Taaa daaa! We are back safe and sound in Ohio. :P

He called shortly after I left the office to make my drive to Hamilton, ON to pick him up. They actually had his visa by 1:30 p.m. and he took a cab to the airport to catch his flight. His flight arrived at 12:45 a.m. this morning. We drove to Brantford and got a hotel for a few hours of rest. We got up morning and drove to the Windsor/Detroit crossing. Of course, I stopped in Windsor and hit the slot machines and came out 75 cents ahead. LOL! The border crossing was a breeze. We were there about an hour and everybody there was really nice. There was some drama going on while we were there so it made the wait a little easier. The customs officer that assisted us was so nice and helpful. Darcy got his EAD stamp at the crossing. We were then on our merry way after that.

I applied December for me and my daughter. We received a notice from CRIS that card production has been ordered for my 12 year old daughter and will be delivered within 30 days. Strange that I haven't received any notice yet for my card since I was the primary petitioner.

04/07/06: No appeal from Solicitor-General. RTC recorded the decision in the Book of
Entries of Judgment (as final and executory). Entry of Judgment signed by
the Clerk of Court. This was then forwarded to Local Civil Registrar.
Annotation was done to my Marriage Certificate. Submitted the Annotated
(with Annulment Remarks) Marriage Certificate to NSO (National Statistics Office)
for authentication and on SECPA (Security Paper). I got my SECPA annotated
marriage certificate after 3 weeks.
04/10-16: Holy Week; no office
04/17/06: Submitted requirements to RTC for issuance of Annulment Decree
04/18/06: Got my Decree of Declaration of Nullity of Marriage (annulment process

The question of your daughter can be a complex one depending on several factors and the time it takes. If you are both approved and granted a visa before she reaches 21 and enters in to the US, and you the K-1 gets married to the original US citizen petitioner with in 90 days you will be allowed to file for adjustment of status.

The question that arises is, does the K-2 have to be under 21 at the time of the Adjustment of Status (AOS) interview for final adjudication? The law seems clear on this to some at the USCIS, but some USCIS district offices are denying these cases as “age outs” in that the K-2 was over 21 at the time of the AOS interview. Usually stating in the denial, that the K-2 must meet the definition of a child (sec 101) and therefore does not meet the Immediate Relative status (sec 203(d)) under the Immigration and Nationality Act. The thing is a K-1/K-2 are not Immigrant petitions that fall under sec 203/204, they are Non-immigrant petitions under sec 214(d). The only real and relative age restrictions are on the Non-immigrant visa issuance, entry into the US, being under 21 at the time of the marriage, and filing for adjustment of status, but not the AOS interview.

Currently there are several cases (like ours) that are either going to court or as in the case with ours being submitted through the Administrative Appeals Office (AAO) for a certified decision. I would seek legal advice ASAP, the USCIS can and will expedite these kinds of cases where a potential “age out” might occur, but hopefully in the long run (soon) there will be a new policy within the USCIS that will clear this up.

You just affirmed the information John, my fiancé, got when he telephoned again just this week the gentleman in this toll-free phone (earlier query about sites covered by IMBRA, etc; I have to validate from my fiancé which Senator’s office; it was a 30 minute wait for a live person). The gentleman told John that my daughter, on K2, will be fine as long as she arrives the U.S. and her K1 parent marries before K2 turns 21. And you said, there is no restriction on the AOS interview. Yehey! But the AOS should be filed before she turns 21. Ok, I am hoping for the best. By the way, my daughter is presently on her 4th year nursing (last year). If she is within the timeline (we entered the U.S.; I got married and we filed AOS before she turns 21), can she go back to the Philippines on Advance Parole and finish her nursing? Or she remains in the U.S. and finish her nursing there?

One more thing, you recommended legal advise. USCIS can expedite K1/K2 if K2 is an “age-out” potential? Thanks! I thought all the while it is only for Family-based. :D John and I should hurry up. I miss him very much.

Hello everyone,

I want to thank you all for the information and insights. I've been visiting the site and learned a lot. I just joined yesterday. I am a beneficiary of a K1 petition. You would see below our journey...and it was really a journey..gone through the annulment procedures which took most of the time, money and energy and generated frustrations as well because of delays and things that happened beyond our control. And then after things turned out well, having all the documents and had sent off the I-129F, John and I became frustrated again because of this IMBRA which caused delays in the processing.

Time is gold. My other daughter is turning 21 this january 2007. She is included in the petition since she is below 21. I am positive that I will have the NOA2 soon but the interview date is what I am worried about. If the interview will be in December and got approved, is she fine? She will turn 21 on January 6, 2007. I know she will be fine as K2 if she gets admitted before reaching 21. But when she turns 21 in the U.S., does the K-2 expires? Could anyone shed light on this? I've been trying to look for sites on other K2 information. Do I have to get married as soon as i get there before she turns 21?

Another question. In the event that I still don't have the NOA2 (situation # 2) or have the NOA2 but no interview yet (situation # 3), and my daughter turns 21, what happens to the petition? what are the implications? What should i expect? Next steps?

I am praying for a fast NOA2 and a fast interview schedule and visa approval so that everyone in my family and John's family will be very happy. I have waited for so long and I deserve to be with John.

Hi Nessa...kindly fill up the empty box on RFE received... John received the IMBRA RFE last 6/30/06 through snail mail (though email notification said it was sent 6/23/06...it took 7 days!). It took us a few days before sending the reply because we wanted to be sure what category YM belongs (We put "No"). We sent The IMBRA RFE on 7/05/06...and we received an email notification that it was received by CSC on 7/17/06... it took 12 days! Had we known that they based the approval on the day the IMBRA RFE was sent back, we should have sent it immediately! Now they have stopped the approvals! :( :unsure: :clock: I pray they start the roll-out approvals again!

03/23/06: Regional Court Decision out: Declaring absolute nullity of my marriage. We were very happy! The long wait was over!
Actually, the decision/resolution made was dated February 23, 2006. It took a month for editing, finalization, etc by the
court stenographers, clerk of court, etc.
Upon receipt of the Decision, I flew to Manila (I’m from Iloilo City) and personally hand-carried the Decision to the
Solicitor-General (was praying Sol-Gen won’t object to the decision; RTCs give 15 days for Sol-Gen to appeal)

04/07/06: No appeal from Solicitor-General. RTC recorded the decision in the Book of Entries of Judgment (as final and executory).ENTRY OF JUDGMENT signed by the CLERK OF COURT. This was then forwarded to Local Civil Registrar.
Annotation was done to my Marriage Certificate. Submitted the Annotated (with Annulment Remarks). Marriage Certificate
to NSO (National Statistics Office) for authentication and on SECPA (Security Paper). I got my SECPA annotated marriage
certificate after 3 weeks.
04/10-16: Holy Week; no office
04/17/06: Submitted requirements to RTC for issuance of Annulment Decree

04/18/06: Got my DECREE OF DECLARATION OF NULLITY OF MARRIAGE (annulment process took 1 year and 10 months from
filing of petition to getting the decree) SIGNED BY THE JUDGE! Sent remaining pertinent documents to John needed
for the K1 petition. Both of us were elated!

04/22/06: John sent I-129F to Texas Service Center
04/25/06: I-129F received at California Service Center (Fr. TSC); NOA1 (Received Date)

I've already met my fiancee in person and started the K1 Visa process. I left her some money before coming back to the states but I need to send more to her.

I used Western Union Online once already sending about $100 USD as a test, which worked out perfectly. So then I go to send a $500 and they denied it. So I tried again with $100 USD, maybe the 500 was too high, but they continue to deny it. Very wierd. They want me to show up in person with the cash but Im trying to do this from the internet wity my Master credit/debit card.

So I do a google search and I find several companies/websites that offer similar services of transerfering money world wide, some specifically dealing with just Philippines.

Anyone else sending money to their fiancee by doing it online? If so which website/company would be recomended? For best, fastest, secure way of doing this? I want least hassel too but I understand the hassel is for fraud purposes.

Please advis, thanks.

John sends me money regularly (to my PNB savings account) through any PNB branch/outlet in Texas (even on Saturdays and Sundays) and only pays $9. I receive the money the following day. :thumbs:

Just make sure that your fiancee is around when Delbros delivers but in the event she is not, she should have an authorized representative to receive her visa. Delbros will not give the VISA to an unauthorized representative. If there is delivery failure/receipt of the VISA twice, Delbros will return the VISA to the Embassy. I suggest you call/contact Delbros. You can even email them at: busdev@delbros.com

We received this text message from Delbros Today at 9AM(I requested it to be delivered in Manila, not in my provincial address since I have learned that it will take only a day after release from the Embassy for the VISA to be delivered in Metro Manila):

"Delbros Delivers! Delivery for MNL2006764XXX01 starts today! You MUST leave a VALID ID & a signed Authorization letter or a delay of one week will ensue."

Delbros also texted me of my 2 daughters' (MNL2006764XXX02 and 03) visas to be delivered.

I then called their direct line 02-3392761 to verify. The lady asked me what was the text message about. I told her that the text message states that the delivery starts today. She told me to wait for the visa and don't go anywhere because it is the commitment of Delbros to deliver it within the day if it sends a text message that the delivery starts today. She said it can be in the afternoon but definitely it will be delivered within the day.

We received our VISAS at 10:15AM! (Delbros delivery man in motorbike).

Do you know .... who do we notify of the authorized representative.. the embassy or delbros?

my fiance is planning to stay with friends in metro manila after her interview...rather than go to Cavite. Again, should we now notify the embassy of her 'temporary' address to have the visa delivered? .. Or can she notify them at the interview? Or just let Delbros know?

At the Embassy, after your pink slip (approval) is released from window 37 or 38, you go to the Delbros Counter (just across; and near the door entrance/exit). A male representative from Delbros will look at your pink slip (present the slip which contains your case number and the number of visa to be issued...next to my case number is an encircled 3 because my 2 kids are included as K2)...The male representative will give you one form for each visa. That form asks you where you would want your visa delivered. And whom you would authorize to accept it for you. It also asks you of your landline number and cellphone number. I asked the male representative the timeframe for visa delivery. He told me that if your delivery address is within Metro Manila, as soon as your visa is released by the embassy to Delbros, they deliver it the following day.

After you fill up your form, go to the Delbros Cashier and pay the corresponding fee. You will receive the receipt with your tracking number...actually it is your case number.

Delbros will send you a text message same evening that they will send you a text message as soon as your visa will be released by the embassy.

If you look at the pink slip, you will see there the number of the Call Center at the US embassy (1-909-1017878) accessible only by PLDT and Smart phones. You can follow-up your visa status, if it is still under process or had been released. However, it charges at a rate of 56 pesos per minute. Of course, at first an automated machine will answer and you have to press some numbers (1 or 2, what your queries are...press again 1 or 2, if you want English or Tagalog, etc...)...then a live person will talk to you.

Processing of visa up to delivery will take about 3-5 working days in Metro Manila, 5-7 days in the province. This is the average. Though I have a friend (we have the same interview date, on a wednesday...she is on IR-1/CR-1 visa) who had her visa delivered in our province (Iloilo City). She received a text message after 2 days (friday 3 pm) from Delbros that her visa was released by the embassy. Delbros delivered her visa last Sunday but she was not around and won't give the visa to anyone. My friend picked up the visa at Delbros Office in Iloilo City. That was fast, Delbros delivered in 4 days.

Here's a tip...it worked for us...the Power of Prayers! No one can beat that. You can feel the Hand of Divine Providence working.

By the way, Delbros at the Embassy will give you that receipt with tracking number and at the back of that is an authorization for your representative to receive the visa in your absence (in case you have to leave for an emergency and might not be around when the visa is delivered...your representative should have a valid ID and of course, you also have to leave a valid ID)

Just make sure that your fiancee is around when Delbros delivers but in the event she is not, she should have an authorized representative to receive her visa. Delbros will not give the VISA to an unauthorized representative. If there is delivery failure/receipt of the VISA twice, Delbros will return the VISA to the Embassy. I suggest you call/contact Delbros. You can even email them at: busdev@delbros.com

We received this text message from Delbros Today at 9AM(I requested it to be delivered in Manila, not in my provincial address since I have learned that it will take only a day after release from the Embassy for the VISA to be delivered in Metro Manila):

"Delbros Delivers! Delivery for MNL2006764XXX01 starts today! You MUST leave a VALID ID & a signed Authorization letter or a delay of one week will ensue."

Delbros also texted me of my 2 daughters' (MNL2006764XXX02 and 03) visas to be delivered.

I then called their direct line 02-3392761 to verify. The lady asked me what was the text message about. I told her that the text message states that the delivery starts today. She told me to wait for the visa and don't go anywhere because it is the commitment of Delbros to deliver it within the day if it sends a text message that the delivery starts today. She said it can be in the afternoon but definitely it will be delivered within the day.

We received our VISAS at 10:15AM! (Delbros delivery man in motorbike).

03/23/06: Regional Court Decision out: Declaring absolute nullity of my marriage.
We were very happy! The long wait was over! Actually, the decision/resolution
made was dated February 23, 2006. It took a month for editing, finalization,
etc by the court stenographers, clerk of court, etc.
Upon receipt of the Decision, I flew to Manila (I’m from Iloilo City) and
personally hand-carried the Decision to the Solicitor-General (was
praying Sol-Gen won’t object to the decision; RTC’s give 15 days for
Sol-Gen to appeal)
04/07/06: No appeal from Solicitor-General. RTC recorded the decision in the Book of
Entries of Judgment (as final and executory). Entry of Judgment signed by
the Clerk of Court. This was then forwarded to Local Civil Registrar.
Annotation was done to my Marriage Certificate. Submitted the Annotated
(with Annulment Remarks) Marriage Certificate to NSO (National Statistics Office)
for authentication and on SECPA (Security Paper). I got my SECPA annotated
marriage certificate after 3 weeks.
04/10-16: Holy Week; no office
04/17/06: Submitted requirements to RTC for issuance of Annulment Decree
04/18/06: Got my Decree of Declaration of Nullity of Marriage (annulment process
took 1 year and 10 months from filing of petition to getting the decree)
Sent remaining pertinent documents to John needed for the K1 petition.
Both of us were elated!
