I will check the county and state regulation for applying for a marriage license. For example, in Athens, Georgia, you apply for a pre-marriage certificate, which last for 6 months until you get married, then after you r married, you get the certificate the same day. Some counties have discounts (about 50% of the marriage certificate) if you take a pre-marital orientation class. Each county and state is different and have their own rules. I think it is important to do a little research to have an idea about this

I feel sorry for both - OP and her fiance, but I can't agree with point of view that only her USC fiance is guilty. K-1 process requires a lot of work, and I think it's not right to put everything just to one person. Both in couple should work on it if they both want to move together. I wouldn't feel myself good if I would ask my Amy to do all work about K-1 by alone. At the same time I would be slightly offended if Amy would tell me something like "prepare all by yourself, just show me where I need to put a signature". We have been working about everything together and we prepared our petition package together, sitting at one table, while Amy visited me for the 1st time. I hope it doesn't sound rude, but both should learn the lesson, and I sure if they will start to work together, 2nd attempt will be successful. :)


I agree with you. It takes 2 to get all this work done. At that time my fiancee and I decided to apply for K-1, I was busy teaching, taking classes and working. He was working full time as well. We agreed to schedule a time for a skype call and filled the forms together (took like an hour or so). After filling forms, I e-mailed them to my fiancee to make sure everything was correct and for him to sign them. He gather the rest: notarized-translated birth certificate; copy of passport, passport photos, proof of relationship. He signed everything and sent all that back to me. We did a last doulble check and I was able to sent everything the day after I received all the documents from him.

Without the help of my fiancee, I was not gonna be able to sent the documents so quickly.

if there is true love then nothing should matter. Also, I am sure that this is something that you and your fiance have talked about for a long time before summiting the papers.

Second guessing yourself ...not really a good sign. Maybe you are just nervous about this process, which is very long and fustrating at times.

They are going to be good and bad stories about this process. Don't rely on the bad experiences of others unless you have a similar situation or see red flags on your own relationship. I am sure you have a wonderful fiance and a great relationship.

i don't think student loans apply as income. They are merely to pay for your tuition. Do you have a job?, how much do you make a year?

You need to make sure you make over $18,000/year for the affidavit. If that's not the case, you will need a co-sponsor. Also, remember that your future wife WILL NOT get a job immediately because you need to apply for a EAD card first.

You need to ask that in the regional forum for Peru so others that have gone through the medical there can tell you. Each country is different in how things are handled at the consulate for the interview, and the medical. Mexico does not give vaccinations or a completed DS-3025 to K-1 applicants, and I think a few others do not either. I believe most do though. Like I said, just ask others that went through there already.

My embassy is in Lima, Peru...anyone out there knowledgeable of this specific embassy? Will it be a deal breaker if I am not there? It is going to be tough for me to leave work this fall...


To answer your question. No, you, the USC, don't need to be there. My fiance's interview was last wednesday and I was not there. He was approved right away without any trouble, Please read the reviews posted for this particular embassy. I just entered our experience last week.

"Court ordered" child support can be listed as an income source and alimony/spousal support would be too as long as it will continue for at least three years after the intending immigrant arrives. You would list it regardless and supply copies of the court orders unless included in the certified copy of your divorce decree.

Letters of intent need not be notarized but it won't hurt. Do have the I-134 notarized.



My child support will go on until all my children reach the age of 18 and they are 13,8 and 7 but my alimony will be gone once me and my fiance get married. But that is okay cause I make up for that with me working. But thank you for letting me know i appreciate it. I have all documents is they need evidence of how much I get from my ex-husband.

Thank you very much for the insight I will definately look into it more. I dont know how long I have until the NOA2 comes in and what other paperwork I will need. Since it hasn't arrived yet. I just want to be prepared and get it out asap but not make any mistakes. And i am not good at filling out paperwork. And I don't know what he has to fill out. We just dont want to make mistakes.

My fiancee and I have been together for over 2 years now. We try to see each other often. I should be getting my NOA2 any day now. My first question is the affidavit of support. I live in the USA and he lives in the UK. I have a job working in the school system but I do receive child support and alimony for I have three children. Does that count as income. Even though I work full time i make okay money. Does anyone know about that. And second he wants to come and visit me for a couple of weeks but dont know when anything else will take affect like the medical and how fast the process is after I get the NOA2. If someone could help me I would greatly appreciate it. We don't like being apart from each other for very long. And can't wait until we are together forever.

Just wondering how many steps are there in the process. Received my NOA1 june, 24, 2008 and waiting for my NOA2 any day now. What do they need for NOA2 so I can prepare and send that out immediately and what else will I have to do after that is over. Just want to prepare so I can get everything out asap. Also what hard copies does my fiancee need for him. So I can send them to him but he may come to visit for a bit so I can give him while he is here.

I would think that they base their decision on the relationship itself. They want to make sure that you are both in good faith and that it is a "real" relationship. That's just my opinion.

They also check for the legal stuf such as if you can both legally marry and if the partner coming in has a record.


Well then we should have no problem we talk every day with each other it is a real relationship we dont have criminal records and we can both legally marry. Just cant wait for the day we can spend the rest of our lives together. Thank you for the response.

If you have a look in the UK Interview Thread in the UK forum you'll see all the people that have been approved this year. Hopefully it'll put your mind at ease. Some have been in and out of AP but no one has been denied yet. It's also a good place to find out why some people were or are in AP.

While that is all important, FINANCE is major as well. You must meet the 125% above the poverty line criteria, or have assets to make up for the difference. Or you must have a co-sponsor who can meet these requirements instead. That's a must. If you have all that squared away, and the proof of ongoing relationship, etc., then you should be all set. It's not abnormal for your fiance to be worried. Before my fiance received her visa I was stressing and worrying over everything. Basically I was inventing reasons that my fiance would be denied. A way that I was able to calm down and stop worrying was to THINK LOGICALLY and think straight. I mentally went over the requirements, and asked myself "Do we have all these requirements satisfied? If so, then you'll be fine". It helped, and after I did that I didn't worry about it again. AND I'm a huge worry wart.

I am a big worry wart myself. But we have everything we need I believe just waiting on the NOA2 to come in. But I believe that with my job and my child support and alimony we be fine if they dont except the child support and alimony which I will lose once we get married I have a co-sponsor that will help us out (my mom) lol. But i still have child support that brings me over the poverty line and my job which I have a letter from my employer. Affidavit of support isn't needed until the interview stage. Please start by studying the K1 Guide. Most of your questions will be answered there.

File your ITR for 2008 as soon as you can as the interview probably won't be until 2009.

I did file for the itr cause i am head of household in 2007 I have three children. 2008 will be different and show i am make more money but my NOA2 should be coming in soon and my finacee should be here in Jan - Feb so i wont have my 2008 taxes filed yet. Is there a way I can avoid giving them my 2007 taxes and just give them bank statements my divorce agreement which shows how much money he gave me and my employer letter

Ok but my 2007 tax return only shows I made 3000 dollars for the year cause my ex husband didnt start paying me until Nov 2007 it was a weird situation we were separated but he still lived in my house until april of 2007 when he moved out he didnt pay me child support for 3 months when the divorce became final that is when he started paying me what he was suppose to. So I had to claim just want he was had given to me because I didnt have a job.

I filled out my affidavit of support. I have a job plus I get child support and alimony which I dont know if they will except the child support and alimony if they do then I make over the poverty limit. I just want to have enough for my fiancee to get accepted. Im a big worry wart. And i want to be prepared and make sure they have enough of what they need.

Does anyone know how i can get a form for a co-sponsor. My mother is going to co-sponsor me and i want to get forms for her to fill out. Because i wont be able to submit my tax returns but she can. I have a job but recently got it in August. And i didnt make much money last year for I was divorced but get child support and alimony. I have a letter from my employer and what do I need from my bank statements what does it have to say.

It took my husband and I 8 and half months to receive NOA2, while other people got their NOA2s a lot quicker.
There was nothing wrong with our application either though they RFEd us for them losing our passport style photos.
I was the one who was posting the similar message to yours about half a year ago.
So, I feel ya...
But, I am here in the U.S. now after all. So, your day will come for sure.

The good thing is that once you receive NOA2, the process goes a lot quicker.
We received our NOA2 late June and I was already in the U.S. the first week of August.

I want to thank everyone for the encouragement it means a lot to me. We are already talking about our wedding date and getting things prepared. I just hope things just go smoothly and I will be hearing something soon.

It's a torture I'm dreading, so understand your frustration. From what I've read, once that NOA2 arrives, it's all systems go especially with the London embassy. Make sure he puts a planned departure date and wedding date when responding to package 3 (I believe it makes a difference to how quickly you get an interview!)

Have you got all your paperwork together for the interview? Can you start planning your wedding at all? Set yourself a different goal to fill the days as you countdown and each week gives you a yay instead of a 'bother, still no news'. For example, my torture right now is waiting to see him again (we can't file yet until my divorce is finalised). This won't be until end of March, so I've decided to concentrate on working out and losing the weight I want to before we get married. I know that we have just under 19 weeks from now and each week that I lose, I feel like I've at least accomplished something! That'll go to hell when Christmas gets here, but still...

Thank you I found that out about the doctor he is going to go to his regular doctor to see if he has all his vaccinations up to date then go to the embassy doctors for his medicial.

Make sure he brings some proof of ties to his country for the POE just in case. They can refuse him entry and you don't want that to happen. I took a letter from my employer saying "scheduled leave from work", copy of my mortgages, car payment etc. He may not need to show any but good to bring with him.
