I told them I would send them the money when I get it and to continue processing my papers. I did the same thing for my mortgage payment...it seems to be working fine. I want to know who your mortgage company is... I'll switch, even if it IS at a higher rate! it's Countrywide...it works well if you don't answer your phone and keep a shotgun in your house to scare away all the visitors. Did somebody already get his post-IMBRA NOA2 by snail mail? If so, what is the date written on your priority date on NOA2? Is it the received/receipt date (not the notice date) on your NOA1? I wish I had returned the RFE sooner. Sadly we had to wait until the 19th to send it back and they sent the confimation email on the 28th.... so I really hope they process my case sometime this month! Anyone out there with RFE from around the 28th???? Good luck to all of us as we deserve to hear some good news We also should have sent our RFE reply immediately...we wanted to be sure what to be put in the form...a yes or a no..took us 5 days...but took about 12 days for CSC to receive it! ". It is not what the US consulate will require to give a visa. You will need either consent of the father or a court order. Doesn't the OP's fiancee have full custody of her son as stated in her Declaration of Finality of Absolute Nullity of Marriage? Wouldn't this suffice? In my case, I do have full custody of my minor daughter as stated in the Court Decision (Annulment). I also have a Permanent Protection Order relative to R.A. 9262 (Violence Against Women and Their Children Act of 2004) granting me full custody of my daughter; my ex is not allowed by the court to come near us (including my 2 other children) within 200 meters nor even communicate to us directly or indirectly. Would the Consulate still require me to ask the consent of my daughter's father? Jo I have no idea what their document says, they didn't mention it. Is the full custody statement enough for the consulate? ... You would have to ask the consulate. Is a Protective Order adequate? ... You would have to ask the consulate. In any event, the reason for not needing the father's consent would not be the link you provided. The legal documents that you have may be valid alternatives. What I previously stated was that either the father's consent or a court order would be required. It appears that you may have the requisite order depending on what the consulate accepts. I do not know the nature or wording of what the OP has. Just because a marriage is annulled doesn't mean a father gives up all rights to his children. Thanks for the enlightenment. God bless! She said the consulate and people there were very friendly. The last thing the consulate said to her was, "Enjoy your stay in America".
