Hi guys,

Quick question on the I-134 Affidavit of Support Question 7. The first line says "I derive an annual income of: (If self employed, I have attached a copy of my latest tax return or report commercial rating concern which I certify to be true and correct to the best of my knowledge and belief."

My question is, on this line item, are we suppose to put the amount stated on his 1040 or his current annual income. I ask this because my fiancé only started working at the latter part of year 2011 and only paid taxes for the months he worked for. The income stated on the 1040 is far less than what he really gets in a year. I am just confused as to what number to put in here. I have read it should be what is on the tax return. I have also read what is the actual annual income backed by an employment letter of course.

Any help would be appreciated. Thanks a lot!

Someone I spoke to told me they thought (in the second quote) that they were improperly referring to the K-1 visa as the I-129F petition.

Does this mean that if someone's K-1 visa expired before they travelled, they could get it extended for more time if they paid the fee again and wrote a written request? Because our baby's passport may not be ready by the time my fiancee's K-1 visa expires.

A K-1 visa cannot be extended or revalidated. if it expires, a new visa would have to be issued, which would involve the payment of another visa application fee.

It is common knowledge that the I 134 is not enforceable. A quick search of this site will provide plenty of data.

The I 864, there have been a couple of cases, the one I remember was featured on www.ilw.com where a lady tried to use it to obtain support following a divorce to the minimum standard. She was very partly successful.

As far as the US Gov going against someone, well I can not remember a case, I am sure there has been at least one. How do you think all these people bring their elderly parents to the US and survive financially, if it was regularly enforced?

None of them require anybody to buy airline tickets, both are specific as to what they refer to, just read them.

While our immigration law does not disallow joint sponsorships for K nonimmigrant visa applicants, the mere submission of an I-134 Affidavit of Support from joint sponsors is not sufficient to establish that the alien is not likely to become a public charge. Accordingly, we make a thorough evaluation of other factors, such as the sponsor's motives in submitting the Form I-134, the sponsor's relationship to the applicant or petitioner, the length of time the sponsor and applicant have known each other, etc. An I-134 Affidavit of Support submitted by a casual friend or distant relative who has little or no personal knowledge of the applicant has limited value. Unlike the I-864 filed by joint sponsors in immigrant visa cases, the I-134 is not legally binding and imposes no legal obligation on the joint sponsor to make good on his or her promises. Please be assured that we look at the totality of circumstances in assessing the credibility of joint sponsorships.

Nevermind the Embassy's list. Most people get just a few vaccinations at St. Lukes. Typically, they get MMR, TDap, Varicella, and the flu shot (during flu season). If they get these shots, then they won't need any shots in the U.S.

Have you gotten appointment date for your interview yet? I filed Form I-130 for my wife on August 29th here at the USCIS in Manila as I also have resident status as an American Citizen living here in the Phil and received our Notice of Approval (NOA2) today. It was actually approved on Sept 18th, 14 business days after the initial filing. Just trying to prepare for the next step myself. Direct Consular Filing seems to be very fast.
