I don't like to get involved in these kinds of matters as I feel there is always two sides to the coin and I have yet to hear her side.

 

But I will say, if you want to do this so it is fair to each of you, then you will need to file the divorce as this will permit her to go back to the Philippines and she will have a "status" that she has been annulled/divorced and this will permit her to marry again.

 

I believe she would also need to get a Judicial Recognition of Foriegn Divorce.

Hi All Vj's,

I would appreciate if someone can help me shed the light on my case. I came to US through K1 Visa, got married and got my permanent residency status. Here's the situation: I plan to go home and i dont have worries to enter US as a permanent resident, however I never went through CFO seminar since I got my visa in other country. I worked outside Philippines which they don’t need CFO and CFO sticker in my passport before my flight ( I even called the Philippines Embassy at that time to make sure I am in the right track if they can have any means to provide any CFO for overseas resident, but they told me they don’t have and CFO is not needed in US embassy as this all about Philippine requirements and I never go through Philippine Embassy at that time before my departure.

Now, since I don’t have CFO do I need to go through this process before my flight back to US? Also I didn’t submit yet and report my marriage to Philippine Embassy here in the US, ( its my fault -I don’t have time to do at that time) for sure if CFO requirements need a certificate for Cenmar or Cenomar then I am sure I can get a Cenomar not Cenmar and my passport still in my single name ( I don’t think its an issue having your passport not change yet to marriage name) since I just renewed it before my flight to US. I am a bit clueless what necessary steps should I tackle now to avoid any trouble at the Philippine Immigration before my departure.

Any info is highly appreciated especially to those who went through the same situation. Thanks in advance.:-)


if your passport is in your maiden name make sure to bring a copy of your marriage certificate when you travel to the Philippines. as far as CFO, I found this on it's website under FAQ. The following are exempt from attending the counseling program:

* Filipino spouses and other partners previously granted permanent residence status in the country of destination; or>

* Filipino spouses and other partners with permanent residence visa issued abroad.

agree.good.gif my wife had a similar problem with proof of singleness. she went to the seminar in Cebu. I had provided her with copies of my tax return and pay check stubs, but she forgot them in Davao. they were insistent thet needed them, but she pleaded her case since she left them in Davao. they said sorry, she would need to return with them. after she continued to insist that I was single, she was asked how do you really know? she told them " I've talked to his mother, she told me, we can call her. " after that , they dropped the issue.

based on my experience and without getting into the technicalities, a K-2 will not be issued a SSN on the basis of an I-94. a K-2 needs an EAD or green card to be issued an SSN.

PhilippinesPolice Clearances NBI AND Barangay Clearances??

Okay my spouse has her NBI clearance. I keep reading in the visa requirements that Police Clearances are needed. Does this apply to Philippines? She previously had Barangay clearances, do we need to submit these also?? Just got our IV bill email and wanted to make sure they do not need Barangay clearances. (I think we had to obtain those for her to get her passport.) Anyone know the answer to this one?


if she has only lived in Philippines, only NBI clearance is needed. Barangay clearances have not been needed for many years.

The son/daughter would be considered unmarried and eligible for F2B. as stated in the previous post, they will need  to remain unmarried throughout the entire process. the petitioner will need to have a copy of the death certificate of the son/daughter's spouse.

just to note. I haven't noticed that a certificate is issued for attending PDOS. perhaps that's why the visa must be in hand and CFO is only a one day process for Emigrants, along with those exempted from attending PDOS.

Yup 23-25 years sounds right, my remaining aunt and uncles arrived about 2 years ago after almost 25 years of waiting. It would be MUCH faster to petition your parents once you become a citizen, have them become US Citizen(around 5 years of living stateside assuming they follow the rules and don't stay out of the US for any prolonged amounts of time) then petition their children(your siblings)...


First: (F1) Unmarried Sons and Daughters of U.S. Citizens...... 14 years. (current priority date Feb. 15, 1999 )

Second: F2B) Unmarried Sons and Daughters (21 years of age or older) of Permanent Residents:... 11 years ( current priority date July 15, 2002 )

if a parent was here, it would be faster to file the petition as an LPR.

Ok ... I guess this part has changed. I read they no longer take your passport.. sorry if I misinformed you, but like I said, this is two years old.

yes, she was a rescue technician. she does know a City Administrator. I don't remember his name. I'll ask her later. I meant him briefly when we were at City Hall in 2005. I saw the Colonel many times while we were at 911.

my wife is also from Davao. a little of the history of Davao.
Local historians claim that the word davao came from the phonetic blending of the word of three Bagobo subgroups when referring to Davao River, an essential waterway which empties itself into Davao Gulf near the city. The aboriginal Obos who inhabit the hinterlands of the region called the river, Davoh; the Clatta or Guiangans called it Duhwow, or Davau, and the Tagabawa Bagobos, Dabu. To the Obos, the word davoh also means a place "beyond the high grounds", alluding to the settlements located at the mouth of Davao River which were surrounded by high rolling hills. When asked where they were going, the usual reply is davoh, while pointing towards the direction of the town. Duhwow also refers to a trading settlement where they barter their forest goods in exchange for salt or other commodities.

Spanish influence was hardly felt in the Davao until 1848, when an expedition led by Don Jose Uyanguren came to establish a Christian settlement in an area of mangrove swamps that is now Bolton Riverside. Davao was then ruled by a Muslim chieftain, Datu Bago, who held his settlement at the banks of Davao River (once called Tagloc River by the Bagobos). After Uyanguren defeated Datu Bago, he renamed the region Nueva Guipúzcoa, in honor of his home in Spain, and became its first governor. Uyanguren's efforts to develop the area, however, did not prosper.

A few years after the American forces landed in 1900, private farm ownership grew and transportation and communication facilities were improved, thus paving the way for the region's economic growth.

A Japanese entrepreneur named Kichisaburo Ohta was granted permission to exploit vast territories which he transformed into abacá and coconut plantations. The first wave of Japanese plantation workers came onto its shores in 1903, creating a Little Japan. They had their own school, newspapers, an embassy, and even a Shinto Shrine. On the whole, they established extensive abaca plantations around the shores of Davao Gulf and developed large-scale commercial interests such as copra, timber, fishing and import-export trading. Filipinos learned the techniques of improved cultivation from the Japanese so that ultimately, agriculture became the lifeblood of the province's economic prosperity.

Davao was formally inaugurated as a chartered city on March 1, 1937 by President Manuel L. Quezon. Thirty years later, Davao was subdivided into three independent provinces, namely Davao del Norte, Davao del Sur, and Davao Oriental. Over the years, Davao has become an ethnic melting pot as it continues to draw migrants from all over the country, lured by the prospects of striking it rich in the country's third largest city.

On December 8, 1941 Japanese planes bombed the city. Japanese occupation started in 1942.

In 1945, American and the Philippine Commonwealth forces liberated Davao City from Japanese forces.

the others are correct about the passport. I don't remember if there is anything on the website about the passport being taken at the medical by SLEC, then forwarded to the Embassy. have you checked out the Sheriffs Manila Embassy Guide in the Philippine Forum? It contains alot of helpful info.

I remember back in March 2006 when I submiited the I-129f. That's when IMBRA went into effect. nothing seemed to be happening till June. When petitions were starting to be approved, CSC seemed to be moving at a snail's pace, while some were zipping thru VSC.
I learned just have to be patient, otherwise the process would have driven me crazy. it can be a long process, but you'll get thru it. wink.gif

unfortunately the answer is no, at least that's the answer i got when I asked the Embassy this question last year. If so, I you don't bring the kids before their visas expire, you will have to start from scratch by filing an
I-130's for them. that process can take over a year. on follow to join, the 1 year is the time you have for the K-2 to be issued. once issued, they have to be used within 6 months. the Embassy does not elaborate on how to extend a K-2, since that option is not available.
still you can contact the Embassy to see if that has changed.

I've seen this before with NVC. NVC assigns the case number. for Manila your case number will start with MNL2007.......
the operator at NVC probably will not see any info on your petition until the case number was been assigned. one year ago when I was at the stage you are, the NVC kept telling there was no record of my petition at NVC. allow 4 to 6 six weeks from approval date... after several days and phones calls, they had my case number and said an electronic file of the petition had been sent to Manila. just have to be persistant with NVC, one day you'll call and they will have the case number, good.gif

she will not receive her packet until she has been scheduled an interview by the Embassy. you usuallly receive the packet 4 to 6 weeks before the interview date. interview date is about 3 to 3 1/2 months from date Embassy receives your petition.

they were married before the I-94 expired. no need to file an I-130. an I-130 only needs to be filed when married after the
