No, I have no issue with Philippine immigration we are married so I get a special visa.
My problem is, I am worried that my stay of one year here will affect the visa process.

What no one has come out and said, is that there is no divorce in the Philippines.
If your wife was realy married before then you are not married.
there are two countries in the world where there is no divorce and the Philippines is one of them.
The reason is the strong catholic influence. You are not married and cant get married to her.
The one obscure exception I have found is if her husband is muslim he can divorce her by saying I divorce you
three times. This exception was made to placate the muslim terrorist/ freedom fighters who dont think they
should be controled by the goverment in manila. A muslim woman can not divorce her husband in this fashion so dont bother converting her.
I went through this 20 years ago. If you look on the Filipino Kisses website about 30% of the women say they are
divorced. they are not there is no divorce in the Philippines.

since you are in this deep already; If you are lucky she married an old man when she was young. which would mean
there is a good chance he was already married to someone else before he married her and therefore their marriage is null and void.
It would also increase
the chance that he has since died, meaning that she was free to marry.
You can not take her to another country to get divorced. the US will not "recognize it". they will go with the philippine law which would not recognize it. there are annulments in the Philippines generaly reserved for the rich and famous. You can probably pay a few thousand dollars and get an anaulment. There are misc grounds for anaulment like the marriage was not consumated. But more than likely she dosnt fall under any of the grounds available so you would have to pay the big money and tell a big fib. there is an excellent chance your "wife" was perfectly aware of this and with a desperation born of poverty was willing to shoot for it.
dont bother with a fiance visa she dosnt have capacity to marry.
to sum up, If she was married to a muslim man he can divorce her.
Other than that prove that her first marriage was void because the husband had a prior marriage.
or take a chance on trying to "buy" an annulment. Im not sure if you already filed or not.
If you have not filed yet you might get the idea to just not mention the marriage but the Philippines has a national marriage registry which means it would be fairly easy for the consulate to find her prior marriage even if you managed to get a certificate of no prior marriage. also if she had kids with the prIor husband that would be all over
their birth certificates. to really sum it up "YOU'VE BEEN HAD" I went to three different lawyers in the states including at least one who had offices in the Philippines, they all said you are not married and cant get married. Dan

We will be getting about 5 of those 13 affidavits signed today before we send them off, as for the pictures we are going to send some from each visit and the wedding.

Still not sure about the Skype logs and letters/emails though..

You can go ahead and include some of your Skype logs, letters and emails to prove of your ongoing relationship as everybody else did.

Thanks to both of you for the responses. I do have the same instructions as George, if they are going to make a big deal out of them not being signed then I will have to correct it. As for now all that is done and now on to the pictures we are going to include. Any idea on how much is too much :)


Can't really tell on how much is too much but we definitely sent a bunch and it worked.

As for the affidavits that you mentioned above...ours were all signed (of course by the third party) and notarized.

Well if she has a tough time keeping her story straight here on VJ, I guarantee that USCIS and the U.S. Consulate will have a tough time believing her too. I can bet that her chances of getting a Visa is an absolute ZERO. I had a little sympathy for her at first and then lost it all as her story unraveled and became completely inconsistant.

Hello Everyone...
I just want to share my story here if there is some who has the same of my story.
Here is my story : I came to USA as a k1 visa full of love and happiness with my fiance but we didn't marry due to the complicated situations ( to make the story short ) After the bad situation happens i stay with my aunt and so on i meet a friend of my uncle and we became friends. Everyday he calls me sometimes he visit me in my Aunt's and Uncles house with their permission but at the times goes by we fall in love and we married 10 days before my K1 visa expired and we are happy living together as what i have observed he is a great guy he introduced me in his family and they are a very nice people and family oriented . So My Husband went to the one of the senator's office to file my AOS and one of the senator's lawyer entertain him but the lawyer said that he can't file the AOS because he is not the petitioner and that is against of the law so the lawyer said that since we are already married i have to go back to my home country and while he filed the K3 visa.My question is :

1. Are does someone have a similar situation? If has are the Embassy doesn't give you the difficulties? or can you still come back here?

2. Do i have to change my status in my home country as a married woman eventhough i marry in states?

3. Do i still have the assurance to come back in states and be with my husband?

4. I already have the records of fiancee visa is it possible that the consulate in my home country denied mefor k1 visa?


Thanks any advice would appreciated...

PS.. Im already here 100+ days but i have a waiver that i still have the 180 days here to stay eventhough me and my petitioner didn't marry but i marry with the USC. So i have to leave the country before the 180 days expired.:( :( :(

I agree, stop typing in all caps! Second, why are you mad? Third, and important, what was wrong with the photos? We are here to help but keep emotions in check. Remember that many thousands of us go through monthly without an RFE for a photo so something was missed. Have her take the correct photo, send a bmp file (much clearer) and you can print them at your US home on photo paper and it's the same as printing them there. BREATH my friend. Now is not the time to get mad, but to get focused.

At 32 my eyes are already "bad" therefore CAPS does not bother me at all. :lol: Kidding!

Why is he mad? Good question! He shouldn't be. In fact, he should be happy because getting an RFE indicates that their case is being processed! :yes:

Same thing happened to mine/ ours. I sent the whole packet to NVC myself (including the two 2x2 size photos) and one week later we received an RFE list asking/ requesting for my pictures and a copy of my passport.

Reason? It got lost! :blink: Ridiculous!!! So I sent in the requested documents and two weeks later our case was completed!

Your marriage date appears several times in the package you filed. If it is only incorrect on one of the two G325a forms but IS correct on the other G325a, the I-130 (three times) and the marriage certificate, I wouldn't worry about it.

Sometime is a good idea to book a flight/ purchase a plane ticket early but most of the time is NOT. It happened to us.

We're just fortunate that my husband was able to reschedule my flight (JAL-American Airline) with no cost.

Hey JAPrincess...Honestly. We just printed our pics from our wedding and other pics from trips. They were regular 4 x 6 printed at the local Walgreen's Pharmacy. They were in no plastic protectors or anything else but just placed in the package. No request for further evidence received. However, we did provide quite a few pics. Hope this helps but I don't think that there is any need to jump through any extra hoops. Take Care..

NVC forwards everything to the Embassy. However it is always good to have all the copies in hands during the interview, most important the AOS (Affidavit of Support).

Based on what I have read here on VJ, that most applicants were asked for it and only a couples were not (including myself..they didn't ask for mine), so be sure to have yours with you.

i read the guidlines for cr1/ir1 but still not sure about something. my wife's interview is in 2 weeks and my lawyer mentioned she will get packet 3? is that true? does she need to fill anything else like DS 230? because i remember my lawyer filled hers and mine out and sent it with the I864 packet to the NVC. any help is appreciated, i'm trying to get my wife prepared for her interview and seems like something always comes up to get paranoid.


I'm not sure how the Vietnam Embassy works with regards the DS-230. But in my country, we are required to bring/ submit one at the interview.

I'm guessing that the I 134 is for Fiance' paths and the 864 is for marriage paths......we're I-130/CR1-IR1 path and the 864 Affidavit of Support is all we were required. Someone please correct me if my guess is wrong.....

I-134 is for (non-immigrant) K-1/ K-3 visa applicants and I-864 is for (immigrants) CR-1/ IR-1.

You only need the i-134, i-864 is usually used for AOS.. :) but you are more than prepared!

The OP is a CR-1 (immigrant).

She does not have to do the AOS after she arrives here in the US, therefore she need the I-864 not the I-134.

the reason why they are asking for 'new' copy is because NSO is changing the color of their security paper yearly. The CO will know if your documents are new or not. NSO security paper is in yellow/brown now. They changed it yearly.

friends, our birth certificate copy from NSO here in the Philippines doesn't have an expiration right? but i remember that i've read before here in VJ that one consul ask the applicant to send them a NEW copy during her interview-which makes her visa to be delivered late. i just cant find that forum again.. if its true, how did the consul find out that the copy is old enough? coz i'm confuse if i should ask for NEW copy where in i have lots of original copies with me now? please tell me if anyone here passed their old copy-how old was your paper?

and the NBI clearance, does anyone here passed that even if it's 6 month old, im really scared that even its expiration is 1 yr, they might ask me for a new one.. THANKS in advance!!! :)

The best/safest thing to do is to get a new certificates two weeks prior the interview.

your husband can start filing a K3 petition for you even with or w/o you changing your family name...however, it is much better and alot easier to change your surname in your passport over there in PI than over here in US i suppose...i maybe wrong though...

Why do you think you need help completing the paperwork?

My wife and I did it all ourselves. Read and follow the instructions and like another post said, it's all straight forward.
I did meet with an immigration attorney but, only to review our completed forms and (later to) get some further insight about the process.
We used him for a sounding board. Met with him 3 times ($75 each) throughout the whole process. He did give us some good ideas regarding prep for the interview but mostly, he just confirmed everything we had read on this site. Did give us a little more peace of mind but our best resource was VJ. Perhaps a visit with an immigration attorney prior to the interview might garner you some good tips. Consider, this process takes time and maybe your fiancee can work on her english and be more prepared to communicate comfortably.?
Another thought, before you spend money on form fillers, there are other costs (nickle and dime and a few good pops at the end) that might encourage you to do the paperwork yourself.
Sorry if your not getting the responses your looking for. I used to change my own oil but now I pay some1 to do it bcoz I have better things to do with my time. Maybe your thinking the same way about this?

i tried to search the estimated cost for the medical and interview. i don't have any idea how much it cost for the tickets, hotels, etc. all i know is the visa fee $131. anyone here will give me an estimated budget for all of these?

*plane ticket from cebu to manila (medical) = you can call your local ticketing office and inquire
*hotel good for two nights? (medical) = 2,500-3,500
*food = depends on what kind of foods/restaurant you like
*pocket money, etc. = you can bring all your money as you want :lol:


interview = your welcome
*visa fee delivery = 115-250
*plane ticket from cebu to manila = same as above
*hotel 1 night
*food
*pocket money, etc.


other expenses like:

NBI Clearnce = 250
NSO BC = 150
Cenomar = 180
CFO = 650 (250 for seminar and 400 for sticker)

this is her history:
for the first 2 times she applied in 2006, we didn't know each other yet.
she was married to a Filipino who became a US immigrant and had her on petition but it was taking a long time.
she wanted to have the option of being the one to visit her then husband since he was busy working.
she was denied in both tries.

we met in 2008 in the philippines. she was already annulled then.
i was working in manila but recently i had to go back home and continue my work here.
she applied for the 3rd time last year so she could go with her mom on vacation but again, she was denied.

we want her to have a tourist visa so she could visit me when she has free time from work to see each other.
we know that k-1 visa will take some time processing and we want to have the option of visiting each other.

but we don't want it to affect our K-1 visa application that's why i'm seeking advice from those with experience if it's wise to do it or just forget about trying for a tourist visa.

are you saying that most people apply for a tourist visa to attend a work training program?
I think the mutliple tourist visa applications might raise a red flag for the CO.

My fiance and I are having a dilemma on whether it's safe for her to apply for a tourist visa before we apply for K-1. One lawyer we consulted said that it's best not to apply for any other visa types if we intend to go for the K-1 route. But I would want to know experiences of other people here.

My fiance and I have been together for almost 2 years now and it's always me visiting her in the Philippines.
Before I met her, she has been denied of a tourist visa 2x (because her previous husband was a US LPR - a Filipino) and when she was already annulled, she was again refused a tourist visa (just last November 2009). Total of 3 tourist visa denials in the past 3 years.

She hasn't met my family yet and I want her to see my hometown and spend time with my parents and brothers before she goes here for the 90-day marrying period on K-1. The only way we can do that is if she applies for a tourist visa. But like I said, some people advise against doing that.

To be honest, I want her to go here on vacation first and see where we want to live before she actually goes here for our marriage later on.
I can't always be in the Philippines to visit her during the waiting period for K-1 visa so it would be great for us if she has the capacity to visit me too.

I hope to see others with a similar experience share it with us and others who would benefit with the stories too.

There is only one fee that have to be paid at the Embassy...the air21 visa fee delivery which is Php115-250.

Sending proof of relationship at this juncture is optional. However if you choose to front load to some degree, then copies of cards and letters are certainly a good thing. And bunch of pictures, receipts, boarding passes (with our/my married name(s) on it and notarized affidavits from relatives and friends etc...


This is exactly what we did and it worked.

i am here now in united state by k-1 visa. but all of a sudden my fiance back out and had an affair to another woman. anyways to make my story short i left him and went to a friend and now i already overstay my visa.. not that long cause it just expired a few days ago.

he bring me here and just throw away our relationship so i needed to take care my self now. it's kinda hard cause i am alone. so i am left with so many choices .. i heard that k1 visa cannot be adjusted and if i stayed and find my self a decent guy on the future i will not be able to marry him too..

so my question is if i overstayed here for few months, go back to my country and marry another guy (us citezen) will i be able to go back then?

You don't need your fiancee's CENOMAR when filing the petition. She only needs it during the interview.

oh we didn't think of doing the print screens.... thanks for the responses guys.. we appreciate it. i guess the same goes for email logs...
we have like 700 pages of chat logs in YM. sigh...

We had over a thousand pages of chat logs, printed 2-4 copies each month, brought 'em with me to the Embassy and they didn't even look at it. :o

Effort was wasted! :P
