Well I called the DOS today to see if I could get any information out of them and spoke to a woman named Sarah. She looked up my case and told me that there was no reason why they should still have my file (meaning it was not undergoing security clearances) and that the delay is because of our request to change the embassy. She had me on hold for awhile and called NVC and spoke with a supervisor that a status check has been issued on my file to find out why they are just sitting on it. She said next week it should be sent out to the embassy. I don't mind waiting another week, I'm just glad I finally got some answers besides the typical "still in AP."

I am going with the attitude that the squeaky wheel gets the oil....Probably not, but allow me my illusion in this case please. Am calling them in the morning and being very nice and polite and then again in the evening again being nice and polite. (So Sweet Sugar wouldn't melt in my mouth.) Figure that maybe they will just get tired of me and kick our packet out just to make the stickiness go away. B-) :D :P   :innocent:

Any news on your case? Also, did you happen to receive a letter from them stating they received your file and it would be sent to the embassy within 1 week or something along that line? I have heard others who have, even while being in AP, and I have not received anything so I called them today to ask why and was told that with my type of case a letter is not sent until the case has been forwarded.

Well I'm still here :( They have had our case for 13 days, hoping that something will happen soon. Going to try and fight the urge to call all week, and I have a friend coming to visit me for a week on Sunday so that should help to keep my mind off of this. Good Luck to everyone else in the boat!!

Great news. I was patient all week and resisted the urge to call. So tonight I called and was informed that they finished, and my paperwork is on the way to Manila. So 20 days in AP.
I just called Charina, and we are so happy.

Thanks for the support from this forum, it did help ease the time a bit.
Charina & I pray everyone here will be on their way soon also.

Thats great!! Congrats!! Hope the rest of the journey goes more smoothly for you!! :)

Squeaking does not help when it comes to AP... They often run FBI checks or other forms of investigations.. often when the petitioner was married before... nobody can speed up the FBI.. not even a congressional inquiry.. been there done that... its only a few weeks extra in the scheme of things... if you let this get to you, it will make the rest of the journey more painful..

I was married before so perhaps that is one of the things they are looking into. And actually the day we received our NOA2 my fiance and i were saying how we hope things go a little slow (because of his work contract not being up), then that night I received the approved email. So I don't really mind it being held up for a 2-3 weeks, however its the not knowing that is killing me, and also the fact that my fiance comes from a "T" country makes it worse. It has be wondering if they are looking at him more closely and keeping my case held up for months.

I'm doing the same thing. I am willing to bet my life that my nagging over our request to change the embassy put us in this boat. I think the supervisor got tired of me calling her (I called her 2x), did what she had to do and now is deliberately making us go thru AP. Its kinda ironic how they received the case on 7/13 and when I called it was just "processing," and when I spoke with the supervisor she gave me the impression it was urgent to fix the embassy before it left. Then after 2 days of calling about it, my request was granted and suddenly I'm in AP.

Well now I also belong to this group. NVC has been performing additional administrative processing on our visa since 7-2-10. In reading the prior posts, I am guessing that ours was also flagged for a security clearance. So I guess I can't complain if that is why. Too bad NVC won't tell us, to at least give us a little peace while we wait.
I am glad to see the average AP time is now less than than a month, so Charina & I are about halfway through it then. All this waiting is so tough, Im keeping myself busy gathering together the papers and info for the embassy interview.

The not knowing is whats killing me :bonk: Please keep us posted and good luck!!!

Well I called NVC again today and our case is still there. I asked if there was a difference between "additional processing" and "administrative processing," (I have read on this thread that some people were claiming there was) and was told nope, its all the same thing. I then stated that a K1 is a nonimmigrant visa and that it was my understanding it just passes thru NVC on the way to the consulate, she said well its just clerical work that needs to be done. Told me to call back at the end of the week and see if there is any update.

Well it looks like I am now a member of this group :( NVC received my case on 7/13 and I had some issues with the embassy and needed it to be changed. When I called back today the girl told me it was going thru AP, when I asked if it was standard she said sometimes. Then I asked if she knew if it was for background checks or what and she was clueless, but she did say that since my case was being worked on because of the change of embassy it probably slowed thing down and they just need more time to process now. Not sure if I believe her or if she was just trying to make me feel better; does anyone think that this could just be a small delay because of the change of embassy I had? Also, for cases that go thru AP at NVC, I wonder if it makes them more likely to go thru AP at the embassy level or do they usually have a good outcome after the interview? If anyone has any information I would appreciate it.

Thanks
Mandy

K-3 Spouse Visa Process & Proceduresmarrying in egypt
hi everyone, I was hoping I could get some advice here. I am engaged to an egyptian man and will travel to egypt in the next 1-2 months. we wanted to marry there and then begin the process to bring him here to the states as my spouse. however I have heard stories that bringing him here on a fiance visa will be faster. I was wanting to know if anyone here agrees or if a K-3 visa would be faster. Also, any suggestions or tips on marrying abroad would be appreciated. Thank you

K-3 Spouse Visa Process & ProceduresK3 vs. K1

wow i am in the same situation i am a fresh graduate have no work experience, i am the american citizen and my fiance is Filipino. I read that a co sponsor doesnt work well with fiance visas. since ive already said i am a fresh graduate, i have no income tax returns to show( i went to school in the philippines and am moving back this month)... what is the best route for me? can i get a job then file, or do i need to have income tax returns? any advice. thanks

first a co-sponsor can be used for a K1, but it depends on the embassy you will be going thru. I suggest you look to the top under portals and see what it says from others that went thru the same consulate. Usually they have a problem with co-sponsors because they know that once you apply with for AOS you still will not meet the income requirements and you will need a co-sponsor at that time. But if you are a recent grad they are more likely to take a co-sponsor into consideration in your situation. You can file at anytime, if you don't have tax returns you just need to show proof that you were in school to explain why you had no income. Hope this helps

K-3 Spouse Visa Process & ProceduresK3 vs. K1
First congrats on your upcoming journey!! :)

I read thru this thread and I seen that many people are comparing the K3 to the CR-1, maybe they are not aware, but the K3 is no longer an option. Early this year the government replaced the K3 with the CR-1. Before the K3 was used because it was faster to process, but that is not the case anymore, you can get a CR-1 in around 8 months or maybe less and I hear the average for the K1 is 5-6 months. So the CR-1 does take a little time longer, but as mentioned you receive the greencard right away, you can work, and you can also travel out of the country immediately, whereas a K1 you need to do an AOS, apply for permission to work, and if you want to travel out of the US before you receive your greencard you will need to apply for Advance Parole. If you were to leave the US after entering on a K1 without an advance parole they will not let you back in.

As for not being married long that does not matter either, it may look strange if you only knew each other a short period of time and married quickly, but if you have a strong relationship history you should be ok.

Good Luck!!

US Embassy and Consulate DiscussionSudan police report

What consulate office did you call in the USA... no such thing...

Did you point out to NVC that according to there own website they indicate that PC's from Sudan are not available?

You profile indicates K-1, if so, then why are you conversing with NVC on this matter? It is a matter for the consulate abroad that the K-1 will interview at... NOT NVC

I called the Sudan Embassy in New York and in Washington DC, the woman in Washington DC told me I had to speak to the consulate and transferred me over to them. I was then told that I had to speak to an officer and she was did not know if they could provide a report. When she transferred me to the officer and I began explaining what I needed, he asked if I was Sudanese and when I said no he hung up on me.

No I did not tell NVC about what their website said because when I called I did not see this information. I am doing k-1 and my fiance is trying to get all of his docuements in order, I called NVC only to ask for their help based on what I was told from the Sudan embassy and NVC told me if he couldn't obtain the report from the embassy he would have to travel to Sudan to get it.

You are wrong. Back in 2008 I have to do the same thing for my wife is some trick to it
If you know any one in Sudan will make the process so easy for the fee of $40 and is so simple.

I did look at that site and it said they were not available. If he can have someone in Sudan do it for him what do they need to do, and I also seen you can order a report off the internet. Its expensive but if they will accept it then it will be worth it.

US Embassy and Consulate DiscussionRiyadh or Cairo Embassy
hello everyone, I'm hoping that someone with experience with the Riyadh Embassy or Jeddah Consulate can help me. I recently sent in my I-129F and just received my NOA1. On the petition I listed the interview location as Jeddah Saudi Arabia (Im not sure if they are doing interviews there for K1, if not I'm sure they will send to Riyadh). My finance is Egyptian and in Saudi Arabia for work. My question is what kind of luck have people had with the embassy in Saudi? I read one story on here and it was like a nightmare. If the embassy is very difficult to get a visa thru we may try and change the location now to Cairo before we get to far into this thing. Although it would cause problems for him and his work if he has to go back to Egypt for this interview, we would rather face that then face a denial or months of additional processing.

Thanks in advance :)

I just sent in my I-129F and need to change the embassy location of where the interview will take place. Does anyone know if this is possible to do and how I go about doing it? I called USCIS and needless to say they were absolutely helpless. FYI initially we selected the interview to take place in Saudi Arabia (where my fiance is currently working), but would like to change to Cairo (he is an Egyptian citizen) because 1) I want to attend the interview with him, and 2) by the time the interview comes around he will probably be living back in Egypt.

US Embassy and Consulate DiscussionI-184 & ASSETS

hey mandy,, ill tell u somethng sweetie, its cairo they will want the 125 percent ,, and show them the last 3 years tax return, also useeeeeeeeeeeee the assets cause u dont meet the income requirement as of last year,. showwwwwwwwwwww them your pay stubs now and if i wre you i would get a co sponsor just to be safe, this is cairo embassy sweetheart and anything and all things are possible, be totally prepared for them.. better to show to much income than too little okkk.. and best of lluckk to u

Thanks Aishia, I will just bring everything with me, and 2 of the last 3 tax returns has my ex husbands income, but they will see from the W-2's from 2008 I worked for the same company and made more money than I did in 2009. I don't think I can get a co-sponsor only because my mother is going thru some type of immigration (long complicated story but she has been here for over 50 years) and my father has to sponsor her. I was also thinking of having my boss write in his letter of employment verification why my wages were down in 2009 compared to 2008 and this year. Also, when I say I was just shy of meeting the requirements I mean it literally, I think my W-2 is $100 less than the income requirement at 125%. And as the other person suggested I will bring court documents of my child support and bank statements showing the deposits.

But you think I can use the assets even though it is joint between me and my daughter?

Thanks for your help sis, and good luck to you :) Hope all is going well, I will be praying for you !!!

US Embassy and Consulate DiscussionI-184 & ASSETS
I will be going thru the Cairo consulate hopefully soon and have a question regarding the affidavit of support. I read that for a K1 you only need to meet 100% of the poverty income guidelines and that the 125% applies for the CR-1, however someone told me that with Cairo they still like to have the sponsor meet the 125% income guideline regardless of the visa being applied for. I have a large family and I meet the 125% income guidelines, however last year when the economy was bad my employer reduced our hours and cut our pay, however our hours and pay have been reinstated. So according to my tax return of last year I was just shy of the 125%. Im curious if the CO will use my 2009 return for my income, or if they will use my recent pay stubs and letter from my employer. Also, I have assets that I can add to my affidavit. My father signed over the deed to his vacation home to me (I own it free and clear, mortgage has been paid off and no equity loans), but its also in my daughters name as well, can we include assests that are joint with someone other than the beneficiary? And finally, will the CO take into consideration the child support I receive, and if I can include this on the affidavit where do I note it?

Thanks everyone

US Embassy and Consulate DiscussionWhat address should I use

Definitely put the Cairo address to avoid any confusion as to where the interview will be held or where some letters might need to be sent.

It is a remote possibility they will ask why the Visa stamp in the passport shows him in KSA when he filed the forms with the Cairo address. A simple explanation of the facts will suffice. He knew his Work Visa would be up and he would be returning to Cairo to go through the interview process. The honest and direct answer usually leads to the best possible outcome.

Thanks for the advice!! :)

US Embassy and Consulate DiscussionWhat address should I use
Hi All,

I got my NOA2 earlier this week and I'm trying to get some forms prepared ahead of time. Our file is being sent to Cairo, however my fiance is currently residing in KSA. We are having the case sent to Cairo because his work visa will be up soon and he will be returning to Egypt and there is no way for him to complete the visa process there in KSA. So my question is, if he is still in KSA when returning the forms (DS 156 & DS 157)to the embassy should he list his KSA address or his home address in Cairo? I don't know if I list the Cairo address if it will cause problems because they will see his visa stamp on his passport with the date he left KSA, and they may say why did you say your address was in Cairo when you were still in KSA...I don't want to cause any problems. But we also don't want to put the KSA address because we fear they will transfer the case over to Riyadh and then he will have to transfer it back over to Cairo in about a month.

Any suggestions would be appreciated.

Thanks

US Embassy and Consulate DiscussionMy experince at the US consulate in Cairo

I wanted to share my experince just in case not everyone reads it on the reviews :)

K1 visa - US consulate in Cairo, Egypt.

The interview 7-7-10

I got there at about 7 am, gurad looked at my invitation letter, they took my phone, scanned my body, and gave me 2 numbers, I was called the first time to submit my birth certificate and passport to an Egyptian woman who asked me a few questions:
- How did you meet your fiance?
- For how long have you been together?
- Was he married before?
- Did you have an official engagement at church?
then told me to sit down and wait again, 30 minutes later an American woman took my biometrics and told me to wait again for my interview.

My name was called again for the last time, 2 men were there, I think one is a trainee since he just watched, the man who interviewed me was in his 30es, married, and very funny.
He started with 'Hey, Goodmorning!, can you please show me the DHL and bank receipt? (I kept looking through my huge bag, and I was like sorry it's just so small, and he was like oh yea it's pretty small, it's okay take your time! I then found it.
then he said : I've a couple of questions for you!'

- Did you fill these forms yourself?
- How did you meet your fiance?
- For how long have you been together?
- Do you call him Joseph, or Scott (his middle name)? I said I call him Joe :P
- When did you decide to meet?
- When did he visit you? and the second time? How long did he stay? How often did you meet then?
- When do you plan to get married?
- What does he do? what does his company initials stand for? (I didn't know)
- Do you swear to marry him within 90 days? Sign on it.
He said 'Very good!' after each answer, I felt like I'm in KG :P

He then said everything looks very good and he has no reason to not approve me and he was like, listen, I'll approve you right away! Congratulations! Have a nice wedding! You'll get your visa in 2 weeks. I kept thanking him. )

He didn't ask to look at my evidence and I didn't even offer.

Overall experince is really good, the US embassy in Cairo was always so responsive and reliable! Whole time I was there was no more than 2 hours and a half!

Best of luck for those next in line!

Congrats!!!!! I hope my fiance has the same great experience at his interview. Good luck with your travels and welcome to the United States!!!

US Embassy and Consulate DiscussionHow long does a CO takes to review a file

I was interviewed in June , I brought in a joint sponsor doc to the interview I was told to pay dhl for delivery, I waited a month no delivery was made so I contacted the embassy and I was told that my file is with a CO and is being reviewed and as soon as the review is complete,if everything is in order they will process the case to conclusion. Has anyone every been through this process and o long does it take the CO to review a file, please.

I wish I had some encouraging news for you but I don't know a lot about this as Im going thru the process myself. However, I have read several places on these forums that sometimes people are placed in Adiminstrative Review which is a review of the file at the embassy level and is typically resolved within 60 days, and there is Administrative Processing which can mean a number of things but most likely additional security screening in Washington DC. They say these are usually resolved within 60 days as well, however I have read cases that have been in AP for 2 years. I would call the embassy back and specifically ask if you are in AP or AR and see what they say. If you are, there is a forum under the waivers and AP section called the AP tracker. You may be able to get some more information from someone on there.

Wish I had some better news, but I hope that your case is completed soon. Good Luck!!!
