Getting married on a K-1 visa is not "reporting" the marriage--it is just getting married under the laws of the state where you have the ceremony, and it doesn't have to be the state where you live. For example, we live in NJ, but eloped in NYC because we thought it would be romantic--and it was !!!

Doesn't the K1 visa holders needs to report their marriage to the consulte here in the US after marrying, ie. Philippine Consulate? For it to be recognized? I'm not a K1, so what I wrote was just based on what I read here on VJ!

i thought the same... but one of her cousins told her that they knew someone who got deported back because they didnt "legitimize" their marriage.

You shouldn't be running to believe the "hearsay"... coz most often, if not always...hearsay will drive you crazy...so, be careful in listening to "it"next time.

who's telling you that your marriage needs to be legitimized?

If yer a USCitizen,
and
she's come in on a spousal visa,

you already represented to the US Government that you've married a foreign national, they gave her permission to immigrate based on yer marital status.

If you'd read something that clearly states you MUST make steps to LEGITIMIZE the marriage, I'd appreciate an url.

I got one question maybe u can share some of your insights. Me and my husband applied for i130 and i already have noa2 and we ar e waiting for case number from nvc tomorrow tuesday... We filed the all our papers under my maiden name will that be a problem? and my passport and all my documents are under my maiden name.... any violent reactions?


As above poster said, you can fix it long as you present your MC... and, be sure that you'll be using a match passport when you travel.

Interesting, back in 2007 my wife was able to change her passport (maiden name) with out the CFO seminar first.


I'm not sure when the DFA changed that policy but, it seems that everyone who is married to a foreigner requires to do the seminar, first.

<BR><BR>You're welcome! I found out about the CFO thing right at the DFA office. I had no idea about it until I went and was told to "attend the seminar first, then come back and bring the certificate".

Hi!

My wife (in the Philippines) is changing her name to mine, and will order a new passport. I turned in our I-130 etc in her new married name.

Does her NBI and medical clearance need to be in her new name? Does she need to wait for her passport before proceeding?

FYI, your wife cannot amend her (maiden name) passport without the CFO certificate. She will be advised by DFA to attend the counselling first in order to have the said certification.

Is it the IR-1? We are planning to apply but we don't have yet any knowledge on what to do yet. Did you do it yourself with your hubby or you are using a travel agency?

I assume that you meant Attorney. Using an Atty. is a waste of money.

You will receive the NOA1 in a week or two from the date of filing.

You can also start gathering all necessary docs that proves your ongoing/bonafide relationship while waiting for the NAO2.

Well folks I've got some bad news. After paying the AOS and IV fees, sending in all the required forms, and waiting for nearly a month... I get an email yesterday from the NVC saying they also need my wife's DS230 and all civil documents. HUH? The embassy website clearly states these documents will be collected on the day of the interview. So I call the NVC and they confirm that the documents are required before an interview date will be set.

Fortunately we had completed the DS 230 two weeks ago and it only needed to be printed out. So she sent a Fed Ex envelope with all the documents to me yesterday and when it arrives here I will include the email letter and cover sheet and send it to the NVC for another month of delays.

For those of you at the stage of AOS and IV fees do yourself a favor and triple check everything. Even call the NVC with the list of documents you have and see if they are going to work.

That's not a bad news at all.

DS-230 is one of the required documents at NVC. Without it, your case will never be completed. Your wife would also need to bring a copy of her complete (UNSIGNED) DS-230 to her BIG day. She will be asked to sign the form during the pre-interview.

I completed my DS-3032 and DS-230 and mailed 'em to NVC myself.

after reading lots of stories here about marriage interviews, i came across this valid interview but was mistakenly thought to be 'fraud. so everything basically depends on the documents and the actual 'conversation'?? do they actually arrest you right there and then if they find out its a fraud? just wonderin the typical scenario when an IO suspects the couple to be fraud. thanks

Nobody wants to get REF'ed and if someone get any, they usually feel scared, stress and frustrated. So, my advice would be, just IGNORE those who mimick you for as "SIMPLE" as the "Check List" that you received. Their ignorance shows who they are. :whistle:

Like other posters have said, calm down... and when you are already relaxed, pick up the phone and call NVC. They will answer your query clearly. :yes:

Thanks for all the input, the good thing is my command is calling and asking for expedite processing, I have a Navy Commander that is really pushing for her to come here since we've been apart so I am grateful. Right now my biggest thing is waiting for the PCC from Malaysia, she is doing that first thing in the morning. I hope we can get the expedite approval since we were approved at USICS. He wants to call NVC now and get the ball rolling, but I was told until you have a case number you can't call?

No problem.

Based on our case, my husband was able to call NVC (he'd bug them almost every day lol) before we had our case#.

Just wondering, is making through USCIS the harderst part of the journey? My petition was approved in 31 days and now is working it's way to NVC, any suggestions to keep it moving....

As above posters said, the most difficult part of the entire process is at the embassy. However, it'll be the mostest smooth and painless one if you are loaded with the proof of your bonafide relationship and, if ya know ALL about your husband/ petitioner.

Thank you. Sample form DS 230 from web site is not helping me at all. I have looked that sample many times so far. This sample is single woman applying for naturalization visa or i94 process. I did google samles of DS 230 form and could not find right sample. All of them are for divorced couples or single petitioners.

That....is actually the right sample. All you have to do is go to this site travel.state.gov for an updated form and fill it up with your (benificiary) spouse's information.

It's really easy.

dejan, EITHER (not neither, as one of the posters said) you or your spouse can fill the form. You or her can do it, but all the information has to be about your spouse (the beneficiary), not you. Remember, everything is about her, she's the immigrant applicant. You're already a US citizen, you don't need to "apply" for an immigrant visa. And, it's all her signatures, not yours. Just don't have her sign Part II.

That'll explain your question there.

I know. I went through all that. Right after I received my visa I went to seminar and obtain my sticker in one day.

Will explain her situation they got married APRIL of this year, submit I-30 package around MAY and waited for their NSO marriage certificate and went to DFA with all the requirements needed and had her passport around third week of JUNE and never asked for CFO seminar or sticker. I don't know why she was able to do it without the CFO seminar.

Apparently, your friend/ cousin is lucky, IF, she was not really asked for the cert. :wacko:

she just brought her OLD passport, NSO marriage certificate,NSO Birth Certificate and SSS ID and never asked for CFO sticker. She is married to a guy from california. And same with some of my friends who are now in Europe they change their passport's last name first. And as soon as they have their flight scheduled they went to CFO seminar.

CFO sticker can only be obtained/ stamped after you received the visa NOT during the seminar.

FYI, for women, married to a Foreign National you need to secure the CFO Certificate from CFO OFFICE (Commission on Filipino Overseas) and present it to the DFA before claiming your renewed passport.

  • Marriage Contract (MC) in Security Paper (SECPA) issued by the National Statistics Office (NSO) and Certified True Copy issued by the Local Civil Registrar (LCR) if MC SECPA is unreadable.
  • Certificate of Attendance (color green) from CFO (Commission of Filipino Overseas) if married to a foreigner.

I do not know about CFO seminar but you can always apply for renewal/change of passport on the basis of change of name due to marriage without taking CFO seminar... and it can be done in the nearest DFA office...

I am. NVC did not change my middle name. I am using my father's last name as my middle name. I'm glad NVC left it at that.
