My wife also had hep b and we didnt file because we thought she would be denied but finally we did file and when she went to st lukes all she had to do is go to a local doctor and have tests done to show she wasn't active. she passed and has been here two years now with our three beautiful children so dont worry she will pass.

Personally, I would wait and purchase the ticket until the visa has been approved.
As to where to fly, I would chose the cheapest route, so that would depend on the itinerary.   I would not go through another country unless it was necessary



Thanks but I will not be purchasing his ticket yet due that I want to wait after the interview But if he wont have a problem flying from HAV to MEX then to California that would be easier for me. I just don't want him any conflict by flying that way. if the Visa he receive is to enter the USA and he can enter through mexico will be fine

He can travel anywhere he wants to.  Just keep in mind the K-1 visa is a one-time entry visa.  What he does before he gets here doesn't really matter.  Once he uses the K-1 visa to enter the USA he can not leave without the AP card or a GC.  If he does, he will not be allowed to re-enter.



Thanks the reason I ask cause I live in California and the two options to fly to cuba is either Miami or Havana and I don't want a conflict when I have to purchase his ticket when am coming back through mexico once we get to usa border by flying through mexico

I am from Thailand and I have tourist visa for multi entry. I would like to go visit my fiance in the state while I m waiting for NOA2. I got NOA1 since May 31. Since I m not sure how long it will take  but i just want to go visit him and his family. Is it ok if I will get NOA2 (or even package3) send to my home in Thailand  when I am still in US ?  then when my family in Thailand inform me that  the package3 has arrived I will fly back to Thailand and have an interview.   and  does package 3 has time limited , I mean how long we can gather all the document before we submit package 3 to US Embassy in Thailand?

I sent a lot of pics but don't worry.. I think the pictures are another evidence to prove that you guys have met each other in a person. That made the case more reliable..  you will be fine. They need to check for other proof too..

Friday 2 PM: Well I finally got the RFE I have been awaiting since Jan. 16. They sent it to my OLD address! Thus the delay. Geeze, I had received a letter from DHS to my NEW address confirming the change in early November! What do you make of that?! :angry:

In my initial I-129F I had only send 4 photos of us together and copies of my passport, showing arrival in Chennai in May 1989 and exit in Aug 2005.

Now I will search my apartment for further proof that I was in India, I guess. I have copies of the airline ticket and boarding pass stubs, I have Exit Permit issued by the Indian govt as well as visa renewals for every year I was there. I’ll only submit the ones from 2004 & 2005, I suppose. I never had credit cards there so… that’s out. Too bad I never got printouts of my bank statements, accounts which I closed when I left. I might have dollar to rupee exchange certificates with my name & address within the two years, which I can send.

Any other suggestions? For your info, please find the letter below.

LAST MEETING: the petitioner and the beneficiary must have met in person between October 17, 2004 and October 16, 2006. Submit evidence of meeting the beneficiary in person within the two-year period preceding the filing of the petition. The primary evidence may include copies of passport pages that show the identification page and admission stamps, military orders, letters from Commanding Officer, or any evidence that will help the Service to determine that the petitioner has met the beneficiary within the two years. The secondary evidence may be airline ticket stubs and receipts (that indicate month, day and year), ATM and credit card transactions, flight itinerary on airline/travel agency letterhead, etc. NOTE: secondary evidence is used to support any primary evidence that has been submitted. The following DOES NOT constitute evidence of meeting: disc, videos, emails, letters, phone bills, and greeting cards.

The petitioner may also submit bank statements and/or credit card statements and receipts showing that a withdrawal/purchase was made in INDIA. Please ensure that any documentation that is submitted has the petitioner’s name, location, and the full date (month, day and year).

Yes, as fwayguy said, emails are only sent for RFE and NOA2. To see the touches, you have to log into the USCIS website and see if the "Last Updated" date has changed. Thus, the obsessive compulsive checking disorder that many of us have. :whistle: (All the more so because updates are often logged after office hours!)

Well here is the list of docs I compiled to send today, in a few hours. They asked for proof I was in India from October 2005-August 2005, so I included visa extensions, as well as again sending passport copies. Any suggestions welcome! (If the NOA2 comes through after this, I’ll post the list in the pinned RFE thread.)

1.Plane ticket and boarding pass showing flight from Chennai on August 8, 2005.

2.Travel Confirmation from Expedia.com. The round trip ticket was bought by my father in USA with his credit card, and sent to me via hand delivery with a friend visiting India. I had planned to stay only two weeks in USA then return to India. Unfortunately, my father had a heart attack on August 2, 2005 and I decided to stay on in USA to be with my parents. Sadly, my father had another heart attack, which was fatal, on September 6, 2005. This further cemented my plan to stay on in USA, to offer support to my widowed mother.

3.Exit Permit dated July 28, 2005, issued by the Office of Foreigner Registration, Superintendent of Police, Anantapur, Andhra Pradesh, India.

4.Hotel bill dated January 28, 2005, while renewing my passport in Chennai.

5.Encashment certificate, with my name and passport information, dated January 28, 2005.

6.Encashment certificate, with my name and passport information, dated August 7, 2005.

7.Application for visa extension dated March 20, 2004 (requesting visa valid for May 3, 2004-May 2, 2005).

8.Visa fees paid to the Government of India, dated May 6, 2004.

9.Application for visa extension dated March 5, 2005 (requesting visa valid for May 3, 2005-May 2, 2006).

10.Visa fees paid to the Government of India, dated February 26, 2005.

11.Certification from Karuna Society for Animals & Nature where I worked, dated February 28, 2005.

12.Statement from Canara Bank dated February 24, 2005.

13.Statement from State Bank of India, dated February 24, 2005.

14.Renewed Passport issued January 31, 2005 in Chennai, India, and valid until January 30, 2015. The stamp inside the passport is the departure from Chennai dated August 7, 2005 (boarding flight departing India at 12:50 AM on August 8, 2005). There are no other stamps in the passport because I was present in India where the passport was issued, and I did not travel outside India before my return to USA. This passport as well as copies of my previous passports were included in my original I-129F.

15.Six photos of my fiancé and I, taken between October 2004- August 2005.

Wow, my folks moved from Honolulu to the Bay Area in 2000(first Hayward, then San Mateo) - now are in Fresno and like it a lot.

There is a HUGE population of immigrants here in Fresno - lots of cultures to choose from, stores, restaurants, etc. Also something like 25% of the population are under poverty line so there are plenty of benefit programs, cheap housing, bus service, 99-cent and thrift stores on every corner, etc. Personally I would like a simple, small town and hope to find an ideal place where I don’t need a CAR and where it has WARMER weather. Someday, over the rainbow, when financially I am free to pack up and find a place.

Your guy will have the priest and my guy – well, soon after I moved in this apartment complex in November, I found out the maintenance manager is from Andhra Pradesh state where I lived all those 21 years (and where my guy is from!). Just today they invited me over for the first time – wife, three children and mother-in-law too. We had a grand time talking in Telugu and eating lots of homemade South Indian food, yum!

Besides that, I found out that Fresno is building a huge Hindu temple (small one near the site has been functioning for years) and of the two priests there – one of them also lives in this apartment complex, and only a few doors away from me! Haven’t met him yet but wow. What a “coincidence”.

Yes, I thought Bora Bora had a good idea of filing now and delaying sending Packet 3 if necessary. Also it will probably take you a few weeks to get the bio etc all ready to send. It will be a great relief to you to have the process at least on its way! Caladan had a good idea of calling the Nepali Consulate (or having your guy call), they just might give you some info on how long it would take to schedule the interview (after getting Packet 3).

For your info - your had been worried about police certificate - my guy just returned from 2 weeks in his village and he said the local passport office would NOT look into that until he has the announcement letter from Packet 3. However, they said it is a relatively easy thing and takes no time at all.

Hey your mom & stepdad are here in Fresno? That’s great! That would so cool to meet up next Xmas – all of us together! Yep hopefully we will all be newlyweds by then! (You said your parents moved from the Bay Area. I grew up in the Bay Area – first in Berkeley/Albany until age 9, then in Walnut Creek till I left for India when I was 18.)

Neat that you have a Nepali priest in the temple there in Flushing – wow! Bet your guy will love that!

am currently living with a roommate and don't want to be spending $$$ on an apartment I won't be living in for 3 months - so many things to think about... :unsure:

I was in the same situation, living with roomies and planning to get my own apartment several weeks before he came - thinking that would be in late Jan or so! :rolleyes: But a sudden situation had me leave early and get my own place - on Nov 1st. Boy do I LOVE living alone! I knew I would be leaving eventually so for months I called practically every apartment in the city, searching for the cheapest.

I’ve also been researching local community colleges/Adult Ed for courses to fill my guy’s time before the EAD comes through (like English as second language to get comfy with American English, and he’s an accountant but they use different computer programs here, than in India). Also I tagged the volunteer site http://www.volunteermatch.org/ from another thread – gotta keep the men busy or they will go wacko! :P

We’ll do the civil marriage 2-3 weeks after arriving so the work permission will come ASAP. I have tons of notes for requirements to file AOS too. Yikes the whole thing is really expensive!

You have the right thought process going. Though there are not many examples of Nepal (only two documented on VJ, so hard to predict how far ahead they schedule the interviews, after receiving packet 3), it is possible that the interview will be scheduled about 3-4 months after you file the I-129F. If I was in your shoes, yes, I would probably wait another month at least before filing. :thumbs:

Bottom Line: go with your gut feeling, your intuition about when to file. It will usually guide you right.

What a reverse irony! We are all eager to get our SO’s here, but are stuck in months and months of processing and delays. Meanwhile with the combo of VSC and a less-used Nepali embassy, you could get approved really quickly – but need to delay due to your own schedule! That’s life for ya. :yes:

Now and then I come across more & more valuable info I didn't know before – and I'm really sorry I didn’t discover this site before I mailed in my I-129F! Instead of a thread (which often gets off-topic – even the pinned RFE one), someone who has TONS of time on their hands could go through all the other threads and make notes on the rights, wrongs, mistakes and info that others have posted. I can’t think of any other way to correlate all the info in one place.

I agree though that a step-by-step guide, including don’t forget this or that, is a good idea.

Last Saturday I mailed the RFE docs and now it is Thursday with no return receipt and no touch… I'm getting antsy again but am trying hard to control myself… and am again checking the USCIS site numerous times every day…put that on hold while waiting for the RFE to come.

Sometimes its good to be a packrat! I tend to chuck everything without an immediately, specific purpose so I was lucky at least to have the docs I found!

Yes, that's what I told him! But he was concerned the process would be too FAST and the passport would not be there before the interview. His passport ended up taking 8 months to get, due to the different spelling of his name in English on various official documents in India. (He had go through a lot of red tape to get them all changed to the same spelling, and re-apply for the passport.)

One VJer here sometime ago, was frantic cuz the interview date was scheduled and no passport had come yet. Wonder what happened with that?

Nah, the first one was before NOA1. I first filled in the I-129F in May 2006, and stored it on my computer. We were waiting for his passport to be issued before sending it in. Passport only came in Septtember, then I mailed in the application. Turns out that application had an expire date of June on it! So my whole packet was returned, requesting me to send in an updated I-129F form. I did that immediately and only after that, the NOA1 was issued.

Do you have airline tickets from when you left India?
How about a receipt for paying for the airline tickets?


No pics of us near India landmarks... we lived in villages where inter-racial relationships are REALLY frowned upon, so we just stayed mostly indoors! However we can prove we were in India only – he never left the country and my passport shows I never left, either!

I DO have my airline tickets when I left India in Aug 2005 – and no, I had NOT submitted them with the I-129F. Never thought of it! My father paid for the tickets online in USA and sent them to me via a friend going to India… I have the original emails from Expedia.com confirming the flight (phew! just dug them out!). Geeze I never thought sending those would mean anything. Guess I should send those, in case that’s what the RFE is?

Yes, I labled the photos with dates but they might question that! I wonder if anyone else has only had photos as proof of meeting? I know many people show plane tickets and passport stamps - but my passport says I did not leave India at all from 1989-2005 August!

Darn! I was touched on the 13th - Saturday! And a message popped into my mailbox at exactly 8:16 PM today, Tuesday the 16th, saying a request for more evidence was mailed. (Why stuff comes in after work hours, I know not!)

I'm really nervous that it is about proof of meeting within two years. I was living in India and my fiancé used to visit me all the time – he worked 12 hours away but came on holidays, spending a week or 10+ days at a time, several times a year. but he always took the train, and threw away the crumbling tickets! And I had my own place (staying free at a friends apartment, because she hasn’t come to India for years), so there are no hotel receipts. We never traveled together because our relationship was so taboo in the culture. I just sent photos of us together in my apartment. I do have plenty of letters, phone records, etc., dating from 2001 to the present – but of course that doesn’t prove meeting! What to do…?! (I'm worrying myself sick, here.) :(
