the DS-156k is NOT required for the K-2 applicant. only the K-1, your fiance, submits an DS-156k. been there done it...

You can fill up the form I -130 as long as your husband signed the form. Dont have to be him ..as long as you know what to answers on the form.Question # 7 means if you have other names used like may ibang name ka on other legal documents. Alien relative refers to your husband or the petitioner which is him.


I do not mean to confuse the issue but on section C question 17, the alien relative refers to you, not your husband. his name would be listed there since he is your spouse. if he has any children, they would not be listed. only your children would be listed if you have any children.

you can also include tax returns, voters cards, bank accounts, rental lease or mortgage info. and don't forget the Social Security card copy too. Hope this helps some!

I think it's looked at on a case by case basis. I've seen some post their co sponsor was accepted, others say it was not. I remember the Chat session on the Davao Virtual Consulate. I was going thru the process at that time. without going back to read it, I do not recall it being said flat out that a co sponsor would not be accepted. basically, the CO is trying to determine if the applicant is likely to become a public charge.

I would suggest someone who at present time might need a co sponsor, to try to include evidence that your financial situation will improve to the point where a co sponsor would not be required.

Hey....does anyone know about the K-2 visa's expiration. I know the child must follow-to-join within one year of the mother's K-1 being issued. If we apply and are approved for the K-2 within that one year, is her K-2 visa still valid for 6 months after issue (like the K-1) if that 6 month's goes beyond the 1 year requirement to follow-to-join, or is it one year complete to set foot on the USA POE? Our one year ends in May, but we would like to bring Mir's daughter here in August for the start of school so we don't have to worry about child care for the summer months when there is no school.

the K-2 visa just needs to be issued before the end of one year from the issuance of the K-1. after that, a k-2 Visa expiration is the same as a K-1. once the visa is issued, you must enter the USA within six months.

Ok..i cannot work till I get EAD, which i would probably get after AOS is approved...but...

can an employer apply for a work permit for me even before i get married or applied/approved for AOS? I am just thinking that since i am an auditor here..i could find an audit firm in the US who is willing to get me a work permit since i already have a visa to get in the US. Some firms just dont want to spend more for petitions or visas if they hire me directly from the phils.

i hope this could work since i need to have a job badly even before wedding or AOS...


Try getting a flight with JFK as POE it will automatically give you permit to work until your I-94 expires without having to apply EAD, as its the only POE that gives the that privilege. I wish I had done that so I could find a job after a few days i got here in the US. Look up the EAD process on the USCIS site for better understanding. Hope that helps.

ok, lets say you do get your I-94 stamped if your POE is JFK. that would only authorize you to work until your I-94 expires ( 90 days after your arrival). after that you should have an EAD. IF you dont get your I-94 stamped at your POE, you can apply for an EAD before you AOS, but the EAD would expire with the I-94. since it can take 3 months to receive an EAD after applying for it, doing so before AOS would be impratical and waste of money.

for AOS, after July 30th the fee will be $1010. that will include AOS fee ( I-485), EAD ( I-765), Advance Parole ( I-131)
and Biometrics.
there is no fee for your SSN.
Civil Surgeon, TD shot fees can vary. it pays to shop around. we paid $60 for TD shot and to have vaccination records transcribed to the I-693a.

Got few questions:

1. When is I-864 required?
the I-864 Affidavit of Support will be used when you AOS.
2. Can I already work if I already have SSN?
you also need an EAD to be employed.
3. I understand that EAD is no longer required to apply for SSN but I can only have EAD during AOS. Am i right?
a K-1 can obtain a SSN without an EAD. you need to do so before your I-94 expires. best to do so no later than 2 to 3 weeks before your I-94 expires.
4. I need to know when can i exactly start working?
depends on how soon you marry and submit AOS/EAD after arriving in the USA. it takes about 3 months for the EAD

hi everyone!

just want to ask some info regarding what documents i need to bring with me at the airport when me and my kids will leave for the US, aside of course from our visas. I have three kids and i was never married to their father and the birth certificates of my kids don't list their father's name. I know I don't need any DSWD clearance to take my kids out of the country. But i have read somewhere that at the NAIA airport, the Immigration people would ask for birth certificates and CENOMAR from me to confirm i have custody of my kids and don't need father's consent? I just want to know if this is true, especially from those with K2 children, what were your experiences about this? And if they do need those documents, would they require originals or just photocopies?

I don't have yet our visas but I just want to prepare all the documents I may need as early as possible. Thanks!


hi... got the same situation my friend. But no need to worry there is no need for you to show them anything except for the passport with the visa and stickers from the CFO and the sealed envelopes from the Embassy( do not open it).and of course the ticket. he he he...kidding aside I and my daughter were scare too the whole duration of the flight but it was very exciting too. Just put a smile of ur face and enjoy the whole flight. The immigration officers are all good and understanding. Be ur self and just answer the questions they ask you.But it would be wise not to check-in ur Documents bring it with you.

i got question regarding CFO...

Is there a certain period required for me to take the seminar from the date of my visa approval? I was approved in may 22 and only planning to leave for US in september...will it be okay if i take the CFO around july or august? as long as a date before i leave?

also...with regard to validity of visa...

my visa will expire on nov 22, 2007...i understand that this is the last day i need to leave for US...right? So would there be problem if i leave in september and only gets married in december 2007? the nov 22 date does not pertain to actual wedding date, right? otherwise, ill get married beyond the nov 22 date or should i get married before nov 22?

CFO can be done at any time. will need the sticker in your passport by the day you depart for USA. Nov 22, the date your visa expires, is the last day it would be valid for entry into the USA. once you arrive in the USA, you have up to 90 days to get married. so say if you arrive in the USA sept 1, you would have to be married by Nov 29th.

even with a letter of invitation from your husband, it could prove to be difficult unless your mom can prove significant ties to the Philippines.

the medical is usually scheduled one week before the interview. the medical can be done before the scheduled date. interview is the important one. you may want to call the Embassy to verify the dates.

Is there any possibility that I-130 will be adjudicated earlier than I-129F? As you can see in my timeline, my I-130 (June 5) is near to being approved as compared with my I-129F (June 23). If in case, what should I do? We have not submitted my child's I-130 yet, since we plan to doing so during AOS. Definitely, I will not leave my child here in the Philippines. Please advise.

when you attend the K-3 interview, you are not giving up the CR-1. As PW earlier pointed out, the processing of a CR-1 Visa was running 3-5 months behind that of a K Visa. That is why many married couples pursue the K-3 Visa. It allows the couple to be together sooner in the USA. Recently it seems the CR-1 processing has been catching up to the K-3 Visa. that is why you now see many with K-3 interviews having their CR-1 interview only a couple of weeks after their K- interview.


I think the best way to go would be with the K-3 since your child would be able to obtain a k-4. that way you'll be able to come here at the same time. hopefully your child was listed in the 129f. if not, I would contact the Embassy when the 129f arrives at the Embassy and request your child be added to it.

they are different. The tax transcript is a record of your return that you can order by phone from the irs at 1 800 829 1040. I heard the embassy prefers the transcript to the actual return. It's a free service and I got my 2005 and 2006 transcripts in less than a week.



The embassy actually prefers a copy of your tax return NOT the transcript. If you show up with only transcipts you may be very disappointed. All they asked from me is 2006 tax return.

I think you will be advised to pursue CR since the interview appointments are really close to one another...

Even if i not mention the cr1? i like to request the cr1 on wednesday but i also like that it is kind of security blanket to go for both you know?

You cannot be issued two visas. Appear for K3 interview and request if you can interview for CR-1 instead as it is the superior visa. Embassy can either grant your request or tell you to appear again for CR-1 interview.


CR-1 would be the superior visa since you will not have to AOS after entry into the USA. you will receive conditional green card after you enter the USA. you will just need to remove conditions within 90 days before the 2nd anniverasy of your entry into the USA. if you have been married for two years before your entry into the USA, you will be an LPR.

i understand that once the K3 process is pursued, the CR-1/IR-1 petition is "given up" (so to speak, for lack of a better term)
so how does a K3 beneficiary get a CR-1/IR-1 interview?
are the K3 forms and documentation used for the CR-1/IR-1 interview?
or does the petitioner continue to supply and correspond with necessary CR-1/IR-1 documentation while the K3 is being processed?

this has got me confused
enlighten me please, anyone

when you attend the K-3 interview, you are not giving up the CR-1. As PW earlier pointed out, the processing of a CR-1 Visa was running 3-5 months behind that of a K Visa. That is why many married couples pursue the K-3 Visa. It allows the couple to be together sooner in the USA. Recently it seems the CR-1 processing has been catching up to the K-3 Visa. that is why you now see many with K-3 interviews having their CR-1 interview only a couple of weeks after their K- interview.

Why is it people get two visas then? It make no sense to me hehe. Also other have both interviews close together, some may enter us on k3 then return to home country for CR1 interview. There are a few people here who already have both, confused why you say that?


I think the only explanation I can think of for this is if the interview appointments are far away from one another. If you are in a hurry to be together, the best way is to pursue K3, otherwise, take the CR. I think others got 2 visas (I'm not sure about this) because the interview appointments of their K3 and CR are far from each other... Someone correct me if I'm wrong...

Mae is correct, if one is in a hurry to be together, beneficiary can interview for K3, fly to the US (K3 expires once used at POE), wait out the CR-1 and come back for interview. Beneficiary ends up holding just one "valid" visa if CR-1 visa is granted as K3 expired upon POE. This supports the statement that she cannot be issued two visas at any one time. One has to be cancelled or expired before new visa is issued.

It's the same thing with having a tourist visa. My B1-B2 was cancelled as soon as I appeared for my K1 interview as I cannot hold two valid visas at the same time.


the k-3 is a multiple entry visa valid for two years. i would think if you fly back to the Philippines for CR-1 interview, the K- would be cancelled when you go to the CR-1 interview.

I need your inputs regarding the DS Forms. I should submit

2 DS 156
2 DS 157
1 DS 156k for myself and its the same for my son except the DS 156k right?

On DS 156 #41 applicants signature-what will I do for my son since his only 3 yrs old? Should I just stamp his thumb mark?

Is it ok to just use the DS 156k and DS 157 that the embassy sent in the packet? I already downloaded the DS 156 and got the barcode but the others not cuz there's a problem with the site I guess, it wont let me type anything. I thought its only my pc acting weird so I went in an internet cafe but its still doing the same thing.

Im wondering.... if the embassy really wants/asks for the DS forms that got done online or not?

DS-156K one for you, not needed for your son.

DS-157 and 156k, you can use either the one's provided in your packet or one's you can download.
since your son is 3 yrs old, I would think you could sign the DS-156 for him. perhaps others with similar situation will chime in

Can I already apply for SSN card before the wedding? Can I apply it while I am still here in manila? I want to have my SSN as soon as possible after arriving in the US so I can start working.

a K-1 can not apply for SSN until after arriving in USA. After your I-94 expires (90 days), you can not work until you have an EAD, even if you have your SSN. after you marry, you can apply for an EAD with your AOS, but it will take a few months before you receive the EAD.

St lukes doesn't have the TD vaccination, so she'll have to get it here.
you'll need to go to a civil surgeon for the I-693. can get the TD shot there. if you get it from someone other than civil surgeon, make sure you're given a record so you can submit it to the civil surgeon.
