K-3 Spouse Visa Process & ProceduresWhat kinda evidence is actually being requested in RFE?
RFE is a request for evidence. usually it is insufficient or evidence missing from a petition. the one you're seeing mentioned alot is the one due to the IMBRA which took affect on March 6th. there is a scan in the IMBRA section if you want to take a look at it.

K-3 Spouse Visa Process & ProceduresI'm debating. One-way ticket or round trip?
i'd go one way, since should be cheaper. a k-3 does have multiple entry, but if you should need to go back to Philippine you'd need a round trip to return here. if you were using the return leg of a round trip to go back to the Philippines, you'd then have to purchase a one way to return here.
IMHO, one way is the way to go.

K-3 Spouse Visa Process & ProceduresSched for Interview in Manila?(I-130, k3)
doesn't sound like your case has been completed yet. from State Dept website:
What Does the National Visa Center Do?

After a Department of Homeland Security, U.S. Citizenship and Immigration Services (USCIS) office in the United States approves the petition, it sends the petition to the National Visa Center (NVC). NVC does the following:

Assigns a case number
Sends Form DS-3032 Choice of Address and Agent (../visa/frvi_forms.html ) to the applicant (your spouse). The applicant selects an agent. The agent can be anyone, including the applicant. The NVC will mail all future letters (except for the Affidavit of Support, Form I-864) about processing the immigrant visa case to the agent. Make sure the postal address is correct and is kept up-to-date.
Sends the bill for the Form I-864 Affidavit of Support processing to the petitioner
Sends the Form I-864, Affidavit of Support to the petitioner after the petitioner pays the I-864 processing fee
Sends the bill for immigrant visa (IV) processing fee to the agent after the applicant sends form DS-3032 Choice of Address and Agent, to the NVC
Sends an instruction package to the agent after the agent pays the immigrant visa application processing fee, form DS-230
Reviews information for technical correctness and completeness.
Sends the petition to the embassy or consulate where the applicant will apply for a visa when the case file is complete
Note: It is important to follow instructions from the NVC carefully. Send the NVC only those things that it asks for.

How Do I Pay the Fees for the National Visa Center (NVC) Services?

The NVC sends bills for certain fees at the appropriate time in the immigrant visa process. It sends bills for these services to the following people:

Bill for processing the I-864, Affidavit of Support to the petitioner
Bill for immigrant visa processing to the agent
The NVC sends a correctly addressed, return envelope with the bills.

Remember these important things:

It is important that you use the return envelope provided to you, when paying the fees
Don't forget to put the correct postage on the envelope
Don't pay the bill until the NVC tells you to do so
Don't send payments to the NVC at Portsmouth, New Hampshire
For further information see National Visa Center.

whichever petition arrives at the Embassy first, go with that one. takes about 120 days from date petition arrives at Embassy till the interview date.

Have you been together in the last two years? having met in the two years prior to filing of the I-129f is a requirement of the fiance visa. if yes, then fiance visa would probably be the faster way for her to come here. if not, then you would need to make another trip to the Philippines. if another trip to the Philippines is needed, then you might want to consider marrying her there and doing the K-3 or CR Visa.

My interview is on the June 25 and I heard from other applicants yesterday that embassy would have recession issuing visa. They said the qouta already reached and those applicants that have interview by July would get their visa by August. I dont know if that's true, but I hope it's not.
Keep in touch!!

i've read in some posts that K1/K3 visas are not affeceted by economic recession in the US not like the H1 visa of nurses/teachers. im not sure though. i also hope it's not true unsure.gif

US Embassy and Consulate DiscussionQuestion about K1 Packet and some other things

Hi, I'm new to this board and just had a few questions about the K1 process.

WILL TRY TO ANSWER. MY REPLYS IN CAP.
First question is.. is my fiance required to have all her vaccinations done before she gets her VISA? According to the embassy website, it indicates that it is not required but they might deny her anyway due to this?
NO, SHE WILL NOT BE DENIED VISA IF DOES NOT GET VACCINATIONS, BUT SHE'LL NEED THEM TO AOS. MIGHT AS WELL GET THEM THERE SINCE INCLUDED IN THE COST OF THE MEDICAL.
Second..
When my fiance gets her Packet, will it contain more information than just this?
http://manila.usemba...ov/wwwfivk1.pdf
IT WILL ALSO CONTAIN HER APPOINTMENT LETTER AND THE FORMS DS-156, DS-156K, AND DS-157
Third..
I got the NVC letter with case number on July 14th. I have yet to recieve any information on when her interview is. I went to this website: http://manila.usemba...v/wwwh3227.html and typed the case number but it doesn't give a date. When will I be able to check using this site?
NOT SURE ABOUT THIS
Fourth...
I understand that the packet will contain the interview date.. does the packet also include the St Lukes Medical exam date as well or can she go whenever she wants?
SHE CAN GO WHEN SHE WANTS. NEEDS THE HAVE THE APPOINTMENT LETTER,
And finally..

Is there something within the packet that cannot be opened until the interview? I think I heard someone say before that there is something sealed in the packet that cannot be opened or you won't get your visa?
BELEIVE THAT'S THE BROWN SEALED ENVELOPE WHEN SHE RECEIVES HER VISA. YHAT'S NOT SUPPOSE TO BE OPENED TILL SHE COMES HERE.
Thank you for your assistance

US Embassy and Consulate DiscussionAffidavit of support and Mortgage

Let me add...I should have said this earlier....

I think it depends somewhat on the consulate as to the depth of info you reveal.

London tends to barely glance at the I-134 if the income levels are met.

I'm not sure that would be the case at a more stringent consulate, such as Manila.

Take that into account when compiling your affidavit.

i could be wrong, but i've read similar things about Manila on the income requirement. i heard they're really picky when it comes to co-sponsers. they are more stringent when it comes to determining that the relationship is genuine.

i am just going to use my income to meet the fiancial requirement since it's more than enough. the CO will probably just look at tax returns and w-2's to see if meet fiancial requirements. they probably don't even look at assets unless income is not enough. i also going to print out a couple of my most recent bank statements and have a letter from my employer. the i-134 isn't binding. they'll probably look at our i-864 more closely when AOS. that one is binding.

i wouldn't call my knowledge in depth. the CO will not be looking at the beneficary's financial status, he will be looking at the petitioner's to make sure he/she will be able to support the beneficary. they want to be sure the beneficary will not become a public charge.

for K-1 visa will not need the DS-230. also at some point she will need to attend CFO.
here's a useful link to embassy website if you want to see what the Fiancee Visa Appointment Package looks like.

http://manila.usemba...ov/wwwfivk1.pdf

Just a small note... Your statement about the DS-230 seems to be correct for the Phillipines, however it is not true for all K-1 Visas. In my situation, Colombia, they require you to send a completed DS-230 when you reply back to the Packet 3, before getting a packet 4.

Reason being... a K-1 Visa beneficiary will possibly become an Immigrant at some point in the process.

i saw that they would be going thru Manila Embassy, as am I. your right about DS-230. should always check with your Embassy to see what's required.
Dave, the CFO is REQUIRED. not by the US Embassy, but by the Philippine govt. she will have to attend a seminar and have her passpot stamped, here's a link to a post with some info about it.

my advise was based on what i was told by someone who has helped prepare numerous petitions for the Embassy in Manila. the I-134 is used mainly to see if you meet the income requirements. when you AOS with an I-864, that one is binding.

Put N/A - Fiance Visa.....this question does not pertain to a Fiance visa

Did you say check do not??? I`d rather place N/A than that. I personally wrote

both dependents will have full access to my resources indefinitely

just because i do not know which CO may decide N/A is too vague but dont quote me. I will be interested in hearing more about this question from those that have gone through the process already. MyI-134 is still here with me, notarized and all, so i am hoping my answer is okay

at this point in the process, either way would be accepted. the I-134 is not legally binding. the Embassy uses it to see if the petitioner meets income requirements so that the benificary will not become a public charge. when you AOS, the I-864 will be legally binding.
sunandmoonMalePhilippines2006-09-02 17:06:00
US Embassy and Consulate DiscussionDo we inform embassy that we're not going to use K-2?
you don't need to notify the Embassy. on the DS156K you will list your child's name. you would check no in the box Will accompany you. check yes in the box will follow you. a K-2 can be issued up one year after the K-1 was issued. after that you would have to file a I-130.
if at all possible that the child could come at the same time as you, the process would be much simpler and less expensive. plus will will not have the emotional consquences of being separated from your child for a long period of time.

i'm not familar with the Embassy there. generally, there is no phone call or email by the Embassy. they deliver the package by whatever method that Embassy uses to the beneficary's address listed on the 129F.
check the Embassy's website for more information.

i haven't received the interview date yet.
after NOA2, in about 2 to 4 weeks your petition will be assigned a case number by the NVC. you can call the NVC for the case number. a snail mail should be sent to you with it. after being assigned a case number, an electronic file of your petition will be sent to the Embassy. it will take about a week for the physical petition to arrive at the Embassy. once it does you will be put on que for an interview schedule. right now they are saying it's approx. 120 days fom receipt of the petition to have an interview scheduled.
when the interview is scheduled, about 4 to 8 weeks before it, your fiance will receive the Fiance Visa Appointment Package. it will have the appointment letter, DS- 156, 156k, 157 forms in it. a $100 visa application fee needs to be paid at a bank listed in the package. believe the fee for the medical exam is $95.
it should be done at least a week before and not more than a month from the interview date. your fiance has to attend a CFO Seminar before departure. it can be done at any time.
