You should soon be able to call (and/or email) NVC - the number is on your NOA2. It's good you got an answer and that they (USCIS) did indeed scan your file - but not to worry about the expiration, the consulate/embassy will very likely extend this period as a matter of courtesy. Be aware, your case will not be track-able on the USCIS site after NVC gets it (will be a DOS case then). good.gif



My fiance just did call them a while ago.. still no paperworks... I don't know what to think anymore. CIS updated our case number on their site from 07-07-08 (our NOA2 approval notice) to 09-05-08... We don't know the latest update coz the description says the same when we got our NOA2.. So probably the 09-05-08 is time they would, will had sent it to NVC.

I'm really into panic mode

You need to call NVC... press 1 then 5 as K1's are not entered into the automated system. They will tell you when they receive your petition and when they send it out to the Consulate.

Under normal circumstances, the Consulates routinely extend the validity date of the petition when you are not interviewed before the expiry date but you will probably want to call and talk to the folks at the USEM in Manilla just to make them aware that there was a mistake made by the uscis and that your approved petition is to arrive soon and perhaps they can even expedite your interview date. You will need to request that as well.

It should not be a problem. So sorry you got held up. This seems to be almost routine at CSC... sad really.

We just called NVC and followed the numbers... No paperworks yet. -big sigh- I wonder when they will get it? CIS obviously made a mistake and let our papers rot in their files for 2months. Now they gave us another wait time that is within 2 weeks it should be fixed.. I heard it before.. It really means 2 months.. I'm sorry If im so whiney now.. I'm just extremely frustrated and helpless.

My fiance and I are just waiting for that "promised" 2 weeks then we will contact the Ombudsman.

If you check my timeline you'll be surprised because we got approved july 7, 2008 Noa2 and we have yet received anything from NVC up to now. It's been two months already.

Then recently we spoke to Julie from USCIS last wednesday 9-3-08 and she said they made a mistake. Instead of filling our papers to NVC, they filled it to their records. So she told me it will be fixed within 2 weeks and I checked our case from CIS site and it got updated from 7-7-08 to 9-5-08.

Geez.. the last time they promised us it will be sent to NVC within 2-4 weeks (written on the approval notice, that nvc should receive it at that timeline) it took them 2 months! now they are promising us again that within 2 weeks it will be fixed. It is really frustrating.. now I'm starting to think that their 2 weeks means 2 months. We are giving them till 09-19-08 coz that will be two weeks from 09-05-08.


I'm sorry guys If i sound too aggravated and discouraged. I just feel helpless. sad.gif

whew.. hi people! it's been an excruciating month for me and my fiance because of our K1 process is taking longer than it should. We got our Noa2 (approval) July 7, 2008 and hasn't received anything from NVC when USCIS claimed that within 2-4 weeks NVC should receive it and notify us by mail.


Anyway, we tried everything... bugged CIS and NVC's with calls and email. My fiance just got back from here and while he was here we tried to call CIS and NVC together. So, ok I talked to somebody from CIS named Julie and she told me she'd call us back once she has some news with our papers... So we waited for two days... and finally Julie called me back and told us that they made a mistake and are sorry for the delay. What they did, instead of making a file to send to NVC they made a file for their record. So she told us within 2 weeks our papers will be fixed and sent to NVC. Now, I just checked our case online and they updated it again from 07-07-08 to 09-05-08.


Anybody got to experience this?

Some facts: she is a korean national and we got married in korea. I got receipt for the I-130 end of january (NOA1).

1) Is it worth it at this point to file the I-129 to get a K-3 visa? i dont think its worth it at this point

2) What if she enters on a B2 visa just to stay with me? If we are living together in the US and then we get the I-130 approved while she is here, can we still do the adjustment of status? Will she get booted out even though she's married to me? this can be considered visa fraud and can lead u into additional problems..i wudnt recommend doing it and so wont any lawyer.

3) Should I panic at this point? As the "normal" wait time is 180 days, although on the tracker on the front page of VJ it says it's about 258 days for the VCS. u shud call ur congressman/senator

4) Do "touches" actually mean anything? I'm a bit freaked out since mine has not been touched since 2/24. I've spent the last 4 hours reading the forums and found totally contradicting information. touches are always a good thing. they give u an idea that ur case is not lost and is being worked on.

5) Are the processing timeframes from the official uscis site really accurate? accoring to this: https://egov.uscis.g...eviceCenter=VSC they are STILL working on I-130 forms from sept 03, 2007!!!!! in my opinion these dates are bogus and dont mean anything

you are not alone in this. We are also experiencing almost the same thing! Like you we submitted our paperworks Jan 24, 2008 and we are seeing people who are being approved and got an interview already even though we are ahead of them. I tried calling the USCIS office and told me they cant spare me some info coz I'm not the petitioner eh? I told them he's at work.. well.. i couldnt really do much about it.. We emailed the congressman but no reply.. Called/Emailed the NVC told us the same thing... not in their system yet. My fiance will be here on Sunday Aug 31, 2008 and we're gonna call everybody from USCIS. Don't lose hope people just hang in there! Although, I'm into losing mine! lol

We printed off two copies of everything but only complied one of them for the original packet. As it's being processed, my fiancee is going to make sure the copies are created as before and send one of them to me.

The NVC can't tell you why they haven't received it yet. The problem is at the CSC. For some reason, they haven't sent it yet. I had the same problem. I got my Congresswoman's office to inquire to the CSC, and suddenly it was sent. Coincidence? I think not. I would suggest that you do the same. Good luck!

Good Day!

My fiance and I are currently experiencing a problem regarding our K1 visa application. We received our NOA2 (approved) July 7, 2008 and USCIS told that within 2-4 weeks NVC should receive it and notify us by mail. It's beyond that timeline already and we haven't gotten any mail or email from NVC.

Then, my fiance called NVC and was told that we should receive a notice from them after 90 days.. and that we are not yet in their system. I'm confuse because they are telling us a different thing. USCIS 2-4 weeks, then NVC 90 days? Today i called the us embassy in Manila hoping that they might have our papers already. She told me our papers are not yet in Manila and can't assist me any further since I don't even have a Manila case number.

Help! feels like our papers are stuck in the middle of nowhere.

did you actually talk to a real person when you called NVC? if you used the automated system you will not show up. K visas are NOT entered into the automated system and will say not in system forever. You have to speak to a real human to see if you are there. If you did that and a real person told you they dont show anything yet, then you are in a bind and will have to wait.

gosh this is really annoying.. i must say! first at CIS they got my name incorrect! -delayed- we got stuck in CIS for more than 60 days coz they filed it as their record -major delayed- and now that our papers is finally at the NVC my fiance's birthdate is incorrect! -another delay!!!!- It made me feel stupid coz I was the one who called... they got my name, his name, my birthdate and the case number right but not his birthdate! Gosh... what should we do? I told her... 'that is his birthdate.. im looking at his passport!' she said... 'he'll have to verify that and have him call us back' How can those information be wrong when its not manually typewritten?

Oh good lord! Why? Why? why?!?! why do they keep putting mistakes in our petition?

by the way we submitted our petition: Jan 24, 2008 and now we are just arriving at the NVC we got approved July 7, 2008, then they lost the papers so they had to approved us again on September 15, 2008. Now that our papers are at the NVC they have the his birthdate incorrect geez!

My fiance has been receiving notifications from NVC 3 times already saying that they already sent the petition to the foreign consulate which in my case here in Manila, Philippines. What does it mean? Do they keep on sending the petition many times? What's the normal duration on when it will be received by the foreign consulate?

-sigh- i went to the bank today to pay the visa application fee of $131 and it was validated on one of my ds 157 forms. Then I just noticed it when i got home that there's a doubled letter on my fiance's last name... his last name is Boutell and i accidentally put Boutelll ... 3 L's. Maybe my hands were shaky or the keyboard was too sensitive... I don't know. Would that be a problem? What should i do about this? Should i just erase this or i need to pay the visa application fee again?

I did a screen shot at my skype history and it works. But during my interview the consul never look at my printed chats, emails, handwritten letters and my skype call history. to do a screen shot press ALT+PrtSC (near the scroll lock to the upper right of your keyboard) then press CTRL+C. Go to MS word and press right click in your mouse and select PASTE.

it's usually the petitioners job to cancel it not hers.. who submitted it should be the one to cancel it. Tell her to tell the ex-fiance to write a formal letter to USCIS or even just call and tell them they are canceling the petition.

in my case, yea they sent me one through mail and they will give you an email confirmation too. You have to print those (the email confirmation) coz they will ask for it during your interview. smile.gif

i don't have a ds 230? the ds 156, 156k and 157 you should have 2 copies and yes the ds 157 will be the one needed for the bank payment. You will pay your visa fee at some designated BPI or CITIBANK, i paid mine at BPI-MEGAMALL. Yes, you should just go to saint lukes as soon as you have your appointment letter either mail or email. Yep, you have to go there early if you want to finish early smile.gif i went there at around 6:30AM and I was number 200!!!! i finished around 9PM!!! it was monday. I had my medical Oct 6 then they told me to come back Oct 13 since my interview date is still far which was Oct 29.
