Removing Conditions on Residency General DiscussionWhat happens if I do not want to remove conditions?
This is what I would do... and in this order.
1. Get her off of everything I own (car, bills, credit cards, ect)
2. Record some of her harsher comments.
3. Let her destroy some things and get it on video.
4. Call a lawyer and present all of this and your story and hope that the courts rule in your favor when you two go your ways.
5. Let her deal with uscis on her own.... if she can prove it was a good marriage she will be able to stay and if not she is gone... but you have no part in that.... let uscis deal with her. You don't have to file to remove conditions.... she does.

6. Have a party with my friends when she is A. Out of my house, B. Out of my country, C. Both

Is it a fact now that you can't pursue a GC outside the US? This is the way I got mine via the US Embassy in CH, way back.

As of today the only way to get a greencard "overseas" so to speak (you would receive it after getting to the u.s.) would be the cr1 or ir1 (or dcf which is the cr1 visa, only put on the fast track). Because they have been married so long they could do dcf which would result in an ir1 visa in a matter of weeks. But the main concern here is that it would delay citz by three years. Most people simply want to get to the citz part so they can get rid of all the immigration trouble. If that really isn't a concern just forget it and start over via dcf when your ready.

First of all "he" can't do anything, as far as your future in America he has no part of it. USCIS will now become your number one concern, not him. If you want to stay you have to prove that you married him for all the right reasons and prove you didn't for all the wrong reasons. If you can do it, it doesn't matter if your still married or not.

I've never checked on ship travel between the two locations, but when you say a few days, I think you should be saying a few weeks. It is a long haul by ship. As far as I know, the only ships which travel that route are freighters, which may have a few bunks for hire, but I'm quite sure they will not have a doctor aboard.


There is a cruise ship that takes 10-12 days from I think Was. to Japan. Search on google for "cruise ship to Japan" or something like that. Back in Nov. I was thinking about heading to Japan and then on to China, but the one way ticket was $1000 or $1200 plus the $150 boat to northern China... compared to just $1050 for a round trip ticket to beijing.

Don't they have boats from the Phil to the U.S.? I am sure you can get something to South Korea or Japan which I know for sure has trips to the west coast for something around $1000. With her still being a ways off, I don't understand how spending a few days on a boat could really cause trouble.... and they often have doctors on those boats anyway.... something to check into at least.

The thing is, there is a different link to fill out an I-865, which isn't the same as a change of address or AR-11. I'm pretty sure I have to send the I-865 in, and that the AR-11 is just for my husband. Am I wrong? Or do I have to change my address online and send in the 865?


Currently they make sponsors send in the I-865, but I think they are working on making it an online service too. So hopefully that will get up and running soon... But of course it has to happen after I send in the I-865 as a sponsor...

Alright, thanks for the replies. We are never gone for more than a few months, and will be sticking around here for at least the next year so by the time we get to 3 years we will prob have close to 28 months in the u.s. so I don't worry about that. I just wanted to make sure that if we were to spend part of the summer overseas we wouldn't come back (or file for roc) and be told we spend too much time overseas. I guess even if something were to come up we have more than enough proof for maintaining our residency.

Its been awhile since I last read up on immigration law and logged in visa journey... But its time to get back in step and so I was wondering how long you can spend outside the u.s. without creating probs for roc? We spent 4 months after getting the green card... came back for a few months and then traveled for a month overseas in July. So our total time is maybe 5 and a half months, my memory tells me that 6 months or a maybe year is the max time we can spend overseas without creating trouble for ourselves. I know all about the reentry permit, but isn't there a total time you have to spend in the u.s.... like 50 or 75%? Thanks in advance

While I am all for animal rights... I think there are just way too many wackos out there. When I was a kid we had a dog tied up (because he loved to chase our neighbor's animals) and some of the very neighbors we tried to help protect from our dog's chasing complained about him being tied up in the heat and cold.... even though he could walk into our garage while tied up. All I can say is: learn about the ppl you live around, some are reasonable and some are so insane that if they so much as see that there might maybe if taken out of context be a prob call the cops on you. Anyway back on topic... Bob is correct. :)

On top of everything that has been said.... another reason they request it is that not paying your taxes is reason for deportation.... That is one of the reasons they require you to send a letter saying "I am a student blah blah blah I don't work... I didn't file..." But the main reason is for proof of a real marriage like others have said.

So my lease is up July 31st and my wife's roc can be sent July 29th at the earliest, while we will be heading overseas Sept 1st to finish our degrees and be back around Jan 5th or so. I was wondering what you guys thought about just getting rid of this apartment and storing our stuff at my parents until we get back (sign a contract with them etc) and inform uscis that we have moved there (yes, my home address will be there, all my mail will go there, my bills, friends wanting to drop something off, etc)? This would save me a lot of money for rent that I would have otherwise had to pay, the letters from uscis would go to my parents not just sent in some mailbox thousands of miles away from me, and would generally seem like a good idea. My only concern is 1. Doing it so close to our filing date 2. if we have to go back early for an interview and are requested to show power, rent, etc how am I going to do that? What do you guys think? Like I said I am not abandoning our u.s. residency... just going overseas for a term so we can finish our u.s. degrees.

but if you are students and don't work how do you guys pay your leaving expenses. Do you have saved money? I ask this because I guess the USCIS is also going to want to know that. the USCIS likes looking for joint assets generally speaking to prove lawfulness. for them, "normally speaking" they like joint tax transcripts even more than probably "house leases" because they come form the IRS . But if you guys are able to justify not having them some how, it could work for you, aside form that you have good evidences, especially the house leases and the joint Credit cards, this are very good evidence for the USCIS



We both get scholarships and were able to save up money from a few years ago, our parents help with what those don't cover. The bank accounts show how money comes in (say we get this grant or scholarship, or withdraw from the savings account, or we get a bank transfer) and how it is spent (say on the rent which is paid at the first of the year when I get the money from the university). Of course I also file a "non-filer" form with the IRS which proves no one has worked using my social security number.

18 months out of 3 years to apply for citizenship, 3 months preceding the application you must live in the same state, no trips over 6 months without advanced travel doc, no trips ever over one year. If you keep a house, bank account, etc and limit your stays it might work out... but you are setting yourself up for some possible stumbling blocks.

You need proper documents to be able to live in Canada. I agree, and what part of Canada are we talking about anyway? If it is a reasonable drive from america your husband could work in Canada and live in the U.S..... You are setting yourself up for a lot of trouble. My parents were driving over an hour via highway to work each day, I don't understand why your husband couldn't tough it out and drive 2-3 hours until he finds a job in the u.s. There is no way you are just going to apply for some sort of long term visa in Canada without uscis finding out (they share info....) and you aren't going to be able to just cross the border every week to "renew" like many of us do in Asia... Canada and America aren't Hong Kong and Mainland China or Korea and Japan! You need to seriously reconsider your plans.

Now that we have reached the 6 month mark on our roc I thought I would post (since it has been awhile) anyway....

My wife's friend has a friend who will be doing roc in a few months and the lady has a 16 year old from another marriage who came with her to the u.s. when she get married almost two years ago. Her husband is now saying that he refuses to file the roc for her son (refuses to pay/do the paperwork) for reasons that are unknown to me. I am not looking to get involved since I hardly know the family.... but it does have me wondering what their options might be. I fail to understand how someone could be so cold as to want to split a mother (he wants to file for her) and son up when the son is by all accounts a normal teenager.

Most state's dmv offices force your application to go through the central office and can takes a very long time (I think ours was 6 weeks or something in Florida). A learners permit or drivers license is a de facto id and has been for decades since the u.s. has no real form of "id card". Of course people can get a state id card, but very very very (maybe 1% at most) americans get them and even then it is mostly limited to people below 16 who need some form of id for a job or school etc etc. Just sent them your learners permit since it is the same thing (your id card will even look exactly the same... only it will it say id haha).

We went back this fall and the only trouble we ran into was exiting China (and even this was a minor hiccup). The entry exit officials in China didn't know what the extension letter said and meant so they had to call their supervisor to make sure it was ok for her to enter the u.s..... which of course the supervisor said it was after a couple of minutes.

All you need are:
1. Passport
2. expired Green card
3. Extension letter
4. Maybe marriage license since it comes in handy if you changed your last name like my wife did
5. Knowledge and patience to explain why your green card is expired but you don't yet have a new one

Point is... if you have those 5 things you will have little to no problems going to China and coming back.

The culture you are referring to his Vietnamese right? Sure it is normal in most Asian cultures to keep your last name, but is it really such a shame for your family if you keep your old name on your old passport/id card/use it when in your country, but use his name here where they have little contact? My wife and I decided that in the u.s. she would use an all English name, but between us we would just keep her old name, and of course keep it on all of her Chinese documents. I didn't really care if she used an English name or Chinese since I speak Chinese... but it is soooo annoying to go to a store or work and find people saying your name 100% wrong. For us the negatives far outweigh the costs of keeping her old name. I had (we will move there again fairly soon) to adopt to Chinese culture, and part of that was getting a true Chinese name, because many people don't really know how to say my English name.

Some law schools run "clinics" and provide free immigration assistance.... but there is no way you will get their help "full" help in 8 days. Try finding a lawyer that will run down the basic steps for you, and also contact one of the free law school programs and what info if any they could provide. To be honest... you already messed up big time when you didn't file right after the divorce, and pretty much made yourself look horrible by getting married again so soon (two years.... and a baby is 9 months... so you had to have met your new husband REALLY quickly). My point is that without professional help in presenting your case a certain way you will most likely get denied. I am not trying to be mean, just pointing out that no one on this board or online guide is going to help you get approved (maybe help you get some time so you can get a lawyer later to help with an rfe etc... but only a lawyer is going to win this case).

If you are still married after two years and lived any kind of normal existence (meaning u took a trip of some kind, paid a couple of bills, have a bank account together, etc) the i751 is as simple as putting all those papers together and sending it to uscis. Even if you got divorced but lived a normal existence with your partner it is as simple as it can be. The only time anyone who has ever heard of this site would use a lawyer would be with a complicated case or really bad luck that even their congressmen can't handle. My k-1 case was simple, but the government made it complicated by their bungling of my papers, yet a congressmen took care of that with a couple of phone calls... no lawyer was needed.

To the OP: I would consider filing a Service Request, but first press your attorney (whom you're paying) to give a decisive answer as to why he's reluctant. Turns out he might have a good reason. I agree that the evidence for the efficacy of service requests is dubious, but there have been some isolated cases where members have reported receiving a decision within days of filing the Service Request. Give it some though, but definitely get more aggressive in getting the rational behind your lawyer's hesitation.


What are you talking about? A service request has ZERO negatives other than it is a total waste of time... surely we would have observed negative consequences of an so at some point on this forum if this were the case. What rational reason other than this would he have? Regardless, she should contact her lawyer by phone and ask why he hasn't responded and what he think of an so... if I was paying someone thousands of dollars I would surely be pressing him to do something to get my case through the system (even if it only had a 1% chance of working).... I simply didn't want to give the op false hope since that is exactly what an so is.

So your saying that when you go back to the U.S. from say Russia... they don't stamp your passport? I am a USC and the CBP has always stamped it when I arrive... just not when I depart (of course the U.S. doesn't do that). I just want to make sure I understand what your saying....

One time I was going back home from Amsterdam (just a short 12 stay or so), and at passport control in the U.S. he looked at "every" stamp I had... and we are talking about a lot of stamps. Once he found my latest stamp (and 10 questions later) he put his U.S. stamp in there (but wrong).

Your understanding is incorrect. My father in-law was a General in the Army but none of his children were ever members of the party, including his son who is a professor at a provincial University. I assure you, Consular Officers in Guangzhou do not ignore CCP membership. They have strict and well understood procedures they follow in dealing with it.

I have a quick question about this. My fiancee was a junior member or however you say it in middle school (had to write a letter and file out some paper work to get in). But she has not and is not a member of the "real" or "major" party. She never went to college in China (all in Europe) and so she never held membership in the the cp. What should I put on the form??? She isn't really a member but what the heck is a junior member? I want to get this done now before the consul gets our paper work. Thanks

Because of China's location there are tons of ways to get there. I always take the flight from tampa or orlando to newark and then on to beijing. That is the fastest and often the cheapest for me (if you book in advance). Other ways are a flight to tokyo and then boat to the north of china (boat ticket is about $125 or so), south korea and hong kong are both options, and so is taiwan now.

Not for K-1, not until AOS (adjustment of status)



There are specific ones that need to be done prior to/during the medical. Those that are not done will get a blanket waver by the Dr. for medical reasons (such as a three shot series that needs 2-6 months to complete). Now the theory behind that is that you will need to finish them once you get to the u.s., but most of the time the original medical form is good enough for aos (that is time dependent on when it was done and when it is used for aos). Do you need to finish the shots? Some of the new ones are worthless (like the cervical cancer shot for anyone older than 13) and can pretty much be ignored... but others like hep A and B should be done even if you are already a usc and not doing it is just plain stupid. Anyway... good luck
