Not for K-1, not until AOS (adjustment of status)



There are specific ones that need to be done prior to/during the medical. Those that are not done will get a blanket waver by the Dr. for medical reasons (such as a three shot series that needs 2-6 months to complete). Now the theory behind that is that you will need to finish them once you get to the u.s., but most of the time the original medical form is good enough for aos (that is time dependent on when it was done and when it is used for aos). Do you need to finish the shots? Some of the new ones are worthless (like the cervical cancer shot for anyone older than 13) and can pretty much be ignored... but others like hep A and B should be done even if you are already a usc and not doing it is just plain stupid. It is pretty good for the most part, my wife is from Chengdu and super picky about food, but finds this place alright. There is another place outside Miami that is even better, but real sichuan food is almost impossible to find in Florida.... and I am sure your wife will complain about it after awhile lol. But we will most likely be moving to texas or cali next year... so I am hoping things will get better with regard to food.

If she can speak English there won't be a problem, what is a problem is the lack of real Chinese restaurants in Tampa Bay... although we finally found a semi-real sichuan place awhile back.

You are taking a route similar to what we take one or twice a year (Chengdu to tampa... and will do again aug 29) My wife's English is really good so she has no problems, but some friends of ours don't speak any english and the trip was hell for them.... They got lost at least two or three times in the airport, wasn't sure what immigration officers were saying, and just got generally scared. My advice: Go with your gut feeling, if she is a smart girl that knows basic english she will be fine... but otherwise PLEASE go back and get her. What happens if a flight gets delayed or a gate changes and she misses everything? It just isn't worth it for someone that doesn't know basic english.

My experience with Chinese documents and universities in the u.s.:

1. The "company" that the university uses will want to translate it... or they will just accept it as is if the original has English on it (We experienced both)

2. Most states allow your wife or son etc to "ride" on your residence status for tuition purposes.

3. Although most universities will accept the credits for general hours... you are going to have a hell of a time applying anything related to your major. My wife was forced to retake marketing, business environment, etc just for her OUT OF CONCENTRATION.... let alone her major hours. Although the university did accept it for general hours (lol she has almost 150 hours for a B.S. now)

4. Even though her English is super good... she still has problems from time to time so you better be ready to help out all the time even if your master thesis is due next week...

This doesn't exist in most urbanish areas... although it does in many rural and minority areas, and dates back to the dynasty era (and even that changed back and forth between who was paying whom). You can get in interesting situations though, considering that in China the guys family should be paying the wedding etc. I never have any problems with her family though... even though some of her uncles are poor they still give me money or buy me stuff from time to time. I would say that they treat me better than an American family would normally treat their son-in-law. But I always spend tons of time in China and got to know them personally over the last three-four years.

Yeah we got married in the u.s., I contacted them and they said most likely I could get the 2 year visa, but it all depends on how the consulate is feeling that particular day and hour... I could end up with anything from the full 2 year visa to a 6 month visa.... we all know what the communist government is like :( I saw on another post you were in chengdu, are you still there or back in the u.s.?

I didn't go through houston, but I was able to get a 2 year multi entry 180 day visa in January through washington. I had to show the notarized copy of our marriage book in order to get it. I think I sent a notarized copy of her passport as well. Basically they wanted proof of her citizenship and proof of our marriage. I used Oasis China Visa in DC for this. Wow, that would be perfect since it is highly likely I would be going back to China within a year after this trip. Last time I sent in a copy of our marriage cert and her passport but they still put the 60 day stay on there. We never got the marriage book (just a standard u.s. cert), is it even possible to get it when we go back to china this time? I have always wanted to have an official document in Chinese that they are familiar with since you can always run into trouble in small towns with hotels (although that is getting better with each passing year).

The last visa I received was about a year and a half ago (one year, multi, two months per stay), but this time I need a single visa for at least 4 months. Sorry for the late reply I just got back to China and have been really busy. About the stocks, I know we were able to get stocks for half price at a joint Chinese-American broker after we showed him her GC and a few other things that linked her to America. I can try and figure out exactly how it works if you are really interested, all I know is that we got a really good price on stocks that were dependent on her status as a GC holder, that even an American couldn't get.

So you think that my fiancee won't be able to get a 1 day passport/visa from Japan to go on land when we dock in Nagasaki, Japan? She will need to stay on the boat?

On another topic, when we get married after getting a K-1 , she would be considered a Chinese yet or she would be an American after we get married? Sound like a stupid question that I should know the answer to but after reading your post, I don't know.

If you can work the cruise into a group tour she would only need to provide 10,000rmb "promise money" and the visa would likely be approved for Japan and other countries like Korea. The Japanese consulate in China does not accept non-group visa applications, a group has to apply for you and if you are seeking a personal visa it is 99% likely to be denied... but you are on a cruise so it wouldn't apply in this particular situation.

Once you have a GC, visas to so so and below countries are pretty much guarantied, but for first world countries like Japan, U.K. etc etc, they will want you to prove at least $5,000 in the bank before they hand you a visa. But that is still a big jump from what a person without a GC needs ($50,000, house, car, etc).

Oh and like someone else said, she is a Chinese until you do citz in America. But a Chinese with a GC is considered a "Super-Chinese" by those within and outside China... so things get a lot easier as far as jobs, visa, etc go... for example with a GC you can buy special stocks that only GC holders can buy in China (a much lower rate).

Most of asia can be seen on your own, Korea is hard, Hong Kong is easy but you have to join a fake tour group (u won't ever see the group except to cross the border) and is pretty cheap.... Japan does not give Chinese personal visas (unless u have a GC) and u would have to go on a very restrictive Chinese group tour.

A Chinese passport is pretty much worthless, everyone will want tons of money and/or you in a group in order to go. Even student visas require at least 350k yuan to be approved, a million for the u.s. We were in South America last year and were restricted on where we could go simply because we didn't have time to apply for 10 visas....

The overall percentage of denials of B visas from China is not nearly as high as one might expect - in reality the overwhelming majority of those who apply for them are approved. Official State Department statistics show that the refusal rate for B visas in China has been steadily decreasing every year for at least the past 5 years. In 2006 the B visa refusal rate for China was 24.5% however in 2010 the refusal rate had dropped to 13.3%. Granted these rates are based upon on all B visas (B1 & B2) however this is very encouraging news for our families.

That is good news, but when you consider the fact that many visas are given to tour group members or businessmen who make regular trips it isn't as likely to be approved as the numbers suggest. Nevertheless, I think within the next 5-10 years things should start to get a lot easier... at least I hope.

The entire system is messed up, my mother in law and sister in law (she is a twin) got denied two years ago and they just wanted to go to our wedding. The visa officer looked at the I-134 I signed and asked what other countries they had traveled to before saying you are denied.... the whole thing took 45 secs. I understand her sister but her mom doesn't make any sense.... I contacted my congressman and was told that many relatives in China get denied because the consulates have to be overly protective and all she could do was make sure they look at the documents and at least consider it... BUT at that point I was so pissed about them throwing away $300 is visa fees that it wasn't worth it. Her dad is going to try and come in May, but I am fairly sure he will get approved since he is a doctor and has much more money in his name.... but you shouldn't have to be rich to get approved. I have had friends in China that had their 90 year old Grandma apply for a tourist visa 4 or 5 times to see their new born kids in the u.s. and get denied every time and told "just apply for the green card old lady... you would already be in the u.s."

The "fat" thing is cultural and not overly something to worry about. I remember a couple of years ago when I was 22, 5 ft 11, and only weighed 148lbs and a friend of a friend called me "fat". Everyone complains about each others looks, since in this day and age we often do need to get healthier.

BUT what really stands out is the whole "not talking" thing. My wife made it clear from the first day we started dating that if you really care about someone you would find the time to at least send a text message or something, how hard is it to pick up the phone and say "how are you doing"? We used to take turns traveling on buses and train to see each other in China, or stay up late or wake up super early to talk online after we had to be apart. I like to sleep later than anyone (and she is almost as bad) but we could still wake up after only a few hours sleep and talk. It sounds like she is just riding this relationship out to see how far she can go, or is super depressed and not happy with you. I would find out if anything is going on and go with your gut feeling. Everyone has times when they just get depressed and don't want to talk, but an extended period of time is not ok.

Which line you use as a K-1 depends on how busy they are. If the u.s. line is not busy they will send you there, if not you will be in the foreign line (like we were). Airports are all diff and also add to this... As a couple we have been through the u.s. (90% of the time), foreign, and even the diplomat once when we were in a real hurry.

Yeah the D is like a cr-1 which gives you access to a chinese "green card". But the real problem is the Certificate of your residence approval. From my research it appears they only issue them to people in wuhan and beijing (weird I know). I don't know when we will move back to china, but I don't want to be bogged down with a stupid company or worse... an english school.

My wife is from Nanning, but she has lived in Chengdu ever since my first trip. Of all the places I've been in China, Chengdu is by far my favorite. I can spend all day just hanging out around Wenshu or Chunxi Lu watching the people.


Plus you live in Tulsa, if I had to say I am from a particular state it would be Oklahoma, I spent a good amount of time growing up near Ponca City. I am still a sooner fan even though I go to the University of Florida... Haha

Ar-11 is only for people in the u.s. you need to call nvc and see if they will change his address (most of the time they won't) and tell you to send a letter to them (they do accept change of addresses by mail unlike uscis service centers). But many cases aren't there long enough for your letter to arrive before it gets sent out. If that happens (like in my case) the embassy will end up sending info to the wrong address but will send it to the correct address if you let them know. So don't worry about it, even if it makes it to the embassy with the wrong address everything can be fixed with a call/letter to the embassy. Also if for some reason you move to another country like we did you just need to have the embassy forward it to the correct embassy, so even in the most complicated nighmare it will be fine smile.gif

I was wondering if it would even be possible for someone to come here when their usc is in prison? What could they possibly ask at the interview, how many times did you see him last month? I mean the conviction will be hard enough to deal with not to mention proving the normal "we are a couple" stuff that everyone else has to go through. I really agree with just getting married and waiting for two years so you can avoid aos. Lets say you are able to get by at the interview in Canada... but then a real hard liner at the local uscis office doesn't like the fact that he went to jail and denies. You admit that the road ahead will be hard, so why not get through it without government intervention by waiting for two years? On the bright side... you have two years to prove to his grandma that your relationship is real and strong and worth supporting.

At least now we TRULY have the proof that they've f*cked up big time and rest assured... It's not going to just end here, oh no... Someone's going to be held responsible for all this bull we've been through ever since we filed our papers - which by the way were done FLAWLESSLY. We did everything by the book, they messed up and they're going to be held responsible.


Wow, I have heard of a few cases getting lost but never just 100% turned into a notebook..... I hope you got it on record and get it fixed soon.

Congrats on being here :)

First, head on over to the AOS thread mentioned in my signature. That will help with required forms :)

To answer your qns though:

1. put unknown and unknown. There is no issue with this because of the exact reason you mentioned, emergencies. Some people actually have trips planned, and the form's also used for re-entry permits etc so writing Unknown for both is fine (got mine no issue)

2. the DS-3025 is the vaccination copy that you got from your panel physician in Australia. If at the bottom of the form it says "complete" you don't need to see a CS (civil surgeon) but if it says incomplete (which mine did) then you will need to see a CS who will complete form I-693. They will not complete it all though (have a read of the instructions, it explains it in the FAQs on the form about a K1 not needing a new medical). You will only need to complete Part 1 (about you), Part 2 (Vaccination table only) and Part 5 (their signature). That's it. Some CS's don't know this though so if you have to call one ask for the cost of "vaccination transcription" and hopefully they know what it means. Should not cost more than $50 for it and you DO NOT need a TB skin test. The price doesn't include any shots that you might require though. Sometimes they have the forms in their office so make sure you ask whether you need to bring the form in, or if they have the most recent copy.

3. No. You have to go to the SSA yourself and apply. You can find the form SS-5 on their website and you can complete that, take it and your passport with K1 in it and you're good to go. If you're married you can TRY and get it in your married name but a lot of people have had issues with that so first you should get it in your maiden name because it matches on their system. Then when you get your EAD you can go and get it changed. For AOS purposes you don't NEED a SSN, and if you have one in your maiden name but complete the AOS forms in your married name it's not a problem (mine is still in my maiden name because we just haven't had a chance to get down to the SSA).

The reason i ask is becuase i thought you also have to go through the name change process after you get married and i might not have done that before i send off AOS?

Hey guys,

I have been here in the states with Kelvin now for 6 weeks and it feels so good to be together again! :-)

We are getting together everything we need for the AOS but we just have a few questions that hopefully someone will be able to help us with:

1. We are applying for the EAD and AP with the AOS. For the AP form, it asks the expected date of my travel and the length of the trip. I am only applying for the AP in case there is an emergency or something back home and i have to travel back to Australia, so what should i put for this question?

2. Since I am a k-1 visa holder it says you do not have to have another medical exam since it is less than a year since i had the one for k-1 interview. But i did read that you are still required to see a doctor and show proof of your vacinations becuase the doctor still needs to fill out part of the medical forms. Is this correct, do i have to see a doctor?

3. Lastly, Do you receive a Social Security Number when you file for the AOS or is this something that you have to apply for after the AOS?

Any help will be very much appreciated.

Personally, I would take the short delay to make sure the documents were correct because the risk is there is a longer delay later if the letter stating it was a mistake is not accepted. Then again, it could be fine...


We decided to take the short delay and get the letter resent. We didnt want to take the risk of not having everything in order. It arrived in the mail today, so now we just have to send it all off :)

If the NVC confirmed the e-mails of both myself (petitioner) and the beneficiary, is it likely that we will BOTH receive an e-mail from the Sydney Consulate with Packet 3, or is it only sent to the beneficiary? Also, if they send an e-mail with Packet 3, is a physical copy still sent to her address? We're a little bit concerned because she has been having troubles with her e-mail lately, and I really want to make sure nothing has been lost, especially because there is no definite way to see if the consulate has received the package from the NVC or not.

She sent an email to the SydneyIV@state.gov e-mail address asking for the case status, but didn't receive the automated response back, and then 2 days letter receivd an e-mail saying it was undelivered and her e-mail servers were having trouble delivering. I just really don't want to the Packet 3 to get lost in the e-mail.

The NVC forwarded the packet on June 3rd, so maybe its a little bit too early to be concerned, but we haven't heard anything so we're just a little concerned. Especially since she just gave her 4 weeks notice!


Our packet 3 was sent to both of us, so hopefully you should both get it too. It also took the consulate 1 week to send us packet 3 from the time that the consulate received our file from NVC.

Hey guys,

Thank you for clarifying things for me about taking a copy of the I-129f package to the interview.

Now i have another problem. I just received a package in the mail from my fiance containing the I-134 affidavit of support and supporting documents. I was looking over everything he sent and i realized that the letter from the bank says that the account was opened on May 26 2010 (the day the bank wrote the letter for him) when in fact it was suppossed to state that the account was opened in May 2009. Is this small mistake a problem? We also have bank statements from each month showing activity for every month dating back to May 2009. So is this enough to show that the account has really been open for a year? Or are we going to have to get a new letter from the bank?

We were also thinking maybe we could get an email from the bank stating that they made the mistake with this date and just attach the email to the letter from the bank?
We are hoping that we dont have to wait to send the letter all over again because as soon as we receive packet 3 (which should be any day now) we want to send it back straight away. We are hoping for the earliest possible interview date as i am trying to leave to be back in the states by the end of June.
However, if a new letter is essential we would rather wait for it and know that we have all the requirements in order. What do you guys think?

I am very confused now!

What do you mean by we need all the oroginal documents of the I-129f? Do you mean we need to have the I-129f form and the G-235A etc to take to the consulate aswell? How do you get the oroginals of these when they were sent to USCIS? Do we need all this for the I-134?

YAY!! Congrats!! I think we all understand how you feel now you have NOA2. For a while there you can't help but think "have they forgotten about me??" but now you're just SO close to being all done with it :)

1. Nope :)

2. Just the letter from the banks and job. If it makes you feel better to take them though (the payslips or tax returns or anything else you have), take them to the interview, they're not needed but just in case they ask (which I honestly doubt!)

3. DS-230 Part 1 yep. Part 2 isn't needed and yes you can send it all together :) That's what Astrid AND Terri did I believe. My stuff took a little longer to come together. You should hear about your interview a couple of (business) days after you send P3 back.

4. About 3 weeks when I was booked in. I think Terri got it in like a week or something. So honestly I think it's anyone's guess, probably 2-3 weeks though.

**Edit - now would also be a good time (if you haven't already) to get all the relationship evidence together. Like phone logs, chat logs, emails, letters, photos etc. If you're anything like us they probably won't even look at them but you know if you don't have it they'll wanna see it :)

Also, start looking into hotels in Sydney unless you live near enough to stay/drive. I wouldn't personally fly in the day of the interview. There is FAR too much stress involved if your flight gets cancelled, and then delayed twice making you over an hour late for your interview :S

We are so exited now. I really want to call the NVC to see if our case is there but im trying to hold out a few more days (i barely have any patience left in me!)

We should hopefully have all the required documents ready by the time we receive packet 3, so i think i will send it all in together along with the DS-230. And for the I-134, i think we are just going to take the letter from the bank, letter from the job, and pay slips. Im hoping i can definitely get my interview by the end of June becuase it is my fiance's birthday the first week of July and i really want to be there for it :)

So when we send back packet 3, do we send in the I-134 and our medical results, or do we take these to the interview with us?

Hi Everybody,

We finally got our NOA2 yesterday after 116 days! We are so happy :yes:

Now we just have a few questions about the next steps.

1. Does the I-134 affidavit of support need to be notarized?

2. Vanessa, i know that you told me earlier on that you did not take your fiance's tax returns with you with the I-134. We have bank statements and a letter from my fiance's job showing that he makes over the poverty guideline. And that is all that the instructions on the I-134 actually ask for, so im hoping that we will be ok with that. Vanessa, did you also take your fiance's pay slips, or just the letter from bank and job?

3. Also, i know that once you receive packet 3 you have to immediatley send back form DS-230. Then once you have all the other documents ready you send them in to show that you are ready for an interview. My question is, If you already have all the documents ready can you send everything immediately along with form DS-230?

4. Lastly, does anybody know what the current wait time for an interview is once you send back packet 3?

Well, it has been 105 days for us now and..... still nothing. What are you doing VSC? We are praying that we receive the NOA2 soon!
I have my medical on Tuesday, so atleast i think we will be ready for the next step... when it comes.

Hi!

For your medical, it depends on your doctor as to whether you can have your medical without your case number. For example, Dr Yates in Brisbane will not do the medical without the case number. Which state do you live in?

For Sydney, I only showed Alex's last tax return, which was his 2009 tax return. But, he has been in his current job for five years, so what he makes has been constant. I also had three months worth of his payslips, his employer letter and his bank statements. At Sydney, once they see that you make more than the 125 percent, they are satisfied. I think they just looked at the affidavit Alex did and were satisfied. But, I think you could submit all three years and they won't ding you for it.

I live in Alice Springs, Northern Territory. And the doctor that i am getting the medical done by is the only doctor in the Northern Territory qualified and permitted to do these medical exams. So i am thankful that i dont have to travel to get it done!
I will inquire and find out if he will do it without the case number. Hopefully he will because he is also a family friend, he actually gave birth to me :D I guess thats the advantage of living in a small place!

Since we have no problem showing that my fiance is currently earning over the 125% line, hopefully everything will be ok with the i-134.

Hi everyone,

We filed at the Vermont Service Center in January and are currently waiting for our NOA2. VSC is currently processing January filers, so hopefully anyday now is our day for NOA2!

I just found this Australian beneficiary topic and i am so glad becuase i have a few questions about getting ready for P3 and the interview.

I already filed for my police certificate about 3 weeks ago, so that should arrive soon. I have booked the date for my medical which is on May 11. It was very hard to get an appointment and i am wondering if we dont have the NOA2 by this date (hopefully we do, i a getting so anxious for it!!) can i still go to the appointment whithout our sydney consulate case number?

Also, in regards to the i-134 affidavit of support, is it necessary to have my finaces last three years tax returns? He is currently in a job in which he makes well over the 125% poverty guidelines so getting the letter from employer and bank statements are no problem. However, last year he was unemployed and his tax return for that year does not show that he made over the poverty guideline. Is this a problem? Does it only matter that he is over the 125% poverty guideline now, or does he also have to show that he was over the guideline in provious years?

I have read through this forum and you all seem so helpfull! Your responses will be much appreciated.
