you can try contacting the Embassy, but unfortunately, the K-2 visa can not be extended once it has expired. looking at your timeline in your signature, even if the K-2 had not been issued at the same time as your wife's k-1, it would still be too late for a K-2, since it would have had to been issued within one year from the date the k-1 was issued. your only option at this point is to file an I-130 petition for the daughter.

yes, your fiance can go to her medical before the scheduled date. as you have mentioned, she should bring a copy of her appointment letter. attending the interview with your fiance is a matter of personal situations and choice. if you decide to attend the interview with her, it's very likely the date would be changed, unless there is some problem at the medical.
that's a reason to have the medical early. if there are any problems, hopefully they could be cleared up before the interview date.

I agree, and the OP said that the Embassy papers he has mention the DS-230...so he may need them. Don't get bent out of shape...things can change...which is why I mentioned what I know about what I will need to do, and also pointed out that I KNOW things can be different.

the indian embassies require a DS-230 for K1, as well as a 156 and 156K.. they dont ask for a 157.. what is that form?

Will BPI validate the 157 I provide to her when she pays or will they give her their oen validated forms?In the instuctions I am writing I asked her to see if they will validate the ones I am sending and if they will not to copy the data to the ones they give her.

In our situation, the biological father disappeared before our daughter was born. my wife was never married to the father. he was not listed on our daughter's birth certificate.
not one question was asked about the biological father during the entire process in our case.

The OP is not going to travel w/ her son....they are pursuing a "follow to join" scenario. I don't know where you would get such an affidavit...but perhaps the US embassy in the Phillipines may be able to help you.

Where do you see that? She stated that she will file a petition for him to follow her to the US....I understood that to mean that she will arrive her and her son will follow at a later date, presumably alone. That's why she thought she needed said affidavit.

she hasn't stated whether she will return to the Philippines to bring the son here or if the son will travel here alone or someone other than her. that's where a DSWD Travel Clearance would come into play.
I think her concern is whether she needs permission from the father to bring her son here. since she has full custody, I do not believe so. someone correct me if I'm wrong on that issue.

for a K-2, the visas would need to be issued by June 2008. allow enough time to set up interview. each child would require a separate visa application. I believe the application fee is $131 each.

As someone that did the follow to join, I did not take your's or anyone's comments to be criticizing those that do the follow to join. I just wanted to present another view from someone that did it. I also hope I did not sound judgemental towards your position either. As I said, there are valid arguments for doing both and the choice is up to the individual. I agree that family togetherness and reunification should be the focus even for those that do follow to join.

I'll admit I am biased towards children coming at the same time as the parent, so sorry if it sounded like I was criticizing those who choose follow to join. whether choosing same time or follow to join the important thing is, in the end, to be together as a family. good.gif

I know everyone's circumstances are different and try to make decisions what they feel are in the best interest of the children. my only hope with those who are thinking of follow to join is to look at the pros and cons before coming to a decision.

More than 6months?!.. i thought it will only take 3months or so:(...

Forgive my ignorance... why would the kids AOS charge be higher? and why would it be cheaper should we apply AOS at the same time?
I wanted them to just follow because I want to be able to adjust a little to life there so I would be able to assist my kids in their adjustment period better later on.

AOS fees for the kids. filing with you $600 each. filing separately from you $930 each.
just my opinion, but kids can have an easier time adjusting to new situations than us, adults.

I know everyone's situation is different, but it's much easier when the kids come at the same time. We were also considering follow to join, but decided to have our daughter come at the same time as my wife. the time that would have been lost being apart is time we could have never replaced.
