First of all, if you sent in evidence that you have been to USA many times, it should be enough (along with photos of both of you together too). Copies of your passport will also confirm your visits. They just want proof that you two have met, it is not required that he show proof that he has been to your country. However if asked (and for the Consulate interview), it would be great if you could provide the proof of him coming to visit you in Japan also.

Certainly they have proof of your visits to USA, but when you submit the immigration paperwork, they want us to submit the proof we have in a nice, neat packet. That's a lot easier than have the employees do extensive research on their own, for every case.

Second, this thread is specifically for people who have received RFEs (Request for additional Evidence) so not many people read it. If you have other questions, start a new topic so more people can see it and reply! good.gif

Our petition got approved without my hubby's birth certificate, it was only required at the Consulate interview in India. yes.gif

If you get an RFE, you can certainly send in the birth certificate. If you don't get an RFE, just include it at the Consulate stage. good.gif

What if you have a boarding pass to a different city than your fiancee lives in? It's rather hard to get a flight to Boondockyville, Idaho.

A different city is OK, the main thing is the COUNTRY. I landed in a city a good 12 hours bus journey from where my fiance lived, and had no problem. :yes:

Please resist the temptation to send anything in now! Just think, they receive HUNDREDS of applications every single day, and they pile up for MONTHS before employees have time to get to them. The one you sent in is now somewhere among tens of boxes stacked high around rooms and against walls. There is no way they will be able to match up the info you send now, with the application you sent in several days ago.

Be patient and wait for the RFE, when your application is sitting cozy and safe on someone’s desk. Have everything ready to send in immediately when you get the RFE, then the info you send will go straight to the correct employee’s desk and within a handful of days you will get the NOA2 approval! That’s what happened to me! Good luck! :thumbs:

I got the same thing, sometimes it takes a number of days after receiving it, to get the NOA2. Hopefully you will get your approval VERY soon! Good luck! :thumbs:

Did anyone get an RFE for leaving the Apt# empty (instead of writing N/A)?

I left Apt# blank (cuz I was living in a house at the time) and did NOT receive an RFE for it.

We got a RFE because we took "passport OR birth certificate of USC" to mean "passport OR birth certificate of USC" LOL. We put birth certificate and not passport, and they RFE'd for the passport so my advice is read all OR's as AND's ;)


I just sent in copy of my passport and no birth certificate and there was no problem. I have heard of a number of people sending in BC only not passport, with no problem. As usual, it all depends upon was employee is looking at your case, NOT about the hard and fast rules! :blink: :wacko:

I made the check out to the Department of Homeland Security as the instructions said, but the note said we need to make the check out to USCIS.

You have a reason to be confused! We all made out our checks & money orders to the Dept of Homeland Security because that is what the instructions said, and they all were approved fine. It is a mystery why you got that note. :unsure: Anyway you have now followed their instructions so here's to a fast NOA1 & NOA2!! :thumbs:

I thought that we could send the copy of the passport in place of a birth certificate, I believe that was on the instructions for the I-129F? Is this correct or will I get a an RFE? Thanks, Milena.

I just sent a copy of my passport (I didn't have my BC at that time) and had no problem about that. So you're good to go, don't worry! :thumbs:

I just got an email from my lawyer about the letter of intent..She said the I-129-F changed right before we applied, Dec/06 and we´ll probably be fine without the letter. Do u guys know when the I-129F changed, and they started requiring the letter??

I started filling out the I-129F form with the version that expired on 06-30-2006 (waiting during the looong 8 months that my fiancé was going through getting his passport). Then I sent in my application (in October) with the version that expired 12-31-06. There is a new version now, valid until 01-31-2010. ALL THREE VERSION HAVE THE EXACT SAME QUOTE THAT I GAVE ABOVE. I have copies on my computer if you want proof to show your lawyer! :devil: Grrr, you should fire her and continue yourself.

The letter of intenet (with your signature) is necessary.

I know the all of the VJ have sent the letter, but my lawyers keeps saying the letter can be sent later on

Dumb lawyers! :angry: I have heard more delays and troubles from them... most of us just read the directions and did it on our own - which works out wonderfully, usually faster and MUCH cheaper! (Unless the case is very complicated).
Instructions on the I-129F application form, the backbone of the whole fiance petition and process:

7. What Documents Do You Need to Prove That You Can Legally Marry?

B. Provide original statements from you and your fiancé(e) whom you plan to marry within 90 days of his or her admission, and copies of any evidence you wish to submit to establish your mutual intent

I WISH I had come accross this site before I sent in the I-129F, then I would not have gotten the RFE.

I got my NOA1 in Dec, and as I know we did not include the letter of intent. My fiance hired a lawyer, and we were not aware of the need of this letter. Is it mandatory? I did email the lawyer and asked him about it, and he told me we´ll need one just farther in the process. Now I´m confused. Any help?

The letter of intenet (with your signature) is necessary. Get it ready and send it to your fiance. He will probably receive an RFE soon, asking for it.

Recap: I sent in copies of my passports (3 total) and all stamps in them, showing I lived in India for 18 years. I also sent pictures of my fiancé and me together, dated. I then got an RFE requesting further evidence of meeting (post above). I sent in the following documents and within 3 days got the NOA2 approval.

Though my case is unique due to staying on in my fiancé’s country for so long, I list below the documents I sent that resulted in the approval, for everyone’s info!

1. Plane ticket and boarding pass showing flight from Chennai.

2. Travel Confirmation from Expedia.com.

3. Exit Permit issued by the Office of Foreigner Registration, Superintendent of Police, Anantapur, Andhra Pradesh, India.

4. Hotel bill while renewing my passport in Chennai.

5. Encashment certificates, with my name and passport information.

6. Applications for visa extensions.

7. Visa fees paid to the Government of India.

11. Certification from Karuna Society for Animals & Nature, where I worked in India.

12. Statement from my banks in India.

14. Copies of passports (AGAIN).

15. Photos of my fiancé and I (AGAIN).

Well I finally got the RFE I have been awaiting since Jan. 16. They sent it to my OLD address! Thus the delay. Geeze, I had received a letter from DHS to my NEW address confirming the change in early November! What do you make of that?!

In my initial I-129F I had only send 4 photos of us together and copies of my passport, showing arrival in Chennai in May 1989 and exit in Aug 2005.

Now I will search my apartment for further proof that I was in India, I guess. I have copies of the airline ticket and boarding pass stubs, I have Exit Permit issued by the Indian govt as well as visa renewals for every year I was there. I’ll only submit the ones from 2004 & 2005, I suppose. I never had credit cards there so… that’s out. Too bad I never got printouts of my bank statements, accounts which I closed when I left. I might have dollar to rupee exchange certificates with my name & address within the two years, which I can send.

Any other suggestions? For your info, please find the letter below.

LAST MEETING: the petitioner and the beneficiary must have met in person between October 17, 2004 and October 16, 2006. Submit evidence of meeting the beneficiary in person within the two-year period preceding the filing of the petition. The primary evidence may include copies of passport pages that show the identification page and admission stamps, military orders, letters from Commanding Officer, or any evidence that will help the Service to determine that the petitioner has met the beneficiary within the two years. The secondary evidence may be airline ticket stubs and receipts (that indicate month, day and year), ATM and credit card transactions, flight itinerary on airline/travel agency letterhead, etc. NOTE: secondary evidence is used to support any primary evidence that has been submitted. The following DOES NOT constitute evidence of meeting: disc, videos, emails, letters, phone bills, and greeting cards.

The petitioner may also submit bank statements and/or credit card statements and receipts showing that a withdrawal/purchase was made in INDIA. Please ensure that any documentation that is submitted has the petitioner’s name, location, and the full date (month, day and year).

My fiance was approved for the visa and we are now waiting for his passport to arrive back to him. The question I have is that he needs to stay in UK for at least three more months . He wants to be able to work and save enuf money so he will be able to purchase his ticket and have enuf for us to file for change of status, and also enuf for us to live easily after he arrives untill he is able to work.

My question is if he stays on for about three months before comeing will this effect any of the processing in any way? As soon as he arrives we will marry imediately and then file everything. But we know the visa is only good for six months and we knoow the processing takes time. Once we file will that extend everything untill processing is complete? and will his wiaitng to come effect anything?

I was wondering how many people out there have had their fiances go to interviews at a consulate in a different country than their home country? My fiance is from Cameroon, but has been living in Germany for the past 3 years under a student visa. His consulate therefore would be Frankfurt. Has anyone had any experience with this, or does anyone think this could be a problem. Do consulates have a problem processing papers from someone not from their country? I just mailed off the I-129F this week, and his visa expires at the end of this year, so I am ferverently praying that everything goes through before he would have to go back home. If he did, would they transfer his papers to Cameroon, or would we have to start all over again?

Well I guess it may depend on each individual Embassy I dont know. However my fiance is from Pakistan and in Uk on a student visa. We applied in Uk and he got the visa. So I think you can do it.

My fiance went thru the POE at JFK and when he gave them the I94 they hand wrote a number on the I94 that starts with FINS and then the number. and this same number they wrote it on his visa So my question is that when he has to list his I 94 number on forms like for SSI etc does he put that hand written number or the pre printed number wich says dept number on the I94??????

Just another person confirming that it wont matter. My fiance also applied for a visitors visa about a year before..he did not get it. So i went to see him. He got the k1 visa and is now here in states.

They did not even question him about it. So dont worry.

On our affidavit of support or co-sponsers dad lived with them and he put that because he supported him. However if you buy your food etc seperate you can just put that because if you are
supporting them and they are not supporting you I dont think you have to include them. Or just put them down and add an attached letter explaining it.

I do think the country has alot to do with it. The best thing is to find as many VJ people from Egypt to see how thier process is going or has went. My hubby was in Pakistan, but he had a chance for student visa to UK. I think because we ended up fileing when he was there made it easier.

Good luck and just be patient. If you think too much you can get stressed for things that dont even occur. I know I did. Its hard but be positive. Its not impossible. You will get it.

Since you lost the pics you could have addtional family members, friends write letters to attest to your relationship and to the fact she was here and how long , etc. And send also a letter with your pics as to what happened with the camera.

My husband learned to speak fleunt English from watching TV. He also finds learning languages He speaks six languages. The first time I spoke with him on the phone he spoke with a slight british type of accent. But even though he writes and speaks well there are still phrases, some words he asks me about.

Like he often uses him , her all mixed up. He may say her for a guy or him for a girl. He calls pillows couches, even though he knows what couches are. One time when we were talking on the phone he was refering to a feather in the conversation. Only he said it like this feeeder. I said what?? a feeder?? he said ya.. I said what?? he said you know a feeder like a bird has..I said ohhh f-eather... we still laugh.

So even when they learn English well there are still some words, sometimes pronounceing them, or even phrases they dont know. And another thing is he learned some English from British teachers, and lived in London for two years. So some slang we have they dont have.

I think if you have been communicateing all this time, you should be patient and realize it will get better over time once he gets here. Some how you have managed to get to know him so far.

You sound like you got it all right, and if there is one piece missing they will send you a notice to send it in. It will not get turned down but will just delay it a little. so relax you have much more time to stress.

if your fiance is the father of your child then she is a US citizen by birth to a US citizen then you need to get the crba it takes about two weeks and you will get a us passport and you will still need the philippine passport. if he is not the father then you will need to apply for a k2 visa for her. My wife and I have 2 children born in the philippines but are us citizens and we can help you if needed to get your child here with you. both my children and my wife are here in the United States. we can help guide you along the way if you need help.

the reason they didnt issue the visa yet is because you have to get married in 90 days the date issue in the visa, since you havent got your son CRBA and PASSPORT they will hold your visa until you get it because of 90 days limitation of married, just in case there are problems with your son CRBA plus it takes up to 2 weeks to recieve his CRBA and PASSPORT, also what if they need DNA test for your son, this will allow your time to get everything together before your visa is printed..

My wife also had hep b and we didnt file because we thought she would be denied but finally we did file and when she went to st lukes all she had to do is go to a local doctor and have tests done to show she wasn't active. she passed and has been here two years now with our three beautiful children so dont worry she will pass.
