Honestly....I don't really know either what forms will be required. I just sent the letter to ask for the appointment and will need to complete forms as well.

Will you go home for your child's interview and medical? if not, do you know what is required from the Embassy at the interview in order to allow a "guardian" to attend on your behalf? I know for a passport, my wife has to send a special power of attorney authenticated by the Philippine Consulate here in the states, so we just included the interview and medical on that too, but not really sure of the requirements.

Any help will be appreciated.

the DS Forms would be same, except DS-156k is not required.
I asked the about guardian of child attending the interview:

USER Asked: roy: My fiancée and I are considering having her daughter follow to join with a k-2 visa. Would she have to be present at the daughter’s interview or could it be a guardian? If they both apply at same time while my fiancée still in Philippines, can the K-2 visa for the daughter be extended beyond six months?

CONSUL: The K1 or K2 visa cannot be extended beyond 6 months from date of issuance. If the K2 will follow to join some other time, he/she should be issued for a K2 visa within one year of K1’s date of issuance. If the one-year window had lapsed a new petition should be filed for the child of the K1. If the daughter will apply as following to join, the mother is not required to be present during the interview; the guardian with proper identification could assist the minor child.

you might want to call the Embassy for more details.

It's been about a year now since the group from Dec 2006 had their interviews. hope everyone's doing fine. Yazi started a part time job this weekend at a senior living facility. she's happy to finally have a job. it's been frustrating for her not working. in the next couple of weeks she has an interview for a govt. job.

Correct. Put his current annual income on line 23 and support this with a letter of employment and the last 3 pay stubs. And then report the adjusted gross income for 2006, 2005, 2004 as provided in item 25 of the I-864 and support this with copies of his Form 1040.


sorry, I thought the question was only about line 23 for current income. didn't know might also be asking about line 25 on Federal Income Tax information.

I used my adjusted gross income (and tax forms) from the 2006 tax year (filed in 2007) because it is the most current year that has been filed and can be verified by the IRS if needed.

my husband's adjusted gross income in tax year 2006 is different from his current income (due to change of work)...higher income this year...the current income is supported by the letter of employment...however, what is asked is the "current annual income", however again that, the affidavit states that the income to be written is the adjusted gross income in the tax return...
pls help me understand further....

I put down my current annual income from 2007. I included for supporting documents, letter from my employer, photocopy of 2006 ITR and photocopy of W-2. you can use an IRS transcript instead of tax return and W-2. if your pay has increased since 2006, you can also include photocopies of recent pay check stubs.

You may want to use the sample form here in VJ as your pattern because that's what I did, but to answer your questions, here it is.

1. Just you and your husband's address, don't worry about the C/O
2. K1 Visa holder
3. Yes
4. K1 or K1 Visa holder
5. You have to make this one clear because I looked for this on my own form and didn't find it

I believe it's correct, $1010 including AP and EAD. Good luck!

My reading from there is what I based my statements about K1 visa holders being able to work before getting an EAD....
We waited until we were married to apply for Novelyn's SS Card so that it would have her married name on it.


That's why a K-1 is able to obtain a SSN. once the I-94 expires, your status has changed. you are now out of status unless you have AOS. then your status is pending for conditional residency.

Your I-94 allows you to work until it expires per SSA regulations (I have the link for this at home) , the trick however will be in finding an employer that will accept it. With the current focus on illegal immigration this will be even more difficult. Good Luck to you!

We applied for a SS number 3 weeks after Novelyn arrived in the US and had the card a week later.



I dont think I have the EAD stamp on my passport at POE. I receive my SSCard today though it says there that "valid for work only with DHS authorization". What does that mean? Is this what it meant by I can work till my I-94 expires?

The employer may hire me part time coz he believes that i can work after getting married. However, what i am worried about is the legality..what if he reports my name for withholding tax purposes? etc.

DHS authorization would be an EAD or green card. your I-94 expires 90 days after your entry. after the I-94 expires, you can not legally work till you have an EAD or green card. when you AOS, you then also can apply for the EAD card, takes about 90 days to receive your EAD card.

need to check the requirements of the state your in for drivers license or ID card. did you get the EAD stamp in your passport at your POE? if so, that will only allow you you to work till your I-94 expires. after that you'll need an EAD or green card. also you'll need an SSN before you can work.

If you are using your huasband's name as your married name. then use it on the forms when you AOS.

good catch on the BEFORE....I missed that and was thinking the old fee was good through the 30th. Thanks for catching and posting that for everyone.

Thanks. I was thinking the same thing when I first read about the fee increases. earlier this month a friend was preparing an application. when I double checked info about the fee increases, I then noticed it was effective on the 30th.

Hello everyone! Well, the wedding went successfully and wonderfully (ham and turkey buffet with cherry cheesecake dessert). :dance: :dance: :dance:

Now here's my question and I know this will sound stupid. :wacko: I got all our paperwork ready for the AOS and the only documents missing are certified copy of our marriage certificate from the court house (of which, we will be working on today), vaccination supplement - I-693A (of which, we'll be doing on Wed) and David's 2006 ITR (since I submitted the original during my interview, we will ask for a copy from his tax lady). My question is, if we get to mail the AOS packet on the 25th of July (I am being optimistic and I'm working so hard for that to happen) and get there in Chicago 1 or 2 days after, are we really able to file before the fee increase on July 30th? I know I'm being stupid here, but I just want to make sure that our packet will not be returned and we'll be asked to issue another check amounting to $1100 once it gets there or to somebody's desk. I will appreciate any helpful advice and please bear with me.

If so, each would have to apply for a tourist visa. they all would have to prove significant ties to the Philippines. there is really nothing you can do. I will not say not to try, but it will probably be difficult for all of them to obtain tourist visas.

just to note.. each visa application will cost $131. I've seen some post their parents were able to get tourist visas, but it's not certain your parents will be able the do so. For the other relatives, it could be difficult.
