Yeah, I agree with above. The divorce would definitely not continue. Why should it? How can a dead person be divorced? Either way the marriage is no longer valid, so that's that! In this case the petitioner/beneficiary would show the death certificate of the prior spouse. Probably USCIS wouldn't even know that there had been a divorce in progress, and really they wouldn't need to know. The only way that it could be relevant is if the alive spouse started dating their new husband/wife BEFORE the prior one died, then they'd have to explain that divorce proceedings were in order at time of death.

As a side note, if you are asking about a K-1 visa, this is not the forum to be in. This is the CR-1 or IR-1 forum, but as this is a hypothetical situation, it doesn't really matter!

1) to confirm, you are applying for a K-1 visa right? This means you are currently NOT MARRIED, because if you are then you DON'T qualify for a K-1
2) are you divorced or did you have an annuled married?

If the answer is no, then you are single....

My fiancee just visited for 10 days from England through ORD. She was asked why she was here, she said to visit friends, they didn't ask her anything about the K-1, stamped her passport and waved her through. I doubt you'll run into trouble.



I just wanted to point out that while that worked for you and luckily your fiancee was not in trouble, that was VERY risky. If the officer saw when he swiped the passport that she had a K-1 visa pending, and she stated "visiting friends" as an excuse, he would have thought she was lying. Or, if he/she had any common sense they would have thought she was lying. In my opinion and from my years of reading on VJ (since 2005!) telling the truth is the best policy. If the officer let her in because she was "visiting friends" then probably they would have let her in because she was "visiting fiance who she has legally applied for a K-1 visa with, and she is willing to show proof of return back to England" or whatever...

I wouldn't risk it with an answer like that that could get me in trouble.

I think you pretty much got your answer, but I figured I'd add my two cents.

The K-1 visa is NOT a test to see if she likes the US and really wanted to marry you visa. If the officer heard you or her say that or even hint at that, her visa would be denied (take a look in the Nigerian regional forum for a girl that was denied for in a way round about way without even meaning to saying this). When you originally file the I-129F (at the beginning of the K-1 process) your fiancee must write a letter of intent that says that she swears that if she gets the visa, she will marry you within 90 days of entering the US. You have to write one of these too.

Of course some people probably use the 90 days as a test period and I'm sure some people never get married once entering the US, but this is not how the visa is designed and again this is a grounds for a denial of the visa in the first place. I understand her wanting to meet your family and see the US (my husband and I are moving to the states at the end of June and he's never met my family of visited the US for the same reasons as your fiancee) but that's the decision that she has to make unfortunately (if she is unable to get a tourist visa as you said). Like the other poster said, the K-1 process is expensive, stressful, time consuming and isn't going to make your relationship stronger!! Lots of people break up in the process of doing a K-1, so if your relationship is already on the rocks, the K-1 is probably not going to make anything better.

I don't know your situation, but is it possible for you to move back to Colombia? That way you guys could be together, get your relationship back on track, and then decide what to do. IF you could legally live in Columbia, you could get married there, live there for at least 6 months, and then apply DCF which takes about 3-4 months from start to finish.... just another option. Although that still doesn't solve her wanting to see the US first.

Your K1 visa isa single enntry. Since you did not get married and you moved out of US there is nothing you can do about it.You have to start all over again..

Hello. I am posting this message to seek help/assistance from anyone in North Texas (preferably Dallas/Ft. Worth area), who has successfully gone through this K1 process with a Philippine fiancee. As of the end of May, it has been one year since I visited her there in Cebu. If I understand it correctly, that means we have one more year to get an I-129f approved.

We need help on both ends... Over there, she is getting the run-around trying to have an error on her birth certificate corrected (apparently this takes 6 months). And if she can ever get that, I need to know what to tell her to acquire next. It seems everything needs a correct birth certificate there though. Here, I don't think I have ever even seen my Birth Certificate - Hmm, do I need to order one for this process too? Anyway, I need help with the steps I need to tell her, plus maybe some contacts to get that birth certificate error fixed quicker.

On my end, I'm just confused. I had no idea it would require so much time and effort when I proposed - but I want more than anything to go through with this. I plan to submit my I-129f on January 2nd, 2011 and I want to get it right the first time. I think I can figure out all my documents I need to include, but what does she need to send to me to include in the petition? I'm hoping I can find a couple (Philippine + American) who can review my packet a few times through December and make sure I am not missing anything.

She don't need to fix her Birth Certificate . I had error on my Birth certificate ,The middle name was wrong but all i had to do is get an affidavit from the lawyer.Alsoto get a Philippine Passport only takes a couple of weeks not months.Identification cards or any documents like Voter's Id, school Id, government id If wud help. Like i said i had the same issue but i sent copies of my different Id's with the correct name on it ad i was approved with no Problem.

You have alot of time to gather stuff for your package, like SabrinaFrance said- tickets, pictures and anything you have done together. see if u can put both of your names on bills, leases, etc, showing you lived together abroad. if you can get a rental in both of your names, or something, more the better.

read up on your visa's you still have a bit of time, but the more you know the better it will be for you.

Question: Has anyone had a controlled entry in their passport? Heres what happened to me: I was working in the US on a TN Nafta Visa (Work dependant) A few months after we got engaged my job was cut due to economy. I had already scheduled a flight to Canada but it was literally the next week following my job loss so I flew home and then when I went to fly back to the US they put a controlled entry in my passport. They said I had one month to return to Canada. So I went back, packed all our stuff into a storage cube and flew home to Canada on time, and began the process of getting ready for the K1 filing. So my question really is, if you have had one in your passport did it cause issues for your K1 filing? I don't think it should for me because i was back within the time limit given, but going through this is nerve wracking at best so I'd rather know the answers! :wacko:

My fiancee's father isn't in the picture at all nor is he on her birth certificate. However, if I put N/A next to Father on the G-325A, would that look suspicious? Should I attach a letter from her stating that "my father has never been in my life and is not on my birth certificate"? She got a temporary work visa when she was here as an au pair without trouble, but I want everything to be perfect.

Hello guys,,correct me if I am wrong. The Immigrant data Summary is only for immigrants bound for US. K1 and k2 visas dont have the IDS.

I came here on a K1 visa in 2007 and i Only have the brown envelope that has the warning "DO NOT OPEN ". My kids came here 2 months ago on an IR2 visa and they have that IMmigrand Data Summary right in front of the envelope where their visas and other documents inside that packet was.

Your 5 and 6 yr. old kids dont need to attend the CFO seminar but u still have to go there to register ur kids and pay the same.

My kids are 9 and 12..i went to the CFO office in Nov.18.2010 to get their CFO done..they did not have to attend the seminar..i just registered them and pay and u are good to go.

You the mom needs to attend the seminar coz it is required.

Actually, photos together are not the most important proof and won't even be considered as evidence at all unless there are travel documents proving you were both in the same country at the same time.

You could try to print out the itinerary of the 2010 flight and include a note explaining that your passport was stolen (and include copies of the pages of your most recent passport) and hope for the best?

Ok, I'm about to file for the K-1 Visa for my Fiance. I've been to the Philippines several times in the past four year's. The problem is that the last time I returned I had my passport stolen from my housing, and had to get a new one. I have the itinerary and a ticket stub from 2008, but not from 2010 the last time I was there to see her. I have letter's from her family and friend's stating our relationship and our intention's to marry, and photographs from March 2010 when i was last over there.

Is the lack of my travel proof going to be an issue for us filing? Unfortunate circumstances of course.

Any advice would be appreciated.



Not really. As long as u have met each other within 2 yrs. and u have proof that u met(Photos together) is the most important proof although the travel records helps too.

Did u file the CRBA for ur son? To make it clear for u let me say this:


If ur son's father is a US citizen it does'nt mean ur son is automatic US citizen. If your child was born in the Philippines u still have to file for CRBA in MAnila US embassy to get ur son's US citizenship and he don't need the K2.

If he gets his Us citizenship through CRBA he don't need to have a K2 visa to come to the US.

hi everyone!here's my question,my fiance filed for a k1 petition and WE do have a SON who is included in our petition.And from the time that we'll be approved,me and my son will going to apply for a visa as a k1 and k2 here in the philippines.Now,from the time of his birth his father(petitioner)is already a US citizen and signed for acknowledgement of paternity from the time of his birth(2002).and just recently we've known this CRBA application...but because its already filed this december we did not apply to CRBA anymore.

Here is my two cents worth:

How old is ur son? If u apply for your son's CRBA and gets approved then he don't need to have a visa to enter the US. He only needs a US passport to come to the US. US embassy might not give him a K2 visa if he is eligible for CRBA.

You will still get a k1 visa but like u have said the son was included in the petition already? If i were u it is best to apply for your son's CRBA to get his US citizenship even before he comes here.

I would say April or beyond, I say walk out on faith and start planning. We filed for the K1 Visa and had to apply for the I-601 Waiver also...since my husband came from Mexico, we had to be in Ciudad Juarez, Mexico for all the interviews. Nothing is free, every form you fill out is pretty much going to cost you, which sucks! The Waiver will cost you $545. Also do not lose ANY of your forms/papers that you receive from USCIS, even if it doesn't look that important, THEY ARE! If you lose anything that you might need in the future, you will be charged for another copy, depending on what you need, it happened to us.
