you do not need to file the I-824. it's not one year to apply for a K-2 visa. the K-2 Visa will have to be issued within one year from the date your K-1 visa was issued. you contact the Embassy when you are ready to schedule an interview. make sure to allow enough time to schedule an interview.

If it has been over a year since your medical at St Lukes, you probaly will need another one. bring your vaccinations records. you will only need the vaccinations you have not taken yet.

your fiance should have listed your daughter on the 129f that he submitted to USCIS. for your interview, you will be listing your daughter on the DS-156k that you will be submitting. your daughter does not need to attend the interview if she will not be applying for a visa at that time. If any questions asked, you would just say she is following to join. you do not need a passport fro your daughter at your interview. however, if she does not yet have one, get her one before you depart the Philippines.

if she is a u.s CITiZEN then and not a us resident (green card holder) then she has no residency requirements and can stay in phils as long as she wants.... her citizenship cannot be revoked for overstaying she has no worries a kuma matada wink.gif

it seems that whoever is adjudicating your case at NVC is not knowlegable on the Philippine Family Code. as a single mom, you have full custody of your child even if the biological father is listed on the child's birth certificate. maybe you could get a consult from an Immigration attorney here who deals with immigration from the Philippines.

Applicants, Agents or Petitioners calling from within the United States will also be able to use this service by calling 1-888-877-9888. The cost of the 888 service from the United States is a U.S. $18 PIN payable using a Visa or MasterCard once you have called into the service.
Applicants or their representatives must have the applicant’s Immigrant Case Number as given in the Embassy notification letter available when they call to schedule an appointment.
Callers can speak with an English or Tagalog speaking operator. The service is available to the public from 8:00 a.m. to 6:00 p.m., Monday to Friday, Manila local time.

The case number is the receipt number, ain't it?


the case number is not assigned until after NOA2 and the petition is sent to NVC. eros, you should be receiving your NOA1 in the mail in a few days. nothing much happens the first month after receiving your NOA1.
