Hi All

I am getting ready to file i-751 and collecting all our joint information.
I was wondering when writing out the cover letter with what is included, is it wise or unwise to include reasons why something is not in there.
My specific example is that my husband and I live together but I am not on the lease as the Landlord would raise the rent a phenomenal amount. He lives out of state so isnt around very often to know.
Would it be silly of us to write a reason as to why there isnt a joint lease included with the evidence that we submit or should we just not mention it.
We have other evidence, joint bank accounts, credit cards, health insurance, car insurance tax returns etc.

I wouldn't bother. If you have other avenues covered there shouldn't be a problem. And those pieces of evidence have the joint address on them anyway, right?

Another thing you could do is include the lease with your documents and write on it why you're not on it. Or ask the landlord if he could verify that you live there? A lot of people don't have joint leases or mortgages because of the USC being established in their home before the spouse turns up.

Depends on your service center. If you've been following the forum, the VSC is very behind with their NOAs so calling them is not going to help much. If you need it for travel etc. an infopass to get a stamp in the passport is the way to go. Otherwise just sit and wait like the rest of us :)

Nope, still quiet this end. I bet the service center is getting a right ear bashing every day. :wacko: I'm almost beginning to feel sorry for them! I don't see I-751 as urgent cases myself, and if you want to travel or need it for work verification, I'm sure your local office will comply you with a stamp if you ask nicely. I will be doing such when my card runs out and I need to travel, otherwise I'm sitting back and waiting.

For anyone who is worried, I crossed the border with the card having approx six weeks left on it and had no problems at all. I will be doing the same up until it has almost expired, so will give feedback if I have any trouble.

You are still in status even though your card will expire. If it will settle you, by all means make an appointment, but judging by what is kicking around, I'm not sure they will tell you much. We all got caught up in the grand August vacation followed by Labor day holiday. I think it's gonna be funny cos there's gonna be a sh*t load of posts in this forum when these NOAs come through :lol:

I just sent one statement per each year we've had a joint account. I only sent the top page and blacked out the amount of money that was in the account, plus part of the account #. It's none of their business how much $$ we have!

It's probably not worth wasting your time worrying about it. In the 3 years I've had to deal with the USCIS I think they just treat every case like your fingerprints. Everyone is different.

Well I have found out that it is indeed a new policy not to give out stamps. Yes, I can travel with the NOA and old GC, but I just thought I'd find out if they would, ya know? ;)

If you were traveling while the GC ran out, you have to get the stamp before you go and wrestle with them, no doubt. :rolleyes:

Anyway, it was a curious experiment and I learned something new. He didn't have to be an ### about it though. :rolleyes:

I went for my I-751 biometrics yesterday. All that was easy and I would have been in and out of the office in 10 minutes. Although I already have my NOA, they didn't know this, and so I thought I'd see if I could get a stamp in my passport to allow me to travel. I called at the desk (I was the only one in the office) and they eventually came to see me. I asked them if they could stamp my passport as I need to travel, and that my GC runs out in 10 days. the officer said he couldn't do it. I asked why not and he said it was against policy. I said that I needed to cross the border a lot and my card would run out soon. He said I would have to wait until my GC runs out, and at that point I could come back and deal with it. I asked when this policy came in to place and he said on October 1st. Has anyone heard of this?? I know for sure many other offices have been giving out stamps in the past month for people who need to travel and have no NOA. I told him of this practice and he said those offices were going against policy. Of course, I don't need to worry as I have my NOA, but I was surprised this officer was being such an ###, and I'm not even sure the 'policy' that he quoted was even true. Any insight?

By the way, didn't you send passport pics in with your application to lift conditions, anyway?
And when we had biometrics done for our AOS, they took our photo with a computer and digital thingy (as well as the fingerprints...

Well, it could slow down again by then. They go in waves with the I-751s. Never assume anything is the same or consistent with the immigration service, no?

Yes, you send passport pics with the application, but many people have been asked to take another set with them to biometrics, AND they get their picture taken too.

I was sent the biometrics. It's in two weeks. But it did say this on the letter:

"If you are unable to appear at this time, you may go on any following Wednesday at the same time noted above, as long as you appear before 1.15.2007. If you do not have your biometrics taken by that date, your application will be considered abandoned."

So I would say your husband is OK to travel and he can do the biometrics when he returns.

I got my NOA and biometrics this morning. The biometrics didn't ask for any pictures to take with me so who knows if they'll send me out to get some :whistle:

I just sent mine via first class mail with the signature return card thingy. I remember years back reading that VSC handle priority mail differently and therefore gets in a different queue. I have no idea whether this still happens, but it may be an explanation. I'm sure it will all be fine. :thumbs:

The only two ways she "could've" gotten back in were through a valid GC and/or AP approval, not a NOA letter.

The NOA letter just says that "some action took place," not that "a final determination has been made."


An I-751 NOA says way more than that. It essentially extends our GC for another year. We don't have APs when the conditional GC expires. Look up a copy of an I-751 NOA!

I probably need to clarify my situation.

The GC is not expired yet. It will in may 2007.
I know I do spend the most of the year (8 months) outside the US, but for the summer I am in the US, and I am working during that time (so, paying taxes, filing for return every year). Last time, when I came back to the States after spending 8 consecutive months in Romania, the imigration officer at the airport didn't say a single word, just "Welcome back home!"

This is my last year in med school, I can't afford the time and money to start the med school from the very beginning in USA, so me and my husband had to go for this sacrifice, even though he is visiting me twice a year.

When we spoke to the authorities, they said he can send the folder [I 751 plus the whole nine yards, including the official document in english stating I am a student, meaning I have a valid purpose to be overseas] while I'm not there. Then, supposeably, I recieve the NOA that officially extends the GC for a year. Most of the people I asked, said I can come back with the expired GC that is accompanied by this letter. Some, say they don't know.

I asked your opinion.

So, you think I should come back to the states before it expires and wait till I get my NOA, get the biometrics done, then can I return to Romania with that NOA and expired GC, just for another few months, to pass my license exam?

I'm sorry if my question is too foggy...

I'm no expert but as far as your GC and NOA goes, yes you can back in the country. The question of abandonment is another thing and to be honest I imagined it didn't matter until you were thinking of applying for citizenship. But as I said at the start, I'm no expert!

Feliz has a scan of his I-751 NOA which clearly extends your status for a year, as you know.

I wouldn't worry at all. There is nowt you can do except wait to see if you get an RFE for some other reason, and then let them know. I doubt they will even spot it. Don't fret! :)

I really shouldn't complain as I have breezed through the K1-to-Premenant Resident process with no delays or problems. However, after receiving approval for the removal of my conditional status, going to the closest district office (which is 2 hours away), having my passport stamped, and ultimately receiving my permenant greencard, I got a letter from the USCIS stating that I need to have my Biometrics taken again (I got them taken about 2 years ago - and they were done on the computerized system.

Has anyone else encountered this? It is only a problem because it is a long drive to the office, and they I have to go on a week day...and take a vacation day to do it. I think they may have made a mistake, but when I call the USCIS "help"line, surprisingly they are unable to help me, or give me any information....or be of any use at all!


Most people are called for biometrics again before they get approval, but it seemed you were not. Go ahead and question as to why they want them, but I would say they probably do. I too had to take time off and drive 2 hours to get there by 8am. I felt that I was lucky -- lots of people have to drive much further than that!

Oh yeah - you are technically living at a different address (or will be) than the one you gave USCIS. You're supposed to give them your new address, even if it is temporary. Since you are also supposed to list all your addresses on various forms and so forth - you might want to consider giving them the new address as a physical address, even if not your mailing address.

I didn't know we need to give abroad address as well since we're only visiting my parents there, just a really long vacation (a few months)... but now that you mentioned it, I am not quite sure how to notify them of a new physical address? I think I'll call the hotline, so thank you for bringing that up! :)


I really wouldn't bother letting them know. You are not living there, just staying there on your travels. What if you were backpacking for 2 months?!! You haven't moved house or anything which what they always want to know.

Mine was less than 10mins though I stayed in the office to ask other questions. Whenever I visit the office there is never anyone there. The security guard must get very bored. :reading:

Wow that is odd! I thought every government building has one. Who lets them in and takes the letter and stuff? They even have an x-ray machine in the waiting room which takes up more than half of it. Thing is, you're already in the building, so putting stuff through the x-ray machine kind of defeats the purpose. The security guard can never be arsed to turn on the x-ray, so uses his plastic ruler to poke through your files instead. :rolleyes:

No. There is a new policy that they won't stamp your passport unless your card has run out or unless you can prove you will be traveling while your card is running out. My card arrived today, by the way.

Hi folks. Glad my list is useful. As you can see from my timeline, I was approved without sending any pictures of us, so it can be done. I sent the strongest evidence I had, and pictures was not part of it.

Crazielady - yep just a copy of GC, no passport copy needed.

They were not notarized, but I did get the people to state their full name, where they live, and their place and date of birth as stated on the I-751 instructions on P1. It also states that affidavits must be supported by other types of evidence, so for example we provided a dental statement with both our names on it with an affidavit from the dentist (the dentist also knows us personally).

I think we'll be submitting a bunch of pics. True, anyone can pose together for a few pics, but we've got pictures of us together at the St. Louis Arch, the Grand Canyon, Mt. Rushmore, Death Valley, Yosemite, Yellowstone, the Grand Tetons, Universal Studios, Disneyland, and a number of other recognizable and distant tourist sites, some of which (like Mt. Rushmore), are only practically reachable by a long car trip. Taken together, the photos show that we travel together, and it would be difficult to forge them all. Trust me, I would not have visited all of those places with someone I didn't love. The photos were fun to put together, and unlike voluminous text documents, it won't take an investigator long to page through them.

Now, pics of people together in a nondescript apartment don't prove much, I'll agree.

I wouldn't want to rely only upon the photos. We'll also be submitting the usual financial evidence, plus the birth certificate of our daughter. I think the birth certificate is one of the more convincing items we have.

Each couple will have collected a different set of evidence depending on their life circumstances. Just because I think our photos demonstrate a relevant point for our case doesn't mean that everyone ought to submit photos.


A fine example of why everyone's evidence is different, and there's not really a fixed list of anything :thumbs: Having boarding passes stuck on one page showing we have sat together on several long distance trips was proof enough for us...I didn't want to bombard them with our holidays snaps too. I have 30 pages of stuff including the cover letter and form. I don't think it will take them long to flick through ours, and being such a hippy I wanted to save as many trees as I could ;)

Good luck with your submission. I agree the daughter is the strongest evidence!

Thanks :) We decided against pictures as it doesn't really prove anything in our humble opinions. Anyone can pose together for a pic if needed. I can underatnd why some would send a few if they really felt the need, but sending an album full seems a bit silly. Same as anyone can mail something to themselves with both names on an envelope. It's easily manufactured and not strong evidence. If we do get an RFE for anything, we have pics, plus plenty of other evidence to send waiting in our back pockets :yes:

Thought I'd supply my list of evidence as an example that everybody has a different list, so go with what YOU feel is right for your case.

FINANCE AND INSURANCE
• Joint federal and state income tax returns for 2004 and 2005
• Joint bank account statements
• Letter from bank manager (saying he sees us in town often)
• Letter from credit card company
• Joint health insurance cards

UTILITIES
• Joint electricity statements
• Joint gas company statements
• Joint phone company statements

MISCELLANEOUS EVIDENCE
• Itineraries and boarding passes from trips we have made together (3 pages in total)
• Dental statements showing shared account
• 3 affidavits (one of which was from the dentist to tie with evidence listed directly above)

Whole package was 30 pages long. Fingers crossed it'll be OK. I'm certainly not too concerned. This was by far the easiest part of the whole journey :thumbs:
