when she got her passport last month, they didn't even ask her for the CFO Certificate. Still good idea to bring copy of it, since DFA website says required for fiancee's of foreign nationals. Did your fiancee get you to eat durian?

Its a document that states how I met her, and my intention to marry her.

I put that we met in 2005 instead of 2006.

Bottom line is, can I submit updated information to the UCIS if they have not begun working on my case? And will this delay the process in any way?

the Letter of Intent. ok sorry I misunderstood. I don't think that wouldn't cause a problem since even with the mistake in date, you still are within the two year requirement. when time for interview, you can also send a letter to your fiancee reaffirming your commitment to marry her. you can send updated info to USCIS, but sometimes not connected to your file.

On the other hand, if you go to the CFO seminar right away and they deny you, in my opinion, you may still have an option. Since you are on a spousal petition, I believe you can delay your Embassy interview for up to one year. If so, you can use that year to complete your annulment process. The Embassy routinely revalidates approved I-129F petitions for up to one year and I believe they will do so for your spousal petition too. I hope someone will correct me if I'm wrong about the spousal petition extension.

I realize that annulments take a long time. However, if it looks like you won't complete your annulment in the one-year period, toward the end of the one-year period you could go ahead and attend your Embassy interview. Then, after your visa is approved, you would still have six months from the date of your medical in which to use your visa. This process would potentially give you one-and-a-half years to get your annulment completed and filed with the NSO. Then you could get your CFO sticker.

Another thing, you could move back to Bermuda and interview at the U.S. Embassy which has jurisdiction over Bermuda. Once you had your visa, you could travel to the U.S. from Bermuda without needing the CFO seminar or the CFO sticker.


I don't think an approved I-130 has an expiration date similar to the I-129f.

They didn't even look at the income, I stated that is my concern yes, but they didn't even look at it - the particular CO we had DID NOT ACCEPT THE TAX TRANSCRIPT OR MY W2. I provided 2007 to 2010 W2s and Tax Transcripts. Did I make a mistake? Yes, I should have included the Form 1040's, but actually I think my case was a special blessing in disguise.

IF they denied based on income, then my 221g WOULD HAVE SAID SO. PERIOD. But it doesn't, it says 2010 W2 (which she had with her) and 2010 Income Tax Return needed. Why would they ask for the stuff if they know it wasn't sufficient?

Point of the story:

TAKE W2, FORM 1040, and IF you have them, IRS Tax Transcripts as backup, because maybe the CO doesn't pay taxes and therefore has no idea what a Tax Transcript really is!


You gotta ask yourself the Dirty Harry:

I know what you're thinking. "Did he take six documents or only five?" Well, to tell you the truth, in all this excitement I kind of lost track myself. But being as this is the Manila Embassy, the most stringent Embassy in the world, and would blow your case clean off, you've got to ask yourself one question: Do I feel lucky? Well, do ya, punk?


And learn from the mistakes (or hidden blessings) of others so you don't have to go through what we did.

AND ABOVE ALL - GIVE GLORY TO GOD no matter what the outcome!

=) Because He sure does know best, and I praise Him for this process because it truly is, a blessing to not have to get a sponsor and go through Administrative Review. Submitting extra documents is much better.


just a question, did the annual income you reported on the I-134 reflect the gross income of your 2010 tax return or your higher current annual income?

hopefully what is not getting lost in the copy of tax return vs tax transcript, is what's required is to show evidence of annual income claimed on the I-134. this can be accomplished by submitting a copy of the most recent tax return and W-2. some members submit a tax transcript to fullfill this requirement. If the most recent tax has a shortfall of the required income, but now are earning enough to meet the requirement, then it is important to show evidence of the substainable income. this can be accomplished with recent pay check stubs, a letter of explanation and an employment letter.

1, Like I said I know many people who used the Tax Transcripts which is even the USICS websit states is clearly acceptable.

2. You still have not produced the poster that said they were denied. You gonna produce a source that backs up your story. ? BTW arguing the term "denied" is symantics. As far as I am concerned if you did not leave there that day with a Visa Approval you were denied.

3. 100's if not 1000's of Manila filers know or have known that as soon as NVC issues your MNL case number you can schedule your appointment. You appear to be the only person that ever married a pinay that does not know that.

4. The only beef I have with you is that you post things that are not true, that I am afraid will cause delays or added stress to an already stressful process. I don't post anything unless I know it for a fact. Stop guessing about things. People here reley on this site for help and guidance.


2. there was a member who said they were given a 221g, later adding it had a notation MNL-IV-22, to submit a copy of the tax return when they had submitted a tax transcript. it is not accurate to say if you were not told the visa was approved on the day of the interview that you were denied.


3. there was a time when the interview could not be scheduled unless the physical petition was at the embassy. after the NVC issues a MNL Case Number an electronic file is sent to the Embassy, followed by the physical petition. if the physical petition is not at the Embassy at the time of the interview, there can be no interview. I've had personal experience with this, not at the Embassy level, but at an USCIS District Office.

4.you don't post anything unless you know it is a fact? Do you think it might cause someone unnecessary stress by saying they were denied if not told they were approved on the day of the interview, but had received a MNL-IV-22 ?

I don't see there being over-stay issues being they had gotten married within the 90 days, just never completed AOS... am I missing something?

 

She may have been "out of status" but with the K-1 as long as the marriage happened I don't see staying beyond 90 days being a big issue.

 

normally yes, but she has left the country. if she overstayed the I-94 by 180 days, a three year ban is a possibility. overstay for over one year, a ten year ban. if so, the may need to get a waiver.

CSPA will come into play to determine if the K2 is still eligible for a visa on the date of the interview.

 

I believe CSPA will only apply to a K-2 if they enter the USA before turning 21. if so, their age would be frozen on their admission date and should be able to AOS.

Just curious about your cenomar request. First of all, try to calm down. I know your agitated by the situation but believe me, everything happens for a reason. Let's try to see where the fault is? If you don't mind me asking, what details did you put on the fill-in the blanks. I know you need to put your full name, birth date, birth place, age, address, mother & father etc. Then after this you will proceed to some questions. Then after everything has been filled up you will be transferred to another page which is the online chat. This guys are going to re-verify everything you have entered. I believe there's a very very very low chance that if you even have the same full name, age, birth date and birth place, there's no chance that other will have the same parent unless your twins (lol, joking). By the way, is this the same website that you have requested. https://citizenservices.com.ph/ If not try to obtain here your birth certificate first for verifying your cenomar.

I called them twice and they were quick to answer the phone both times, they were professional and I did not feel rushed.  The first time I asked them what kind of preparation they had for my fiancee's interview.  They told me about the document.  I asked them if they had any kind of additional service available like transportation to the embassy, a guide, or perhaps someone she could talk to about the process and they said they did not have anything available.  Personally i think that would be a great service to have in the philippines, I'm sure someone must offer that but I was unable to find it at a reasonable price.

 

Overall, they do a good job with the paperwork but the rest is just hype.  Spending a few hours on VisaJourney will give you all the information you need.

UPDATE:

Our Case Status on CEAC has changed today to "READY". I don't know if this was because of my call last Monday. Or the fact that Christopher contacted his representatives and a congressional aide has put in an official inquiry on our case the past couple of days. (Also, I didn't call on Wednesday, was waiting to call next week, so as not to irritate Embassy employees. Hee.)

 

I'm just glad that it was sent back for review, and hopefully, they'd reconsider his assets and savings too.

 

The fiance also learned today that his employer just granted him life insurance benefit worth 1-year of salary. Benefits count too, so this should put us above the 125%. Again, we'll be preparing additional paperwork just in case we get contacted for more evidence of current sustained income, and this time with his pay stubs reflecting his pay raise as CS Manager. smile.png

 

Still hoping for the best!

I don't like to get involved in these kinds of matters as I feel there is always two sides to the coin and I have yet to hear her side.

 

But I will say, if you want to do this so it is fair to each of you, then you will need to file the divorce as this will permit her to go back to the Philippines and she will have a "status" that she has been annulled/divorced and this will permit her to marry again.

 

I believe she would also need to get a Judicial Recognition of Foriegn Divorce.
