K-1 Fiance(e) Visa Process & Procedureswhat false information can do to you

as we all know, ive been on VJ through out my whole visa process and thanks to this website i like to think of myself as some kind of...well pro in simple and normal cases.
to sum it up,i spent 4 sleepless nights looking for that information,so from an old member to the new ones, double check each and every piece of information you see on this website

 "Pro"? "4 sleepless nights"?
:hehe:   Thanks! :hehe:

I think that should go without saying.
Nobody here should take any posts as 100% fact without doing any additional research.

Correction, overstay is forgiven when AOS is APPROVED, not just applied for. If AOS is not approved then the overstay counts.

IR-1 / CR-1 Spouse Visa Process & ProceduresReceived Good News today - So What's next?

Thanks for the reply. How long was it between the time you were notified about the interview date and the actual date of the interview appointment? From what I've been seeing, it's about 1 month out. Does anyone else have an experience with their case being expedited? And how long did it take for your interview to be scheduled?

You're welcome.

Our case was completed on the 23rd of July. We received the notification/ appoinment letter five days later (on the 28th) stating our interview schedule, which was set for September 25th.

So, almost two months.

IR-1 / CR-1 Spouse Visa Process & ProceduresReceived Good News today - So What's next?

I just got off the phone today with NVC and they told me that my case is completed. A couple weeks back, they requested some information like my birth certificate so establish relationship with my parents since they are co-sponsoring my wife and step daughter. What really sucked is that I sent my papers in on a Thursday (5/26) and on Friday (5/27), I got a letter in the mail stating that my request to expedite my case has been granted by the US Embassy in the Philippines. I had to options, to send in a new set of papers to "ATTN: SUPERVISOR SUE" or just wait it out since my papers were delivered to NVC on 5/31. I chose to wait it out and it only took about 10 days for my case to be completed (6/10). Because my case is expedited, does anyone know how long it takes to have the interveiw scheduled? I already sent my wife to take her seminar and I plan to have her take her medical exam early next week. I'm hoping the interview gets scheduled in the next couple of weeks but is this wishful thinking? Has anyone else had their case expedited? Thanks for all your help.

Congrats!

Our interview was set exactly (5) five days after our case was completed.

Good Luck!

I also just received notice that my wife's case is complete. How were you able to request her interview be expedited at the Embassy? Is it too late for me to request an expedited interview for my wife? Please advise.

Nonetheless...congrats!!.. It's been a LONG visa journey for us... we're in the home stretch and the finish line and our wives airplane is in sight.

Congrats!

Best of luck to you and yours...

IR-1 / CR-1 Spouse Visa Process & ProceduresI-130 packet options

Just a follow-up to the first question..

For Marriage Cert (I know it says copy, but when making a copy the certificate's background shows "void" - is that OK?)

I've never heard of this "void" thing before.

I'm confused. Coz we made several copies of our MC back in the visa process and there wasn't any "void" in it at all.

Yes. But don't overkill the package with those items. A few of each are sufficient.

what is poe? the 1st airport you land in US? or the state you will lived in? thanks

Correct.

A port of entry (POE) is a place where one may lawfully enter a country (i.e US). It typically has a staff of (immigration) people who check passports and visas.

That's not unusual. NVC reviews a package, then issue a false RFE asking for the other package without checking first if that package is there somewhere.

We had the same thing happened twice and everything was fine. However, I'd call them and find out to make sure that everything is OK.

IR-1 / CR-1 Spouse Visa Process & ProceduresPrepping for the Interview in Manila

Thanks all for your replies and advice. What's really strange now is that when I emailed the embassy directly regarding our case being expedited, they replied to me last night stating that my wife's interview is on the 7th now. It's really strange to have 2 dates. My wife called and they confirmed that her new date is the 7th. That's less than 2 weeks away now. WOOHOO!!!

That's a good news! Good luck with the upcoming interview.

Why you guys have to hurry to get married before many things have a chance to get sorted out ?

Unless you both are senior citizens who have limited incomes and health issues or there is religious or cultural issues ,etc.... you better explain the real reason , loud and clear.

IR-1 / CR-1 Spouse Visa Process & ProceduresQuestions regarding DS 230 form

my questions are:
DS 230 part I:
after sec 32 where it ask to list all employment for the last ten years it has a question where it says
"In what occupation do you intend to work in the United States?" - do we have to list a specific occupation or can we say something like
planning to study further in management or can we say managment related occupation. so could someone help me in how to answer this question correctly or give me an example as to what they have filled.

I listed "None" on mine since getting a job is out for me (and had no problem).

DS 230 part II
questions # 43a and b: when it ask "do you want the social security administration to assign you a SSN and issue a card? (you must answer YES to question 43b to recieve a number and card)" this seems tricky to me, i am thinking the answer should be yes that ofcouse we want to assign SSN
so am i correct? should the answer on both parts be YES

I clicked the "YES" box and received my SSN card a week after my arrival.

Hope this helps... Good Luck!

IR-1 / CR-1 Spouse Visa Process & ProceduresGot the IR1 Visa

Hi,

got the IR1 Visa and I am moving to the states on tuesday with my big brown envelope.
Do I need to do anymore paperwork to get the actual green card or will it be automatically mailed to the address I indicated in the visa application?

Congratulations on receiving the visa!

Fortunately, there is no more paper work for you to do after your arrival in the US (until the citizenship). All you have to do is wait for your (10 year) GC and SSN card to arrive in the mail.

Best wishes...

IR-1 / CR-1 Spouse Visa Process & ProceduresVaccinations at Medical Exam

Good day to all. One question that we have not been able to have answered is one about the vaccinations being given during the medical exam. Does anyone know if my wife must have all required vaccinations before going to the medical exam or will they be administered during the medical exam. If during the medical exam is there an additional cost for the vaccines?

Thank you in advance for your answers.

Yes, they will... and No, there is no additional charge for the vaccines.

Good luck with your wife's medical.

IR-1 / CR-1 Spouse Visa Process & ProceduresWife in America, now...

If you wanted to get remarried in the church, fine, however you could not legally marry again. Until you divorce from the "first" marriage the second would be void. You would have to declare you're already married and they would deny you a licence. If you don't declare it you've committed fraud.

Basically it can open a huge can of worms when it's totally not worth the hassle. Have a "re-commitment" ceremony, have a church ceremony with no legality.. but don't risk doing it legally because it would be illegal (unless it's specifically a "remarriage" as Magical was discussing)

You nailed it! We had the same plan after my arrival here in the US and, we were declined right there at the marriage license office soon as they found out that we were already legally married.
So, we ended up renewing our vows, instead. :)

Also, in the Philippines many tend to register their marriage. It's not an immigration requirement but I think that's what the previous post was referring to. It's not mandatory, but many do it.

IR-1 / CR-1 Spouse Visa Process & ProceduresWife in America, now...

Getting married on a K-1 visa is not "reporting" the marriage--it is just getting married under the laws of the state where you have the ceremony, and it doesn't have to be the state where you live. For example, we live in NJ, but eloped in NYC because we thought it would be romantic--and it was !!!

Doesn't the K1 visa holders needs to report their marriage to the consulte here in the US after marrying, ie. Philippine Consulate? For it to be recognized? I'm not a K1, so what I wrote was just based on what I read here on VJ!
