my husband called to ask what are the needed papers he has to include esp at the proof he says the only thing they ask is marriage certificatre from NSO.

In our case, we dind't have a copy of our MC from NSO when we filed our petition. All we had was a certified true copy.

We sent in one along with the package and have had no problem.

Is it really necessary to have a sworn affidavits?

Sending a sworn affidavits in ain't gonna hurt you. So, if you think it's a good idea to include some with your petition package, do so.

Some people do and some people don't. But, in our case, we wanted to make sure that we won't get RFE.

However, we didn't send that much of emails/logs. We only sent in a few and we were fine.

Looking at your timeline, I assume that your husband is the beneficiary and only the alien spouse fill up the said form. So therefore, the answer to your question is, yes. Regardless of his zero communication with the kid.

thanks all ....... actually I have called NVC and they told me to wait until 20 days had passed .... and the only sign in I know about is the one I paid my fees through for the I-184 and the DS-230 ... so I will wait a bit and then keep trying . thanks again

I think that's the (sign in) one that vj'ers are talking about. We didn't have one so I'm not really 100% sure...

I just sent out my i130 a week ago how much longer do I have to wait for my NOA1? I know this is a stupid question but I want to be with my wife!!!!

If you are a CSC filer, you might get lucky and get approved within 2-3 months. But if you're a VSC one, then expect for your NOA2 in 5-8 months.

Good Luck! Its better to be there early as possible. I went there at 3:45 in the morning and I was 11th in the line! lol. They started at 6am and have finished at 9am.

1. Q 14 . Name of spouse (Maiden or family name) : this will be her last name prior marriage. Right? What should I put for her Middle name? Should it be the one prior to marriage or post marriage?

2. Q 16 . Address of Spouse (If Different from your own) : My wife is the petitioner but she is living with me in India since last six months but her principal residence is in US so should I fill her US address or leave blank as if her and mine address is same in India ?

3. Q 24 . Mother's Family Name at Birth : What should mothers middle name be? Middle name before marriage or after marriage?

4. Q 32a/32b Person(s) name in 14 and 29 who will accompany you/follow you to the United States now : Person name in 14 is my wife the petitioner who is already a US Citizen.how should I anwser that question ?

List your wife's and kids (if any) name(s) as a person(s) who will accompany/follow you (later)...

It is both funny and heart wrenching to see the lengths couples go through for status checks during this process. I assume it is because we feel so helpless once our packages are submitted. Looking for "touches", "comparing filing dates", "looking at Igors list", etc etc etc. Lol, mine was going on the USCIS website and entering case numbers lower than ours; then watching for status changes. When I would see approvals on cases just a few hundred numbers lower than ours I would start to get excited.


Watching the status etc. is making people crazy. :lol:

I'm sorry, but your lawyer is an idiot. All petitions that are approved for spousal visas, such as yours, go through the NVC. They compile your case file by requesting additional documents from both the petitioner and the beneficiary: petitioner submits financial stuff and beneficiary submits immigrant visa application and supporting documentation. It is also during this stage when the financial fee is due as well as the immigrant visa bill. Once both are paid and all required documentation has been received, THEN the NVC schedules your interview at the indicated consulat/embassy and forwards the entire case file to that embassy.

Only the finance(e) petition files go straight to the embassy/consulate. The NVC assigns a case number and moves it along and all contact is done directly from the consulate.

If a lawyer does not know this, I would fire him/her.

If I missed anything, please, someone let me know, but from going the CR-1 route, this was my experience.

NOA1 received 4 Feb 2011 at the California Service Center. NOA2 received 27 May 2011. Paperwork enroute to NVC. The processing time is 5 months. Ours took just under 4 months. No RFE's or anything. So for all of you thinking of hiring an attorney I would recommend against it. I just made a check list based on all the documents needed and went over it 3 times before I mailed it in. An attorney was going to cost more than airfare and I still had to pay the fees as well. I found the USCIS people to be polite, professional, and helpful when I called.

My wife and I are so excited now. The hard part is over. I am just waiting to pay the AOS and visa fees then we should be all set for her interview.
