I have done some web searching seems it will not be a problem but the only issue if she ever married again she can never marry in the Philippines unless she was annulled

you are correct that the birth certificate of the beneficary is NOT required to be submitted with the I-129f. what the USCIS is concerned with is that the petitioner is a USC, therefore eligible to file a I-129f.
If you do submit the beneficary's birth certificate, it will not cause an RFE.

a copy of beneficary's birth certificate is not required with submission of the I-129f. some do submit it, if they have it available.

If you have any children, make sure they are listed on the I-129f.

good.gif agree. phone records are another way to show a genuine, ongoing relationship. I joked with my wife that I would save up some money to be at the interview by cutting the daily phone calls down to once a week. she choose the daily phone calls.

Your son can follow to join but must receive the visa within 12 months of his mother. He then has six months to enter the US. If that isn't enough time, then you, the USC would need to file an I-130 petition for him after you marry his mother. As the USC step-parent, you can file the petition and have it approved with an immediate priority date. (meaning filing to visa is about a year) If his mother filed as an LPR, he would need to wait for a visa to become available. That's what was meant by waiting several years.


If you do decide to take advantage of the K-2 follow to join, remember to allow enough time to schedule an interview. Manila is a very busy Embassy for visa applications.

I have learned that visa is valid for only a year. I decided to include my son on the I129F becoz I understand that it will really be very hard for me to petition my son once I am already in the U.S and make a separate petition for a relative. The plan is to make him follow only after he finished his high school in 2 yrs or so. When I filled up the DS FORMS, I indicated there that he is to follow, so I didnt pay for the embassy fee for my son.

Am I making the right move?

The K-2 Visa must be ISSUED within one year from the date the K-1 is issued. once the K-2 has been issued, your son would have up to six months to enter the USA. if your plan is for your son to follow in two years, you will not be able to use K-2,
a I-130 petition will need to be filed for him.

I wholeheartly agree with beckypua to bring your son at the same time. I realize everyone's circumstances are different and try to do what is best for their situation.

Philippines is one of the longer consulates to deal with. Look at the VJ timelines to get an idea of processing times.

yap. just depends on how soon your petition gets thru VSC and NVC. once your petition is in Manila, can take at least 3 months for a K-1 interview. I filed my
I-129f in March 06. interview was in Dec 06.

Don't sweat all this too much. A lot of folks don't follow the suggested format what so ever and get by just fine. Personally, I made mine following the suggested guidelines from the USCIS site. I used the Acco fasteners and in my case wrote "Resubmission" on my cover page since this is the second petition I sent for my fiancée (We had to withdrawal her first a few years ago.) I did not use tabs either time. I used a simple table of contents. Don't worry about mistakes in order and presentation. It's the content that counts!

yes the I-129f, G-325a and letters of intent should be signed originals. the supporting evidence and documentation would be copies.

I, like many others, used the example here on VJ or something similar with success. However on the I-129f there is a question that asks you to describe the circumstances with which you met. I wrote about 1 page, 4 paragraghs, describing how I met my wife and the times I visited her.

Agreed. Getting men to send them money before they've ever met is a huge scammer tactic. And while your SO obviously isn't a scammer, it'll probably make USCIS scrutinize your relationship harder than is necessary.

OTOH, what are people's thoughts about using Western Union receipts as evidence of an ongoing relationship at the consulate? That is, including receipts from *after* they've physically met at the interview? Does this strengthen the perception of a commitment or weaken it? I can see both sides.


I would think that should be ok. I sent my wife a couple of money remittance receipts from after we had met and were engaged to use as evidence if need be.

Manila can be a hard Embassy to obtain a tourist visa. significant to the Philippines have to be shown to obtain one. the CO will need to feel confidant the applicant will the USA before the visa expires. an agency saying 2 to 3 weeks, multiple entry ten year visa is what caught my eye. sounds fishy to me...

Ok, a little recent USCIS History Lesson. back in March 2006, IMBRA went into effect. from March till June, no K-1 were approved while USCIS was figuring out how to implement it. That created a big backlog of K-1's. Manila is a busy Embassy for visa applications, that made it even worse. it may have taken longer, but the end result was worth the wait. wink.gif

back in 2006. approvals of K-1 visas submitted March thru June were put on hold. that created a backlog of over 10,000 petitions. so I'd guess there are over 50,000 K-1 petitions submitted each year.
