K-1 Fiance(e) Visa Process & ProceduresHelp Please: Bringing children over under K1 within 1 year of issuance
I would suggest calling the Embassy. 011-63-528-6300 I don't know if it's possible to arrange interviews for the children with enough time before the K-2 benefit expires, but I'd at least give it a try.

just need to do the form again. no need to call the Embassy. nothing is transmitted to Embassy when done online. a third page with a barcode will be printed, which contains the info you entered on the DS-156.

K-1 Fiance(e) Visa Process & ProceduresIs The Interview All That Is Left?
I went thru the Embassy in Manila, so not familar with the procedures in Bangkok. I would suggest checking the website for the Embassy in Bangkok. basically, your fiance will have a medical and will be submitting applications for the K-1 visa and other documents as required by the Embassy. you will be supply her with fiancial documents to show she will not become a public charge by coming here and she'll be having an interview.
here's a link to visa page for Bangkok. http://bangkok.usemb.../visa/index.htm
best of luck with the rest of the process.

K-1 Fiance(e) Visa Process & Proceduresk-2 visa
hi,

i'm in the process of petitioning my fiance from the Philippines. she has a nine year old daughter. we are considering using "follow to join" for her daughter. My fiance has suggested leaving the daughter in Philis. for 1 to 2 years. Since she might have a change of heart, i'm thinking we should apply for the K-2 for the daughter at the same time as the k-1. that way while my fiance is AOS she could apply for advance parole so she could go back for her daughter. disavantage is once the k-2 is issued, would expire in six months. don't know if can get advance parole in that time frame.
Has anyone had any experience, positive or negative using follow to join from the Philippines ?

K-1 Fiance(e) Visa Process & ProceduresAddress Problem Philippines

Hello everyone!! First off, I wish everyone here nothing but the BEST of luck and happiness.

I have a question regarding a Philippines address on the I-129F. My fiancee lives in Davao City, Philippines.

Her address actually shows Buhangin, Davao City.

I guess Buhangin is the province and Davao City is.. the city where she lives.

On the I-129F, there is not enough room to fit her phyiscal address as well as Buhahgin, Davao City.

What should I do? Just put Davao City or submit and attachment with the whole address?

Thanks for your help!!!

Chuck

Hi,
my wife is from Davao City. Buhangin is a distrist in Davao City, I remember passing thru it when going to and from the airport. probably should be ok to leave it off, just put Davao City. just a little more info. Davao City is in the Province of Davao Del Sur. did your fiancee get you to eat durian?

. . People are either married or they are not. Anybody who doesn't know the difference should not be handling their own visa paperwork.

hmm.. My wife, then fiancee, did the paperwork ourselves and she made it here just fine. we chose to have an engagement party instead of a wedding ceromony to avoid any possible complications from having a wedding ceromony. maybe we don't know the difference, but she made it here, no problem.

K-1 Fiance(e) Visa Process & Proceduresdo i pay when i get the visa?

the fee of $100 is the application fee for a nonimmigrant visa. the fees for an immigrant visa ( IR/CR) are different.
Fees - How Much Does It Cost?

Fees are charged for the following services:

Filing an immigrant Petition for Alien Relative, form I-130
Processing an immigrant visa application, for DS-230
Reviewing an I-864, Affidavit of Support (for petitions filed in the United States )
Medical examination (costs vary from place to place)
Fingerprinting fees, if applicable
I beleive the fees are around $380. if you paid the fees to the NVC, I don't think there is an additional visa fee to be paid at the Embassy. someone correct me if I'm wrong

You might be right, but the question was asked in the K-1 forum :P

K-1 Fiance(e) Visa Process & ProceduresIm so confused I need help
here's some info:
Are there foreign divorces that are recognized under Philippine law?

Answer: As a rule, divorce is not recognized in the Philippines as a mode of dissolving marriage. In cases however where a Filipino citizen contracts a marriage with a foreigner, a divorce validly obtained thereafter in a foreign court by the foreigner spouse, i.e. the foreigner spouse initiated the divorce proceedings, such a divorce will be recognized under Philippine law (Article 26, paragraph (2), of the Family Code). The foreign divorce will have the effect of capacitating either the foreigner spouse or the Filipino spouse to remarry under Philippine law.

K-1 Fiance(e) Visa Process & ProceduresUseful information on K1/K3 Visas. Should any of this be added to the FAQ's?
I've seen it asked from time to time about cancelling a petition:

N7 Termination of a K Visa Petition Approval

USCIS regulations, 8 CFR 214.2(k), provide that the death of a petitioner or written withdrawal of the petition prior to the arrival of the beneficiary in the United States automatically terminates the approval of the petition. The consular officer should return the petition to the approving USCIS office with an appropriate memorandum.

is that already in FAQ's?

K-1 Fiance(e) Visa Process & Proceduresk-1 status expiration date

The 90 days begin starting on the day your fiance arrives in the U.S. - not from the date the visa was issued.

I believe that she has up to 6 months to come here - from the date the visa was issued. This is separate from the 90 days you have to get married. Meaning, she doesn't have to come immediately after her K1 visa is issued.

Yes Visa is good for 6 months, when you enter the USA the POE will stamp the I-94 and set the expire for 90 days from entry. Has nothing to do with K-1 expire date, in fact, the officer at the POE will write "VOID" on the K-1 visa, so in fact it expires at the POE.

guess at SFO they're kind of lazy, just made a line thru my wife's visa.

I believe this is the number to the Embassy. 011-63-2-528-6300 ext 5184 or 5185. it's best to call between 7:30am to 8:00am Manila time. might not get thru at first. keep trying. K-1 Fiance(e) Visa Process & Proceduresapplication document for the interview K1 visa

When you guys turned in your I-129F packet did your fiancee abroad in the Philippines started getting/working on the documents to submit at the time of your visa interview? Or is it best to wait until you get the approval first? Because I know it takes alot of time to get all of the documents such as getting the passport, DS-230, birth certificates, Certificates of NO marriage record and etc... Please help

Thank you

Also where do we get the DS-230 application form?

the DS-230 is not used in Manila for a K-1. it's best that Cenomar and NBI clearance are less than 6 months old at the time of your interview. you still have lots of time.

So then even though she's filing at the same time and our son is traveling with her an additional $100 is needed for our son.

Also the medical exam fees which are paid at the hospital will be $95.00 for her and $65.00 for him.

Correct?

unsure.gif

Thank you so much!

Don't be confused with the fact that you only filed a single petition. They will each have there own visa. With each visa requires a seperate visa application and fee.

So even though he's only 10 months old, seperate forms are required... We file DS-156, 156k, and 157 for her but what forms for him?
because technically he doesn't have his own passport, he's not a fiance, so the only form that needs to be filled out in addition is the DS-157 for him and then have it endorsed by the bank. Am I correct in this assumption?

the son will need the DS-156 and the DS-157. his will be a separate visa application, as others have pointed out. it requires a separate payment of $100.
you have the medical exam fees correct.

GOOD LUCK !

Are you kidding Melody? that is some very bad advice. read what i kept in his quotes. their whole relationship will be questioned and her motive for coming to the USA. they need a very good attorney and immigration lawyer. your case and theirs have nothing to do with each other. did you marry your ex at the same time you met you current husband and started your current relationship???????

I can see the possibility of a false marrige occuring in the Philippines. It doesn't seem likely it could have occured here.
