Okay, so my spouse has gotten her NBI Clearance in Philippines. The report states: NO RECORD ON FILE. I have read here and there that she needs some kind of a letter of certification in addition to this NBI clearance from the NBI. Is this correct? Her NBI clearance includes a combination of her maiden name and includes her married name. On the form it says, PURPOSE: VISA USA.....does she need to go back to NBI for some kind of a letter in addition to this clearance? The lady at the NBI did not know what she was talking about when she asked for the letter. If she does need to go back to the NBI office exactly what does she need to ask for as far as a letter of certification goes? Please help.

4. NBI CLEARANCE (Green Form): Applicants aged 16 years and older must have a valid Record Clearance (for travel abroad purposes) from the National Bureau of Investigation (NBI). Clearances should be in the applicant’s current name, birth certificate name, maiden name, married name, and any aliases or nicknames ever used, including different spellings of all names ever used. An official letter of explanation from the NBI is required for any notation of “No criminal record”, or "No pending case”. first step, list the child on the I-129f. if the child is illegitimate, the mother would have sole custody. should be no problem. when comes time for the interview, child will be applying for K-2 Visa.

Just spoke with my girl,

She is at the records office getting latest NSO Birth Certs, and applying for the kids passports with these new docs. Then she will send me the oldest boys new NOS BC with the name change. I can then change this with USCIS according to my call this morning to USCIS.

Better to have this cleared up now.


Once you can verify the name change, I wouldn't wait to receive the new NSO BC. I'd call USCIS Customer Service and have your call escalated to Tier 2. you probably just talked to a Tier 1 employeee who said you would need to send in a copy of the new BC. you probably will not need to send a copy of the BC.

Hello Hank,

She already had a NSO copy of his birth certificate with the original last name but was at the local office with the ex boyfriends Mother yesterday and it was confirmed the he did change the last name to his. I was told that the ex boyfriend/Father is able to do this without the Mother consent. Issue is I just sent our I-129F in with the original last name. I wonder if this is an issue with the I-129F or if this matters more at the Visa application process she will do after the I-129F approval. Seems I might have to call USCIS on this one.

it should not be a problem with the I-129f being approved by USCIS, since the children are only listed on the petition. the question is if there will be implications at the visa application stage. the US Embassy goes by birth certificates from NSO, not the Local Civil Registry Office.

This is sort of confusing as the OP had their K-1 visa approved last year, so not sure who the wedding is for. If they are only doing a "second marriage" -renewal of vows- in the Phils they don't need a marriage license for that as they are already married.


the Op and his fiance did not marry. the fiance returned to the Philippines before the I-94 expired. looks like now they are planning to marry in the Philippines and file an I-130.

Age doesn't freeze at filing. Her age will be calculated at her real age minus ( time between when they get the petition and they approve the petition )

yes, the I-864 is legally binding for the sponsor of an intending immigrant. a K-1 Visa is non immigrant visa, at that point technically not an intending immigrant, which is why the I-864 is not used when applying for the visa. when the K-1 beneficiary applies for AOS, they then become an intending immigrant.

at the interview stage at the Embassy. I don't think which way matters ,since at that point the Affidavit of Support is not legally binding. having an I-864 at the interview would show you have a willing joint sponsor when it comes time to AOS . For AOS,you would submit an i-864 and  your dad would submit an I-864A if you are living in the same household. if living in separate households, you would submit an I-864 and your dad would submit an I-864.

in the past you could use your NOA2. that's what my wife used when she had her medical. I haven't noticed anyone mentioning it recently.

Because as far as I know St Lukes is the only medical facility in the Philippines that is certified by the US Government to do this physical. There is not other place...

being eligible for an immmigrant visa and obtaining a tourist visa are two totally separete issues. he can apply for a tourist visa, but obtaining it is not guaranteed. he has to prove to the CO that he intends to return to the Philippines.

Hank.. it's complicated.. the parents listed on my daughter bc is my parents. The embassy will for sure reject her if they found out that I am not the mother listed on her BC. Do you know how long it'll take if my husband petition her as his stepdaughter?

 

the one year timeframe for a K-2 cannot be extended. if your husband files an I-130 for his step daughter, the process will probably be less than one year, since the step daughter will be considered an immediate relative.

Unless something has changed St Mary's is now CLOSED we were there in September 11, 2012 and we were told by the staff that it was there last week of operations that upcoming friday... From what I understand all CFO seminars are now held at Prism.

 

St. Mary's and Prism are closed. Seminars are now only held at the CFO offices in Manila and Cebu. this thread was started almost 4 years ago.

he still will need to be registered with CFO. would only be a K-4 if was same time or follow to join a K-3.

 need to attend peer conactually the stepson will be an IR Visa, not K-4 Visa. if all goes well with the medical, one week for medical and interview. bigger varaible would be delivery of the approved visa, 1 to 2 weeks. don't forget about CFO for your stepson. under 13 years old just need to be registered. 13 to 19 need to attend peer counseling seminar.

the child should have been listed on the I-129f Petition. the child didn't need to be present at the interview with the mom if not applying for a visa at the same time as the mom.. every person applying for a visa will need to have medical and interview. the child will need to have an interview in order to obtain a visa for follow to join. with follow to join, the K-2 Visa has to be issued within one year from the date the K-1 Visa was issued.

When going to the CFO, make sure you have everything you would have for the US Embassy, all of the same paperwork. also make sure she knows your mom's maiden name. Sometimes, it help to take a parent or relative along to the CFO. Being married, she can expect more questions. (There is no easy out like in a fiance visa.)

DO you know which CFO location she went to?

Is your wife catholic or another religion?

Getting married and filing K-3 (CR-1) visa is not plentiful or typical. (these are a very small percentage.)

Wish you the best, she may be able to get her attendance green check, but after walking out, she may have to redo the whole process, and expect many more questions.

If she went to PRISM, have her go to Good Shepard convent. (it is a little further but on the tram line.)

You were right!!!  They let her sister accompany them on the interview.  And all went well - visa approved!!!!!!!!!  The only reason they wanted the kids there was to verify that they match the pics on the passports and photos attached to the forms.  Thanks for the good advice.

 

Congrats.dancin5hr.gif the age of the K-2 applicant determines what if any questions are asked at the interview. my daughter was 10 at the time of the interview and was asked one question by the CO, " how old are you?"
