K-1 Fiance(e) Visa Process & ProceduresDo I need a waiver

I believe a waiver is only needed if you also fall under the 'multiple petitions' categeory.

i believe in this situation, no multiple petitions, the only action that occurs is the beneficary is informed at the interview.

K-1 Fiance(e) Visa Process & ProceduresIs a lawyer necessary?

Here are my questions:

1) Is is possible to have success in obtaining a K1 visa if I submitt the paperwork? Is a lawyer necessary? Is the $1500- 2000 dollars for a lawyer worth it?

2) Any success stories without a lawyer?

3) Why not use a lawyer in the Philippines to help my wife-to-be?

Ray

i didn't find it necessary to use a lawyer. so far so good. you will be the one submitting the petition here. why use a lawyer in Philippines? if you do feel the need for a lawyer would think it would be better to us one in US.

K-1 Fiance(e) Visa Process & ProceduresQuestions before filing K-1

Yodrak is a very knowledgable member of the forum. the directions for the 129f state if living outside th US, to file with the Service Center of your last residence. the G-325a asks for residence for the last five years. has he had no US residence for over five years? He has had no address to which any mail has been sent to? does he now use his mom's address as a mailing address?
i don't think he should file from a state where he intends to reside. if he is using his mom's address as a US mailing address and hasn't had a residence in the US for over five years, i would think it should be submitted to the the Service Center which has jurisdiction over his mom's address.
i could be wrong. hopefully someone will correct me if i am.

Hi roymcn3rd

Tks for letting me know who Jodrak is.

Before living and working in oversea, i think he has his permanent home address in America of course. But now, he doesn't have. According to what i have just studied from school in my American Culture class, it is said that Americans are very mobile, they are not sticked to live at one place, and every American often moves from place to another at least few times in his/her life. And so does my fiance. He lived in different places when he was in US, and the last place he stayed before working in oversea was NC. According to what you said, should my fiance write down the address that he was staying in NC for last time? Yes, i think he will use his mom's home address.

Hope to get more advices from you, guys.

Lan&Mike

directions for 129f say petition should SUBMITTED to Service Center having jurisdiction over last residence (NC). since he has no mailing address i would use his mom's address on the petition. hopefully someone will correct me if i'm wrong.

K-1 Fiance(e) Visa Process & ProceduresQuestion in writing down the letter of intent (both beneficieary & petitioner)

hi there its best to just write USCIS-
my name, where i live, what i do for a living, tell about yourself, your age, how u met your fiancee, and how u fell in love, when you met, what u did together while u were together, what your family thinks about her, ... i was told by my atty that it best be at least 2-3 pages long. tell everything u can about your relationship from beginning and to present time... and how u miss her and what not.. and what u want in the future and make sure that it fits with her intent letter... you dont want to put something in detail and then hers say something diff.. so check with her.. then at the end of letter write that u intend to marry within 90 days of arriving into the U.S. best of luck!!!!

michelle/otman

The letter of intent does not have to be 2-3 pages long! The example already posted in this thread has been proven time and again to be sufficient. Your attorney is confusing that with question 18 on the form asking how/when you met your fiance -- and that does not have to be 2-3 pages long either.

just goes to show that attorneys don't always know what they are talking about. my answer to question 18 was three paragraphs.

K-1 Fiance(e) Visa Process & ProceduresShould I go with fiance' to interview?
the medical should be done no sooner than a week before the interview or no longer than a month prior to it.
you definitely can accompany her to the interview. i heard at the Manila Embassy it's about 10% accompany their Fiance/spouse. it would be up to the CO whether you sat beside her or off to the side.
at the medical at St lukes, no one will be able to go inside with her.

K-1 Fiance(e) Visa Process & ProceduresPLEASE HELP: Will I be able to get another fiancée or a spousal visa again?
i thought this sounded familar. you can apply, but the BIG question is can you get a waiver. i can only suggest contacting an immigration attorney as other's have suggested.
to qoute you,
"Or is there any other way to easily/faster/surely
bring her here in the USA?"

i don't think so.

K-1 Fiance(e) Visa Process & ProceduresQuestion Please

roymcn3rd,

You already stated that and provided a link to DOS requirements.

Are you disputing the 5x5 cm measurement? This is precisely what the Embassy/Consulate is expecting, from the foreign Fiance.

you need the passport syle photos when submitting a I-129f petition.

no, not at all. sorry if misunderstanding. i interpreted another member saying they were not needed for the I-129f petition.

K-1 Fiance(e) Visa Process & ProceduresQuestion Please

Picture to be attach in the form G-325A? I don't think you need to attach a picture on it. But if you are applying a petition for K1 you and your partner need to submit a passport size photo (American passport size photo).

you do need a passport style photo for petitioner and beneficary.
