hi vj'rs..!am just confused with packet 3 and 4...may i ask who will receive packet 3?is it k1 the fiance petition?and packet 4 the K3 petition?

The Embassy will send the visa applicant a Fiance Visa Appointment Packet. there is no per se packet 3 in Manila. Some receive a letter from the Embassy when the petition is received by the Embassy. My wife did't receive the letter, so don't worry if you don't get one.

. She is staying with a Filipina here in my city I learned. The filipina is married to a very sick man. I met the girl once and being the intuitive person that I am, I felt as though the girl didn't like me for some reason unexplainable. A filipina friend of my wife has called dthe girl Rosemarie is staying with to talk. She told me that the girl talked awful of me. She said things like I should be charged with rape of my wife? I have never heard such absurd things as this woman said.

I am now of the opinion that my wife not only has used me, but possibly will try to find anyways she can to stay here. I have many questions that I need answered or at least some feedback on.
1. I have withdrawn my petition for her, she has no AOS or greencard. Can she stay here legally anyways?
2. I was under the impression that being I am the sponsor, she by law had to be living with me?
3. Is there a way or do I have any right to know if she is in the USA or back in Philippines?
4. How can I divorce her without her signing the divorce papers? I don't know what address to send them too!
5. Is there a number that I can call for help or to have questions answered?

Glenn

Glenn,
there are ways to obtain a divorce if you don't know where your wife is or she will not sign the papers.
http://wiki.answers....sign_the_papers
while she will not be able to stay here legally by marriage to you, she might try to find other ways to legally stay here.
you mention the friend she is staying with has made allegations about you. you need to contact an attorney and do everything you can to protect yourself.
i know this is a difficult time, but you'll get tru it...

I have one quick questions. I'm a little confused on how the CFO works. I noticed there are two offices in cebu. one is the CFO office and the other is the SMEF-COW Cebu office. which one should my fiancee be attending? will she be required to travel to both locations or just going to the CFO office is enough and everything will take place there to get the stamp she needs on her visa?

This is the info we found on CEBU:
(Send this to your fiance...if she's lived in Cebu City, the locations should be easy to find)

SMEF-COW (for CFO guidance/counseling seminar):
3d Floor Aya-ay Arcade
Gen. Maxillon Ave.
CEBU CITY
(Fronting San Carlos University Boys High School beside Cherry Building, near corner of Gen Maxillon / R.Rhamann, opposite the intersection from the Family Choice Pharmacy, on the south side of Gen. Maxilom Ave about a block East of the huge Inglesia ni Cristo church, on your right when coming from Osmena circle and heading to Cebu harbor thru Gen Maxillon). No map available but I compiled here all members indications.
Phone: (63 32) 235-3745/46 or 232-1033

THIS IS WHERE YAZI WENT TO THE SEMINAR.

CFO Extension office (for CFO pre-departure registration and stamp):
Causing-Lozada Building.
Osmena Blvd. corner Lapulapu St. (near Plaza Independencia). It is located on the 2nd floor in DFA building, not far from Basilica Minore del Santo Niño.

THIS IS WHERE SHE WENT FOR THE STAMP AFTER SHE HAD THE VISA AND TO REGISTER HER DAUGHTER.

CEBU CITY

Hi Guys,

I have one question....

Is there an expiration period for the visa? I mean, if every I get approved in May 22 and get the visa a week after, do I need to go to US right away or should there be 3 months or 6 months allowance?

In case I get approved in may 22, i will only leave by mid Sept since I need to get all my bonus from my company till august...

Will there be a problem with this?

thanks for your advice.

you will be fine leaving Sept 22. you will have six months from the date your visa is issued to enter the USA. then you have 90 days to get married.

At exactly 957am (MNL time)...657pm (SFO time), my fiancee text me that she was out of the embassy and got a perfect score  I called her right away and she said her acquaitance with the CO is so short...about 5 minutes only...tops!...and that's it! She was expecting more questions to be asked but we've been blessed!

Is it the way it goes?I hope someone here can help me out and clear some things for me?Thanks!

that's true about Robin's SSN. Yazi's daughter Effie will also have to wait till after AOS to apply for SSN. a K-2 cannot apply for SSN untill has green card or EAD.
Congrats on your wedding day. nice photos!

For the Visa Interview:

What to bring:

7. Police Clearance (original)

11. Evidence of Relationship - This information varies per couple but here is a list of some of the things we supplied: affidavits, Photos, Flight Itinerary, Hotel Receipt, Greeting Cards, Emails, Yahoo Messenger Instant Messenger Log, Yahoo Messenger Instant Message Excerpts, Talklook.com International Call History, Yahoo Messenger Call Log, Union Telecard International Calling Card Orders and etc..

beleive police clearance only needed from overseas country that applicant lived in for 6 months or more after reaching the age of 16.

phone records are great to have, especially if frequent calls where made. the interviewer was impressed by the page after page of almost daily phone calls submitted by Yazi.

great info as always Sheriff

Hi PW and Sheriff! I haven't seen my fiancee since November 2004 but we got approved already by the USCIS and on our way for the interview on 04/25 at USE Manila. Will this affect the approval of her visa? I am not going to the Philippines until next month...I'm worried  Please assure me it's going to be okay.

don't worry, you'll be fine. the requirement for having met in the previous two years is for the submission of the
129F petition. best of luck with your upcoming interview.

CocoPuff, I don’t want to rain on your parade but just trying to be objective and realistic here. Although you have met the requirements at USCIS level (and you just barely made it), the fact that you have not seen each other for two and a half years may raise a red flag with the embassy. Better have a good reason why this is so and make sure you send your fiancee a copy of your plane ticket and other proof of your planned trip like hotel reservation, receipt for the plane ticket, etc. to prove you are visiting again. This should help in convincing the consul that you are serious about the relationship.

make sure you have plenty of evidence to show genuine ongoing relationship. PW's suggestion of copy of plane ticket and intinerary is very good idea. It was 16 months from my last visit till Yazi's interview. one thing we did was have plenty of phone records. the interviewer was impressed by page after page of almost daily phone calls.

Can we attend both the CR1 and K3 interviews? If so what might the outcome be? Our K3 is May 16 and our CR1 is May 30. We want the CR1, but were told we could go to the K3 and request the CR1. With a CR1 interview pending is that wise of us to do still? Or just wait? We'd certainly LOVE to get back to the US sooner and if we can secure the CR1 on the 16th would be great.

Also, if they issues a K3 on the 16th and not CR1, can we still go on the 30th and get the CR1???

Orimai

Kimtung also had their K-3 and CR-1 only a few days apart. they attended the K-3 and were advised by the CO to pursue the CR-1, which I beleive they did. I don't think you'll be interviewed for CR-1 on the 16th. you'll have to go back on the 30th for that interview.

If she can't get her conditions lifted after 2 yrs because I'm not in her life, then her visa status would be terminated?

Which would relieve the co-sponsor of olbligation?

Technically, I think the answer to that question is NO. Plenty of illegals have obtained govt. benefits. Practically, if she's no longer in your life, I would suspect she'd probably be out of the country, thus relieving you and co-sponsor.

That's how I understand it. the obligation would end when she left the country. on the brighter side and you have a happy life together , the obligation for you co-sponsor would end if she becomes a US Citizen. that could be in as little as 3 years.
hope we'll soon receive good news from DocMay and george&jenny on the results of their interview.
best of luck to gelramos & daveandfleur on their interviews tomorrow.

Hello to all, i know this question is already asked but i just can't find the right thread and am a lil lazy looking for it  ... anyway, my question is: Is it ok if I only have a computer printed copy of my husband's Form 1040(ITR)? Actually it is his copy of his ITR when he filed the tax online. Just want to make sure i have the right documents. Hoping for your response... Thanks a lot!

For my interview on Friday, I will be using a computer print-out (TurboTax) of my fiance's Form 1040 and a PDF copy of his W2. His 1040 has a Declaration Control Number and date of acceptance by TurboTax. I will let you know if embassy will accept that.

Is it ok to submit photocopies of my fiancee's ITRs? He doesn't have the transcripts... and he's not comfortable in sending the original ITR forms he filed for the last 3 years...

Mae

What I'm thinking it doesn't matter what is the form of ( photocopy, transcript...) your ITR. what the CO is concerned with is your income level. They may already have our income levels from the government databases. I submited copies of my W-2's, pay check stubs, letter from employer and IRS Tax Transcripts. those who are self employed or using assets should have documentation to back up their income.

When is your due date? You can try to bring her as a visit visa but she have to show like land titles and bank savings to get approved. But however if you have your greencard, you can petition her but dont know how long it will it take.
Prepare yourself to be alone.. Its not that hard as you think.. I am a mother itself and expecting again..

Goodluck!

only a USC can petition a parent. LPR can only petition spouse and children.

Philippinessome reasons why
QUOTE (ninjarocket @ Sep 28 2008, 02:18 PM) <{POST_SNAPBACK}>
I was referring to situations in some countries where a marriage is a business contract between parents. That probably doesn't happen too often in the Philippines, but I wonder how the immigration process deals with it when it does. Just out of pure curiosity.

guess it depends on whether it's the cultural norm in a country. I don't think it's a cultural norm in the Philippines.
In the situations mentioned, I was guessing it being introduced thru a relative, not necessarily an arranged marriage. maybe a google search can find an answer to your question.

Philippinessome reasons why
QUOTE (abspears @ Sep 26 2008, 04:19 AM) <{POST_SNAPBACK}>

As for my experience and to applicants i've talked their reasons why they were also sent to FPU are the FF:

Applicant's #1: She was under K-1 visa. The petitioner is her parents friend in the US. She and the petitioner haven't meet in person yet.
Applicant's #2: K-1 also. Met through a friend, met in person but was questioned due to the lack of endearment's word on the cards and letters.
Applicant's #3: K-3. Due to her husband's 4-5 times divorced and big age gap.
Applicant's #4: K-3. Met through relatives and big age gap also.
Applicant's #5: K-3. Met through relatives

I know i have my own mess to fix but i just want my co-vj's to be ready and know some reasons why me and other applicants were sent to FPU. My intention is not to scare nor make you worry because every case are different, i just only want to give some info's because i know how it feels like to be sent to FPU.

Good luck to all of us and God Bless!!!!

QUOTE (ninjarocket @ Sep 28 2008, 09:26 AM) <{POST_SNAPBACK}>
I wonder how those with arranged marriages deal with this?

I do not think it should be assumed they are arranged marriages. as for the examples given, these situations probably do not apply to the majority of applicants.
applicant #1 . it's a requirement of the Fiance Visa to have met in the prior two years of filing the 129-f. it's not mentioned if a waiver was obtained to this requirement. they are very hard to get...
applicant #2 there is no mention of what evidence of ongoing and genuine relationship was submitted.
applicant #3 this situation would probably come under more scrutiny. there is no mention of what evidence of ongoing and genuine relationship was submitted.
applicants # 4 & 5. It can take many years to petition a relative from the Philippines. Manila is a high fraud Embassy. a situation like this could come under more scrutiny. again, there is no mention of what evidence of ongoing and genuine relationship was submitted.

anyone in these situations should make sure to submit plenty of evidence of ongoing and genuine relationship.

abspears, hopefully your situation will be resolved and you'll have a lifetime of happiness together with your husband.....
