Thanks for the replies, I was pretty sure that an actual meeting would be required. I'm just gathering information now and have not begun the visa process, we've just been talking about it. you do not need a visa to enter the Philippines. you have up to 3 weeks to visit. it can be extended when you are there.

it's a huge red flag. it's extremely difficult to get a waiver for the requirement of having met in person....

the U.S. citizen and foreign fiancee must have met in person within the two years before the K1 fiancee visa petition is filed unless either:

(a) meeting your fiancee in person would violate strict and long established customs of your fiancee's foreign culture or social practice; or

(cool.gif the U.S. citizen can establish that complying with this requirement will result in extreme hardship to them (please note that financial hardship alone is not considered to be an "extreme hardship" by the USCIS); and


you also mention other way around... Philippines to here. if by that you mean to have her come here to met you, it could also prove difficult for her to be issued a tourist visa. the best way is for you to go to the Philippines to met her in person.

(2)(i) A physical or mental disorder and behavior associated with the disorder that may pose, or has posed, a threat to the property, safety, or welfare of the alien or others;

(ii) A history of a physical or mental disorder and behavior associated with the disorder, which behavior has posed a threat to the property, safety, or welfare of the alien or others and which behavior is likely to recur or lead to other harmful behavior;


I understand it can be frustrating. It's OK to let off a little steam. In Principal, we all can fall in love and marry anyone, but when bringing our SO from another country, there are some hoops we have to jump thru for that to be accomplished.

It basically means that the parents have to write a letter stating they are aware of the marriage of their daugher/son. This is taken from the Phil gov website on marriages, but should apply as well.

Parents' Consent (for 18-21 years old) or Parent's Advice (for 21-25 years old): Under Philippine law, the legal age for marriage is 18. If the contracting parties are between the ages of 18 and 21, they must present written consent to the marriage from their father, mother or legal guardian. While any contracting party between the age of 22 and 25 must present written parental advice, i.e., a written indication that the parents are aware of the couple's intent to marry.

Hope this helps, unless the CFO has different rules from this...

whatever you do, do not reschedule the interview. if a document is missing, you would just go on AR and submit the document when you receive it. you can use either a copy of the form 1040 or a Tax transcript.

my mom's going better. her surgery went fine, now just a long rehab period. Yazi's doing fine. she was able to get a full time job as Activity Director at a skilled nursing facility. not the same line of work she had in the Philippines, but she's happy with it.

Sheriff, I tried to send you PM a week ago but I guess I pressed the wrong keys and you may not have received my message. I was going to ask you if you can please have a separate list in the Guide for all the fees that need to be paid (USCIS, US Embassy visa fee/biometrics, Medical (adult/child), Delbros, NBI, etc. and for AOS ~ I-485 application fee, transfer to I-693A, etc.) so we can see all the expected expenses at a glance. That's all the fees I can think of right now. If I missed anything, I'm sure you will come to my rescue.

Im on CR1 and will not file for AOS or EAD but I do know for a fact that your fiance can get SSN as soon as she lands on US soil. In her case, since she's already here, anytime.
