the only number I know for USCIS is 1-800-375-5283. for us, it took 23 days from NOA2 till the Embassy received our petiton. I can remember back when calling NVC, I'd get answers like they don't have the petition, allow up to 4 weeks or try calling back in a week, but I wouldn't be that patient and would try again in a of couple of days. when calling Aug 20th, they gave me the MNL case number and said it had been sent to the Embassy on 15th. I had called earlier on the 17th, then they said they hadn't received the petion yet.
hopefully you'll receive the good news soon.

I envisioned a romantic getaway when my wife arrived here for a formal proposal, but that all changed during my first visit. In guess I would say the proposal occured in three stages. it was nearing the end of my visit, so the first proposal occured while we were lying in bed, talking about plans for the future. the next day, I visited her mom to tell her of our intentions and to ask for permission for her daughter's hand in marriage. Since my first visit was almost at an end, it was decided I would return in a few months so we could have an engagement party. we wanted her family and friends to be able to feel part of the celebration since they would not be present at the wedding.
In the time between my visits, my wife planned the engagement party, wanting it to have the feel of a wedding reception. I decided to make the formal proposal at the party, so her family would feel more a part our marriage celebration.
During my second visit, my wife found the ring box in my suitcase and sensing she could not wait for the party, propasal number two. The ring was alittle large, so we had it sized the next day. then I told her about my plan for the party, otherwise I didn't how to get the ring off her finger. she agreed to go ahead with my plan. At the party, when it was my turn to speak, came proposal number three. I got down on one knee, there was one thing she didn't know, I proposed to her in Tagalog...

true, that would be the fastest way. it might mean more scrutiny at the interview having an immediate relative in the USA. she would want to have plenty of evidence that it's a geniune relationship.

there really isn't a yes or no answer to your question. The CO will consider the Evidence on Financial Support on a case by case basis. The CO is trying to determine whether it is likely the applicant will become a public charge. there has been some debate on this thread about using the I-134 or :whistle: I-864. Neither one is a binding legal document for a K-1 Visa. the CO can look at the totality of circumstances to determine if there is sufficient evidence of financial support.

S. Government. The intending immigrant's becoming a permanent resident is the "consideration" for the contract.
Under this contract, you agree that, in deciding whether the intending immigrant can establish that he or she is not inadmissible to the United States as an alien likely to become a public charge, the U.S. Government can consider your income and assets to be available for the support of the intending immigrant.


Point one: since a K Visa is a nonimmigrant visa, would that make the I-864 not legally binding since it states immigrant visa on the I-864 ?
Point two: Since a K-1 Visa has to get married before AOS, would a I-864 signed before the marrige be legally binding to the sponsor?

Your son's K2 visa must be issued within one year from the date of your K1 visa hence you only have 3 months left to get him to the US or your husband will need to file another petition for him. Not sure if the procedures changed, but you need to inform the US Embassy in Manila ASAP. Send them a fax informing them that your son is ready to join you in the US and provide them with all the pertinent info and fax to (632) 301-2017. They will then send instructions.

Better yet, give them a call so you can get up-to-date information to avoid delays.

:thumbs: give the Embassy a call as soon as you can. fortunately, you still have 3 months for a visa to be issued.

Ah, ok. So did she become a USC before your wife was eligible? Because as I understand it, dependent children under K-2 automatically become a USC when their mother (in this case) becomes a USC.


I don't know much about the process, but believe this would be derivitive citizenship.

on question 3, the Embassy does not sent you the packet. it is only available online.
question 5. I beleive the Embassy has to receive the physical petition from NVC before you can schedule an interview. in a few days, you can call NVC to see if you have been assigned an MNL case number. hopefully you will not be stuck at NVC very long, and your petition will be on it's way to Manila. best of luck as you near the end of you visa journey :thumbs:

i just wanted to say, back when it was written, the Sheriff's Guide was a very valuble resource to those going thru the process in this forum. the Sheriff put alot of time and effort compiling the information contained in the guide. over time things changed and the guide could no longer be updated.

yes, the daughter can do her medical at the same time as the mom. the daughter will be attending the interview, if applying for visa at same time as the mom. my daughter was asked one question at the interview by the CO, "how old are you?"

This is what the lawyer said. The rationale behind the name change for the K2 child on the AOS is derived from the same name change for the K1 wife. Since the K2 child immigration status is really a derivative of the parent. When mother changes name by virtue of marriage, the stepchild can also change the name in the immigration document.

And issuing a green card with whatever name it deems to be legal gives the USCIS and/or Dept of Homeland Security the authority to institute a name change. When it issues the green card under the new name for the wife, it can do so for the child.
Also, there is no need to appear before a judge to change your name upon naturalization. I know--I changed my name when I was naturalized and it was a simple election.


If your name or your child’s name has changed, proof of legal name change (may include marriage certificate, divorce decree, adoption decree, court judgment of name change, etc.)

The USCIS asks for proof of a legal basis for a name change. The marriage certificate is legal basis for spouse's change. a marriage cetificate is not a legal basis foe a child's name change.

When do I or when can I change the last name of my K1 fiance's daughter, to my own last name (as her stepfather by virtue of marriage to her mother)? After the marriage, just like my fiance? Or do I have to go through the adoption process? I read somewhere here that the adoption is not necessary for a K2 child.

Do I specify the last name in the I-485 application?

I believe the only way to change your step daughters last name to yours, would be thru adoption. hopefully someone will chime in if this is not correct.

Fiance(e) Visa or K-1 Visa


It generally takes USCIS 3-6 months to adjudicate an I-129F, after which USCIS sends it to the National Visa Center (NVC) to start processing for a fiancé (K-1) visa. Once we receive the petition from NVC, we will notify the beneficiary via email on what to do to have a K-1 interview here, which is the final step.

the USC Petitioner will first receive NOA1 (receipt notice) from USCIS. after the 129f Petition is approved, the USC will receive the NOA2(approval notice)from the USCIS. the petition is then forwarded to the NVC, before being sent to the Embassy. Once at the Embassy, the beneficary will receive some sort of notification they are eligible to apply for K-1 Visa. check the Embassy website for details on the procedures for applying for the Visa.

I know some have had good experience with mobilecaller, but I would not personally recommend it. data entered on the 129f is first transmiited to the Embassy. the physical paperwork has to be at the Embassy to schedule an interview. guess it's kind of like the speed of an email vs snail mail. email is within seconds. snail mail takes a few days.
