K-1 Fiance(e) Visa Process & Procedureswould this be a problem
Hello all,

I'm not sure if this is the right place to put this, but idk where else it should go. My fiance just returned to Egypt after working in Saudi Arabia because his work visa expired. The timing actually worked out great, because the embassy has received our case and hopefully we will have an interview next month. His employer has sent him an offer letter inviting him to come back and work in KSA. My fiance's father is deceased, so right now he financially supports his family. Now that the interview is approaching he is getting nervous that the visa will be denied or he will be put into AP (which for Egypt is not uncommon), and will be stuck in Egypt without a way to help support his family. So he wants to process another work visa for KSA as a backup plan in case something goes wrong (and if something goes wrong we can work on our next step while he's in KSA). I don't feel the visa will be denied because I have provided a lot of evidence to support our relationship, but I think he is just stressing about it all now that its getting so close. I know he needs his passport for the interview, and he would have his passport back in time for this, but I'm wondering if the CO sees he was just issued a new work visa for KSA if it will raise any red flags or be a problem. If anyone has any information I'd appreciate it.

Thanks :)

K-1 Fiance(e) Visa Process & ProceduresPetitioner past divorce

Dodi was wise to write, " I'm not going to say you WON'T have a problem, there are no guarantees..." because the p[roblems usually do not show up at uscis but do arise at the Embassy.

They often are because of the Petitioner's divorce if there is an issue at all. There are several examples posted in various places at this web site. Often there is some complication or circumstance that causes the CO at the Embassy to have a concern about fraud, legitimacy, marriage to import foreigners, etc...all the same thing really.

There isn't really anything unusual about your case so much especially if you have the very first filing with you. But as you know your country can be difficult and at times they can look for any reason to have a problem.

Good luck.

Yes I know there are no guarantees, and that Cairo can sometimes be tough. I just hope with an explanation of the situation, proof of the first filing, and evidence of our relationship, it will overshadow any doubt on the validity of our relationship. Thanks for the input :)

K-1 Fiance(e) Visa Process & ProceduresPetitioner past divorce

The rule of the K1 is that you have to be eligible to marry at the time that you file, not how long you've been eligible. Since your divorce was final before you filed, you shouldn't have a problem. I'm not going to say you WON'T have a problem, there are no guarantees, but so long as you ARE divorced, and explain in your cover letters that you had issues with the divorce process and it delayed things, but that you had been separated for some time prior to filing, it should clarify things and make it easier.

Thanks for the reply Dodi :) I was legally divorced when I filed so I know I'm good as far as being eligible to marry. I just read 2 different thread today that stated filing for a visa soon after a divorce was a read flag. I thought that would be a problem if it was the beneficiary that was recently divorced but not the petitioner. I didn't explain anything in my cover letter, I was simply planning on explaining the situation if I was questioned about it at the interview (I will be attending with my fiance). The more I think about it, I think I'll get something from the first filing just to be on the safe side, and they can verify my situation and timeline of events against the information I provided on the G-325A. Maybe I should write something and explain the delay, just in case they don't allow me to be present during the interview. I did tell my fiance what happened, but when you're not familiar with our legal system it can be confusing

K-1 Fiance(e) Visa Process & ProceduresPetitioner past divorce
I was reading a thread on past divorce and now it has me concerned. I (the petitioner) seperated from my ex-husband over a year and half ago. At the time I was living in another state, I went and spoke with an attorney about the divorce and told her I wanted to relocate with my child to another state. She informed me that the current state I was living in had a 6 month waiting period before a divorce could be finalized, and during those 6 months I could not remove the child from the state and after the divorce was finalized I would need permission from the courts to relocate the child to another state. So she advised me to move before filing and since my ex would still be living in the same county I would meet the residency requirments and could file and the courts could not force me to move back. So that is what I did, then I returned back for the court date for our divorce and the judge said she could not grant the divorce because the child no longer resided in the state and she had no authority to make ruling on child support and custody, so she said I had to file in my current state. Well my current state has a residency requirement that you have to meet before you can even file, and since I had recently moved there I did not meet it yet, so I had to wait until I met the residency requirement and file, my divorce was finalized within a month of filing.

The problem is that after all of this my divorce was not finalized until February of this year. My ex and I seperated around February of last year, and I met my fiance in October and filed for the K1 in May. Is this going to be a problem for us? I clearly filed for divorce prior to meeting my fiance. I can get court records from the first time I filed as proof of filing if that will help. Any insight would be apprecited.

Thanks

[quote name='Matt & Bing' timestamp='1281714751' post='4127394']
Going through Manila is not especially difficult at all. It is sometimes referred to as a high fraud consulate but that is only because of the extremely high volume there.

I apoligize if I am giving the wrong information, I'm just going by what I have read. And there was another person who posted on this thread that went thru Manila and made the same claim that it is considered a high fraud country.

K-1 Fiance(e) Visa Process & ProceduresDid you include snail mail letters with your petition?
As Gary as said, sending proof of an ongoing relationship is not needed for the petition to be approved. I have heard that going through the Philipines can be tough, my advice would be to post a thread in that forum and ask what other K1 filers did that went through the same embassy you will be going through. See what they sent in the beginning and later, you can learn a lot from others who have been in the same boat, and sometimes learn from their mistakes. Good Luck!

K-1 Fiance(e) Visa Process & ProceduresWould it be ok if...

She will need a police certificate from canada since she lived there for 5 years. She needs the certificate to be valid up untill the date she leaves canada. The police cert will be valid for 1 year from the date of issue even tho it doesnt say it on the paper. It would be easier for her to get one before she leaves canada, it gets harder when shes not in canada to request one and takes alot longer to get it.

My fiance is from Egypt but was living in Saudi Arabia for work when I filed our petition. He then moved back to Egypt and I had to track our case daily after I got the approval from USCIS. I called NVC to change his address and after a couple days of calling finally requested a supervisor (Sue was her name) and had to email her a letter and copy of my fiance's passport. The consulate was changed the next day. If you can get it changed at NVC its best, because I was told that if it went to the embassy in Saudi Arabia there was no guarantee they would comply with the request to transfer the case, or how long it would take.

Good Luck

K-1 Fiance(e) Visa Process & Proceduresdhl couldnt reach address

We found out today that the embassy requested our packet 3 to the embassy. When I tracked down the package at dhl.com it said that few days ago an attempt was made for delivery but the address couldn't be found. Does any body know what the embassy will be doing now?

The embassy sent the packet to the wrong address for my fiance the first time. You need to call and be persistant with them and they will send out another. Confirm they have the correct address, also make sure the phone number is provided in case there are any issues DHL can call your fiance and find out exactly where she is.

K-1 Fiance(e) Visa Process & ProceduresAffidavit of support

I just talked to my fiancee last night. After I made my lawyer fill out all the paperwork on the computer, so it is easier to be read. My fiancee talked to me yesterday, and told me that a girl told her that someone from the embassy told her you can't fill out the forms we sent you on the computer. It has to be filled out using handwriting.
Is that true? Anybody heard of something similar?
Kim, and Dahlia, do you know?

I actually helped my fiance complete all his forms on the computer and he had no problems at all, I've never heard of it needing to be hand written before.

K-1 Fiance(e) Visa Process & ProceduresAffidavit of support

I did research, the visa fee's were changed on June 4,2010 and the Egypt information was updated on July 31,2010. This happened to the girl in late December 2010 to early January 2011. So now this is really very confusing to me

I know of 2 people that got their visas last year over the summer and had to pay the extra fee at the embassy, thats how we knew about it, but we only paid what they emailed to us and then paid the balance at the embassy.

K-1 Fiance(e) Visa Process & ProceduresAffidavit of support

Can you help me with these $131. I am curious what this is for.

When my fiance received packet 3, the fee stated was only $131, however we had to pay an additional $220 at the embassy (which is $350) I'm guessing when the embassy sent packet 3 to my fiance they had not updated their form to reflect the new fee of $350, so I'm pretty certain thats all you need to pay.

Ask about this to the members who have already mailed packet 3, My friend here was so nice to help me understand this. :)

Kim, please see my other reply, when Mohamed got packet 3 I don't think it had the updated fees on it. So I'm sure if you guys just pay the $350 you should be fine.

The embassy sent Packet 3 to my fiancee.

Which form do we need to use for affidavit of support? Form I-864 or Form I-134?

How many tax years do I need to send them?

We did the K-1 and I used the I-134. Also, I only sent them the most recent (2010) tax return, along with my W-2 for the last 2-3 years, and 2 months worth of pay stubs. They accepted all of this and we didn't have any issues.

K-1 Fiance(e) Visa Process & ProceduresVisa Approved but question

Hi Everyone,

My Fiance's visa was approved today! We are really happy. However when she was at the US Embassy in Cairo, the person at the Window (before the Consular) asked her if she could leave before June. My Fiance said yes... then the Consular approved her and said she would get the Visa in 10 days.

1) Today being the 22 of May, in 10 days that's June 1.

2) Do you think we should buy her ticket to come now? or when Visa is in hand?

3) has anyone had to deal with this before? Our original Interview date was back in Jan 30 but because the Egyptian Revolution - she just had it today. What is the usual expiration date on the Visa?

Anyways - we're really happy... just a bit confused and trying to make the best plan moving forward.

My fiance just had the same situation. His interview was on Jan 12 and he completed his medical a few days before then. His visa was approved and finally issued but they asked him if he would be traveling prior to July 9, if not they gave him the option to redo the TB test and have the visa reissued for the full 6 month validity.

It is correct that the K1 is valid for 6 months, but most ppl receive it shortly after their intervew, so their travel dates are not that much of a concern. From what the embassy told me, the TB test is only valid for 6 months, that's why the visa is only valid that long.

I wouldn't know

I know Hilary Clinton is in Cairo right now and just read a statement from her that she is happy with the way things are going there. Hopefully this will influence the government to reopen the embassy.

K-1 Fiance(e) Visa Process & ProceduresUS Consulate in Cairo

I do not know if this is the answer. To be accepted from another country we have to contact them for permission to transfer and approval. I do not know if i want to go this route yet. Well wait and see how these goes maybe they will re-open soon....thanks for the thought...

My NOA2 expired in November and the embassy automatically extended the approval and I wrote them a letter. They can extend it for 4 months and we had no problems with the approval at his interview in January. The Canada embassy is still closed too. Last night when I spoke to my fiance he said that for the last 2 hrs they were hearing ppl fighting in the streets and heard the sound of gun shots. Also heard from a reporter and my fiance about the fighting between the christian and muslims. The US is well aware of what is going on there, things are still not that stable, and as long as this continues they will not reopen. Its very sad, I'm happy the egyptian people won against Mubarak, but at the same time I'm very selfish and wishing this didn't happen or that it happened after my fiance was here. I pray for all of us in this situation

K-1 Fiance(e) Visa Process & ProceduresNVC sent K1 case to wrong consulate - What should I do?

You'll need to establish that you have legal residence in the UK before the London embassy will agree to take your case. Just because NVC forwarded it there and you have a visa doesnt mean it will be possible to continue in the London embassy.

Read this thread, not exactly the same situation but similar...
http://www.visajourn...lled-interview/

I agree with this. My fiance's case was almost sent to Saudi Arabia because that is where he was working, but he had returned to Egypt (his National country), and we had to show proof if Egyptian Citizenship before they would transfer it. If your fiance is not a UK Citizen she will need to show proof of residency before London will process the visa. If they are not aware that you moved and she goes back, you risk the chance of an even longer delay, perhaps they would deny the visa and you would have to reapply all over again in China. I think you should request the change now.

K-1 Fiance(e) Visa Process & ProceduresVisa Denied - Cairo (Age Difference)
I've read through most of this thread, and as I'm sure you've heard, in the eyes of the CO age does matter. I'm only 6 years older than my fiance and of child bearing age and the CO still questioned our relationship. I think what helped us is that I had visited my fiance 3 times (staying 1 week, 3 weeks & 2 weeks) in under 9 months and I was there with him for the interview. We were interviewed seperately and the CO stated that it was her job to look after the American citizen and that it is common to see younger males looking for older women just for immigration, she even gave me the opportunity to back out and cancel the petition right then and there if I wanted too. We also took with use two 2" binders of evidence and photos of our relationship and at this time we had only been together 1 1/2 yrs. Since you and your fiance have been together for twice as long, if not longer, what kind of evidence did you provide and how much?

My advice is to do what everyone else here has stated, go live with him for awhile, or if that is not possible, visit and marry, and bombard them with tons of evidence.

Good luck!!

Well there has been a change in plans, I'm now leaving for Egypt in 9 days on Sept 14!!! I'm having surgery on Wednesday, I have so much to do before I leave and no where near being ready to go :help:

Also, Mohamed due to the possible AP Mohamed may receive, he is considering doing the interview in Saudi Arabia (so he can return for work and wait it out there). I know it would probably be best if I was with him, but I will try and attend with him there. Does anyone know, if he completes his medical in Egypt, can he bring it with him to KSA and will they accept it?

Well i think FL is not even that hot as Luxor LOL .Maybe me and my wife will visit Egypt next year and we might go to Luxor yeahhhhhhhhhhhhhh .But yeah sure in spiring not in summer LOL .

Compared to Egypt I think Florida is hotter. The temps may be near each other but its the humidity that makes it soo bad, and both Andrea and I live so close to the coast that I think the humidity is actually worse than being inland. I have friends visiting from Wyoming and we just came from Disney, I thought they were going to die from the heat

If you're coming from someplace warm then you're acclimated to the heat and there isn't much of a difference.

Okay, sooooooo inshaallah i will be going soon. I am finally coming up with the money to go. What is the cheapest place to get tickets? I would love to take my lil one with me and she is 3. I know I need to get her passport yet but that will not be a problem. I would love to go in December but all the places I have found so far are like 2000 a ticket and that is too much for me and my lil one to go. Im so excited about finanlly being able to plan this trip. I have been waiting almost a year. Inshallah soon but just input on where you guys have found the cheapest tickets. I CAN'T wait to get there but the jitters are kicking in about being able to start this leg of the journey to the rest of my life. Anyway, yup the rambling has started. LOL. Please if you could help me it would be much appreciated!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

I've heard that the winter months are their busier times because it's not as hot there, that may be why tickets are so expensive. I've heard of people going with cheaptickets.com or orbitz.com, but I always book my ticket straight through Delta for the same price. Good luck!!!

Middle East and North AfricaGreen Card and Egyptian Army

I get what you're saying. If he is called to serve at 29 his service can be anywhere between 1-3 years. The amount of time they serve depends on their level of education. The more education they have then the less amount of time they serve. If they have a college degree then expect them to serve 1 year to 16 months. If they have some college expect 16 months to more. And if they have only a high school education then expect them to serve 2 -3 years.

My Husband served till he was past 31 years old. They also can take them at age 30. There are men in their military that are as old as 32 and the men that are recalled for up to 9 years are even older than that. Dh told me about one man who was recalled in his 50's. I don't understand that and I was wondering if he was having a career in the military or something before hand.

So are you saying that during the time he is 29 he should not travel to Egypt at all, or what are some ways to get him out of military duty besides being in school? He has a bachelors degree so I guess they wouldn't expect him to serve for long. And can they call him to serve if he is here in the US?

Well, i don't think i got what you said but i will answer to what i understood, IF he is just your fiancee and you didn't marry him yet and his dad is dead , then he will get outa the army because his dad is dead.and if he is married to you and his dad is dead , he still wont get to the army.so if one of those 2 reasons are apply to you then you are safe , if you have another circumstances i didn't understand so feel free to tell me it.

Best regards
Sam

The letter he has right now from the military says he is not eligible to serve until he is 29 yrs old (he is 27 now). My fiance says that when he is 29 his brother will be out of college, and his brother will receive a waiver from serving in the army, and my fiance will then be eligible. So my question was, if my fiance returns to Egypt after he is 29 but before he is 30, can they still make him serve in the army, and if they do would he only have to serve until his 30th birthdate? Or would he simply be ineligible again for the army because he will be married to me?

I don't mean to hijack the thread, but have a question that maybe Sam can answer. My fiance's father is deceased and he currently has military release until age 29, right now he is supporting his family and at 29 his brother will be out of college and I guess the Egyptian army feels the brother can take over the support. So my question is, does that mean he is only eligible to serve in the army for 1 year? And if he returned for a visit like the OP husband after his waiver is up will they automatically excuse him again because he will be married to a US citizen?

Good Morning MENA, Happy Sunday!!!

Its been a while since I've been on here posting, a lot has been going on. It looks like I will be heading to Cairo probably end of November/early December. The company Mohamed works for will let him out of the contract, but he has to pay an unreasonable amount of money, but if this is what it takes then so be it. If they won't let him leave in November, then for sure he will leave on January 1st, but I'm praying for November. I also, emailed the embassy and explained the situation and all they said was to send the documents back asap (like we didn't know this  ) So Im hoping they will extend our NOA2 approval cuz it expires on 11/4.

Hope everyone had a nice weekend, and has a great day!!! :)

The contract was for 1 year, so they have agreed to let him terminate it 6 months early, but we will have to pay. Will the embassy give us a hard time about extended our NOA2 approval until he gets back to Egypt in 6 months?

Well Mohamed talked with his work and they agreed to terminate his contract 6 months early (which is in 6 months). They have his passport in their corporate office and will not give it back to him before then, so even if he wanted to do the visa in KSA I'm not sure if he could without his passport. Does anyone know if Cairo will extend our approval from USCIS for another 6 months?

Im off again today to Detroit for work, and when I come back I'm taking the kids to Disney for the Halloween party.

Happy Hump Day MENA!!!

Olivia I'm so happy for you and that the new job is going good  . Being happy in your place of work is very important, if you don't like your job or the work environment it will show in your work performance

Well I returned home from Cairo yesterday, I'll try and make this story short....Mohamed went for his medical, however didn't have his passport, he had given it to his work to process his visa for KSA in case something happened and he had to return there to work, so they told him he needed to bring his passport with him next time. He contacted his company to get his passport, they finished his visa, however would not give him back his passport until he picked up his ticket to return to KSA from the airport. They said since he signed another contract with them that if he didn't go he would have to pay a ton of money. So yesterday I came home and he went to KSA. He doesn't really want to do the visa in KSA, so he is planning on returning to Egypt in about a week. I have to travel to Detroit again on Sunday for work for a week, and when I get back I'm going back to Egypt

I had a great time and didn't want to leave, its so hard to come back without the one you love :(

Happy HuMp DaY MENA!!!!

I also want to see that movie about Cairo, maybe when I return back to the states.

Olivia ~ good luck with the job interview today, I hope and pray it all goes well

Andrea ~ I seen your pics on FB and it looks like a lot of fun and you guys had a great time. I made reservations to go Oct 23 & 24 :)

Jeanne I'm so excited about the boat ride, I can't wait. I will definately post pics, that is, if I remember to bring my camera along  I'm sure I won't forget it, but Mohamed made a comment to me the other day that last time I was here I was taking pics every other second, from donkey's in the road to old run down buildings, and now I have hardly taken pics of anything. I don't feel so much like a tourist anymore, the things that once were shocking are now becoming normal to me lol.

Mohamed is planning on going for his medical tomorrow...FINALLY :bonk: The problem is we stay up all night and sleep all day, so by the time we are up and ready to do things, the doctors and other businesses are closing

Hope everyone has a great day!!!

Happy Sunday MENA!!

Olivia ~ Congrats on the greencard, that is so great   , and I'm sure a big relief as well that you are done with immigration for awhile.

Hope everyone is having a great weekend.

When Mohamed and I would talk online many times he would tell me he had Shawarma for dinner, so last time I was here he introduced me to it and I loved it!!! So now, he is taking me all over to try Shawarma from many different places lol, so last night was Shawarma #3, then we went shopping at City Stars mall. OMG I couldn't believe how big this mall was, I was like a kid in a candy shop. Then we went to see Inception at the cinema there. The movie was ok, but half way through the movie they stopped it and everyone was getting up, and I was like "What the heck is going on." lol He said its a break during the movie, like intermission during a concert or sporting event haha.

Hope everyone has a great Sunday!!! :)

Good Morning MENA...TGIF!!!

Not much going on with me, enjoying my time here in Cairo, but missing my babies!!

Mohamed ~ I hope you get to feeling better and enjoy your vacation in Florida, I'm sure you both will have a great time!!

Andrea ~ Wish your hubby a happy birthday from Mohamed and I, and enjoy Disney. I was thinking of taking the kids to Mickey's Halloween, so please let me know how it is.

Olivia ~ I heard about the shooting yesterday at Johns Hopkins, its such a tragedy. Im happy to hear your SIL and family are ok. Its one thing to read and hear about stories like this, but when it has a direct impact on you or your family & friends it is very scary, and makes us realize how precious life is.

Have a great day everyone!!!!

Good Morning MENA!! Happy Thursday!!

This time change really stinks!! I'm glad most things stay open 24hrs here or I would be in trouble. I think last night I finally went to sleep around 11pm which is 6am in Cairo and woke up around 3pm Cairo time. However, if I stay on this schedule I shouldn't have any trouble when I come back and need to adjust back to East Coast time :)

Mohamed sends his greetings to everyone and says thank you so much for all the help and advice everyone here has given us :star:

Hope everyone has a great day!!!
