Im just wondering and if anyone could pls advice. My husband and i got married in philippines last year. Are we still considered fiance/e in the eye of US law even if we got married in PI already? Are we eligible for the k1 visa or should have filed spouse visa instead? Thanx for the help and answers in advance =)

CR-1 is the only option you've got. K-1 is a non-spousal visa.

K-3 may be an option, however.


This is not an option as it is obsolete and administratively closed.

Doesn't sound like a "my bad" but more a "my didn't know".

When there are K-2 children involved, there is no petition for them. When the USC submits a K-1 petition, they must list all the beneficiary's children, even if they're 40 and married with their own kids.

It's then up to the beneficiary to submit a visa application (once their petition is approved) for the K-2 that's either for issue alongside the K-1 or to follow within 1 year of the K-1 issuance.

Each Embassy has a different set of protocol. Unless it's changed in the past 8 months, London didn't require my then 10 year old to attend interview, I just submitted forms and her passport on her behalf.

I think the more important question in terms of what to do is how/ when were you planning on your 6 year olds on joining you?

If you wanted them to travel with you from Dubai, then you may as well get them to do the medical and visa interview (if necessary for them to attend) with you in Dubai. If you were planning on getting the visas and then travelling back to Manila to then fly to the US from Manila, then why not delay the departure from Manila and do their K-2s as 'to follow'. This would mean you get your K-1 in Dubai, travel to Manila to "supervise" the kids through their K-2 medicals and interviews, therefore processing their visas as though you were already in the US?

In any case, I would check with Dubai first to see what they suggest.

But she didn't. She said "apply for him in Manila". Filing a petition is not the same as applying for a visa. They are separate actions that occur months apart in different countries with different US Government agencies. Don't interchange the terms.

I'm not trying to interchange the terms. I guess I should not have used the term "petition" until it's said and done by the OP. My bad!

There is no separate petition for children in a K1/K2 case. One petition with the children listed, then separate visa applications, medical exams and visa application fees. Fees are paid in advance of the interview IN the country where the interview will take place. Certainly, the OP has the option of having all the medicals and interviews together in Manila. On the original petition, which consulate was shown as the one where you would apply for a visa?

Your thread says interview for K1 & K2. Meaning that you already filed the petition for your kids.

You also stated above that you now understand a bit more and that you will may be applying for him in Manila.

I'm a little bit lost. :blink:

If your kids are in the Philippines (as you mentioned above), they will then have their interview at the US Embassy in Manila and that the visa payment must be done at one of the BPI branch near you.

Not during the interview but BEFORE!

Don't expect these quick approvals to be the norm at all. CSC is still taking five months to approve petitions.

Hope and expect are two different things with two different meanings.

The poster above didn't say he expect for a quick approval...he said hope.

And besides, what's wrong with someone hoping for a speedy approval?

Funny! Coz we never got this famous "touch/ed" so to speak until our case was approved.

After I got here, we logged onto the USCIS website and guess what? Our case status was still "pending". :bonk: I dunno know now, though. :lol:

I guess, what I am traying to say is...just relax and don't worry about it.

1. i have seen her more than 8 times since 2009 but we do not have pictures together but we do have pics of each of us in same room so u see every thing is same in back ground,
but do have phone records, many plane stubs and copy of passport will that be enough as she is from the Philippines.

If St. Luke's will allow you to bring the result yourself, then, it won't be a problem. Otherwise, you have to have your medical done at least 4-7 days prior to your interview.

I seen this one coming, no offense but why do you insist on finding a filipina and why so much younger than yourself? Maybe finding a Filipina more mature with commonalities would help? I understand why you dont want an American woman but theres plenty of foreigners in the U.S to choose from and you can probably save a fortune in not having the expense of flying half way around the world. IDK Just some suggestions, yes im with a Filipina but i didnt go looking for mine i was sent to work in the Caymans and met her that way.

I would like prep up my fiance whenever her time comes in...

The interview is the easiest part of the entire visa process but, you should always be ready and be prepared for an "unexpected" question(s). :P

You'll be fine however if you are relax, confident and of course, answer the questions, truthfully.

You are required to have met face to face.

No correct amount of time for your relationship. You do have to prove a bona fide relationship. Meaning that you are not doing this simply for immigration to the US. Do some reading in the K1 forum and the UK forum to get a sense of what is typically sufficient to prove the relationship.

An LLC may elect S Corp tax treatment by filing IRS Form 2553 (Form 2553 Election by a Small Business Corporation).

OK, then he should, technically, be an employee, not self employed if he has an LLC, right? In that case he will have regular paychecks and witholding, etc. (or at least he should)

Shareholder-employees will receive two tax documents from the S-Corporation at the end of the year: a W-2 wage statement (income as an employee) and a Schedule K-1 statement (income as an owner).
