the child would be applying for the K-2 Visa and would require a medical exam. I brought my step-daughter here on a K-2 Visa from the Philippines, so not familar with procedures for Juarez, Mexico. perhaps someone who has been thru there can give you some info. you might also want to check the info on the Juarez Consulate website.

QUOTE (Inquisitive One @ Sep 10 2007, 04:01 PM) <{POST_SNAPBACK}>
I need to know about the process of the interview and how it relates to children. My Mexican fiancee is going to have her interview in Juarez, Mexico. She lives in Monterrey, Mexico. Is her 7 year old child required to attend the interview also? and have a medical done there in Juarez? Also i wanted to bring her across the border there at Juarez after obtaining the K1 visa. What will they give to her son? is it also a K1 Visa or is it one visa that covers both of them? I'm confused on this. And since I know the K1 is good for only one entry I assume we cannot leave her son in Monterrey and cross at juarez and then return for her son in Monterrey. Please advise.

Thanks

the child would be eligible for a K-2 Visa. did you list the child on the I-129F?

K-1 Fiance(e) Visa Process & ProceduresProof of Single (legal Capacity)
CFO in Cebu told my wife, then fiance, the same thing. as you and I know there is no such thing here in the USA. you can provide her with any document the shows your marital status. tax return, paycheck stub etc. as I recall, they did not ask her for it when she attended CFO. she said she was asked several times if she knew I wasn't married. one time they asked her " how can you be so sure?" she told them " I've talked to his mother" after that, they stopped asking.

The phone bills, cards, emails, etc , are evidence that you would use at the interview to prove bonafide, ongoing relationship. with the 129f, you'll want to submit evidence from your last visit: photos, boarding passes, etc...

I'd like to know about this as well, my fiance is 24 (as of 3 days ago), and we did get her parents permission already, but now I'm wondering if she needs some kind of signed letter from her parents stating it's OK presumably at the interview. I'm hoping someone will know the answer definitively and post it here.

It has nothing to do with the interview at the US Embassy, it's for CFO, a Philippine Govt agency. She'll need to attend a seminar and get a stamp in her passport. written consent is not needed ages 21 to 25, just a written statement that the parents are aware of the couples intent to get married.

no, does not need to be sent with the 129f petition. it's a requirment of the Philippine Govt. she'll need to attend a CFO Seminar and get a stamp in her passport in order to leave the country with a K-1 Visa. parental consent is not needed ages 21 to 25. just a written statement that the parents are aware of the couple's intent to get married.

If the PI requires parental advisement (whatever that is) prior to you leaving, then you'll need that. There is no such requirement inside the USA.

It's for CFO, A Philippine Govt. Agency. A stamp from CFO is needed in passport to depart country when marrying a foreign national.

to the OP, since you will be applying for your visa in Manila, I would suggest posting any other questions you may have about the process in the Philiipine Forum.

I am emailing my girlfriend the g-325a , letter of intent, and asking her to take passport pics. I just want to make sure if that is all she needs to MAIL to me. To save time and money, are there any other things she might want to include?

Thank you very much for your time!

You will need to have her Birth certificate too from NSO

time is of the essence for you. the k2 visa must be issued within a year of your fiance's visa and that follow to join process is the same (send in packet 3, get the medical, maybe do custody stuff, and have the interview) as your wife's k1 process, but you get to start at the packet 3 point. i'd start filling out the packet 3 documents, just as you did for your fiance, and i'd write the embassy for instructions on what exactly you should do. this way, you can get ahead of it a little bit.

hope this makes sense.

good luck,

yes, time is of the essence. there is no packet 3 for Manila. all DS forms are submitted at the interview. The OP needs to contact the Embassy to schedule an interview, if there is enough time left to do so. he posted his wife has been here 9 months, not when her K-1 visa was issued.

I did not submit any emails. what I did was use phone service like Talkloop, Sarimanok, etc which have the capability of printing out a call log. if you have been with her since submitting the 129f, provide her with evidence of the visit. If you've provided any type of support, send her the receipts. exchange some snail mails. It's better to be prepared with some evidence than not have any to submit.

I think the others that responded, misunderstood your concern. Your concern is that although you are not married, in you emails you refer to each other as husband and wife and she signs, Mrs (your last name). This is defininitely NOT GOOD but she may be able to explain it at the interview.

Yeah but she only says that in the emails but at the same time not all of the emails does she use my last name. But everything she signed like the letter of intent to marry she signed using her first and last name and it was notarized at the US consulat in Osaka. The same with her G-325a and everything else she signed only the emails is where she will use my last name. I was just worried that they may think because of the email and only the emails that we are married. I was only divorce offically for 2 days when I got to japan and the divorce did not have time to be processed through the system to be able to get a divorce.

I would suggest she stop referring to you as her husband or to herself as Mrs. ... and that you submit no more evidence that does so, then prepare both an explanation and apology for any confusion. They'll understand it is explained as some silly thing people in love do and you in fact are NOT husband and wife.

My fiance called me husband in some of the emails I sent for evidence also. I see that it is bad but why is this a bad thing? Just curious

if noticed by th CO at the interview, it could cause unnecessary questions. the interview can be stressful enough without having questions asked that could have been avoided.

I don't mean to be rude, but why would anybody think that just because a spouse (ex spouse, boyfriend, whatever) disappears for a few years, that they are presumed dead?

It's part of the Family Code of the Philippines. Divorce is not legal in the Philippines. the options are annulment or presumptive death. apparently, many have chosen persumptive death since it is an easier process than annulment. The Embassy in Manila seems to looking at it with suspicion now.

Is this only in the case where there was never a marriage/annulment? If the biological parents were never legally married, the requirements for a notarized letter of permission from the biological father is waived?

based on my limited knowledge of the Family Code of The Philippines, my own experience, and what I've seen posted by others in similar situation, no consent need from biological father for children born out of wedlock. I'm not as familar with the situation of children from an annulled marriage.

correct, it is not a requirement to submit a copy of the beneficiary's birth certificate and/or passport with the I-129f. you do need to include a passport style photo. The I-134 Affidavit of Support is not submitted with the I-129f. It is used for the Visa Interview at the Embassy

K-1 Fiance(e) Visa Process & ProceduresHelp for a Friend

1. June? So is she here already now?
Technically coming on a tourist visa means that you do not intend to immigrate - while she is clearly intending to.
But I think the USCIS forgives that, maybe? I'm not 100% sure.

2. I am pretty sure the rule is that the marriage has to happen before the child's 18th birthday for the USC to be able to petition for stepchildren

3. No, GC is not automatic. Yes, she must adjust status to get the GC

not if the USCIS knows she entered with the intent to immigrate.

Thank you guys. I told her the same thing u told me but she said her lawyer suggested she come here and marry her boyfriend.
She will be back this June 28 on a tourist visa and will marry her boyfriend.

I was not sure about her 19 yr. old son coz my USC husband filed an I-130 petition for my 2 kids who are under 18 and they just passed their interview last June 11.

hmm, a lawyer is recommending she commit immigration fraud.

my wife's father had also passed away. she wrote deceased.

We also have a question about city and country of births/residences. My fiance for example, his father lives
in Sanford, NC USA. So should we just put Sanford, USA? He was born in Newburgh, NY USA. So should
it only be Newburgh, USA?

on my wife's, she wrote city and country. on mine I wrote city, state abbbr, and country. i think either way would be acceptable.

You can always file and ask for an extension to marry under the k-1 once arriving.

just as a point of clarification, there is no extension of the requirement to get married within 90 days. If the marriage occurred after 90 days, you would need to file a I-130 petition and 1-485.
the fact her sister has not brought her over is bothering. You need to ask why her sister has not yet sponsored her.

not a fair statement. do you realize how long it takes for a USC to petition a sibling from the Philippines?

Actually, according to the Act of 1952 and the reform act of 1965. It is a RIGHT to bring in your fiance, spouse, and children to the USA to live with you... The ACT of 1952 which is the basis for the USCIS today placed a priority on family first. Since then the 1% of all applications has been attacked, reformed, and slammed upon. there have been amendments, marriage broker revisions, checks mandated, etc. Many things to make the finace, and spousal visa more thorough. Due to these reforms, the original inceptions has been "muddied" and lost.

were fiance's even mentioned in these two acts?
