Actually, according to the Act of 1952 and the reform act of 1965. It is a RIGHT to bring in your fiance, spouse, and children to the USA to live with you... The ACT of 1952 which is the basis for the USCIS today placed a priority on family first. Since then the 1% of all applications has been attacked, reformed, and slammed upon. there have been amendments, marriage broker revisions, checks mandated, etc. Many things to make the finace, and spousal visa more thorough. Due to these reforms, the original inceptions has been "muddied" and lost.

Thanks for the input. Please note I am not pushing the poverty. The main thing I am pushing is the "state of emergency" declared by the Philippine president for the area. The bus bombings in the area. the kidnapping for ransom, the mass shooting of foreign journalists, the shooting of non-nationals, and the fact the US Embassy in Manila will not allow embassy personnel to go there without "special dispensation" from the US Embassy in manila. ....



I'm familiar with your reasons you've mentioned for an expedite, but I doubt they will result in acceptance of your request for an expedite. I do wish you luck with your request.

Hi all,


Friday I meet with local USCIS office. I was advised to meet with local office when calling in to followup on expedite request and why no answer. The expedite inquiry was sent with this letter:

Your request for expedited processing has been received. After careful review and consideration, it has been determined that the request does not meet the expedite guidelines established by U.S. Citizenship and Immigration Services. As such, the case will be adjudicated in date receipt order.

Again calling, was advised to meet with local office instead of placing another query into the CSC. Stated the forms are not adjudicated there for I-129F. Was told by call center to go into local office anyway.

wonder what is up??? anyone got any ideas? Just wondering what may happen on Friday.



Since you've already made a expedite service request by calling NCSC, an infopass appointment is another way to make such a request.

What else did you provide? pictures are secondary evidence. They look for things like passport stamps, visas, etc.



Photographs are only secondary evidence...One of you must have travelled... Do you have boarding passes? There must be passport stamps so you would send copies of those and hotel booking/receipts or anything else that proves you were in the same place at the same time within the last two years. Photos on their own are not enough.



the documents mentioned show you were at a particular place at a certain time, but alone would not show you were physically together. Photos show you were physically together. both are important. I commonly see one labled as primary, the other secondary, perhaps because of how they are listed on VJ's guide. they compliment each other to prove you have physically met in the two years prior to the filing of the petition.

perhaps you could make copies of his last 4 or 6 months of pay check stubs, add up the gross pay ( 4 months x 3, 6 months x 2 ) and use that to project his annual rate of pay.

These are the things that make me confuse. My Fiance has a little knowledge also about these stuff. He wants already to bring the kids with me, but, I'm just quite not sure because I know I still have to adjust on the new place and I think it would be good if I would adjust myself first, being the mom and make sure apply for AOS, get familiar with the places and culture, find job and able to get driver's license so I can drive before I finally bring my kids.

Btw, I also hope to hear from members who moved to the US with kids, can you tell me your experiences ? My Fiance love my kids very much, but, I know he works everyday and he might not have so much time get us around. And I'm sure no one of his family members will help us get through as he lives alone and away from his family. I would love hearing some good advices and experiences.

a couple of things to consider. the process will be simplier and less expensive if your children come with you , than follow to join. as far as costs go, no need to fly back to the Philippines for your children and AOS will be less expensive if they apply with you. as far as adjusting to a new life in the USA, children probably have an easier time adjusting than do adults. your adjustment will probably be easier having your children with you, than if they are in the Philippines. the time lost being apart from your children is something that cannot be replaced. IMHO, the sooner all of you are united as a family, the better.

It's not the same. K2's are derivatives. IR2's are petitioned separately. No G325A is needed for the kids with the I-129F petition. It's possible the consulate might require one with the visa application, but I'm not aware of any consulate that does.

I don't have personal experience with this -- my wife filed for a CR-1, not a K1. However, based on what I've read here, he just has to apply for an Employment Authorization Document once he gets here. It's not a separate visa -- just a document confirming that he's authorized to work. He'll also need a social security number, which he can apply for as well once he's here.

Both should be granted within 90 days of his entry (probably sooner).


this is basically a waste of money since the I-94 expires in 90 days. The EAD card would only authorize to work until the I-94 expires. it might not even arrive before the expiration of the I-94. he would not be able to get an SSN without restriction unless has an EAD card or green card.

Correct me please. But you sent in the Originals when submitting the packet, not copies? of the originals?

Please note in submitting to the ISCIS and embassy, you need to keep all your ooriginal documents and submit only copies. Because you submitted all of your original documents, you are getting an RFE. This is something which is not common.

When I got my RFE, I took my originals and the copies to the bank. the bank notarized my copies. I then sent my copies to the USCIS, keeping the originals. I would suggest gathering as much data as you can to prove meeting in person in case you need it later on. the good news is getting an RFE means you are very close to the end of your journey at USCIS.

the letter of intent should be an original, not a photocopy. what I did was have my then fiance sign two letters of intent so I'd have an extra one with original signiture.

you need proof on ongoing relationship. Copy of phone bills with calls. copies of emails and copy of a few chats. Nothing major. if you have logs of calls placed and when on skype, that is all you need.

Supporting evidence needs to be logs, history, records, emails. supporting evidence of meeting in person. Plus include photos with who is in the photos. Many have found the photos printed in a word document with tags underneath work the best.

Actually, you don't. proof of ongoing relationship is needed for the interview at the Embassy. what is needed is proof you've met in person, the two years to filing the petition. some people do front load the I-129f with proof of ongoing relationship, but it is not a requirement.

The letter of Intent is to be sent with the 129-F to the Dallas location. And thats the start. There is NO Embassy involved at this time. It goes to USCIS in Texas first for approval of a NOA1.

I would like to do a K1 Visa for my fiancee, and while it seems stright forward enough I would like to enlist some professional help. Not necessarily a lawyer, just someone who know what they are doing and can avoid mistakes that can add time to the process.

Has anyone here used such a service that they were happy with. Maybe one that has a good reputation and is priced fiarly.

If there is a list of such services somewhere on the site could someone please point me in that direction.

The best help you actually can find is in this forum since we all are going through the same process.
Read, read and read and you will find all the answeres on your questions and what still you can´t find the answers for, so just open a new thread and ask and you for sure will get some helpful advices.
Believe me, it´s not that difficult to file for a K-1 visa but it will need you to have some strong nerves and a huge portion of patience.
We had thought about asking a lawyer or visa service to do all the paperwork for us but now since we hopefully will get approved before too long we have seen it wasn´t hard to do it all on our own at all and we are glad we didn´t have to spend so much money on them.
What sucks the most about this procss is the long waiting times until something happens at all and until you will get approved - especially if your case will get transfered to CSC. We originally have filed in TCS too.

the k-2's will require a medical and interview, either at the same time as the mom or at a later date if follow to join. remember that the K-2 visa must be issued within one year from the date the k-1 was issued.
if possible, the easiest way would be for them to all interview at the same time and come together to the USA.

the 3x comes from the I-864 Part 7 line 10 for a spouse or minor child. I guess embassies have the discretion whether to use 3x or 5x for a K-1 Visa. I haven't noticed if anyone has used 3x assets for income shortfall in Manila, so the safe thing would be to use 5x, if needed.

it's just a matter of wording. income needs to be at least 125% of the poverty level. what you wrote could be interpreted as needing poverty level plus 125% of it.


Hank   Could you please explain why my answer was incorrect?  If you refer to page 8 of the I864 instructions it say that to be a sponsor your income needs to be 125% over the poverty level.

I'm a little confused. Will you and your son have your interview together at USEM?  If so you need only one copy of the I-134 with you listed in item 3 and your son's name listed in the child section of number 3. I just completed a K1/K3 visa for my fiance. I have two K3's and I listed them both as I have described for your son. As Hank stated, your relationship to sponsor should read "fiancee".

 

I'm sure you meant k-2. if the son is having a separate interview and at a different embassy, you should provide an I-134 for the son. your fiancee's  I-134 will probably be sealed in her visa packet.

Yes of course they can come. All my statement means is that the person the OP talked to in Manilla was wrong in asking if the names were on the NOA2, they NEVER are, it was a dumb question by the person at the consulate.

We have two sons we brought and neither was listed on the NOA2.

Your fiancee's two daughters will have medical exams and apply for visas (and pay all the fees) at the same time she does, they will be issued K2 visas.


the csr at the number she was calling is about as useful as calling a Tier 1 csr at USCIS NCSC...

yes, I'd call the direct line to the Embassy. you have to be persistant to get thru. I had the most luck when calling about 8am Manila time. One of the first things I did was call that number to verify that my daughter's name was on file. they should be able to verify you son's name is on file. I'd also email the Embassy.
