clarifications will be super helpful as I am planning to travel in a couple of weeks!!! Sorry if it is a millionth time rehashed question around here!!!

Hi guys!!

I haven't been on VJ for a while now, used to very regular during the AOS and EAD days, I know... bad bad! :) I wanted to check in and see where my fellow Oct filers are, and here you all are! I just updated my signature, and wanted to get my name in the running list of updates! I don't want to mess up the good work you have done here, and in my preview something looks askew .. SunshineFL or any other user, could you please add me to the list? Much appreciated!!

Removing Conditions on Residency General DiscussionCheck cashed, small problem
So will I get some sort of official number in the mail from CSC? Without this I have no way to track the case.

Hello,

CSC cashed my check and I can now see it on-line. BofA no longer sends me copies of my checks. So looking at it on-line I have discovered that the BofA scanning software sucks since I can not fully make out the WAC number. i called BofA and they also cannot read it fully as they do not have access to the real check. There is a couple of numbers that I cannot fully worked out. I tried entering every combination into the USCIS website but all of them came up as non valid WAC numbers. Is it possible the case is still not in the system or that I just have the wrong number since it is blurry on the check? Is there some other way to get the WAC number? I am attaching the questionable portion of the receipt. Anyone want to take a guess?

Thanks,

Dave

In my case, tracking no (WAC07268nnnnn) is clearly written on top of check, but USCIS tracking shows it as an invalid no. I know receipt no don't matches exactly with case no.

Removing Conditions on Residency General DiscussionChange of address during I-751 filing
Hello,

Thanks for the reply. If I understand this correctly I can either

Submit a paper AR-11 AND call the USCIS

OR

Submit a paper AR-11 AND submit the change electronically via the website.

Do I have this correct?

Thanks,

Dave

If you are not a U.S. citizen, changing your address for legal purposes does not change your address on any application or petition pending with USCIS and changing your address on a pending application or petition does not meet the legal requirements of informing USCIS of your change of address. You will need to do both. For most cases, you can now do both at the same time on our website using the Electronic Change of Address tool (available under "Related Links" on this page).

With the exception noted above, all non-U.S. citizens who move within the United States and its territories must submit a Form AR-11 within 10 days after completing the change of address. You can do that here on our website with the Electronic Change of Address tool. If you choose to use this online tool, you can complete an electronic Form AR-11 and notify USCIS to update your address on most pending cases.

If you choose not to complete an electronic Form AR-11, you will be required to obtain a paper Form AR-11 and mail it to the address shown on the form. This will delay the process of notifying USCIS significantly. Not filing an electronic AR-11 and choosing to mail in a paper AR-11 will not update your address on any applications or petitions pending with USCIS.

Regardless of whether or not you are a U.S. citizen, if you choose not to use the electronic change of address notification, you will need to call customer service at 1-800-375-5283 to request that the address on your pending application/petition be changed. If you are not a U.S. citizen, you will also need to complete a paper Form AR-11.

If you are not a U.S. citizen and you have a case pending with USCIS, you will need to do both – call customer service and complete the paper AR-11. Completing an AR-11 does not update your address on any pending case. Also, notifying customer service does not meet the legal requirement of completing an AR-11.

If you mail a paper Form AR-11, we recommend using certified, registered or return receipt mail. This is not currently a requirement of USCIS, however it is advisable to send the AR-11 by a method that will give you documentation that you did mail the form to USCIS, in case there should ever be a question.

Removing Conditions on Residency General DiscussionChange of address during I-751 filing
Hello all,

I have submitted my I-751 to the CSC. I have not yet received a case number (No NOA etc). I am now moving. I called the USCIS and got told for them to process the change of address with a case pending that is less that 45 days submitted I need to submit an AR-11 AND fill in the change of address on-line.

The website for the on-line change of address filing does not seem to match this.

Can anyone help me understand how I make sure my I-751 case gets the new address?

Thanks,

Dave

Philippinesscheduling for interview appointment
For IR-I/ CR-1 visa , i think you need to wait for NVC to give you an interview appointment, thats what happened to mine. if it's fiance visa, then you can make an interview appointment once you get a letter from the US embassy in manila with instructions.
Hope this help...good luck!

Removing Conditions on Residency General DiscussionRFE
Thanks for the replies. It is a request for more evidence. I was just confused about it after already having done the biometrics.

Big items that you'd want to include if you haven't already:

  • Federal tax filings showing married filing status (ideally, married filing jointly) covering the whole period of your relationship from your marriage to the present. Tax transcripts are better for this purpose than tax return copies, as the transcripts prove that the returns were actually filed with the IRS. Assuming you got married in 2009, you'd want to submit tax transcripts for 2009 and 2010 (2011 too if you've filed already, but most people probably haven't)
  • Evidence of joint domicile: this would include mortgage, deed, or lease documents with both your names on it
  • Other evidence of financial commingling: joint bank accounts, insurance, 401k, etc.
One important thing to note is that the evidence should cover the entire period of your marriage. For example, one joint bank account statement only proves that you had an account together for one month. Several statements from various dates show that you've held the account together for a period of time. So would a letter from your bank.

As A&B noted, being more specific as to the nature of your RFE will most likely yield more helpful answers.

Hi everyone! Thank you already for your replies. Today we got a letter from USCIS "Request for more Evidence". We originally sent several financial documents with both of our names on them, and some pictures of us and our families. I guess that was not enough. Any ideas what else we should include? Right now my only idea is a statement from family and friends saying that we are a happily married couple. I am also confused that I already had my biometrics appointment and they still want more evidence.

Alright, maybe someone can help me here, I'm pretty confused.
I went to my biometrics appointment back in January 2010. My green card expired on March 3rd 2010 and I still haven't gotten my new card. Am I illegal in this country now? Is it normal that it takes so long to get the new green card?

Removing Conditions on Residency General DiscussionAbsolutely Ridiculous..happended to anybody else?
So like 4 months ago I sent in my I-751 and had my biometrics appointment 3 months ago.
Yesterday I got a letter from them saying that the evidence submitted with my I-751 is insufficient.

Seriously, I dont know what else to send them. I sent them our joint leases from 2008-2010 (I dont have the lease contract from 2007 - 2008 because we moved), sent joint tax return, pictures of us, copies of plane tickets for trips we took together, joint automobile insurance. There is nothing else to send. We have seperated bank accounts, which we do on purpose so there will be no fighting over money, I still have my maiden name. I mean really?!? What else do they want!?!

Did that happen to anybody else?!? All I read in the forum is people getting approved..

Removing Conditions on Residency General Discussionfew questions about i-751 MILITARY
QUOTE (milimelo @ Aug 18 2009, 01:34 AM) <{POST_SNAPBACK}>
If you have a States-address put that but make sure to also add that you are currently on deployment in Germany and for how long.

Repeat this information in your cover letter - definitely about being stationed in Germany - you could put it in both header and footer if you want, together with your A#.

You will also need to send the fingerprint card and two pictures - fingerprint card you should be able to obtain from Frankfurt embassy.

Evidence-wise: DEERS enrollment, beneficiary info for his insurance, Tri-care cards, military dependant card, his military card, drivers licenses. Any mail you have received sent to both of you (postcards, greeting cards), tax returns, car-insurance cards...

Edited to say: even if you send it in September, you're still within the period to send it - 90 days.

thank u soooooooooo much! smile.gif still working on it...stressed out hope to get done with it soon...

Removing Conditions on Residency General Discussionfew questions about i-751 MILITARY
hello everyone smile.gif ! noob here, my husband is in the military and is currently deployed right now so i'm working on my i-751 all by myself and i'm all confused and got some few questions:

1. In part 1 of the form that asks for the address what should i use? ( the address in the states, where i obtained my green card or the address where we are currently living right now which is in germany) and i got the same question on part 4 (i put my husbands name on it and it asks for his info).

2. my green card will expire on oct. 1st. i'm still trying to gather more evidence that i could find (i think i'm actually short on it). i just started working on my i-751 like 2nd week of august cause i waited for my husband to come home from r&r so he could sign the form. so my question is will it be too late to file? like if i file it in between next week to 1st week of september?

thank u so much!

hi! thanks for the quick reply, i was browsing the forum, anyway, i am a military spouse, we are currently stationed in germany, i am a filipina, so what u think do i need to get a new one again? they didn't say anything about it, i was just wondering cause it was not returned with the form...i need to know cause i don't drive and would have to take the military shuttle bus that could only take u to certain places, so i would have to walk my way to the building where they do the fingerprint cards and then to the post office plus i have a 2 year-old boy whom i would need to find a babysitter for tomorrow. life is really not easy and this thing just adds up to the stress...

Removing Conditions on Residency General Discussionhelp, my I-751 application was returned
hi! i have a few questions hope someone could help me.

i just got my I-751 application returned to me from the mail today. my problem is that my green card had expired last october 1st. i sent it last Sept. 21. it says there that i did not give the correct payment. i only wrote $465 on the check, cause i called USCIS military hotline and the lady that i talked to said that i wouldn't have to if i'm already submitting my fingerprint card and passport photos with the form (cause in the instruction for the military spouse we could get our fingerprints done in the military installation near us.) i am going to resubmit my form again with the correct payment of $545 but can i still do it? i mean cause my green card has expired already.

and also they returned my application without the fingerprint card that i sent along with it, what does it mean, should i file again without it cause that is not what they need or do i have to get my fingerprint done here again?

and also about my form, can i still submit the same one, i see on top that it has an expiration of 10/31/09, u think if i submit it again it will still make it before that date? i'll send it via express mail. my husband is deployed so he can't sign it, if i would need to fill up one, he was just here for his leave for two weeks that's why he was able to sign it.

please help me...i'm working on this alone...hubby is not here to help me...i just wanna get done with this to relieve me from stress...thank u!!!

Removing Conditions on Residency General Discussionlost expired green card, would i still need it even though i have already filed my application for a new one?

I am not sure if others will agree with me, but you need to inform USCIS about the lost ID. Even though it is expired, it still has your A# on it and that is risky. In addition, if lets say sometime in the future someone tries to use it (not sure how) then you will be responsible if you do not notify them of the missing ID. Oh, but to answer your question, no, you usually keep your 2 year GC as a souvenir!

can anyone else attest to this? just wanna be sure? :)

@jarl : i know this kinda stresses me out...still no one has returned my wallet. i believe it was stolen so its not in good hands. being in a military community, i thought people would be nicer, guess not...thank u for ur concern...

hi! it's been a while...i posted a topic here before last oct. 2009 regarding my removal of conditions on residency application, and people here have helped me a lot, again thank u so so much! hope u guys can help me again...

so here's my problem:

i lost my wallet earlier today and inside it are my valuable documents such as my military id (yes, i'm married to someone who is in the army and we are currently stationed here in germany), my social security card and my green card. i'm worried about my social number too and i will deal with it as soon as i can. now, my green card expired last oct. 2009 and i have already submitted my application for the renewal of my card and still waiting for my new one. my question is that would i still need my old green card for the renewal of my new green card, i mean do i have to turn it in once i get my new one, or i don't have to worry about it cause they won't ask for it and i could keep it...

hope somebody could answer my question...thank u...
