The day is here, and the Typhoon left Manila unscathed so we are hoping for smooth sailing with today's CR1 interview. Good luck to others with interviews this month. I'll post our experience when we get home later today. Leaving now for the 6am appointment.

hi,

actually, i was kind of disappointed when they didn't tell me anything at all about my medical results, not that i was expecting that i'm sick. It's just that the reason why most of us wanted to have it done earlier than it was scheduled was to know beforehand, if there are some abnormalities in our health that we could take care of. sadly to say, they won't give you any hint at all, as to what i had experienced. i just hope and pray that all of us would pass the medical and interview as well.

Panicked, if you have spent time with her it would be a good idea to visit your doctor and get a chest xray and screening. TB is highly contagious and communicable. You can be a carrier and pass it along to your family if you are infected. Also have her family get treatment.

I worked as a medic through college and they were always screening us for this.

[size=1]St. Lukes discovered that she had active TB! She is undergoing treatment and will not be eligible for her interview in 6 months. No one knew of her aliment until she went to the medical exam, about a week early. St Lukes told her that they canceled the interview, for now. She is curable, doing the traement etc. We think she may have gotten infected when Luzon was struck by typhoons earlier this year.

I called the embassy and they said that I need to fax them some basic information (case number, etc) and that I must sign it, to show that I am not abandoning the petition. Needless to say, I am sticking it out with her for the long haul. She did not attend the interview because she was told not too. When I called the embassy, they said that it is proper but that she is 'showing' as a no-show. (hence why I ned to send the fax)


1. When she gets the 'OK' from St. Lukes, how do we get a her a new interview?

2. Will she have to get a new NSO birth certificate, in addition to a new NBI clearance? I am sure that I will
have to send her a new ITR, but is there anything else that she will need to get?

3. Does any one have any suggestions about what we should be doing, besides sitting on our hands,
crying?

how did your fiance find out that she's sick? during the time that she was about to take her medical exam results? as far as i know, they will not divulge any results to the patient. i had my medical last week and they told me nothing and just wait for the interview itself. i'm really sorry to hear about this. i'll be adding her to my prayers.

Hey guys. The CFO lady at the seminar told my gal that she would not be allowed to use her knockoff L. Viton luggage to travel to the US since they are banned by the US govt. Anybody heard of this, and which agency would be implementing the policy. My quick scan of the regs found nothing.

CUSTOMS DIRECTIVE NO. 2310-011A DATE: JANUARY 24, 2000
SUPERSEDES: 2310-11 July 30, 1991
REVIEW DATE: JANUARY 2002
PERSONAL USE EXEMPTION: UNAUTHORIZED TRADEMARKS

1. PURPOSE. To clarify Customs policy with respect to the proper application of the personal use exemption.

2. AUTHORITY. Generally, Section 526 of the Tariff Act of 1930, as amended (19 U.S.C. §1526) and section 42 of the Act of July 5, 1946 (60 Stat. 440; 15 U.S.C. §1124) (the Lanham Act) proscribe the importation of goods bearing counterfeits of trademarks which have been registered with the U.S. Patent & Trademark Office and recorded with U.S. Customs.

3. BACKGROUND. According to the statute (19 U.S.C. §1526(d)(1)), such restrictions do not apply to the importation of articles accompanying any person arriving in the United States, when such articles are for his personal use and not for sale, provided such articles have been approved and enumerated by Customs, and that such person has not been granted a 1526(d) exemption within 30 days immediately preceding his arrival. However, 19 U.S.C.§1526(d)(4) also authorizes the Secretary of the Treasury to prescribe such rules and regulations as may be necessary to carry out that law.

3.1 At 19 CFR §148.55, Customs has promulgated regulations which provide for the importation of one article of a type bearing an unauthorized protected trademark. Importations of quantities greater than one article of a type bearing an unauthorized trademark are subject to the provisions of 19 CFR §133.24.

4. ACTION. Customs officers shall permit any person arriving in the United States, to import one article, which must accompany the person, bearing a counterfeit, confusingly similar, or restricted gray market trademark, provided that the article is for personal use and not for sale.

4.1 Customs officers shall permit the arriving person to retain one article of each type accompanying the person. For example, an arriving person who has three purses, whether each bears a different unauthorized trademark or whether all three bear the same unauthorized trademark, is permitted one purse.

4.2 Imported items over and above one article are subject to disposition under either 19 CFR § 133.21 (counterfeit) or 19 CFR § 133.24 (gray market and confusingly similar). Under 19 CFR § 133.21, counterfeit items, in the absence of permission from the trademark owner, must be seized and forfeited. Gray market or confusingly similar goods are subject to detention under 19 CFR §133.24(a). Upon such a detention, Customs officers should orally advise the person(s) arriving that the articles are subject to detention and that in accordance with 19 CFR §133.24©(2), such articles may be:

4.2.1 Exported or destroyed under Customs supervision; or

4.2.2 Imported if the mark is removed or obliterated to Customs satisfaction; or

4.2.3 Released if permission to import the goods is obtained from the trademark holder.

4.3 Where the trademark holder consents to the importation of goods bearing unauthorized trademarks in quantities above the regulatory exemption, Customs officers shall allow the greater quantity to be imported.

4.4 Where the importer has failed to obtain release of such detained goods after 30 days from the date of presentation to Customs, said goods shall be seized and forfeiture proceedings instituted.

4.5 In the past, there has been confusion over whether the personal use exemption contained in 19 CFR §148.55 applies equally to crew members. 19 CFR §148.55, and its governing statute, 19 U.S.C. §1526(d), state that the personal use exemption is available to "any person." This includes crew members.

5. RESPONSIBILITIES. Customs field officers are responsible for following these guidelines. Area/Port directors, assistant port directors (trade operations), supervisory import specialists, and supervisory inspectors are responsible for ensuring that their staffs are aware of the content of this Directive and adhere to the guidelines provided.

Hey guys, I posted my timeline a couple of days ago and I got an assumption than since my case number is MNL2006805xxx, I could probably get my interview late March or early April next year. Can you like help me again and do another forecast, that, if thats the case when should I get my interview packet? The reason I have asked about this is because my fiance and I are planning to see each in Hong Kong early January of the upcoming year. Is it okay for me to leave on the said date? I just don't want to miss out the packet just in case they send it to me. Hope one of you guys can shed some light on this matter. Thanks in advance.


the interview dates aren't released till after the 15th of the month, so a packet probably wouldn't be delivered before the 20th of the month.

Unfortunately for me, the umpire (consul) gave me a technical foul and my penalty is to sit it out until next year :clock: :cry: BOO-HOO! Anyway, I’ll be happy to watch my teammates pass the ball around and root for all of you while I’m at the sidelines.

However, Manila Embassy now sends out a one-page letter advising beneficiaries the date they received the physical file from NVC. Is this what your fiancee received? Packet 4 is very thick, it contains more than 10 sheets of instructions and forms and your fiancee does not receive this until her interview is scheduled. You are now number 55, up from 57 because your case number is lower. Hmm, I just realized that I have the power to promote and demote people here :devil: hehehe

yes they are free and easy to obtain. call 1-800-829-1040 and follow the prompts. you'll receive in about 10 days. it's a single page, front and back. 2006 ITR will not be requested till after April 15, 2007. if you've filed it already, I'd send photocopy. if not I'd send copy of W-2 to back up your income.





are you sure 2006 ITR will not requested till April? why my fiancee has his ITR for 2005 and he requested it january 26, 2006? its done electronically. i think you can get your tax return that way and much easier and early. but i am not sure if in the other state some doing that? now m confused here also coz we are expecting my interview this coming Feb as well. your opinion could help alot to us. thanks.

don't worry. 2005 ITR will be fine in Feb 2007. the deadline for filing is April 15th. an ITR return isn't something you receive from the govt. it's something we do to determine if we're getting a refund or have to pay more taxes. hopefully the former. :D

Hello to all! We got approved (NOA2) last February 27 and as of this time, we haven't heard from NVC about the status of our case (but we're sure they got our case from California). Looking at others timelines, it usually takes 2-3 weeks for NVC to forward it to Manila (that's if not being put under AR-God forbid). Now my question is, what is the best way to contact USE Manila about our case (if we already heard from NVC)? How long does it takes for me to receive what they call "Packet 3" if ever they will send one? I know I'm a bit excited about the whole thing but as I've heard from others, once you got the NOA2, things are a lot easier now. I hate surprises (because it could kill me- :wacko: ) and I don't want to be surprised from lacking of knowledge about what to expect after being approved at USCIS... Any advice and input will be highly appreciated. :help:

the only packet you will receive is the fiance visa appointment packet. that wont be till after you've been scheduled interview. what some refer to as packet 3 is the pre-interview letter, which everyone doesn't receive, so dont worry if you don't get one. you can take a look at the appointment packet on the Embassy website so you know what you'll need for the interview. the Sheriff has a link in his signature. your journey is nearing the end. best of luck the rest of the way.

To All Having Interviewed This Month:
As several questions have arisen in several other topic areas about the Phil's.
I have a very good question. With the delays of the last year, and with all the problems having arisen due to all the changes that have created delays, has anyone been asked for this years (2006) tax returns thus far? Lorelle (Aussie) and a few others have made it known that it has happened before, and at this point in saving many a trip to the embassy to be saddened in arriving without knowing it, do we need to bring New transcripts with our loved ones to the Interview, will this be a problem?
Just was wondering, and hope it really isnt a problem at all, and just me being a worry wart.

Seems Manila has too many issues , and this is just another to worry about.

I'm really not sure, but would think they would not start asking for it till at least sometime in May since the deadline for filing a return isn't till April17th. you can always send copies of your W2 to show your income for 2006.

the schedule for April has already been released. the May interview dates will be released anytime after the 15th of this month.

Dont forget Alcatraz and Jollibee in Daly City! lol... SFO will be my POE (this March 2- WOHOOO!!) and we will stay there for 5 days to see all these places.. and Visit with Mari. My Fiance misses Jollibee so we looked it up and found one in Daly City so we will go there (i hope they have Daing na Bangus since thats what he likes..lol) and visit couple of Filipino Restaurants too :dance:

For the Port of Entry preparation, does anyone know of anything else needed besides the brown envelope in your carry-on, and the Xray in the checkin? (Assuming the hawaii experience above was unusual...) My wife is travelling light and really does not want to carry the filing cabinet of interview preparation.

Yazi's POE was SFO. she was just asked for the brown envelope, passport with visa and the completed I-94. she was not asked for the x-ray. she had fingerprint scannind and photo taken. asked questions like whose your petitioner, when did you meet, are you sure he's single, etc... and reminded that you have 90 days to get married. welcome to America, good luck. the whole process took about 10 minutes.

Well Lorna passed the physical with flying colors.... nothing came up about her cough.... which was my main concern.

Oh, now she laughs about how easy it was although I know it was a different story yesterday morning, hehehe!

She didn't enjoy the 9 vaccinations to much but was fine when we chatted afterwards.

I guess I was lucky, the lady who had my finger scanned was nice, the (male) filipino interviewer was super super nice,and my American consul was super duper nice, hehehe. The documents asked from me were:

*NBI clearance
*Birth Certificate
*emails
*pictures
*ITR
*W2
*I-134
*Certificate of employment

The American consul asked me only one question,"what is your fiance's job?", that's it,went to window 37 and paid DELBROS. Advice to those who will be having their interview,eat heavy breakfast coz when I was about to have my interview w/ the Consular Officer, I was starving and I thought I was going to collapse,hehe.

I submitted DS156 EVAF, but it is ok to submit the ones from the packet as some of my seatmates submitted the ones w/out the bar code. Don't leave any blanks,put NA or NONE.

maybe, the immigration guy at POE made a mistake and took the x-ray? Wow, this is really confusing now.

For those who have recently entered the US, please let us know if your x-rays were taken at POE and where your POE is.


That's what I'm thinking. She handed it to the Immigration Officer and by mistake didn't give it back.

on the I-94, may I suggest taking a look at the link in the Sheriff's signature. I had Yazi do that. after seeing it, it put her at ease to see it will be simple to fill out. I think she was having formophobia coz of all the one's she had to fill out during the visa process. :lol:

someone posted in another thread to hand carry the X Ray coz they asked for it at the at their POE in Hawaii. everything I've read or heard is you don't need to hand carry the X ray. I told Yazi to put it her in checked in. I just want to check to be sure, do you need to hand carry the X-ray?

someone posted in another thread to hand carry the X Ray coz they asked for it at the at their POE in Hawaii. everything I've read or heard is you don't need to hand carry the X ray. I told Yazi to put it her in checked in. I just want to check to be sure, do you need to hand carry the X-ray?

Hi guys! Im sorry if im being impatient with my visa delivery, its just that I have a reservation for my ticket and tom (Feb 22) is the deadline. If they automatically cancel my reservation, i might not be able to get another March 2 flight because its already fully booked. I checked Delbros website and my question is: what does this mean "SHIPMENT RECEIVED AT DISTRIBUTION CENTER"? Y'guys think its already here in Davao? I hope I'll get my visa tom b4 12 noon so that I can book my ticket already. They wont book my ticket until they see my passport and visa :(

I got a msg from DELBROS today "Delbros Delivers! Delivery for MNL2006783***** starts TOM up to d Next 2 days! U must leave a Valid ID & signed authorization letter or a 1 week delay will ensue"
Im HAPPY to rcv their text! yey! but ummm.. How long should I expect to have my visa? Im in Davao by the way

Mira is APPROVED. YEAH. We were not prepared for the number of people waiting to get into the Embassy. I thought we would be there all day. I was impressed by the way they moved applicants from one section to another and I was surpised that we were finished at 11:10am. Hope Mike n Jennie and 2hearts have the same news.
