K-1 Fiance(e) Visa Process & Proceduresquick question
I have a quick question yes it is me again. I feel like my head has so much information in it and im trying to get some answers. Ok here goes. My friend has received his NOA2 which he filed after me and I still haven't received mine. Anyway. He said that the letter said it should be done within weeks. They send the packet and schedule an interview. Now here is my question. I am hoping that my NOA2 comes in any day now (fingers crossed) but in three weeks my fiancee has decided to come visit me because we didnt know how long the process would take. He is coming dec 24 and leaving Jan 8 just for two weeks. If my NOA2 comes in before he comes will that screw him up for an interview. And would it be schedule while he is here in the states. I know he has to schedule his medical in London and go for his interview in london which is about 5 hours from him he is in england. Im just worried now that might screw things up. And I know he would be upset because he cant cancel his flight. And if packet 3 comes to his house while he is in the states. Can we do it online and then send it to his friend in england to print it out and mail it from england for us. Wow i dont know what to do now im getting nervous can someone shed some light for me plssssss. Thank you very much.

K-1 Fiance(e) Visa Process & Proceduresaffadavit of support
Yes that is what I am thinking. See now I get the alimony and child support and with my job sends over 32K a year. I will still continue to get alimony once my fiancee lives here just when we get married I wont get it anymore. But we plan a march 2009 wedding. so up until march ill still receive the alimony. If they count it now. I haven't received my noa2 yet been a long 6 months. Im just trying to prepare when that times comes I believe that if my alimony goes away after I get married i am still 27k. Ill still get it while he is in the process of his interview so I'll have to put that in. Oh this is draining my brain. That is the only document I am worried about. Im trying to get prepared well ahead of myself. But I do appreciate your responses and advice puts me a little at ease.

Yes alimony will go away once I get married but I have been still receiving it for over the past year so that is still considered money that I have made this past year. I dont live with my mother I just live with me and my three kids.

You'll need to show income level of 31K or more (125% of poverty level for household of 5-you, 3 kids, & fiance) to satisfy the affidavit of support.

If your income isn't going to be at that level (inclusive of alimony/support) then you'll need that co-sponsor. See below.

http://www.uscis.gov...00045f3d6a1RCRD

Oh ok so I need to add him too. I make just over 31K. But that includes my child support and alimony. Can I use that. That technically is income to me. So with my job and child support and alimony I make about 32K. Is that enough. Or should I get my mom to co-sponsor me.

So if I dont need her for the AOS then I shouldn't need her the affidavit of support then right.

Okay that is a little bit understanding thank you very much. I know my mother is a little hesitate. But said use her as the last resort if she dont want to do it I can always ask my friend.

Thank you for your response but im still confused. I am a us citizen always have been. I already have an employment letter from my employer. I dont have much in my savings (don't know if that will cause a problem). I've have money in my account and can get a bank letter. I have my divorce agreement that shows how much my ex husband pays to me. I can submit that. I only made 3000 last year cause my ex husband didnt pay me and I was out of work I just got a job this year. I already got the affidavit of support notorized. So what I am trying to say I can't use that 2007 tax return cause it shows I made no money. That is my question do I have to submit it anyway showing I made no money. but have made money this year and hopefully he will have his interview way before I file for my 2008 taxes. I appreciate the details you gave me. Just thought it would be a little bit simplier than that.

If I have a job and receive child support and alimony is it necessary that I have to supply tax returns. My tax returns from last year i didnt make any money cause I was going through a divorce and my ex husband wasn't paying me the full amount i was to receive. And 2006 was when I was going through a separation so my ex husband would be on the tax form cause I was married in 2006 got legally divorced in Nov 2007. I have my employment letter I can supply documents of how much I receive for child support and alimony and I can get bank statements of how much I have deposited through the year. But tax returns will be no good for me. I thought you need tax returns if you are self employed. I already have my affadavit of support notorized which I did back in Oct. I believe with all of that I make over the poverty level. Cause it is me and my 3 children. Do I have to put him too. I am so confused about this document and stressed out to the hilt. Cause my mom said she would co-sponsor me but use her as the last resort. I am trying to do this without her co-sponsoring me I know she is a little hesitate. I live in Georgia and she lives in New York. Can someone tell me what I can do. Thank you in advance. wacko.gif

I have a quick question hope someone can shead some light for me. It has been over 6 months since I got my noa1 and I have still yet to hear about my noa2. So I decided to look at my packet that I sent seeing if there was something I missed. As I was looking through I noticed that my marriage name and my birth certificate are different I still have my ex-husbands last name never changed it to my maiden name so my birth certificate has my maiden name and all my other forms has my married name. I forgot to submit my marriage certificate to prove I have changed my name I put in my divorce certificate to show that I am legally divorced. My question is that going to cause a problem and that is why it is taking so long to get my noa2 i havent received any RFE or anything so I dont know what is going on. Should I call and send that in you think they will need that. I dont know what to do and now im worried something is wrong. It shouldnt of taken this long to hear anything. Stress and depression is killing me and Im getting worried. sad.gif

K-1 Fiance(e) Visa Process & ProceduresK-1 TOTAL COST

Just curious for those who have completed their journey here. What was your total cost breakdown for this petition all the way to your fiancee becoming a US citizen? We are now only at the interview stage of the game. Thanks in advance!!!!!

I just read this from another post which states that next year (2008), an increase is expected. bad news! Let's hurry it up folks!!!

The increases for a K-1 applicant would be as follows:

Form and amount increased/decreased:

I-129f --> $285 (petition for fiancee of US Citizen)
I-485 --> $580 (filing for adjustment of status to get green card)
I-131 --> $-170 (no cost to file or renew while I-485 is being processed; required if you travel outside the US before getting a green card)
I-765 --> $-180 (no cost to file or renew while I-485 is being processed; optional but almost always filed so applicant can work)
I-751 --> $260 (almost always required if I-485 is approved within 2 years of marriage)
N-400 --> $265 (application for Citizenship)

Total = $1,040 increase (current rates total: $1,380, proposed rates total: $2,420)

Yes, it's much safer to wait until the Visa has approved and arrived, otherwise you run the risk of having to pay to reschedule on another flight.

However, if you look on the back of the check, your number is there, and you can go to the USCIS site and track your case with it.

Hmm i dont know if i can see the back of the check on my banks web but ill sure try thank you!

Ok quick question what number should i look for? There is alot of numbers and stamps on the back of the check lol. is it the WAC#?

Yep

Ha, I don't have a WAC# on the back of mine, but there is an EAC#. The image isn't readable enough to make out the whole number.

EAC is Vermont.. WAC is California.
Let's see... "W" is west and "E" is east... Now... if I can just make it out...

Thanks

K-1 Fiance(e) Visa Process & ProceduresHow much time between the interview and actual visa

Sorry if this is common knowledge to some of the responders but I would really appreciate some insight into how much time passes between the interview and the K-1 recipient's departure on the visa? Are there time frames that apply to that? Thank you!

That might depend on the individual consulate, but my fiancee was able to pick up her passport with her visa three days after her interview. She still must attend a seminar (required by Philippine gov., not the U.S.) before she can leave for the U.S. It will depend on the consulate workload and policy.

K-1 Fiance(e) Visa Process & ProceduresReligious Differences between Fiancees

My friend's husband is Pentecostal and my friend is a Baptist, she is happily married now in Seattle. Catholic and Baptist are both christian just different ways but both non-trinitarian.

Excuse me, but the Catholic and Baptist traditions are BOTH Trinitarian, i.e., the both view the Father, Son and Holy Spirit as a part of the Godhead.

This would also include Episcopal/Anglican, Lutheran, Methodist, Presbyterian, most pentecostal/charismatic, including the majority of non-denominational churches.

The important thing is to learn of each other's beliefs, finding the points you both have in common. It can be more difficult, but it's not impossible.

K-1 Fiance(e) Visa Process & ProceduresI-134 question

You do realize that there will be several weeks to many weeks after he arrives before he will have the proper documentation to be able to leave and re-enter the USA?

Yes, it's no problem for him to take some unpaid leave from his job. If the normal three weeks he takes is not sufficient. He has workth 15 years with this company and has many benefits

K-1 Fiance(e) Visa Process & ProceduresI-134 question
My fiance makes very good money at his overseas job. He works 6 weeks, and has three weeks off. After our marriage, he wants to continue this job, and simply come here to the US during his 3 weeks off instead of to what will be his former country.

I have always made enough to satisfy the I-134, but recently resigned by job so that I could spen the next month doing some work on my home to rent it. Our plan is to relocate to another state, and I am the one making the preparations for this. In the next month, I will begin looking for work in the area of our new residence. Right now, my fiance is supporting us with his income.

It's possbile I'll already to back to work by the time his interview comes around - we are jsut now submitting the petition - but if not, will we require an I-134 be completed? He makes a 6-digit salary in euros, and has no intention to leave this job unless he had a very goo opportunity here in the states. Is this, with his large savings, enough to satisfy that he will not be a public buredn? Or is it best to wait a few months until I am working again to submit this petition? We are eager to start our married life.

I printed 2 5x7 black and white photos on plain white paper. 6 photos total on 3 pages. Each photo very clear and in distinctly different locations with different time stamps and wearing different clothes. We chose very prominent and easy to recognize land marks for each photo. Each photo had a time stamp and each page had a description on the bottom. Our K-1 visa was approved today without any questions.

Bolding mine. That's not true; I'm delaying getting through NVC myself, and the first thing I did was to pay the fees. NVC won't send the case to the embassy until all the documents and forms are in.
