The K3 will probably be at your embassy in a couple of months. But it will probably take 3 months or longer to get the CR1 through NVC even if you use Jamses' shortcut. My suggestion is to have your spouse contact his Senator or Congressman and explain your delema with your kids I-130. It is possible that the Senator or Congressman could speed the approval some. K-3 Spouse Visa Process & Procedures	APPROVED YESTERDAY	Hello Our I 129F got approved yesterday, by October 29, basically what are my options now? My I 130 was approved on July, 2, and I also received the IV bills in August, but I was waiting for either this form to be approved or the I 130 for my kids, which were received on June, 22 at CSC. Now my question is: it is possible for me to get the both visa here K3/K4 and the CR1 in Switzerland? My question is because with the CR1 it would save alot of money, but if I wait for the kids I 130 to be approved and then come to the point when mines is, it will be too much time and we(my husband and I) have been apart for so long! Rainbow, no I didn't yet, in the package i got the instruction letter with the case nr assigned, the DS-230 forms, the 156 forms, I 134, list of doctors in Switzerland, list of photographs, etc, the letter to sent it back to them, signed, dated, etc so they can proceed further, I have mailed them today the DS 230 forms along with the letter signed and dated, and I made an appointment for the medical examination next Friday in Bern. I will post more next Friday. I got the police certificate, and everything else i might need. I also emailed a form of the I 134 to my husband, and wait for him to send me the exact copy of everything we sent ( package I 130's and I 129F) along with the approvals. As the medical exam results are going to take around 2 weeks, and as most of doctors are not working between 20 Dec to 5 Jan, I wanted to have enough time to do all and try to save a month or more. In Geneva, the doctor assigned is having a break from 20 Dec to 5 Jan and he couldn't give us an appointment till 10th of January.... I decided to go to Bern. If you have a K3 visa, your child has a K4 visa. You have one petition and two visa applications. If you have a CR1 visa, your child has a CR2 visa. You have two petitions and two visa applications. First you each have a visa. Then you leave together. In the CR1 scenario, you can leave together, provided the child's visa is issued within six month of your own, and you haven't already left. Hi Donchelle, The I 130 petition gives you a CR1 or CR2 visa which is an individual visa based on one beneficiary. The 129F petition is a family based petition and is for the spouse and their children. In order to be able to bring with you your child you have two options: you wait for your I 129F to get approved and therefore you will get a K3/K4 visa for you and your child, or you wait for your child's I 130 to get approved and she will travel with you on a CR2 basis.You can not bring your child with you if it is only yours 130 that get approved, this situation will put you in the horrible deal to leave the country without your child it is better to wait for the I 129f to be approved and leave the country together. My husband faxed to them the whole divorce decree and I still waiting for mine to arrive by mail from the city where I was living and got divorced 15 years ago. At soon I will get them I will send it and then I will be waiting for the visa. I have never thought of that. I can not believe that. I got a letter today saying that under 212 g they are not able to issue the visa until the missing documents will arrive to them. I called today and he insured me that once they will have all the papers they will issue the visa and I will still able to join my husband in February 08. I was very surprised because everything was so easy. Not too many questions, not too many suspicions... the only questions was about me (name, city of birth), my wife (her address, her job) and our relationship (for how long we are married, for how long i intend to stay in the us, if i'll work). my advice... relax! it was a little chat they asked me if i carry any food or alcohol, but they trusted me without any check of luggages (btw i had 2l of wine and some traditional cheese). Anyway... the fact that i had a K3 visa and immigrant status mad that entry so easy. Be calm, be natural, be honest and everything will be perfect. Now...about American life... is so very different than the Europe. the first thing i notice here is that the people are smiling all the time, they enjoy every minute of their life, they are relaxed... and they thank for everything. the driving is a pleasure... shopping too... and the beer is like tea so very light... As far as for your AOS you should file as soon as you can for it, and once you get the EAD then you can file for SSN. I still need pics for the interview, hope i will manage to have it done before the interview ..... My husband sent me copies of every form or notice for/from USCIS it will be here next week. I still very stressed about the pics... I will keep you updated next week. Hi there, I think she should wait, excepted you are in a kind of life or dead emergency, and maybe just ask the embassy if she is allowed to enter the US with a tourist visa while her case is pending. I also have two children that are permanent resident. Do I send their applications at the same time with mine or do I have to wait? Thank you, Andrea Thank you for each of you who took the time and offer some guidance. Things are looking clear now. I will file the N400 for myself in two weeks, once I get the certificate of naturalization and the passport then I will file their N600, get their US passports and after that I will renew their swiss passports that have expired. Since Switzerland issues passports for small kids valid only 5 years and I would have to return the expired documents to the Consulate, I will keep them until the whole process is finished in case someone has any type of question or wants to see a stamp, visa, etc. Again thank you for the clarification, your help has been very much appreciated. US Citizenship General Discussion	Procedure to apply for US citizenship for a child that is a permanent resident	Children under 18 are not eligible for naturalization as such (i.e., they cannot file an N-400 application as being at least 18 is one of the requirements for that process), but they are eligible for citizenship through a naturalized parent if "At least one parent is a U.S. citizen, the child is currently under 18 and residing in the U.S. in the legal and physical custody of the U.S. citizen parent pursuant to lawful admission for permanent residence."
