so i have sent off my petition and it was recieved on the 15th of july!
i know its still very early on, and it will most likely be a while until i recieve the 1st approval.
i wasnt able to send a personal check, so i cant check it that way. i had to send a money order.
but i have heard stories of people not even recieving anything in the mail (a 1st approval)......only recieving there 2nd approval like 3-4 months down the road....
any advice?
also, how many days after they have recieved it can i contact the Cal. Serv. center?



I would keep calling to check if the money order has been cashed. If it has you should be able to call the CSC and get a receipt number, or wait until you receive it in the mail, most people do receive the notice. After you get the receipt number you can track on their website. Good Luck!!

I am curious as to what the best procedure for obtaining international police reports would be? My woman lived in Amsterdam for a year so how do we get the police report from there for the K-1 process?

I assume the best thing to do is call and ask for someone who may speak Russian or English in the records department?

Any insight is appreciated.



Please see the link below, the DOS states that this needs to be requested by the embassy. Also, it states it is only available for immigrant visas, a k1 is considered a nonimmigrant visa, however since your fiance will be immigrating they may still want it

Thank you for the response, but I'm not sure that answers my questions as I have read through the guides.

It appears that the form is designed for one person living in the US and one planning on coming to the US.



A DCF (direct consulate filing) is only available on CR1 applicants and for that you would have to be married. You could possibly file for a k1 while you are living in China and use a US address on the petition (such as a parents address, etc...), but honestly I would not do that. I know its difficult but I would quit my job, return to the states and file. Also, if you do use a temp address while living in China, you will need to have someone in the US as a co-sponsor because your income from your job in China could not be used, but if you return to the states and file it would give you some time to find work and maybe not need a co-sponsor. And if you decide to marry and do a DCF you would have to of lived in China for at least 6 months, and would still need a co-sponsor. Hope this helps.

I only sent 1 passport pic of both of us and it was fine. As for the birth certificate I didn't send that either. I think people who get a RFE for that are possibly filing for a CR1 and in that case the NVC will need that, but typically for a k1 the beneficiary's birth certificate is not needed until they return packet 3 or at the embassy. Also, a person can get a RFE from the embassy (i.e. missing birth certificate) before they will proceed, so maybe thats what they meant.

I'm pretty certain, and if I'm wrong I'm sure someone will come along and correct me, but since you received a 10 year ban, your fiance will have to prove extreme hardship on himself, and honestly I don't know if this can be done with a k1 petition, you may have to marry in your country and apply for a CR-1, and again he would have to prove extreme hardship on himself (because of your absense)and stating why you should be allowed back in. In my opinion your case is more complex and you should probably consult an immigration attorney and work with them.

Just curious as to what others have experienced. I submitted a really organized and well put togeather fiel to the Vermont Service center certified mail that was recieved by them on July 26th 2010 as of today July the 30th no check cashed or such action. I know that much time has not passed i just have noticed some times lines indicate the check being cashed rather quickly .. Any isight as to weather this is the norm or should i be worried they lost my file or soeother issue??



It took them 4-5 days to cash my check, maybe tonight it will clear your bank. If it doesn't I wouldn't worry, I have heard some cases taking over a week. I think after the VSC received my petition, they started sending them down to Texas to help with the processing, Im not sure if they are still doing that, but that could be one reason why it is taking some time. I wouldn't stress though, I'm sure you will receive your NOA1 by the end of next week. Good Luck on your journey!!

Hi there -
I (the petitioner) was out of work when we filed in April. I had chosen to take some time off so that I could pursue some other opportunities, so I was not technically 'unemployed,' I was not collecting benefits or anything - I was simply not working at the time. We made sure we had our financial bases covered before filing so we weren't worried about support / poverty line issues.

Anyway, I just got a new job (but I don't start until September). We are still waiting for our NOA2. Should I call to give them my new employment info? Will this help at all? Or will it hurt us, but sort of putting us back at square 1?

well if you weren't working you were unemployed, regardless if you were collecting benefits or not. You could always write USCIS a letter with your new employment information but there are no guarantees that it will make it into your file. After you receive your NOA2 and your fiance receives the packet from the embassy, you will need to return the I-134 affidavit of support, and that is when they will really look at your income and care that you are now working. USCIS really doesn't care if you're working or not.

Hello everyone.
My fiancè is in the military, and yesterday he got a call from his work, saying that he is going to be sent [b]TOMORROW (07/31) to the gulf to help with the oil spill problem...
The thing is, he is going to be gone for 2 MONTHS, and we are in the middle of the k1 process. We estimate that we are gonna get the NOA2 in the next 2 months or less, but he won´t be home to get the notification.
My question is, can he go to the post office, and ask them to forward his mails to his mother´s house?
He will probably be staying at barracks or a hotel, so he can´t forward the mails to where he is going to be staying...
I am not freaking out yet, but a little concerned, because if we get the NOA2 while he is gone, we might have some issues with gathering documents and stuff....
Any ideas???

I think the safest thing would be for him to put his mail on hold at the post office, this will prevent it from getting lost or returned to USCIS. Or he can go online to the USCIS and update his address and use his mothers if he likes.

I had to change my fiances address and the embassy. I was told by NVC to email them, so if you just sent it regular mail you may want to do this. Also, they wanted a copy of my fiances passport, but I think that was only beause of the change of embassy, but you may still want to call and see if you need to send some sort of proof of your new address.

I am new here and we are going to start the process of petitioning me for a visa K1, My fiance is worried because she doesnt know if she meets the poverty guidelines, She has been working for the same place for 2 years and she makes 19000 dollars a year, she has no kids, no past marriages, she is only 23, she has only one year tax return because she was studying before and she has 8000 dollars in save and maybe will have more for the time we have the interview. I also dont have past marriages or kids so it will be the two of us. Do you think we will need a co sponsor or we are fine this way.

As Dodi said your fiance is just over the income guidelines, however I have heard some cases when the sponsor is close to the guidelines and the CO will still request a co-sponsor to be on the safe side, I think it depends on how close to the quidelines you are and the consulate. However, since your fiance has $8000 in savings I would have her include that on her affidavit of support. Although she makes over the requirement, this will help strengthen the affidavit and eliminate the chance of the CO requiring a co-sponsor.

As others have stated most of us on here are doing this ourselves. This is site is very resourceful and there are many knowledgeable people to help you along the way. I considered using a lawyer and the more I looked at what was required the more comfortable I felt I could do this on my own. Another thing I noticed too was that I had searched and read the reguirements and the various forms that needed to be filed and when I contacted several attorneys I was given informatoin I knew was incorrect because of the research I did, such as I was told by many that you can start this process immediately and you don't need anything from your fiance until later in the process, which is completely not true, there are forms that require their original signature from the beginning along with a recent passport type photo. So I would suggest that regardless what route you take you should still study up on the process and when/if you decide to go with an attorney ask them some detailed questions and see if it agrees with what you know or have learned. I agree with the other post, if your relationship with your fiance started after you arrived then you can simply marry and file for AOS. And as far as I know, applying for 2 different visa's is fine. There have been other people that have applied for the visitor visa while their k1 was processing, and some were approved and others were not.

Ok, I recv my RFE and it states i need my fiances divorce certificate from 7 years ago translated form spanish to english... the RFE states this " If you submit any document in any language other than english, it must be completely translated. The translator must certify that the translation is accurate and that he or she is competent to translate"

Does this mean anyone can translate this and sign it with this statement, or does it need to be done by an attorney or notary??



Yes, it means if the person translating is fluent in both spanish and english can simply state that and give their signature that the translation is accurate. It should say something like this:

I think you are just thinking of things to worry about! LOL with that being said, technically I don't believe you have anything to worry about. He cancelled the appointment so he never went to the embassy and was given permission or denied a vistior visa.



I know...it's getting so close that I'm starting to get paranoid :) And it didn't help matters that when I posted a reply to "Cairo's final review club," someone told me not to expect him to get his visa for at least 6 months :(

I also looked at the DS-156 again, and it only asks if he was approved or denied a US visa, or if his US visa was cancelled, and the answer to both of these is no, so I think I'm ok lol

I'm in the process of a K1 visa and my case is now at the embassy. I'm sitting here tonight and just remembered that about a month or two before I applied for the K1 visa my fiance applied for a tourist visa and submitted the application online. For various reasons (mislead by lawyer), he cancelled his visa appointment and never rescheduled. On the petition I submitted and all his forms for the k1 we have stated he did not previously apply for a US visa, because technically he didn't follow thru with the application. So since his application was never approved or denied will the CO still feel he previously applied for a visa and say we lied when filing for the k1? I'm stressing out a bit about this, any news or advice would be appreciated.

I-129F package requires proof of meeting and proof of ongoing relationship. You will need further proof of ongoing relationship at the interview.



Actually the I129F packet only requires the proof of meeting. The proof of relationship is not needed until the interview, however, if you are dealing with a consulate in a high fraud country it is advised to front load the I-129 petition with proof of meeting, but it is not required.

Hi everyone, I'm fairly new to this world of K1 visa applications and I'm needing some help. My fiance filed the I129F forms on the 10th May 2010 with several photos and a story of how we'd meet. I wasn't even aware that I had to do anything at the beginning so now after 3 mths of waiting they have asked us for the additional documents that should have been sent ie- letter of intent to marry 90days, his divorce papers and my story of how we met. I'm in Australia and he's in the US so getting the orginal documents to him takes time so I'm wondering if I'm able to scan them to him to save time? Or do they need to be original? Also, how much time would this mistake have held our processing time up now?? Thanks for your help everyone!



Normally they like to have the original signature, however if its just the letter of intent to marry you may be able to get away with scanning it since its not an official document. However, if they refuse to accept it, then its going to cost you more time in waiting for another RFE, so in my opinion I would just send everything to him to be safe. From what I hear, after they receive the requested documents most people get their NOA2 within a couple of weeks.

What are the general requirements for "strong ties to return" and would it endanger the K-1 process in any way?



As stated a letter from an employer, school enrollment, lease agreement, also bank statements showing funds in her account. Anything you can think of that would prove to someone she would be returning. And no this does not endanger the k1 at all, there have been some people who have managed to get thru the borders while a k1 was in process and they had no problems getting their application approved. Also, if she is approved for the visitor visa, be sure she brings all that evidence of strong ties with her so show when she arrives because they may request that. There is also a risk of them not allowing her to enter once she arrives, although she may be approved for the visa, it is always at the discretion of the border officer to allow her to enter (not trying to scare you), but if she had strong evidence and brings it with her she should not have any problems.

As others have suggested maybe meeting in another country, but if your fiance requires a visa to visit there it may be difficult to obtain or time consuming. She could apply for a visitor visa to come to the USA, however there is no guarantee that they will approve her or let her in, she would would need to show strong ties that she will be returning to Russia to wait out the k1 process.

Oh I wasn't aware of that. I know my case arrived at VSC right before they started sending them to Texas...I guess the only way to know for sure would be to ask someone who had their case processed from Texas. But idk why they wouldn't put the receipt number on the back, that doesn't make any sense. To the OP, it wouldn't hurt to look at your cleared check, if there is no receipt number on the back then I guess you will have to wait to get your NOA1 for it...sorry if I misinformed you.

I only got snail mail. Also, if you paid by check you can see if it has cleared your bank. If it has there will be a receipt number on the back, you can use that to access your case online.

No it will not. There are many people who have had previous denied visas and were still approved. However, they may question you a little more about the validity of your relationship, especially if the visa denial was recently. Just make sure you bring a lot of supporting documents for your relationship to the interview and you should be fine. Good Luck!!!

I certainly know that, and agree with that law. My question is related to the past of the alien fiance(e) and overcoming this one issue. For example, if a woman was once married to a man for a short time who had another wife elsewhere (accepted in that culture), but now wants to be in a monogamous marriage with a U.S. citizen, will she be denied entry on that one issue alone?



If her husband was the one that was married to two women, then no it would not have any effect on her visa, she didn't commit polygamy. But she would have to be divorced from him before they would issue her a K1 visa, and if she married again before she was divorced then that would be considered polygamy.

I agree with everyone, try and get all other documents gathered, but I would check with the embassy and see how long the police reports are valid for. It would be a shame to have it done, and when you interview comes around its no longer valid. I read somewhere that they are valid for a year, however I emailed our embassy to confirm and was told they will only accept them if it was issued within 3 months prior to the interview. Good luck!!

A few quick questions please. We do not have the boarding passes he travelled with to visit me in the UK but he has the stamps on his passport. Could this be a problem. Also we do not have hotel receipts because he stays at my house during his visits. I have lived in the UK for 2years since sept 2008. I am originally nigerian will i need to get a police certificate from Nigeria and UK or UK alone will be fine.

The passport stamps will be fine. Please see the attached link from the DOS, according to this you have to physically be in Nigeria to get a police report. The embassy will know this and waive the requirement.

I am gathering information (proof) in order to submit the K1. My fiance & I started speaking in April 2010. I have phone records from April through July of many conversations on my cell phone. However, during the month of May I obtained a home phone for the purposes of getting cheaper phone calls. We spoke sometimes for 7-8 hours at a time on the weekends. The phone company is going to charge me $25 a month ($75) for these phone records. I only want to purchase them if absolutely necessary, and I'm not sure if they are or not. I have many pages of emails/Facebook messages, copies of passport (stamp,) airline ticket stub, and receipts of things we did together. Can anyone offer thoughts on if these other phone records are necessary or even helpful? Or are they just superfluous? Thank you!



For submitting the I-129F petition you don't need to show proof of an ongoing relationship, just proof you have met in person in the last 2 years. Although most people front load their petition, its really only advised to those dealing with high fraud consulates, which England is not one of them. As coconut said, if you want to add the records you can, but its not necessary. Good luck!! :)

Ok i got 129F approved on 20 JULY 2010, recieved hard copy about a week later, now its August 11 and no word about NVC or consulant. also fiance has not recieved anything yet. How long should it take everyone i check seems to have dates a week maybe 2 at most later. Here i am at 3 weeks and nada. When should i start worring and find answers?



NVC received my case within a week after it was approved. I would call them today and ask, if they don't show a record of it then you need to start finding out where its at. Although they tell you it can take up to 4 weeks it usually doesn't take that long ( and there have been a few cases on here lately that USCIS claimed they sent the case to NVC when actually they lost it!!). They will be able to tell you if the case has been sent to the embassy also, if they still have the case ask if you're in AP. If they have sent the case, ask when it was sent to the embassy. You can call the embassy to confirm they received it, or call DOS (look on Darnell's profile for the number) and they can tell you as well if it was received by the embassy. I was in AP @ NVC for 3 weeks, and I called daily, and as long as you're polite they don't care. When I wasn't getting any answers from them I called DOS and received more info from them.

No its not bad that you don't have that, your fiance is in England and from what i've read they don't pay much attention to the evidence to support the relationship. My fiance is from Egypt and its considered a high fraud country, so its advised to front load the petition. I included everything, chat longs, chat conversations (1 for each month), phone records (each bill was about 25-30 pages long), text messages, pictures, emails, you name it, it was in there lol.

I see it says to have put together where it can easly be taken apart. Is a binder a bad idea? Should you staple it and put it in a folder maybe? Next does anyone know the latest and greatest on information of bringing pets into the U.S.? My finace has a cat in england and wants to bring it when she moves here. You should send your package so that its easy to review. Using a binder is not a good idea, and I have heard of some people just using the big binder clips. I myself (sent over 400 pages of documents and evidence), broke everything out into sections...petition, proof of meeting, and evidence of relationship. I then used different colored sticky notes and tabs to divide each section, and guide them to certain documents without having to dig thru the whole package. If I had more than 1 page for something (i.e. copy of passport, emails, phone records) I stapled them, but did not staple the whole package together.

As for the pet, Im not really sure, I would maybe check with someone in customs or call a local vet and ask them, I'm sure they have some idea on what needs to be done. You could always google "how to bring a pet into the United States" and I'm sure you would get a ton on information from that too.

Proof of engagement can be a receipt for an engagement ring, but VJ recommends sending a letter of intent to marry (similar to the one sent with the petition) stating you will marry within 90 days of your fiance entering the US. If you look up to the guides, under the K1 guidelines they will give you an example of this letter.

For the I-134 it sounds like you have everything, except you will need last years tax return, and it is recommended you have all W-2's and tax returns for the last 3 years. Other than that you should be good.

While people DO need to follow the rules and SHOULD have backup copies of everything, there is NO REASON whatsoever for the kind of attitudes that many of the older members (and even some of the newer ones lately) take regarding many of the newer members and mistakes that are made.

I'm sure she feels bad enough at having lost the laptop and the original. She's just as stressed out as the rest of us who are going through the process, and now is even more stressed out because she's lost so much during her visit to her fiance, which could impact the Interview and AOS in the long run.

Please stop acting like you're the judge and jury of this place. It might not be your intention, but it comes across that way. You're not helping her by issuing your judgments. You're not helping anyone that way. She DID make a digital copy. Most of us know to do that. I've got a digital copy on my laptop at home, my work computer, on a flash drive, in my gmail account, and even on the SD card in my phone just in case, as well as 3 paper copies of everything in my file. I'm a bit OCD about backups. It doesn't mean things don't happen beyond our control.

Please, just try to have some compassion for others, and as your mom probably told you a million times: If you don't have anything nice to say, don't say anything at all. You older members who have been there, done that, got the t-shirt, burned it and are now wisened to the immigration ways seem like you're getting callous to the fact that YOU were once here, YOU were once going through this process and were just as new and scared as we are. You are making the newer members feel very unwelcome and unwanted when you act like this.

Gary & Alla - you are one of the posters here I've actually looked up to when you've given information in the past that has seemed invaluable, but your post here sounds like you're taking a page from the "legacy members" in the UK forum. What is this window contingent on? Does it vary? I'm wondering if this is a good window to squeeze in the family, ceremonial wedding before my fiancée travels to the US for the civil wedding.

The visa is typically valid for 6 months, however I have read that if your fiance has any kind of medical conidition (that is discovered during the medical exam) the embassy can change how long the visa is valid for.

I was in US for 1.5 years and i read that they dont need PCC from the US. So i am good there.

What i understand from your answer is that it is going to be a piece of paper saying i am clear. I also read somewhere that something also goes to passport. I am not sure but may be it is called Passport Clearance Certificate. Do i need that too? If yes, shall i apply it from the place where i reside as of now or from the place my passport was issued? I am sure they will keep my Passport with them so is it advisable to initiate the process now?


From what I know the only thing that goes into the passport is the visa. Also, every country/embassy is different. Some want you to bring the passport with you, some want passport type photos, and I believe they all take fingerprints, but they don't keep your passport (for the PCC). Also the Police Clearance Certificate it was I was referring to before, that is what you need for any country you lived in except for the USA. And yes, the paper is a report either stating your clear or if you have a criminal history it will list that

Hi,

We recently got our NOA2 approved and now i am planning to get PCC from Bangalore. Here are my doubts. If someone can help me with this then it will be a great help.

1. My passport is issued from Gujarat but i currently stay in Bangalore. So i will need two PCCs. One from Bangalore and another one from Gujarat. Is that correct?

2. Is PCC just a piece of paper or will it get endorsed on my passport too? If it will get endorsed on my passport then will both of them endorsed on the passport or only the one from Gujarat will as my passport is issued from Gujarat.

3. I have started the process of getting PCC from Bangalore but it looks like all they will give me is a piece of paper. In that case how will it go on the passport (if it has to)?

If someone can explain a bit about this then it will be a great favor.

You need a PCC from any country you have lived in since age 16 and for over 6 months. There is nothing that goes into the passport, you will just simply send the report back in packet 3 or take with you to the interview, the consulate will let you know when they need it.

My fiance is going ahead and extending his work visa in France before interview. Better safe than sorry. How easy is to get a work visa in the KSA? For example my fiance got contract extension and he will get his visa on passport the same day he request it. Hope all works out for you two :) :thumbs:

I don't think its very hard to get a work visa for KSA, last time they had it processed and completed in 2 weeks or maybe even less.

Hello all,

I'm not sure if this is the right place to put this, but idk where else it should go. My fiance just returned to Egypt after working in Saudi Arabia because his work visa expired. The timing actually worked out great, because the embassy has received our case and hopefully we will have an interview next month. His employer has sent him an offer letter inviting him to come back and work in KSA. My fiance's father is deceased, so right now he financially supports his family. Now that the interview is approaching he is getting nervous that the visa will be denied or he will be put into AP (which for Egypt is not uncommon), and will be stuck in Egypt without a way to help support his family. So he wants to process another work visa for KSA as a backup plan in case something goes wrong (and if something goes wrong we can work on our next step while he's in KSA). I don't feel the visa will be denied because I have provided a lot of evidence to support our relationship, but I think he is just stressing about it all now that its getting so close. I know he needs his passport for the interview, and he would have his passport back in time for this, but I'm wondering if the CO sees he was just issued a new work visa for KSA if it will raise any red flags or be a problem. If anyone has any information I'd appreciate it.
