if you decide for the children to apply for their visas at a later date. the k-2 visa must be issued within one year from the date the K- was issued. make sure to allow enough time to schedule an appointment
I know everyone's situation is different, but it's much easier when the kids come at the same time. We were also considering follow to join, but decided to have our daughter come at the same time as my wife. the time that would have been lost being apart is time we could have never replaced.

Fiance is planning to send in petition application on the last week of January or 1st week of February the least.

I know embassy interview appointment is still very far down the road but I just want to be sure that there will never be problem with my daughter (10 years old) and my son (8 years old) deriving K2 visa from me and following me later. They are listed on fiance's I-129F which we believe, is a requirement for them to be able to have derivative visa.

Our plan is for me to go there first, get married in a civil wedding and then adjust status, then I will go back after 6 months or when I get temporary permanent resident status to get the kids... and then have a Christian wedding with the kids in attendance after we bring the kids there.

My question is: 1. Should I file for visa application for the 3 of us straight away. (provided my fiance's petition application for me gets approved)
2. Are there specific tips to follow in cases like this?

Any input will be greatly appreciated. thank you very much.


if the kids apply for a K-2 Visa at the same time as your K-1, then they would have to enter the USA within six months. a K-2 can not be extended. your AOS could take longer than six months from the time you enter the USA, in which case you will need AP to be able to go back for your kids.

the 1040 is his Federal Income Tax return. it is not required to have it notarized. only the Affidavit of Support I-134 form itself is required to be notarized.

my fiance told me he only have 2005 and 2006 ITR.. but we will bring his 2007 pay stubs and Letter from company stating his current earnings. Will this be enough Roy?


along with I-134, and if meets minimum income requirements, you should be fine. good.gif

in the past, I don't recall anyone who had a March interview posting they were asked for previous year tax return. in addition to co sponsor, if your present income situation has improved, you can have ready evidence such as recent pay check stubs, letter from employer, etc...

If you are using tax transcripts then the notarization is not neccessary. When using 1040s it is a good idea to have them notarized because the consular can request the originals.


also, make sure to include a copy of the W-2, since that backs up the income declared on the 1040.

Hello. The DS156 has been E Filed and is included in the financial packet. The others (DS156K, DS157, DS230) are attached below in an editable format so you can complete them. The DS230, part one, absolutely needs to be completed. The forms attached do not need to be E Filed as far as I know.

Its good that they did not ask for your xray film from your checked in luggages but I have read a thread here before with the lady who did the same thing and it took her hours in the POE because her xray film was inside her checked in luggage and the immigration officer wanted to see it. The immigration officer in San Francisco asked for my xray film. What I did was placed it inside the box where my wedding dress was which I hand carried so it didnt bother me at all during the flight.

To those who are getting ready for their flight here , my advice would be to always hand carry your xray film because you never know what an immigration officer will ask. Better to be safe than sorry.

well last yr my POE was san fran and they didnt asked for my x-ray film so i guess it varies. i took a shot and got lucky or i may have end up waiting for hrs and miss my connecting flight lol...

write down whatever is reflected on the child's birth certificate as they would always cross reference the ds157 with the BC--the information should always be consistent.

sorry, but I have to disagree based on my own experience. I agree with mikeandlani to list the father's name if it is on the birth certificate. If there is no father listed on the birth cetificate, it is not necessary to put it on the DS-157. there is a third option, leave it blank. that's what we did. not one question was asked about the biological father by the CO.

an RFE would not be issued if there never was an NOA1. from what has been discribed, a document was missing from the I-129f petition. once the petition is returned, it's likely the situation can be resolved. the fiance can try calling, but I've never heard of anyone being able to go to the Service Center to resolve the problem.

calling USCIS might not get any additional information. your fiance may have to wait until the packet is returned to see a detailed description of what is missing. without knowing exactly what the Notice of Intent to Deny says, would only be speculating as to the reason. hopefully it's something that can be easily resolved.

Did you apply for Advance Parole? If you did, that's your ticket to go out of the country and come back. You will also need a copy of your marriage certificate to go along with your travel documents. If you don't have AP and your AOS is not approved yet, don't leave the country because K1 visa is one-time entry.
