If you only mean travel you will also need plastic 1 quart ziplock bag for all liquids ( 3 oz max) check airport rules for international flights. If you mean what to take to US it is like teapot said work history school transcripts medical history etc.

No problem. Philippine law for marriage no longer applies to you because you are now USC and in the eyes of US law, you are free to remarry.

As long as your fiancee is legally single, then no other issues.

In general yes. You can still list assets as it provides an overall financial picture but your income is high enough so no need to back up assets with docs because with high income they wont vet the assets. It really comes down to current income and line 22 of most recent tax return. I would send the first page of the last 3 bank statements anyway because its easy to get and the embassy can ask to see anything they wish, its a good idea for fiance to have a complete copy of the k1.

I have a business too and I cannot pay my fiance to work for me I can only make her an officer ( unpaid) until she has work permit. Besides, without ss# how do you do payroll? I dont know about texas but immigration is federal level not state. an immigrant can really cause themselves problems working (paid) before they have permit. If you dont pay them its not work in other words. Your family is just helping in your bar but I would research that. the weird part for me is I have to use e-verify. so someday if I "employ" her i will have to verify that my wife is legal even after all the fiance processes we have been thru.

Jim...I see what you're saying-- the CO wanted a completely separate NBI for her married name. I think that is unusual too.

It's my understanding that CO's will sometimes order an NBI clearance themselves after the interview, and not involve the K-1 applicant in the process. In your friend's case, the CO actually required your friend to submit the additional NBI clearance. Interesting.

I agree that it's better to have the additional NBI clearance with you when you walk into the Embassy for your interview. It's better to be safe than sorry.

Welcome everyone. For what it is worth it was a male CO that asked for that. Our CO was female. If we dont hear more of this than maybe no worry just he had mood lol. but it was the day before our interview so we got the extra NBI just to be safe

I will be putting up a review soon. We are approved. But for now... we were not asked for the 2nd NBI but it was included with her paperwork just to be safe. people can do as they want but our thinking it is a small cost and better than getting a 221g and delay. Augie was able to get hers in manila in about 4 hours. Maybe the CO just wanted to be sure all was checked so he did both names. My contact does this for A living and she was very suprised too when they Asked for the 2nd NBI it is not normal and there was nothing in her clients case to make them want that. I guess maybe if the next month no one is asked then it was the CO's mood that day but we wanted to warn people about what happened. Jim

Yes thats correct. It was an unusual request and thats why I am passing this info along. Its easy to get this before your appointment so we did just to be safe.

My contact in the Philippines informed me that she had a client today asked at interview for an NBI with the ex-husbands surename. Even tho she had her NBI with AKA's. So we were advised to get one before our interview friday just to be on safe side. It is unclear for now if this will be a new trend or just the CO's mood today but it is not normally asked for so I wanted to pass this on so people know. Jim.

That's counting everything-- except if you are put in administrative processing/review. If your case has to undergo administrative processing/review, then all bets are off because it could take weeks or months to receive a visa. Heaven forbid that to happen.

Chinook received her visa in Bacolod six calendar days after she submitted some documents to replace ones which the Embassy mysteriously "lost." We counted ourselves fortunate that we had to wait only six days.

I have the same problem. From what I have read 3 days is only at the pickup points like the Mall in Manila. Provinces are about 9 - 10 working days. You can try to track yours at the 2go website but they dont usually show there for about 3 days, still can't track mine yet but if you go there use your manila case number to track your delivery. Just an update, our visa was approved nov 25th. I knew my fiance the entire 3 years it took for the annulment. ( she was only separated all that time). We filed k1 as fast as we could because already waiting 3 years. They can ask anything they want of course and they did ask how long it took, what date it was final etc. It was not a problem at interview. Jim.

Tis ONE thIng is not country specific. You have to be free to marry to file.the child is irrelevant in this case.the child is a USC.
See when you file for k-1 in basic matters such as the divorce law,you have to meet the states requirements. When it comes to proving your relationship and the legitimacy of your relationship, you have to follow the home country's culture.
OP you may or may not have a problem. The CO may or may not be satisfied with your answers when they ask about your husbands past. I suggest you get ready for getting grilled and front load with evidence.

you do have to be free to marry at time of filing. The OP here said she was unless I misunderstood. Is that the problem in the Nigeria case? I thought it was more about some of their laws but I only read thru it once. I read at a US site that they follow the laws of the other country in divorce and custody.

about 3 months ago there was an episode on Nat Geo where an Australian or Brit was living with a filipina in Phil. She was separated but not annulled and he got her pregnant. the husband asked for money or he would turn them in. Long story short he turned them in they got locked up for a bit paid a bribe and "escaped", forged her passport and made it to his country. many phil family code laws came into play on this. It was why they got locked up and NO JOKE under these laws the husband could claim the child at birth. if you visit a girl there be careful. it is not something either country enforces and I have never heard of an issue at interview. the danger is if her husband even tho gone many years hears about it he can invoke the law thru complaint. You have to stop thinking by US standards and know the laws of the country you are in or petitioning. Nothing like that would ever happen in the US and I know it sounds crazy. I have no idea how crazy Nigerian laws are but in a petition the US has requirements but also follows the other countries laws on divorce and custody. Dont let that nigerian post scare you just research Philippine law or whatever country you are dealing with because its the only one that matters. the other thing to get your head around is divorce is a US disposition. Phil is annulment its very different. It is a way for the church there to pretend the marriage never occurred. I believe this is why the problem of knowing fiance before she is annulled is not an issue at interview. if the marriage never occurred then neither did the crime of knowing her while she was married because she was never married. I know it sounds twisted but get it?

to clarify ..if you were in the US already his ex wife could sue you or if he left you or stayed with his wife and did not marry you you could get child support thats about all from the US side. its not a criminal case. None of that applies because in your k1 you met the requirements and they will be following phil law of which you broke none. Its great you already have all the papers on the child. I believe this is strictly a Nigeria law issue.

my point really is that US follows the other countries custody and divorce laws. since you were not the one that was married I see no issue with Phil law. its not illegal to have child out of wedlock there. You broke no law. If they chose to follow US law well those things happen everyday here and they have no issue with your boyfriend. I think the problem is with Nigeria but thats only my opinion. I know nothing bout Nigeria law. Worse if you were the married one because they could enforce the Phil law but that is rare.) Hopefully someone who has been in your situation will reply but just relax and research ok ?

some of this is country specific maybe someone more experienced can chime in later. I hear nigeria is very strict. example..in US it is normal to be dating someone who is only separated but not yet divorced. In my case I knew my fiance while she is separated but did not FILE k1 until the annul was done. You both have to be free to marry to file. thats the US requirement I think the one in Nigeria they are just giving hard time to. I will not have any problems in my case. yours will be a bit different since petitioner is father of the child but just some different forms to establish that. someone with more experience with that will need to explain more. worse if you were the one still married as it does violate phil law but rarely enforced. meantime you can research at VJ. there was one about a month ago asking about k1 since the childs father is the petitioner. good luck

Ok I just get done calling now at the US embassy Manila there was a delay with my visa it is because my son visa issued just this December 16 the CO inform me anytime this week or next week I can recieve my visa and my son too. I feel ok now here . Thanks All here.

The only way they send you a text message is if you include the notification page with what you sent. http://www.uscis.gov...form/g-1145.pdf you would fill this out and attach it to the top of your pages. in this case then you will get a text/email message. if you did not include this, you wont get a text message.
